Picking up the question of what FLaK might be, this editorial considers the relationship between openness and closure in feminist legal studies. How do we draw on feminist struggles for openness in common resources, from security to knowledge, as we inhabit a compromised space in commercial publishing? We think about this first in relation to the content of this issue: on image-based abuse continuums, asylum struggles, trials of protestors, customary justice, and not-so-timely reparations. Our thoughts take us through the different (...) ways that openness and closure work in struggles against violence, cruel welcomes, and re-arrangements of code and custom. Secondly, we share some reflections on methodological openness and closure as the roundtable conversation on asylum, and the interview with Riles, remind us of #FLaK2016 and its method of scattering sources as we think about how best to mix knowledges. Thirdly, prompted by the FLaK kitchen table conversations on openness, publishing and ‘getting the word out’, we respond to Kember’s call to ‘open up open access’. We explain the different current arrangements for opening up FLS content and how green open access, the sharedit initiative, author request and publisher discretion present alternatives to gold open access. Finally drawing on Franklin and Spade, we show how there are a range of ‘wench tactics’—adapting gifts, stalling and resting—which we deploy as academic editors who are trying to have an impact on the access, use and circulation of our journal, even though we do not own the journal we edit. These wench tactics are alternatives to the more obvious or reported tactic of resignation, or withdrawing academic labour from editing and reviewing altogether. They help us think about brewing editorial time, what ambivalence over our 25th birthday might mean, and how to inhabit painful places. In this, we respond in our own impure, compromised way to da Silva’s call not to forget the native and slave as we do FLaK, and repurpose shrapnel, in our common commitments. (shrink)

This essay examines Harriet Jacobs’s Incidents in the Life of a Slave Girl (1861) in light of new archival findings on the medical practices of Dr. James Norcom (Dr. Flint in the narrative). While critics have sharply defined the feminist politics of Jacobs’s sexual victimization and resistance, they have overlooked her medical experience in slavery and her participation in reform after escape. I argue that Jacobs uses the rhetoric of a woman-led health reform movement underway during (...) the 1850s to persuade her readers to end slavery. This essay reconstructs both contexts, revealing that Jacobs links enslaved women’s physical and sexual vulnerability with her female readers’ fears of male doctors’ threats to modesty and of their standard bleed-and-purge treatments. Jacobs illustrates that slavery damages women’s health as much as heroic medicine, and thus merits the political activism of her readers. Specifically, Jacobs dramatizes her conflicts with the rapacious physician-master at moments that are crucial to women’s health: marriage, pregnancy, childbirth, and motherhood. Ultimately, this essay advances a new understanding of the role of health reform in social change: it galvanized other movements such as women’s rights and abolition, particularly around issues of bodily autonomy for women and African Americans. For 170 years, Harriet Taylor Mill has been presented as a footnote in John Stuart Mill’s life. This volume gives her a separate voice. Readers may assess for themselves the importance and influence of her ideas on "women’s" issues such as marriage and divorce, education, domestic violence, and suffrage. And they will note the overlap of her ideas on ethics, religion, arts, and socialism, written in the 1830s, with her more famous husband’s works, published 25 years later.

A combination of social forces has thrown marriage into question in westernised societies at the end of the millennium. This uncertainty creates space for new ways of thinking about marriage. In this context, we examine the idea of marriage as friendship. We trace its genealogy in the work of Mary Wollstonecraft, John Stuart Mill and Harriet Taylor and then subject it to critical scrutiny using some of Michel de Montaigne’s ideas. We ask how applic- able the ideal of higher (...) friendship is to marriage and what might be gained and lost by a synthesis of marriage and friendship. Grounding the discussion in historical sources is valuable because the topic is so little explored in the contemporary philosophical literature. This approach also allows any enduring value in these historical texts to be elicited. (shrink)

Amajor shift in critical attitudes toward the arts took place in the eighteenth century. The fine arts were now looked upon as a group, divorced from the sciences and governed by their own rules. The century abounded with treatises that sought to establish the overriding principles that differentiate art from other walks of life as well as the principles that differentiate them from each other. This burst of scholarly activity resulted in the incorporation of aesthetics among the classic branches of (...) philosophy, heralding the cognitive turn in epistemology. Among the writings that initiated this turn, none were more important than the British contribution. The Arts in Mind brings together an annotated selection of these key texts. The answers intertwine the personality and polities of Harriet, the sexism of those who wrote of her, misunderstandings of the means and meaning of her collaboration with John Stuart Mill, and the disturbing challenge of her questioning.

Literary works across cultures are never written in a vacuum. They depict the reality of the society where they are set. With the societal obligation of the writers to serve as righters, especially in Africa, this study attempts a pragmatic inquiry of the state of the Nigerian society as implicitly and artistically painted in Remi Raji’s poetry collection, A Harvest of Laughters. The known literature on Remi Raji’s A Harvest of Laughters have analysed the collection mainly from literary and ideological (...) perspectives. Attention has not been given to the collection from a pragmatic perspective, hence the intervention of this study. Drawing insights from Jacob Mey’s Pragmatic Acts Theory, the study analyses the pragmatic imports in the collection with fourteen randomly selected excerpts across different segments of the collection constituting the data. Data was purposively selected from different poems in the collection. The findings show that the two major discursive issues in the text are the depiction of the government as cruel and the portrayal of the citizenry as victims. The former was conveyed through the practs of oppressing, embezzling and deceiving, while the latter was revealed through the practs of suffering and hoping. The study concludes that pragmatics is a valuable tool in the demystification of texts. (shrink)

This paper examines Nietzsche's views on love and marriage in the works of his middle period. Contrary to the general consensus in the secondary literature regarding Nietzsche's ideas on these matters, it shows that he offers several positive reflections on love and marriage. Indeed, at times he accepts that friendship is possible between the genders and even models marriage on friendship. Modelling marriage on friendship creates an overlap between Nietzsche's thought and that of John Stuart Mill and Harriet Taylor. (...) The concept of white ignorance refers to phenomena of not-knowing that are produced by and reinforce systems of white supremacist domination and exploitation. I distinguish two varieties of white ignorance, belief-based white ignorance and practice-based white ignorance. Belief-based white ignorance consists in an information deficit about systems of racist oppression. Practice-based white ignorance consists in unresponsiveness to the political agency of persons and groups subject to racist oppression. Drawing on the antebellum political thought of Black abolitionists Frederick Douglass and (...) class='Hi'>Harriet Jacobs, I contend that an anti-racist politics that conceives of its epistemic task in terms of combating practice-based white ignorance offers a more promising frame for liberatory struggle. A focus on practice-based white ignorance calls for a distinctive form of humility that involves recognition of the limits of one’s own political agency in relation to others, which is integral to democratic relations between free, equal, yet mutually dependent persons. She hoped to sell select pieces from her famed wardrobe in (...) order to supplement her income, which was, at the time, rather meager. Accompanying the recently widowed socialite was her self-described “modiste” and “confidante ” Elizabeth Keckley, a formerly enslaved African American dressmaker who had been “intimately associated” with Lincoln for years.1 Despite the various measures undertaken to ensure the scheme’s success, including attempts to extort monied East Coast Republicans and strategic appeals to the press, it ultimately proved fruitless. Political nemeses seized on the opportunity to publicly mock Lincoln, who was seen as an “extravagant and improper” social climber, for her “pecuniary embarrassment,” treating the public auction of her clothing as a spectacle akin to the World Fair.2 Eventually, the former First Lady was forced to retreat to her home in Chicago, leaving Keckley behind to tend to her affairs. 1. However, perhaps unsurprisingly, the book’s release had the exact opposite effect: Keckley’s literary disclosures were met with scorn, regarded by large swaths of white Americans, including some of the same people who had been most vocal in their condemnation of Mary Todd Lincoln, as constituting a set of socially impermissible transgressions of class, race, and gender. Sales of the book were subsequently suppressed, Keckley’s relationship with Lincoln (who had been caught off guard by the text’s release) came to an abrupt end, and there was even a brief, parodic pamphlet produced, titled Behind the Seams; by a Nigger Woman Who Took in Work from Mrs. Lincoln and Mrs. Davis, which cast the entire ordeal as a sort of (racist) cautionary tale.5 Given the clear disdain held for Lincoln by people across the political spectrum at the time, it can be difficult to make sense of the visceral reaction prompted by Keckley’s airing of the controversial figure’s dirty laundry (pun intended). Abstract:According to the Oxford English Dictionary, the conjoining of “teaching” and “about” suggests a modality of orientation never not regulated by an imposed telos. To teach about suggests a place of unknowability that can be resolved with the successful illustration of beginnings and possible ends, a way of getting from there to here.Beginnings and ends themselves are upset by accounts of racialized and sexualized subjection. As students consider Harriet Jacobs' nineteenth century slave narrative alongside contemporary accounts of anti-black (...) violence, for example, the silliness of a syllabus unravels in the violence of palimpsestic life, texts becoming other texts, scenes collapsing into each other. In that way, the temporality of a classroom must reorient itself in the face of the terrible reach and collapsings engendered by violence and to acknowledge the complex contingencies shaping our philosophical engagements. Ryan Johnson and Biko Mandela Gray study the relationship between Hegel's Phenomenology of Spirit and Black Thought from Frederick Douglass to Angela Davis. This staging of an elongated dialectical parallelism between Hegel's classic text and major 19th-20th-century Black thinkers explodes the western canon of philosophy. Johnson and Mandela Gray show that Hegel's abstract dialectic is transformed and critiqued when put into conversation with the lived dialectics of Black Thought: from Frederick Douglass and Harriet Jacobs through to Malcolm X (...) and Angela Davis. While Hegel articulates the dynamic logics that we see in these Black thinkers, when they are placed in parallel and considered together, the whiteness, both explicit and implicit, of Hegelianism itself is revealed. Forcing Hegelianism into the embodied history of Black Thought reveals a phenomenology of America whose spirit is Black. (shrink)

In this article, we explore two related questions. First, under what conditions, if any, can a Black person trust a white person to be a reliable ally in the context of a society founded on racial slavery? Second, under what conditions, if any, can a Black person trust a white person to be a reliable ally in the context of a white supremacist society? We follow Karen Jones and Nancy Nyquist Potter in arguing that allies must not only be competent, (...) conscientious, and accurately self-assess their epistemic capacities, but they must also signal their trustworthiness in advance to those who would trust them. Furthermore, we argue based on our readings of the slave narratives of Mary Prince, Harriet Jacobs, and Frederick Douglass that allies must display social awareness of the social context that they share with those who would trust them and the power dynamics involved in that social context. This essay examines the theory of maternal impressions, the belief that a woman’s experiences or emotions during pregnancy could explain congenital disability or emotional/ behavior differences in her child and asks why this theory circulated as an explanation for disability seen at birth by both medical doctors and in literature for far longer than it did across the Atlantic. By presenting examples from nineteenth-century medical literature, popular fiction, maternal handbooks, and two canonical works of literature, Nathaniel Hawthorne’s The Scarlet Letter (...) and Harriet Jacobs’ Incidents in the Life of a Slave, I argue that maternal impressions worked to maintain anxiety for women, and particular white women, to ensure they felt responsible if anything was “wrong” with their child. Ultimately, I show how maternal impressions was both an ableist and racialized understanding of inheritance that wouldn’t be discarded until the emergence of eugenics in the early twentieth century. Epistemic injustice is defined by Miranda Fricker as injustice done to people specifically in their capacities as knowers. Fricker argues that this injustice can be either testimonial or hermeneutical in character. A hearer commits testimonial injustice against a speaker by assigning unfairly little credibility to the speaker’s testimony. Hermeneutical injustice exists in a society when the society lacks the concepts necessary for members of a group to understand their social experiences. We argue that epistemic injustice is necessary to permit the (...) functioning of race-based chattel slavery and that this necessity is illustrated in slave narratives. The testimonies of slave narratives like those of Frederick Douglass, Olaudah Equiano, Harriet Jacobs, and Mary Prince identify and transform a culture of race-based epistemic hermeneutic and testimonial injustice. Through telling their stories, these agents establish their capacity as knowers and thus resist the epistemic injustice that undergirds the oppressive system of race-based chattel slavery. The authors of slave narratives not only identify race-based epistemic injustice, but actively fight against it. (shrink)

This qualitative study examines the discourses that 25 preservice secondary social studies teachers create surrounding whether to include themes of sexual violence in the formal curriculum. As part of their first methods course, the participants read Harriet Jacobs's 1861 memoir Incidents in the Life of a Slave Girl and planned a unit using it as the central text. Using discourse analysis and feminist poststructural theory, the author finds that no singular discourse prevails but that the participants struggled with (...) whether to include or exclude historical accounts of sexual violence in the formal curriculum. Are there key respects in which character and character defects are voluntary? Can agents with serious vices be rational agents? Jonathan Jacobs answers in the affirmative. Moral character is shaped through voluntary habits, including the ways we habituate ourselves, Jacobs believes. Just as individuals can voluntarily lead unhappy lives without making unhappiness an end, so can they degrade their ethical characters through voluntary action that does not have establishment of vice as its end. Choosing Character presents an account (...) of ethical disability, expanding the domain of responsibility and explicating the role of character in ethical cognition. Jacobs contends that agents become ethically disabled voluntarily when their habits impair their ability to properly appreciate ethical considerations. Such agents are rational, responsible individuals who are yet incapable of virtuous action. The view develops and modifies Aristotelian claims concerning the fixity of character. Jacobs' interpretation is developed in contrast to the overlooked work of Maimonides, who also used Aristotelian resources but argued for the possibility of character change. The notion of ethical disability has profound ramifications for ethics and for current debates about blame and punishment. (shrink)

Corruption poisons corporations in America and around the world, and has devastating consequences for the entire social fabric. In this article, we focus on organizational corruption, described as the abuse of authority for personal benefit, and draw on Weber’s three ideal-types of legitimate authority to develop a theoretical model to better understand the antecedents of different types of organizational corruption. Specifically, we examine the types of business misconduct that organizational leaders are likely to engage in, contingent on their legitimate authority, (...) motives, and justifications. We conclude by suggesting managerial implications of our theoretical model and propose directions for future research. (shrink)

Charles Taylor is one of the most influential and prolific philosophers in the English-speaking world today. The breadth of his writings is unique, ranging from reflections on artificial intelligence to analyses of contemporary multicultural societies. This thought-provoking introduction to Taylor's work outlines his ideas in a coherent and accessible way without reducing their richness and depth. His contribution to many of the enduring debates within Western philosophy is examined and the arguments of his critics assessed. Taylor's reflections on the topics (...) of moral theory, selfhood, political theory and epistemology form the core chapters within the book. Ruth Abbey engages with the secondary literature on Taylor's work and suggests that some criticisms by contemporaries have been based on misinterpretations and suggests ways in which a better understanding of Taylor's work leads to different criticisms of it. In liberal political theory, meaningful work is conceptualised as a preference in the market. Although this strategy avoids transgressing liberal neutrality, the subsequent constraint upon state intervention aimed at promoting the social and economic conditions for widespread meaningful work is normatively unsatisfactory. Instead, meaningful work can be understood to be a fundamental human need, which all persons require in order to satisfy their inescapable interests in freedom, autonomy, and dignity. To overcome the inadequate treatment of meaningful work by liberal political (...) theory, I situate the good of meaningful work within a liberal perfectionist framework, from which standpoint I develop a normative justification for making meaningful work the object of political action. To understand the content of meaningful work, I make use of Susan Wolf’s distinct value of meaningfulness, in which she brings together the dimensions of objectivity and subjectivity into the ‘bipartite value’ of meaningfulness (BVM) (Wolf, Meaning in life and why it matters, 2010). However, in order to be able to incorporate the BVM into our lives, we must become valuers, that is, co-creators of values and meanings. This demands that we acquire the relevant capabilities and status as co-authorities in the realm of value. I conclude that meaningful work is of first importance because it is a fundamental human need, and that society ought to be arranged to allow as many people as possible to experience their work as meaningful through the development of the relevant capabilities. Four questions are raised about the semantics of Quantified Modal Logic. Does QML admit possible objects, i.e. possibilia? Is it plausible to admit them? Can sense be made of such objects? Is QML committed to the existence of possibilia? The conclusions are that QML, generalized as in Kripke, would seem to accommodate possibilia, but they are rejected on philosophical and semantical grounds. Things must be encounterable, directly nameable and a part of the actual order before they may plausibly enter into (...) the identity relation. QML is not committed to possibilia in that the range of variables may be restricted to actual objects. Support of the conclusions requires some discussion of substitution puzzles; also, the semantical distinction between proper names which are directly referring, and descriptions even where the latter are "rigid designators". Views of W.V. Quine, B. Russell, K. Donnellan, D. Kaplan as well as S. Kripke are invoked or evaluated in conjunction with these issues. (shrink)

They justify their decisions not only on legal grounds but also on the basis of their own often prejudiced judgements of the applicants' ability to `integrate' into Austrian society. A discourse-historical method is combined with systemic-functionally oriented methods of text analysis to study the official letters which notify immigrant workers of the rejection of their family reunion applications. The systemic-functionally oriented methods are used in a detailed analysis of (...) a sample of rejection letters while the discourse-historical method allows this analysis to be intertextually connected to other related genres of discourse and strategies of argumentation, and to the history of post-war immigration in Austria generally.
