La contribución de David Gauthier a la filosofía moral es poco conocida en nuestro país, a pesar de ser uno de los más novedosos y originales aportes que en materia de ética se han desarrollado en las últimas décadas en el ámbito norteamericano. El uso de la Teoría de la elección racional y de la teoría de los juegos hace que sus tesis morales contractualistas resulten muy interesantes a la luz del neocontractualismo. Algunos comentaristas han sostenido que desde la Teoría (...) de la justicia de John Rawls el contractualismo no volaba tan alto. En este trabajo se presenta de forma muy sintética la tesis de Gauthier, a la vez que se cuestiona la validez de su proyecto a la luz de sus posibilidades de aplicación práctica. (shrink)

If $\mathcal{F}$ is a filter on $\omega$, we say that $\mathcal{F}$ is Canjar if the corresponding Mathias forcing does not add a dominating real. We prove that any Borel Canjar filter is $F_{\sigma}$, solving a problem of Hrušák and Minami. We give several examples of Canjar and non-Canjar filters; in particular, we construct a $\mathsf{MAD}$ family such that the corresponding Mathias forcing adds a dominating real. This answers a question of Brendle. Then we prove that in all the “classical” models (...) of $\mathsf{ZFC}$ there are $\mathsf{MAD}$ families whose Mathias forcing does not add a dominating real. We also study ideals generated by branches, and we uncover a close relation between Canjar ideals and the selection principle $S_{\mathrm{fin}}$ on subsets of the Cantor space. (shrink)

Virtue ethicists argue that modern ethical theories aim to give direct guidance about particular situations at the cost of offering artificial or narrow accounts of ethics. In contrast, virtue ethical theories guide action indirectly by helping one understand the virtues—but the theory will not provide answers as to what to do in particular instances. Recently, this had led many to think that virtue ethical theories are self-effacing the way some claim consequentialist and deontological theories are. In this paper I defend (...) virtue ethics against the charge of self-effacement. I distinguish between modestly self-effacing theories, immodestly self-effacing theories and theories that recommend indirect guidance. Though all self-effacing theories are indirect, not all indirect theories are self-effacing. I argue that virtue ethics is not self-effacing, but rather indirectly action-guiding. The response I articulate draws on the distinctive virtue ethical mode of action-guidance: namely, that thinking hard about virtue and what kind of person one aims to be offers the kind of guidance we want (or should want) as we face practical moral problems. As Social Economy financial institutions, credit unions have traditionally been considered less efficient than traditional banking entities. However, like banks and savings banks, they have to be as efficient and competitive as possible to survive in today’s business environment, especially at times of crisis. To date, there have been very few studies on their efficiency and practically none for the crisis period. Moreover, almost all the existing studies assess only financial efficiency, without considering their social function. This study examines the (...) levels of both financial and social efficiency in Spanish credit unions as well as their main determinants during the recent crisis. We apply the two-stage double bootstrap data envelopment analysis methodology based on panel data corresponding to all the credit unions active in Spain between 2008 and 2013. The empirical results indicate that financial and social efficiency achieved an acceptable level, although on average the former was slightly greater than the latter. We also find that both age and merger and acquisition activity were positively influential on the financial efficiency of credit unions but had a significant negative effect on their social efficiency. Moreover, the regional location of such entities and the financial crisis were also crucial determinants of both types of efficiency. Our findings are therefore useful for all the stakeholders of credit unions to know if these entities have been efficient according to a double bottom line accounting in the crisis period and hence to maintain successful social management that is compatible with satisfactory financial efficiency. This article investigates how talk show interviews are brought to an end. The closing process of televised talk shows is analysed and compared with Clayman's characterization of news interview closings. The study concludes that closings in both genres share features relating to the structural organization and the participants' behaviour which can be accounted for in terms of the institutional context in which the speech events take place. Nevertheless, the particular closing structure of each type of institutionally situated talk, as well (...) as its content and style, is genre-specific and shaped by the specific goal pursued in each speech event and by the relationship between the parties to the encounter. Thus, unlike news interviews, the entertainment purpose of talk show interviews ultimately justifies the complexity of the closing structure, its interpersonal content and informal style. Explicitness has usually been approached from two points of view, labelled by Kirsh the structural and the process view, that hold opposite assumptions to determine when information is explicit. In this paper, we offer an intermediate view that retains intuitions from both of them. We establish three conditions for explicit information that preserve a structural requirement, and a notion of explicitness as a continuous dimension. A problem with the former accounts was their disconnection with psychological work on the issue. We (...) review studies by Karmiloff-Smith, and Shanks and St. John to show that the proposed conditions have psychological grounds. Radical enactivism supports radical embodied cognition (REC), which is the idea that basic or fundamental cognition (perception and action) does not need to be understood in representational, contentful terms. REC departs from the idea that the mind can be naturalized through biological functions, but rejects the idea that mental content, which is understood as having a representational nature, can be naturalized. For REC, the natural origins of content (or NOC) is a program based on the following hypothesis: first, we depart (...) from basic cognitive processes that are target-based and guided by an Ur-intentionality or directedness toward the world, and then sociality enters in the picture when language appears into the scene, allowing for establishing full-blown semantic content in which that content is about worldly states of affairs. Here, we are going to focus on the phenomenon of directedness since there are blind spots in this picture: as many authors claim, REC takes Ur-intentionality as the starting point, but there is simply no explanation to date of how this directedness or Ur-intentionality is established. Therefore, how could we account for Ur-intentionality? How does this kind of intentionality emerge? We believe that we can answer this question if we invoke the best scientific evidence from ecological perceptual learning especially in regard to the role of the environment and the information for perceiving affordances in our learning processes. This allows us to offer an answer to the question of how the most basic form of cognition (Ur-intentionality or directedness) emerges in nature. (shrink)

The medical cannabis industry in Colombia is recognized as an emerging industry, and the development of the regulatory framework stimulated the interest of entrepreneurs in creating companies for medicinal purposes. The objective of the work was to examine the key components of the sustainability of the therapeutic cannabis sector in Colombia. In this sense, the study with a mixed approach and analytical scope included a review of the theoretical aspects and regulatory framework. A statistical analysis was carried out to determine (...) the perception of potential clients of the medicinal cannabis industry. A downward projection was found in the number of licenses granted. In conclusion, the therapeutic cannabis sector in Colombia shows promising potential, and its long-term sustainability requires addressing the gaps identified in the implementation of policies, improving social inclusion, promoting innovation for the development of high value-added products, and ensuring environmentally sustainable practices. From a social perspective, the industry promises to generate employment and boost rural development. Environmentally, the industry could contribute to reducing deforestation associated with illicit crops. The sustainability of the sector is an achievable goal, but it will require coordinated efforts in the regulatory, economic, social and environmental spheres to materialize its potential. (shrink)

To achieve their goals, organizations for individuals with intellectual disability have to stimulate high-quality relationships between professionals and family members. Therefore, achieving professionals’ trust in family members has become a challenge. One relevant factor in explaining professional’s trust in families is the degree to which family members use the “problem-solving” conflict management strategy in their disputes–disagreements with professionals. It is reasonable to argue that when family members use problem-solving conflict management, professionals’ trust increases. Professionals’ trust, in turn, stimulates the use (...) of problem-solving strategies by family members. However, it is also plausible that professionals are the initiators of this positive spiral. To examine this relationship between problem solving and trust over time, we conducted a longitudinal survey study in which 329 professionals reported on these two constructs three times. Using structural equation modeling, we compared four nested models: stability, causality, reversed causation, and reciprocal. The results of the χ2 difference tests, regarding the comparison of the models, showed that the reciprocal model was significantly superior to the alternative proposals. Our findings supported a complex view of the relationships between problem-solving conflict management and trust, based on dynamic reciprocal relationships over time. (shrink)

A la différence de Cotteret [1969], Labbé [1983, 1990], désormais Mayaffre [2004], nous saisissons le discours présidentiel sous un angle plus étroit mais dont on peut penser qu’il apportera des éléments intéressants si l’on considère cette forme codifiée comme une quintessence du statut présidentiel en représentation. A la suite (...) de Françoise Finniss Boursin [1992] mais aussi de Françoise Chambre [1984] et Elisabeth Rivory [1991], nous nous intéressons aux allocutions de fin d’année des présidents français, mais adoptons une démarche plus expérimentale, mobilisant différents outils lexicométriques que nous comparons. Nous saisissons ici l’ethos politique à travers les emplois des marques personnelles inscrivant le locuteur dans son discours, par le biais de plusieurs analyses des cooccurrences. (shrink)

As an alternative dispute resolution procedure, Domain Name Arbitration addresses not only contentions regarding the ownership of web pages, but also infringements of the Intellectual Property law such as cyber squatting or Internet piracy. In this spirit, panelists of the World Intellectual Property Organization enact law in accordance with what the involved parties provide them as burden of proof. Following this line of thought, we can assume that one party may remain unrepresented when it is not able to accomplish legal (...) procedures successfully. Nevertheless, does this kind of asymmetry always function in the way that we presume? This paper sets out to study how WIPO panelists tackle knowledge asymmetries when being manifested in Domain Name Arbitration. In particular, this paper concentrates on comparing two Domain Name Arbitration processes in which knowledge asymmetries play a significant role in the panelist’s final-and legally binding- decision. This analysis also examines how specific text-internal features give us a hint of unbalanced relationships between the Complainant and the Respondent of a Domain Name Arbitration process. It endeavors, thus, to understand how lexical, rhetorical-grammatical and discursive features work within discourse and may reach to influence the communicative act itself. Following Vijay K. Bhatia’s critical discourse analysis as main theoretical framework, this paper tries to comprehend the role asymmetries play in enacting Domain Name law. (shrink)

Nuestra pretensión en este artículo es modesta: nos proponemos únicamente poner de relieve el doble sentido de los términos "idea" y "sensación" en la filosofía de los siglos XVII y XVIII. Como es sabido, ambos términos constituyen, respectivamente, el núcleo esencial del racionalismo y el empirismo. La idea para el primero y la sensación para el segundo se erigen ciertamente en piezas gnoseológicas clave sin las cuales ni uno ni otro podrían ser cabalmente comprendidos.

The study of school effectiveness and the identification of factors associated with it are growing fields of research in the education sciences. Moreover, from the perspective of data mining, great progress has been made in the development of algorithms for the modeling and identification of non-trivial information from massive databases. This work, which falls within this context, proposes an innovative approach for the identification and characterization of educational and organizational factors associated with high school effectiveness. Under a perspective of basic (...) research, our aim is to study the suitability of decision trees, techniques inherent to data mining, to establish predictive models for school effectiveness. Based on the available Spanish sample of the PISA 2015 assessment, an indicator of the school effectiveness was obtained from the application of multilevel models with predictor variables of a contextual nature. After selecting high- and low-effectiveness schools in this first phase, the second phase of the study was carried out and consisted of the application of decision trees to identify school, teacher, and student factors associated with high and low effectiveness. The C4.5 algorithm was calculated and, as a result, we obtained 120 different decision trees based on five determining factors (database used; stratification in the initial selection of schools; significance of the predictor variables of the models; use of items and/or scales; and use of the training or validated samples). The results show that the use of this kind of technique could be appropriate if mainly used with correctly pre-processed data that include the combined information available from all educational agents. This study represents a major breakthrough in the study of the factors associated with school effectiveness from a quantitative approach, since it proposes and provides a simple and appropriate procedure for modeling and establishing patterns. In doing so, it contributes to the development of knowledge in the field of school effectiveness that can help in educational decision-making. (shrink)

Here, I first prove that certain families of k-valued clones have the Gupta-Belnap fixed-point property. This essentially means that all propositional languages that are interpreted with operators belonging to those clones are such that any net of self-referential sentences in the language can be consistently evaluated. I then focus on two four-valued generalisations of the Kleene propositional operators that generalise the strong and weak Kleene operators: Belnap’s clone and Fitting’s clone, respectively. I apply the theorems from the initial part of (...) the paper to analyse the fixed-point property of Belnap’s and Fitting’s clones when some special operators that reflect the semantics are added. The conclusion of the paper is that Fitting’s clone is better suited than Belnap’s to provide self-referential languages with highly expressive resources. (shrink)

In this work, we develop and propose an ontological formal definition of time, based on a topological analysis of the formal mathematical description of time, coming from approaches to both quantum theories and Relativity; thus, being compatible with all physical epistemological theories. We find out a mathematical topological invariability, thus establishing a rigorous definition of time, as fundamental generic magnitude. Very preliminary analysis of physical epistemology is provided; likely highlighting a path towards a final common vision between Quantum and Cosmology (...) ontology and human feeling of time.
