This paper examines the ethical aspects of organ transplant surgery in which a donor heart is transplanted from a first recipient, following determination of death by neurologic criteria, to a second recipient. Retransplantation in this sense differs from that in which one recipient undergoes repeat heart transplantation of a newly donated organ, and is thus referred to here as “reuse cardiac organ transplantation.” Medical, legal, and ethical analysis, with a main focus on ethical analysis. From the medical perspective, it is (...) critical to ensure the quality and safety of reused organs, but we lack sufficient empirical data pertaining to medical risk. From the legal perspective, a comparative examination of laws in the United States and Japan affirms no illegality, but legal scholars disagree on the appropriate analysis of the issues, including whether or not property rights apply to transplanted organs. Ethical arguments supporting the reuse of organs include the analogous nature of donation to gifts, the value of donations as inheritance property, and the public property theory as it pertains to organs. Meanwhile, ethical arguments such as those that address organ recycling and identity issues challenge organ reuse. We conclude that organ reuse is not only ethically permissible, but even ethically desirable. Furthermore, we suggest changes to be implemented in the informed consent process prior to organ transplantation. The organ transplant community worldwide should engage in wider and deeper discussions, in hopes that such efforts will lead to the timely preparation of guidelines to implement reuse cardiac organ transplantation as well as reuse transplantation of other organs such as kidney and liver. Comparative quantifiers, such as more than three books, cannot take scope over any quantifier in subject position if they occupy object position. This is clearly different from the behavior of other quantifiers (e.g., universal quantifiers). This paper argues that this scope puzzle is due to a more complex internal structure of comparative quantifiers than other quantifiers. In the decompositional approach that I pursue, comparative quantifiers are decomposed into two generalized quantifiers (i.e., in the case above, the comparative operator er than (...) three and the DP many books). In this approach, obligatory narrow scope of comparative quantifiers in object position is a consequence of the interplay of the independently motivated principles of grammar that also constrain other quantifiers. On the basis of the scope puzzle, I specifically argue for two constraints on Scope Shifting Operations (SSOs) a locality condition on SSOs and Scope Economy, proposed by Fox (2000), which prohibits SSOs that have no effect on semantic interpretation. Thus, I argue that the apparently peculiar facts of comparative quantifiers are, in fact, additional evidence for the core properties of SSOs. (shrink)

In recent years several books by major figures in Japan's modern philosophical tradition have appeared in English, exciting readers by their explorations of the borderlands between philosophy and religion. What has been wanting, however, is a book in a Western language to elucidate the life and thought of Nishida Kitaro, Japan's first philosopher of world stature and the originator of what has come to be called the Kyoto School. No one is more qualified to write such a book than Nishitani (...) These volumes present the text of Abū Ma’͑šar’s _Great Introduction to Astrology_ in Arabic and Greek and the divergences in the Latin translations. It provides a fully-comprehensive account of traditional astrological doctrine and its philosophical bases.

The Hagakure is one of the most influential of all Japanese texts--written nearly 300 years ago by Tsunetomo Yamamoto to summarize the very essence of the Japanese Samurai bushido ("warrior") spirit. Its influence has been felt throughout the world and yet its existence is scarcely known to many Westerners. This is the first translation to include the complete first two books of the Hagakure and the most reliable and authentic passages contained within the third book; all other English translations (...) published previously have been extremely fragmentary and incomplete. The principal pillars of Bushido are loyalty, filial piety, bravery and mercy. Yamamoto lived his life based on these principles and was willing to sacrifice his own life to bring them to ultimate fruition once his lord died. However, Shogunate law forbade Samurai retainers from taking their lives after their liege and master died, so Yamamoto became a monk instead--spending the last years of life in seclusion recording his wisdom and insights in the Hagakure for the edification and training of future Samurai warriors in the essence of bushido. Alex Bennett's completely new and highly readable translation of this essential work is the only full version of the Hagakure published to date. Its extensive footnotes fill in many cultural and historical gaps found in previous translations. This unique combination of readability and scholarship gives Bennett's translation a distinct advantage over all other English editions of this work. Japanese conversations are known to contain a large amount of unexpressed information. When a speaker speaks with elliptical information, he or she assumes that the addressee will understand what is not overtly expressed based on the knowledge that is supposed to be shared textually, personally or culturally. The addressee, on the other hand, must determine what is not being expressed overtly using such shared knowledge. At the heart of this kind of communication is the existence of trust assumed among the (...) interlocutors. Using the term ‘entrustment’, we will examine how one particular Japanese formulaic construction, [Noun yo Noun], ‘It’s Noun, you know, Noun’, indexes mutual trust to manage conversational interaction. We will argue that this meta-pragmatic awareness needs to be recognized beyond surface interactional patterns identified in conversation. (shrink)

The earliest Chinese record of the maritime relations between India and China can be found in the “History of the Former Han Dynasty” (Chien Han-shu) which covers the period from B.C. 206 to A.D. 23. In its chapter (28b) on geography it is stated that ever since the time of the Emperor Wu (Wu Ti, B.C. 14087) the country called Huang-chih has sent tribute to the Chinese court, which in turn dispatched envoys to this remote country. Huang-chih has been identified (...) by many scholars with Kāñcī (Conjeeveram) on the east coast of South India. It is recorded that there were chief interpreters belonging to the Yellow Gate (the office of eunuchs serving in the palace) who went to sea to buy bright pearls, opaque glasses and other rare articles, taking with them from China gold and various kinds of silk for exchange. This study aimed to clarify the coping strategies of nurses working in general wards who face the ethical dilemma of restraining older people with dementia. The participants were 272 nurses working in general wards in the Kansai region of Japan. Coping strategies were measured using a questionnaire consisting of 16 items. A low score of 1—4 points suggested good coping strategies. Factors were difficult to interpret for three of the 16 coping items identified; these items were therefore deleted. Eleven of (...) the remaining 13 items were used for analysis. An explanatory factor analysis revealed three factors concerning coping with ethical dilemma: (1) self-initiated positive cognition and action; (2) negative cognition and action; and (3) choosing not to act, or maintaining the status quo. These findings highlight the need for programs that could disseminate effective coping strategies among nurses faced with the ethical dilemma of restraining older people with dementia. (shrink)

Homologous chromosome pairing is required for proper chromosome segregation and recombination during meiosis. The mechanism by which a pair of homologous chromosomes contact each other to establish pairing is not fully understood. When pairing occurs during meiotic prophase in the fission yeast, Schizosaccharomyces pombe, the nucleus oscillates between the cell poles and telomeres remain clustered at the leading edge of the moving nucleus. These meiosis‐specific activities produce movements of telomere‐bundled chromosomes. Several lines of evidence suggest that these movements facilitate homologous (...) chromosome pairing by aligning homologous chromosomes and promoting contact between homologous regions. Since telomere clustering and nuclear or chromosome movements in meiotic prophase have been observed in a wide range of eukaryotic organisms, it is suggested that telomere‐mediated chromosome movements are general activities that facilitate homologous chromosome pairing. How does a country repair its harm to a vulnerable minority targeted during times of national fear because of race? How did the United States redress its then popular yet unconstitutional WWII incarceration of 120,000 innocent Japanese Americans in desolate barbed wire prisons without charges, hearings, or bona fide evidence of military necessity? In response to a Congressional inquiry, political lobbying, and lawsuits, the Civil Liberties Act of 1988 directed the President to apologize and authorized over one billion dollars in (...) reparations. Congress also created a fund to educate the public about the government’s false assertion of “national security” to restrict civil liberties. Some considered redress a tremendous victory — rewriting history and personal healing. Others questioned reparations for one U.S. group but not others. Japanese American Redress served as a catalyst for reparations movements worldwide. This paper examines its genesis, legal implementation, and apparent effects. It also explores wide-ranging political mobilization and social meanings of redress and “unfinished business”. Reparations cannot be measured by laws alone. Diverse communities must engage contested questions of history, justice, and belonging. Reparations claims face often unforeseen benefits and limitations. A total of 366 UK children in four different schools, one in Wales, one in Northern Ireland, and two in England, were asked to respond to 20 potentially stressful life experiences. Each event was rated on a scale ranging from 7 to 1 , and the scale value and interquartile range were calculated. In addition, whether or not a given event was actually experienced was noted. Across the groups, there was a very high degree of agreement on all three measures, (...) the median correlations being 0.95 for scale values, 0.70 for interquartile ranges, and 0.92 for incidence. Furthermore, the pooled UK results were found to correlate equally closely with the figures previously obtained in the USA and five other countries. The possibility of a prevalent ‘culture of childhood’, cutting across geo‐political boundaries and ethnic groupings, appears to receive further support. (shrink)

The purpose of this paper is to highlight the ontological character of Friendship in Aquinas. The originality of Aquinas's theory is found in the ontological foundation expressed by Neoplatonic concepts (unio, unitas, communicatio). By integrating such Neoplatonic concepts with his analysis on the transcendentals(aliquid, unum), I will make a new ontological foundation to the theory of amicitia. In order that a man is a one (unum), he must establish himself as something different (aliud quid) in the midst of the relationship (...) with others and then has to return to himself. So long as he stays self-contained without moving outward, he cannot constitute himself as an independent being which is different from other beings (aliquid). The ontological oneness (unitas) as an independent rational substance makes it possible for a man to form the mutual relationship of unity (unio) without losing himself in the midst of the deep relationship with someone else. The title of my paper may look odd. If one is questioned “What is a dog?”, everyone could give a more or less valid answer. But to the question “What is not a dog?”, there can be innumerable answers which may be correct, but mostly quite unhelpful. Provisionally, what I intend to do under this title is to consider what we should not hold time to be. Through the history of ideas we meet various opinions and theories concerning what time (...) is. But it seems to me that most of them are not adequate enough, though each has its reason and often profound import as well. So I would like here to make a proposal for reconsidering how time appears in our life and thinking. (shrink)
