In _Biocultural Creatures_, Samantha Frost brings feminist and political theory together with findings in the life sciences to recuperate the category of the human for politics. Challenging the idea of human exceptionalism as well as other theories of subjectivity that rest on a distinction between biology and culture, Frost proposes that humans are biocultural creatures who quite literally are cultured within the material, social, and symbolic worlds they inhabit. Through discussions about carbon, the functions of cell membranes, the activity (...) of genes and proteins, the work of oxygen, and the passage of time, Frost recasts questions about the nature of matter, identity, and embodiment. In doing so, she elucidates the imbrication of the biological and cultural within the corporeal self. In remapping the relation of humans to their habitats and arriving at the idea that humans are biocultural creatures, Frost provides new theoretical resources for responding to political and environmental crises and for thinking about how to transform the ways we live. Is there tension in a view of the conditions of being in a proper position to make aesthetic evaluations that is committed to aesthetic autonomy and norms of exposure? I define ‘aesthetic autonomy’ in terms of the Kantian idea that in order to make a proper aesthetic evaluation, one must rely on oneself rather than on any outside source. I define ‘norms of exposure’ in terms of the Humean idea that practice and aesthetic education are conditions of proper aesthetic evaluation. (...) ABSTRACTThis article addresses the identity of the legitimate actors of international law-making from the perspective of democratic theory. It argues that both states or state-based international organisations, and civil society actors should be considered complementary legitimate actors of international law-making. Unlike previous accounts, our proposed model of representation, the Multiple Representation Model, is based on an expanded, democratic understanding of the principle of state participation: it is specifically designed to palliate the democratic deficits of more common versions of the Principle (...) of State Consent. In light of the central role scientific research plays in Merleau-Ponty’s phenomenology, the question has arisen whether his phenomenology involves some sort of commitment to naturalism or whether it is better understood along transcendental lines. In order to make headway on this issue, I focus specifically on Merleau-Ponty’s method and its relationship to Kant’s transcendental method. On the one hand, I argue that Merleau-Ponty rejects Kant’s method, the ‘method-without-which’, which seeks the a priori conditions of the possibility of experience. On (...) the other hand, I show that this does not amount to a methodological rejection of the transcendental altogether. To the contrary, I claim that Merleau-Ponty offers a new account of the transcendental and a priori that he takes to be the proper subject matter of his phenomenological method, the method of ‘radical reflection’. And I submit that this method has important affinities with aesthetic themes in Kant’s philosophy. (shrink)

Recently, Kant’s account of aesthetic autonomy has received attention from those interested in a range of issues in aesthetics, including the subjectivity of aesthetic judgment, quasi-realism, aesthetic testimony, and aesthetic normativity. Although these discussions have shed much light on the implications of Kant’s account of aesthetic autonomy, the phenomenon of aesthetic autonomy itself tends to be under-described. Commentators often focus on the negative aspect of this phenomenon, i.e., the sense in which an aesthetic judgment cannot be grounded on the testimony (...) of others. However, on Kant’s view, autonomy is a positive phenomenon, something that involves self-determination and self-legislation. My aim in this paper is to clarify this positive aspect of Kantian aesthetic autonomy. In order to defend my interpretation of aesthetic autonomy, I appeal to another key concept in Kant’s aesthetics, viz., ‘common sense’. I claim that, for Kant, aesthetic common sense, which we acquire through aesthetic education, is what makes aesthetic self-determination and self-legislation, hence aesthetic autonomy, possible. Drawing on research in posthumanism, science and technology studies and biosemiotics, this essay analyses the challenges epigenetic processes pose for our understanding of embodied subjectivity. It uses the work of Charles Sanders Peirce to argue that epigenetic processes are indexical in their patterned logic, that they are meaning-making processes and that, consequently, they can be conceived as a form of attention. To conceive of bodies as paying attention through epigenetic processes is to rupture the distinction between matter and meaning that (...) governs many philosophical categories. In contrast to those who trace civil society to “community” per se, Foucault is keen to locate this concept as it emerges at a particular moment in respect of specific exigencies of government. He suggests that civil society is a novel way of thinking about a problem, a particular problematization of government that emerges in the eighteenth century and which combines incommensurable conceptions of the subject as simultaneously a subject of right and of interests. This article takes up Foucault’s discussion (...) of the Scottish Enlightenment in The Birth of Biopolitics to trace the distinctiveness of his discussion of civil society, but also in order to suggest that we ought to pay closer attention to the tensions between commercial-civilizational and civic republican themes in the literature of the late eighteenth century than does Foucault. It is my tentative suggestion that Foucault’s account leaves out significant aspects of these debates that offer counter-valences to the dominant models of the subject available to contemporary political discourse. When, if ever, are we justified in infringing a rights claim on the basis of benefit to the right bearer? If we assume that the rights of individuals can be overridden on the basis of what is at stake for others- that is, that rights have thresholds - we can ask how these thresholds are affected when the person who will benefit from the right being overridden is the right bearer herself.

Thomas Hobbes is an iconic figure who serves as an easy reference for pundits commenting on the brutality of war as well as for critics of a distinctly modern individualism in which calculating and rapacious self-interest is the cause of the violence, destruction, and exploitation endemic to the contemporary world. Frost's reading of Hobbes's philosophy shows us that underlying such visions of self and politics is another iconic figure: that of the Cartesian subject. What gives the iconic Hobbes his hardcore (...) individualism and its corollary accounts of instrumentalism, conflict, and absolutism is a Cartesian rendering of the self as split into mind and body. Carefully elaborating Hobbes's materialist ontology, _Lessons from a Materialist Thinker_ challenges both our implicit Cartesian assumptions about the self and the commonplace Hobbes that so readily figures violence in our political imagination. Through his materialism, Hobbes presents an alternative modern account of self-consciousness, reason, agency, power, freedom, and responsibility. In doing so, he shows that our fundamental intersubjectivity and interdependence require that we pursue peace above all else. (shrink)

This is an essay in appreciation of The Abundant Herds, a study of the ama-Zulu's naming practices for their Nguni cattle. The book reveals an aesthetic vision in which contemplative and practical attention are intertwined and a complex classificatory system does not undermine an appreciation of the individuality of the cattle. The book and the practices it celebrates permit a richer account of the beauty of farm animals to the standard functionalist approach.

Abstract25.6 Million people in the United States have Limited English Proficiency (LEP), defined as insufficient ability to read, write, or understand English. We will (1) Delineate the merits of approaching language as a social determinant of health, (2) highlight pertinent public health values and guidelines which are most relevant to the plight of populations with LEP and (3) Use the COVID-19 pandemic as an example of how a breakdown in public health ethics values created harm for populations and patients with (...) LEP. We define a framework to tease out public health responsibilities given some populations’ limited proficiency in a society’s predominant language. The American Public Health Association (APHA) public health ethics core values serve as a framework to interrogate current practices. Should feminist ethical theories include rights as a component? There is a tension between feminist politics and the endorsement of the language of “women’s rights,” and feminist ethics and its critique of rights.1 In this paper I begin the project of reconciling moral theories that include rights as a component with feminist criticisms of rights. There are two parts to this project. First, I must respond to the criticisms feminists have made against rights theories in order to show that it (...) is possible for a moral theory that includes rights to be a feminist moral theory. Answering these criticisms is necessary if I am to establish that moral theories that include rights are among the candidate theories from which feminists might choose. Second, I must develop a feminist moral theory that encompasses rights, and argue for its superiority to other sorts of moral theories in order to show that a moral theory that encompasses rights is a plausible feminist moral theory. Going beyond responding to criticisms and developing a positive feminist rights theory is necessary if feminists are to find rights theories to be attractive candidate moral theories.2 In this paper I am concerned mostly with the first part of the project, responding to some feminist arguments against theorizing about morality in terms of rights, although in the course of responding to the objections I make remarks that might suggest ways in which some rights theories might be developed as feminist moral theories. To this body of literature, we add the observation that female bodies were positioned by Jean Jacques Rousseau as necessary food for the stuff of society. We trace the ways in which Rousseau’s rendering of the natural female body have followed us into our modern (...) educational systems such that any hopes for gender equality in our educational and social structures must attend to the pervasive naturalization of the bodies – human and nonhuman – that we are taught to milk for all that they are worth. Interest in republicanism as a political theory has burgeoned in recent years, but its implications for the understanding of law have remained largely unexplored. Legal Republicanism is the first book to offer a comprehensive, critical survey of the potential for creating republican accounts of fundamental issues in law and legal theory.

Habermas does not rule out the possibility of violence in language. In fact his account explicitly licenses a broad conception of violence as ‘systematically distorted communication’. Yet he does rule out the possibility that language simultaneously imposes as it discloses. That is, his argument precludes the possibility of recognizing that there is an antinomy at the heart of language and philosophical reason. This occlusion of the simultaneously world-disclosing and world-imposing character of language feeds and sustains Habermas’s legal and political arguments, (...) where he states that in order to achieve consensus rational deliberation must eliminate force. In this paper, I claim that this argument operates through a manoeuvre that leaves Habermas’s position curiously blind to its own predicament. To explain why, I turn to Kant’s treatment of the problem of evil in Religion Within the Boundaries of Mere Reason. Here, as in the Western philosophical tradition more generally, evil has no separate existence: it is folded back into Kant’s philosophical scheme. Arendt notes that as soon as Kant identifies the problem of evil he rationalizes it into comprehensible motives. I will show how, through a move that is structurally similar to Kant’s rationalization of evil, Habermas rationalizes and attempts to eliminate violence from his consideration of law and language. In Habermas’s work, law and language appear as ciphers for reason. The case to be made here is that Habermas’s inability to recognize the paradoxical character of language and reason makes his work blind to the violence in which it is unavoidably implicated. In his Letters on the Aesthetic Education of Man, Friedrich Schiller draws a striking connection between aesthetic value and individual and political freedom, claiming that, ‘it is only through beauty that man makes his way to freedom’. However, contemporary ways of thinking about freedom and aesthetic value make it difficult to see what the connection could be. Through a careful reconstruction of the Letters, we argue that Schiller’s theory of aesthetic value serves as the key to understanding not only his (...) view of aesthetic engagement, but also his distinctive account of individual and political freedom. In Part I, we develop a reconstruction of Schiller's view that aesthetic value is the only path to individual freedom and in Part II we analyze how Schiller connects aesthetic value to political freedom. In the end, we show that Schiller defends a non-hedonic, action-oriented, communitarian theory of aesthetic value and a theory of freedom that makes the aesthetic not just supererogatory but fundamental for any fully autonomous life. Although we have lost touch with this way of thinking about aesthetic value and freedom, we submit that it is illuminating for contemporary thinking about both. (shrink)

In this volume, we bring together for the first time the diverse threads within the field of serendipity research, to reflect both the origins of this emerging field within different disciplines as well as its growing influence as its own field with foundational texts and emerging practices. Many have been drawn to the mystery of serendipity, the wonder of the ‘aha’ moments humans experience when they encounter it. In the present volume we present, in contrast to the storytelling approach that (...) drives common fascination with serendipity’s impact on our lives, chapters by experts who have addressed questions about serendipity from a more scientific approach. They ask difficult questions in the following chapters, such as: what is serendipity, exactly?, what role does it actually play in discovery and how does it influence our methods?, how can we study and measure it?, are its results always or necessarily positive?, and how can we potentially influence it?, each with the intent of scientific rigour in their investigations. This introductory review highlights the impact that the phenomenon of serendipity has on human lives, and thereby its worth as an object of serious study. (shrink)

All across our society are plastered expectations of perfection, normalcy and “acceptable” images.I am 27–years–old and, despite the years of education I have received, the communication skills I have gained in English and American (...) Sign Language (ASL), the countless hours spent with doctors consulting about how to “get better,” I have lost my sense of identity. And, the more I think about it, the more I realize that my “authentic voice” has not yet been born. This is the reality for me and, I suspect, for anyone else who has been labeled disabled.When I sat down to write this, I did not struggle coming up with a story to share nor the words to intrigue readers. Instead, I grappled over using my real name and not using a “pen name.” Despite my long and varied history with disability, it took me a long time to advocate my issues enough to receive services. Because labels are embarrassing. Because disability is embarrassing. And, so, now I have labels... many labels. However, it is still accepting them that I am left with. Unfortunately, I am just one of millions who are also fighting to find some sense of balance between honesty with myself and the societal labels that are at the forefront of our communities.It has been a year since I took Disability Studies, a cultural pluralism course requirement for my Liberal Studies Degree at California State University. On the surface choosing this sub topic could have been perceived as an easy A, given that I am disabled. Yes, having a disability enabled the language used to be less of a shock in my overall comprehension. In reality, however, the struggle to achieve success academically is continuously challenged by my own disabilities. However, despite succeeding in the course, “easy” is not an adjective that appropriately represents my experience. The knowledge I grasped in the classroom helps me to understand what happens when I walk outside on any given day; but therein lies the glitch... the class is over, but my disabilities never will be.Did I enjoy the topic of Disability Studies? Yes, immensely. Because it was something I could relate to. Did enjoying the subject matter take the struggle for comprehension away? No. Did my dyslexia absolve into thin air? No. Being disabled does not admit me, nor anyone else for that matter, into the disabled world with a “free pass from suffering” as if we are all in a club. Having a diagnosis helps to identify why I may not be able to do things in the way others may perceive as “normal.” But, it is the label of being “normal” that is detrimental to achieving success. It represents why our society has a stilted perspective towards those who wear glasses, use walking aides, or need assistance to get [End Page 205] something from a grocery store shelf. Additionally, implying that any one way of completing a task is “normal” is wrong and further accents those differences, which are just that... differences.One component of this course was a Panel Discussion with those living in the TAB (temporarily–able bodied) community. Approaching this event, I was possibly more nervous to ask questions than for the four members having to answer questions. The paradox of wanting to gain more understanding from those most qualified individuals who live with these struggles everyday and intellectually knowing that respect needed to come first was immense. Oddly, once the panel opened up, asking questions was not hard. Within the first ten minutes my fears subsided; the entire experience was like speaking to old friends, only I had just met them. These individuals were, yes, dealing with impairments, but were just as relatable to me as I was to them. And, to my surprise, they were inquisitive and curious towards each other as well. This reinforced that fact that when information is lacking our society we still rely on stereotypes about topics we are... (shrink)

Abstract:The value structures associated with distance and proximity have been at the center of the field of environmental aesthetics since its emergence. The British natural sublime acted as a catalyst for those debates by introducing the importance of immersive properties in relation to standards of taste. This article maps out the complex construction of the sublime over the eighteenth century by isolating those figures who emphasized different models of spectatorship in relation to the concept. ‘Serendipity’ is a category used to describe discoveries in science that occur at the intersection of chance and wisdom. In this paper, I argue for understanding serendipity in science as an emergent property of scientific discovery, describing an oblique relationship between the outcome of a discovery process and the intentions that drove it forward. The recognition of serendipity is correlated with an acknowledgment of the limits of expectations about potential sources of knowledge. I provide an analysis of serendipity in science (...) as a defense of this definition and its implications, drawing from theoretical and empirical research on experiences of serendipity as they occur in science and elsewhere. I focus on three interrelated features of serendipity in science. First, there are variations of serendipity. The process of serendipitous discovery can be complex. Second, a valuable outcome must be obtained before reflection upon the significance of the unexpected observation or event in respect to that outcome can take place. Therefore, serendipity is retrospectively categorized. Third, the primacy of epistemic expectations is elucidated. Finally, I place this analysis within discussions in philosophy of science regarding the impact of interpersonal competition upon the number and significance of scientific discoveries. Thus, the analysis of serendipity offered in this paper contributes to discussions about the social-epistemological aspects of scientific discovery and has normative implications for the structure of epistemically effective scientific communities. In the Critique of Pure Reason, Kant describes schematism as a (A141/B180–1). While most commentators treat this as Kant's metaphorical way of saying schematism is something too obscure to explain, I argue that we should follow up Kant's clue and treat schematism literally as Kunst. By letting our interpretation of schematism be guided by Kant's theoretically exact ways of using the term Kunst in the Critique of Judgment we gain valuable insight into the nature of schematism, as well as its (...) connection to Kant's concerns in the third Critique. This article argues that feminist theorists should conceive of the life sciences not only as a factual resource but also as a figural resource. It proposes that in shifting our conceptual orientation to biological science from fact to figure, feminists will be able to give theoretical life to scientific findings about the ways in which social environments and material habitats are processes integral to our development, growth, and social and political well-being. The figuration of ourselves as specifically biocultural creatures will (...) enable feminists to gain a stronger theoretical and analytic purchase on the ongoing mutual shaping of the biological and social dimensions of existence. In this paper, I argue that in spite of suggestions to the contrary, Merleau-Ponty defends a positive account of the kind of abstract thought involved in mathematics and natural science. More specifically, drawing on both the Phenomenology of Perception and his later writings, I show that, for Merleau-Ponty, abstract thought and perception stand in the two-way relation of “foundation,” according to which abstract thought makes what we perceive explicit and determinate, and what we perceive is made to appear by abstract (...) thought. I claim that, on Merleau-Ponty's view, although this process can sometimes lead to falsification, it can also be carried out in such a manner that allows mathematics and natural science to articulate what we perceive in a way that is non-distortive and in keeping with the demands of perception itself. This book explores the relationship between the law and pervasive and persistent reasonable disagreement about justice. It reveals the central moral function and creative force of reasonable disagreement in and about the law and shows why and how lawyers and legal philosophers should take reasonable conflict more seriously. Even though the law should be regarded as the primary mode of settlement of our moral conflicts,it can, and should, also be the object and the forum of further moral conflicts. There is (...) more to the rule of law than convergence and determinacy and it is important therefore to question the importance of agreement in law and politics. By addressing in detail issues pertaining to the nature and sources of disagreement, its extent and significance, as well as the procedural, institutional and substantive responses to disagreement in the law and their legitimacy, this book suggests the value of a comprehensive approach to thinking about conflict, which until recently has been analysed in a compartmentalized way. It aims to provide a fully-fledged political morality of conflict by drawing on the analysis of topical jurisprudential questions in the new light of disagreement. Developing such a global theory of disagreement in the law should be read in the context of the broader effort of reconstructing a complete account of democratic law-making in pluralistic societies. Conceptualism in natural aesthetics takes knowledge of natural objects to be necessary for their appropriate appreciation. Concentrating on animals, I explore a particular version of conceptualism – functionalism – in light of debates about the effects of cognition on perception - so-called ‘cognitive penetration of perception.’ I establish the claims about cognitive penetration to which functionalism is committed, and assess the implications of its assumptions for the normative claim that functional appreciation is most appropriate to nature.
