. On June 13, 2013, the Supreme Court issued a unanimous decision in Association for Molecular Pathology v. Myriad Genetics, holding that a naturally occurring DNA segment that has merely been “isolated” is not patent eligible, and effectively overturning a longstanding policy that had allowed for patents to be issued on thousands of human genes. Drawing largely on the expert testimony and arguments presented during the court proceedings, this paper provides an overview of the discovery and patenting of the BRCA1 (...) and BRCA2 genes at issue in the case, the impacts of gene patents on biomedical research and innovation and clinical practice, and the legal analysis presented by the plaintiffs throughout the case for how patents issued on genes violate the Patent Act and the U.S. Constitution. Finally, it discusses how the Court’s decision in this case marked an extraordinary victory not only for the plaintiffs directly involved, but more generally for women, patients, researchers, civil liberties, and the future of medicine. As employee assistance programs (EAPs) have evolved and expanded their scope in the past decade, many factors have contributed to meeting the demands of conflicting client constituencies in a multifaceted client environment. This article enumerates several of these factors, notes consequences of ensuing conflicts, and ultimately proposes some methods to counter some of these ethical dilemmas in the future. It is the hope that greater recognition and understanding of ethical conflicts in client loyalty within a host organization will foster increased (...) sensitivity on the part of the EAP practitioner toward resolving these conflicts. Background: Recent changes to regulatory guidance in the US and Europe have complicated oversight of secondary research by rendering most uses of de-identified data exempt from human subjects oversight. To identify the implications of such guidelines for harms to participants and communities, this paper explores the secondary uses of one de-identified DNA sample collection with limited oversight: the Human Genome Diversity Project (HGDP)-Centre d'Etude du Polymorphisme Humain, Fondation Jean Dausset (CEPH) Human Genome Diversity Panel. Methods: Using a combination of keyword (...) and cited reference search, we identified English-language scientific articles published between 2002 and 2009 that reported analysis of HGDP Diversity Panel samples and/or data. We then reviewed each article to identify the specific research use to which the samples and/or data was applied. Secondary uses were categorized according to the type and kind of research supported by the collection. Results: A wide variety of secondary uses were identified from 148 peer-reviewed articles. While the vast majority of these uses were consistent with the original intent of the collection, a minority of published reports described research whose primary findings could be regarded as controversial, objectionable, or potentially stigmatizing in their interpretation. Conclusions: We conclude that potential risks to participants and communities cannot be wholly eliminated by anonymization of individual data and suggest that explicit review of proposed secondary uses, by a Data Access Committee or similar internal oversight body with suitable stakeholder representation, should be a required component of the trustworthy governance of any repository of data or specimens. When a physician employment relationship terminates, the physician–patient relationship may also be terminated by enforcement of a covenant not to compete, which typically forces the physician to leave the geographic area for a period of time. This gives rise to several ethical dilemmas. The public interest is compromised when enforcement of these covenants contributes to the shortage of physicians in the community, and individual patients are harmed when their physicians are no longer available. The authors undertook a unique study to (...) explore physician perspectives concerning the ethics of banning a physician from practice and the impact of the ban on both the physician and the physician’s patients. The results identified harmful effects that have not been raised in prior scholarly articles or reported court opinions. After reviewing the legal background of covenants not to compete, this paper presents the results of that study and concludes that resorting to the legal system for enforcement of covenants not to compete is not always the ethical course of action. Moral case deliberation (MCD) is a specific form of clinical ethics, aiming to stimulate ethical reflection in daily practice in order to improve the quality of care. This article focuses on the implementation of MCD in nursing homes and the questions how and where to organize MCD. The purpose of this study was to evaluate one way of organizing MCD in two Dutch nursing homes. In both of these nursing homes the MCD groups had a heterogeneous composition and were organized (...) apart from existing institutional communication structures. As part of a naturalistic evaluation, systematic observations, interviews and focus groups were completed. The findings indicate that the heterogeneous composition and MCD meetings separate from existing structures have benefits. However, the participants also reported negative experiences. This gives rise to the question whether a mixed MCD group which meets separately is an effective way to embed MCD as an instrument for reflection on moral issues in daily practice. We conclude that there is no single answer to that question. In the end, the two implementation strategies (i.e. within existing communication structures and a mixed MCD group) can be complementary to each other. (shrink)

Human-eyelid conditioning was the principal source of information on Pavlovian conditioning, especially human, in the 1950s and 1960s, but it suffered a sharp decline in productivity, beginning in the late 1960s. The present article treats the decline as a case study with potential implications concerning the survival contingencies of research specialties. We make use of questionnaire data from eyelid-conditioning researchers and examine a variety of publication, topic-of-investigation, and institutional data to identify the major factors in the decline of human-eyelid conditioning.

The technology for the digitized text creates fluid meaning, representing its culture in transition from the dominance of the single-authored text with its hierarchically ordered system. This new architecture for the digitized word has been making explicit the shift from human consciousness reflecting the interiority of the self to a human consciousness reflecting self in relation to others. Educators using the technology of networked writing environments need to understand how the technology functions and intervenes for pedagogical processes during models of (...) asynchronous and synchronous collaborative writing. Both models support a constructivist view of learning; however, for each, educators need to consider the ethos of the writer as inhabiting a negotiated, shared space with readers during text production. This article explores the role of changing memes in large systems change toward marriage equality—popularly referred to as same-sex marriage—in the United States. Using an abbreviated case history of the transformation, the article particularly explores the shifting memes or core units of culture, in this case, word phrases associated with marriage equality over time, influencing the social change process. In the present study, we examine the interactive effect of vowels on Mandarin fricative sibilants using a passive oddball paradigm to determine whether theHEIGHTfeatures of vowels can spread on the surface and influence preceding consonants with unspecified features. The stimuli are two pairs of Mandarin words ([sa] ∼ [ʂa] and [su] ∼ [ʂu]) contrasting in vowelHEIGHT([LOW] vs. [HIGH]). Each word in the same pair was presented both as standard and deviant, resulting in four conditions (/standard/[deviant]: /sa/[ʂa]∼ /ʂa/[sa]and /su/[ʂu]∼ /ʂu/[su]). In (...) line with the Featurally Underspecified Lexicon (FUL) model, asymmetric patterns of processing were found in the [su] ∼ [ʂu] word pair where both the MMN (mismatch negativity) and LDN (late discriminative negativity) components were more negative in /su/[ʂu](mismatch) than in /ʂu/[su](no mismatch), suggesting the spreading of the feature [HIGH] from the vowel [u] to [ʂ] on the surface. In the [sa] ∼ [ʂa] pair, however, symmetric negativities (for both MMN and LDN) were observed as there is no conflict between the surface feature [LOW] from [a] to [ʂ] and the underlying specified feature [LOW] of [s]. These results confirm that not all features are fully specified in the mental lexicon: features of vowels can spread on the surface and influence surrounding unspecified segments. (shrink)

Western Michigan University’s Center for the Study of Ethics in Society has always had a “generalist” approach—that is to say, an interdisciplinary orientation toward studying a broad range of ethical issues. This article explains how the center’s “generalist” orientation developed and why it is desirable for promoting public reflection about ethical issues. It focuses on these dimensions: valuing an across-the-curriculum approach to promote understanding of complex ethical issues; adopting a broad, rather than narrow focus, when it comes to ethics; committing (...) to practical ethics, which bridges theory and practice to shed light on issues of practical relevance to all; and decentering philosophy as the arbiter for what counts as “doing ethics.” The article ends with a look at challenges concerning stable funding and administrative support for a center that does not fit neatly into a single academic unit or specialty and shares some lessons learned. This investigation examined age-related differences in auditory-visual integration as reflected on perceptual judgments of temporally misaligned AV English sentences spoken by native English and native Spanish talkers. In the detection task, it was expected that slowed auditory temporal processing of older participants, relative to younger participants, would be manifest as a shift in the range over which participants would judge asynchronous stimuli as synchronous. The older participants were also expected to exhibit greater declines in speech recognition for asynchronous AV stimuli (...) than younger participants. Talker accent was hypothesized to influence listener performance, with older listeners exhibiting a greater narrowing of the AV simultaneity window and much poorer recognition of asynchronous AV foreign-accented speech compared to younger listeners. Participant groups included younger and older participants with normal hearing and older participants with hearing loss. Stimuli were video recordings of sentences produced by native English and native Spanish talkers. The video recordings were altered in 50 ms steps by delaying either the audio or video onset. Participants performed a detection task in which they judged whether the sentences were synchronous or asynchronous, and performed a recognition task for multiple synchronous and asynchronous conditions. Both the detection and recognition tasks were conducted at the individualized signal-to-noise ratio corresponding to approximately 70% correct speech recognition performance for synchronous AV sentences. Older listeners with and without hearing loss generally showed wider AV simultaneity windows than younger listeners, possibly reflecting slowed auditory temporal processing in auditory lead conditions and reduced sensitivity to asynchrony in auditory lag conditions. However, older and younger listeners were affected similarly by misalignment of auditory and visual signal onsets on the speech recognition task. This suggests that older listeners are negatively impacted by temporal misalignments for speech recognition, even when they do not notice that the stimuli are asynchronous. Overall, the findings show that when listener performance is equated for simultaneous AV speech signals, age effects are apparent in detection judgments but not in recognition of asynchronous speech. Children’s sociocultural experiences in their day-to-day lives markedly play a key role in learning about the world. This study investigated parent–child teaching during early childhood as it naturally occurs in the home setting. Thirty-nine families’ naturalistic interactions in the home setting were observed; 1033 teaching sequences were identified based on detailed transcriptions of verbal and non-verbal behavior. Within these sequences, three domains of learning (knowledge, skills, and dispositions) and subtopics were identified and analyzed in relation to gender, child birth order, (...) context, teaching strategies, and learner response. Findings show knowledge, skills, and dispositions were taught equally, marked by the most prominent subtopics taught within each domain, including cognitive (skill), game rule (knowledge), and social rule (disposition). Further, mothers and fathers were found to teach their children equally, however, fathers taught knowledge more than mothers, whereas mothers taught dispositions more than fathers. Differences between domains of learning and subtopics also existed between mother’s and father’s teaching based on child birth order and gender. This study also assessed the contrast between teaching knowledge, skills, and dispositions by context, parent teaching strategies, and child learner response. Results support the notion that family interactions in the home setting set a stage for children’s rich informal learning experiences. Vygotskian sociocultural conceptions underpin this research and findings are discussed using this central theoretical lens. (shrink)

A definition of [George] Eliot as renunciatory culture-mother may seem an odd preface to a discussion of Silas Marner since, of all her novels, this richly constructed work is the one in which the empty pack of daughterhood appears fullest, the honey of femininity most unpunished. I want to argue, however, that this “legendary tale,” whose status as a schoolroom classic makes it almost as much a textbook as a novel, examines the relationship between woman’s fate and the structure of (...) society in order to explicate the meaning of the empty pack of daughterhood. More specifically, this story of an adoptive father, an orphan daughter, and a dead mother broods on events that are actually or symbolically situated on the margins or boundaries of society, where culture must enter into a dialectical struggle with nature, in order to show how the young female human animal is converted into the human daughter, wife, and mother. Finally, then, this fictionalized “daughteronomy” becomes a female myth of origin narrated by a severe literary mother uses the vehicle of a half-allegorical family romance to urge acquiescence in the law of the Father.If Silas Marner is not obviously a story about the empty pack of daughterhood, it is plainly, of course, a “legendary tale” about a wanderer with a heavy yet empty pack. In fact, it is through the image of the packman that the story, in Eliot’s own words, “came across my other plans by a sudden inspiration”—and, clearly, her vision of this burdened outsider is a re-vision of the Romantic wanderer who haunts the borders of society, seeking a local habitation and a name.11 I would argue further, though, that Eliot’s depiction of Silas Marner’s alienation begins to explain Ruby Redinger’s sense that the author of this “fluid and metaphoric” story “is” both Eppie, the redemptive daughter, and Silas, the redeemed father. For in examining the outcast weaver’s marginality, this novelist of the “hidden life” examines also her own female disinheritance and marginality.12 11. This argument has emphasized the professional character of Darwin's early activities, largely in order to balance the usual portrayal of the amateurishness of his early training and field of study. Arguing this way has revealed the interplay between Darwin's personal interests and his professional obligations, the latter being particularly important for the period from October 1836 to July 1837. In several instances, notably the treatment of his collections, the progress of his thought followed the professional lead directly. In the absence (...) of such a lead Darwin did not pursue certain issues, if only for lack of time. Thus the subject of man did not figure in his initial formulation of a transmutationist position. Only after the commitment to the new point of view had been made did the issues emerge which will be treated in Part II of this article. However, we may close by noting Darwin's inherited disposition on the subject: in the summer of 1837 Darwin responded to Lyell's claim that the change from irrational animal to rational man represented “a phenomenon of a distinct kind from the passage from the more simple to the more perfect forms of animal organization and instinct” with a fanciful doodle in the margin.121 The thoughts behind the bemused scribbling were to occupy a good portion of Darwin's time for the next two years.
