This paper questions the conceptual and pragmatic worth of the category of relational values. Combining philosophical reasoning with ethnographic field-work in Wallmapu/Chile, I analyse a variety of ways in which people think about, value and behave toward the land. I thereby demonstrate that relational-ity is inherent to held, instrumental and intrinsic values. This means that there is no meaningful way in which to distinguish relational values from more familiar types of values. Yet, to be able to argue that a distinct (...) class of relational values exists, those who have proposed the term have been compelled to silence or downplay the relational natures of those other values. This has the perverse effect of confining, rather than promoting, relational thinking. (shrink)

Following a Toulmian account of argument analysis and evaluation, I offer a general unitary schema for, so called, deductive and inductive types of analogical arguments. This schema is able to explain why certain analogical arguments can be said to be deductive, and yet, also defeasible.

Our aim is to defend the Precautionary Principle (PP) against the main theoretical and practical criticisms that it has raised by proposing a novel conception and a specific formulation of the principle. We first address the theoretical concerns against the idea of there being a principle of precaution by arguing for a distinctively political conception of the PP as opposed to a moral one. Our claim is that the rationale of the PP is grounded in the fact that contemporary societies (...) wish to avoid morally unacceptable risks while at the same time pursuing other goals, aspirations and values. Following this political conception of the PP, we propose a specific formulation in terms of an argumentation scheme—the Argumentation Scheme for Appealing to Precaution—which is meant to solve, in turn, the main practical concerns that the PP has raised. We explain the advantages of our proposal by analysing appeals to precaution in the cases of (1) the European restrictions on the free movement of persons during the COVID-19 pandemic and (2) the discharge of nuclear wastes into the Irish Sea. The main goal of this paper is to show that politics constitutes a normative domain of its own. To this, a concept of political value that explains why the politically good provides reasons for actions is indispensable. I shape this concept by adopting the framework of political minimalism and developing one of its central tenets, namely, that politics, as a constitutively normative practice, specifies objective standards for evaluating political phenomena. I characterize the notion of political value in these terms to (...) offer a non-moralist foundation for political normativity. In this endeavor, the work of Bernard Williams plays two opposing roles: while his metapolitical ideas exemplify the shortcomings of substantialist accounts of political normativity, his criticism of the morality system and his conception of practical rationality as all-things-considered practical deliberation are fundamental, to the point that the conception of political normativity endorsed here can be seen as an extension of Williams’ ideas on normativity in general. Finally, I draw some consequences from this account of political minimalism to show that this conception of political normativity can hardly be considered a variety of political realism. (shrink)

a recent paper, Fábio Perin Shecaira proposes a defence of Waller’s deductivist schema for moral analogical argumentation. This defence has several flaws, the most important of them being that many good analogical arguments would be deemed bad or deficient. Additionally, Shecaira misrepresents my alternative account as something in between deductivism and non-deductivism. This paper is both an attempt at solving this misunderstanding and an analysis and criticism of Waller and Shecaira’s forms of deductivism.

This paper provides a philosophical analysis of the Price equation and its role in evolutionary theory. Traditional models in population genetics postulate simplifying assumptions in order to make the models mathematically tractable. On the contrary, the Price equation implies a very specific way of theorizing, starting with assumptions that we think are true and then deriving from them the mathematical rules of the system. I argue that the Price equation is a generalization-sketch, whose main purpose is to provide a unifying (...) framework for researchers, helping them to develop specific models. The Price equation plays this role because, like other scientific principles, shows features as abstractness, unification and invariance. By underwriting this special role for the Price equation some recent disputes about it could be diverted. (shrink)

The aim of the present study was to determine statistical differences in a set of badminton competition matches in five different modalities with regard to competition level (Group Phase versus Eliminatory Phase). Data from 453 sets (125 in men’s singles; 108 sets in women’s singles; 77 sets in men’s doubles; 73 in women’s doubles and 70 in mixed doubles) from the RIO 2016 Olympics Games were recorded and classified in two groups of variables to analyse variables related to match (5) (...) and set (15). A descriptive analysis and univariate test (Mann Whitney U) for non-parametric data were conducted. The results show in men’s and women’s singles all the variables related to match were higher in the Elimination Phase than in the Group Phase (p<0.01). In Sets 1 and 3, the longest set duration, rally and average rally were found in the Elimination Phase than Group Stage (p<0.05). In women’s singles, these differences were also recorded in Set 2. For doubles, the results are more stable among groups. Men’s doubles had a longer duration of the match and set (set 1 and set 2) (p<0.01), and also scored highest for average rally strokes (set 1 and set 3) (p<0.05) and shuttles used in the Elimination Phase versus the Group Phase along the match (p<0.01). In women’s doubles, more shuttles were used in a match in the Elimination than in the Group Phase. Moreover, the same results are established for Set 2, including for average rally. Mixed doubles saw no match going to three sets. However, the greatest differences showed a longer rally and average rally being registered in the Elimination than in the Group Phase. In conclusion, the timing factors of the badminton singles and doubles games were different in the Elimination and Group Phases. This information may help players and coaches prepare and administer different types of workouts or, more specifically, competition schedules adapted to the characteristics of modern badminton. I argue for the distinction between presuming that p and maintaining that presumably p. In order to make sense of this distinction, I defend a non-inferentialist conception of presumptions and offer an account of the correctness conditions for both presumptions and presumptive inferences. I characterize presumptions as a type of constative speech-act having certain semantic correctness conditions. In turn, regarding presumptive inferences, my strategy is to provide the correctness conditions for the use of an epistemic modal such as “presumably.” This (...) epistemic modal is characterized as a force indicator for speech-acts of concluding in complex speech-acts of arguing involving presumptive inferences. Se intenta mostrar que el escepticismo de la autora, al presentar esta institución social como un proyecto fallido, constituye una protesta feminista contra la soflama masculina hegemónica del siglo xix, que aceptaba como válido únicamente el vínculo conyugal bendecido por la Iglesia y/o sancionado por el Estado. Con este objetivo, se estudian algunos factores que afectaban las relaciones maritales de (...) las mujeres de aquella época, tales como la percepción que se tenía de la mujer—como agente civilizador y como inductora del mal—, las expectativas sociales de la mujer casadera y casada, el alto valor atribuido a la virginidad prenupcial y a la maternidad, la doble moral en el ejercicio de la sexualidad, la subordinación de la mujer al hombre y la violencia doméstica física y mental. I attempt to show that the author's skepticism of this social institution, which she presents as a failed project, is a feminist protest against the 19thcentury hegemonic masculine discourse that considered Catholic marriage and/or legal marriage as the only acceptable forms of a conjugal bond. With that intention, I comment on several key factors that affected women’s marital relationships at that time. For example, the dual perception of women both as civilizing agents and as a temptation to sin and subsequent perdition, the social expectations from a maiden and from a married woman, the high value attributed to prenuptial virginity and of maternity, the double standards for men and women in the expression of their sexuality, the subordination of women to men, and domestic physical and mental violence, among other. Ziel dieses Aufsatzes ist es zu zeigen, daß das ontologische Grundschema von Leibniz eine eigenstandige Erneuerung der Aristotelischen Einteilung des Seienden ist. Die Erklärung der genauen Entsprechung zwischen beiden kategorialen Systemen soil dazu dienen, gewisse, heute weit verbreitete MiBverstandnisse zu korrigieren. Die Originalität von Leibniz in dieser Sache liegt darin, daß die von Aristoteles am Anfang der Kategorien aufgestellte vierfache Gliederung des Seienden im Lichte einer doppelten Unterscheidung zu sehen ist: in der ontologischen Unterscheidung zwischen konkreten und abstrakten Sachen und (...) in der logischgrammatikalischen Unterscheidung zwischen konkreten und abstrakten Termini. Als Konsequenz dieser Neuheit kann die Leibnizsche Klassifikation der Dinge einige Ungenauigkeiten vermeiden, in welche die Aristotelische Kategorienlehre verfällt. (shrink)

This paper analyses the structure of evolutionary theory as a quasi-Newtonian theory and the need to establish a Zero-Cause Law. Several authors have postulated that the special character of drift is because it is the default behaviour or Zero-Cause Law of evolutionary systems, where change and not stasis is the normal state of them. For these authors, drift would be a Zero-Cause Law, the default behaviour and therefore a constituent assumption impossible to change without changing the system. I defend that (...) drift's causal and explanatory power prevents it from being considered as a Zero-Cause Law. Instead, I propose that the default behaviour of evolutionary systems is what I call the Principle of Stasis, which posits that an evolutionary system where there is no selection, drift, mutation, migration, etc., and therefore no difference-maker, will not undergo any change (it will remain in stasis). This article analyzes the view of evolutionary theory as a theory of forces. The analogy with Newtonian mechanics has been challenged due to the alleged mismatch between drift and the other evolutionary forces. Since genetic drift has no direction several authors tried to protect its status as a force: denying its lack of directionality, extending the notion of force and looking for a force in physics which also lacks of direction. I analyse these approaches, and although this strategy finally succeeds, (...) this discussion overlooks the crucial point on the debate between causalists and statisticalists: the causal status of evolutionary theory. Both because of the vagueness of the word ‘give’ when speaking about giving reasons, and because we lack an adequate definition of ‘reasons’, there is a harmful ambiguity in the expression ‘giving reasons’. Particularly, straightforwardly identifying argumentation with reasons giving would make of virtually any interplay a piece of argumentation. Besides, if we adopt the mainstream definition of reasons as “considerations that count in favour of doing or believing something”, then only good argumentation would count as argumentation. In this paper, (...) I defend a qualified characterization of argumentation as reasons giving that is shown to be fruitful for shedding light on the practice of giving reasons, and an inferentialist conception of reasons that makes room for speaking of “bad reasons” and, consequently, makes it possible to talk of argumentation as reasons giving even if we are talking about bad argumentation. Due to its high degree of complexity and its historical nature, evolutionary biology has been traditionally portrayed as a messy science. According to the supporters of such a view, evolutionary biology would be unable to formulate laws and robust theories, instead just delivering coherent narratives and local models. In this article, our aim is to challenge this view by showing how the Price equation can work as the core of a general theoretical framework for evolutionary phenomena. To support this claim, (...) we outline some unnoticed structural similarities between physical theories and evolutionary biology. More specifically, we shall argue that the Price equation, in the same way as fundamental formalisms in physics, can serve as a heuristic principle to formulate and systematise different theories and models in evolutionary biology. The reasons for the bipartite division of moral religion—confirmed also by the findings of Kant’s third Critique—not only provide a direct, explicit, and maybe sufficient answer to the question posed, but also shed light on the role of Christianity in Kant’s conception of religion. Venezuelan media present corruption as a major problem of the country and a research conducted by the author shows managers perceive it as business ethics' main issue. The corruption type addressed to in this article is the collusion between public officials and private managers for illegal or undue profits. Corruption in this form is related to the long-standing policy of State intervention and overregulation of the economy in order to industrialize the country. The issue analyzed is the perception of corruption (...) as a major political and social problem. Corruption is pervasive in many societies but it is not perceived as a central problem. The explanation for this perception in Venezuela is the increased impoverishment of people as a consequence of present economic crisis (the corrupt person is perceived as taking from my pocket) and the openness and pluralistic character of the political system. Moral indignation and scandal is the result of this new feature of Venezuelan society. Changes in the economic policies and the awareness of corruption seem to establish the basis to overcome the perception of corruption as the paramount problem it is now. (shrink)

There are many types of artistic representations of the legend of Don Juan, i.e. the universal archetype of the seducer who, through deception, conquers a woman and, once she succumbs to his charms, he boasts of his triumph, despises her, and shifts his interest towards another lady. In this work, I compare three of the most famous versions don Juan: The Trickster of Seville and the Stone Guest by Tirso de Molina, Don Giovanni by Wolfgang Amadeus Mozart and Lorenzo (...) Da Ponte, and Don Juan Tenorio by José Zorrilla. The first and third are theatrical pieces, while the second is an opera. The myth of Don Juan is essentially the same in all three, but the message and the moral vary according to the cultural movement the works belong to, namely the Baroque, the Enlightenment and the Romanticism, respectively. Key words: The Trickster of Seville and the Stone Guest, Don Giovanni, Don Juan, Tirso de Molina, Wolfgang Amadeus Mozart, Lorenzo Da Ponte, José Zorrilla, sin, redemption, sociopath. Resumen. Son muchos los tipos de representación artística —teatro, música, ópera, ballet, literatura, cine, televisión, pintura, escultura, etc.— de la leyenda de Don Juan, el arquetipo universal del seductor que, mediante engaños, conquista a una mujer y, una vez que ella sucumbe a sus encantos, se jacta de su triunfo, las desprecia y reenfoca su interés en otras damas. RESUMEN: El uso de analogías en bioética es muy frecuente. Dado que son instrumentos especialmente eficaces desde un punto de vista retórico, resulta fundamental determinar bajo qué condiciones la formulación de analogías constituye un recurso discursivo legítimo. En este artículo, distinguimos entre usos no-discursivos y usos discursivos de las analogías, y dentro de estos últimos, entre usos explicativos y usos argumentativos. En base a esta clasificación, proponemos distintos conjuntos de criterios para determinar si una analogía particular constituye un recurso discursivo (...) legítimo o no. Para ello, ilustramos brevemente nuestra clasificación mediante algunos ejemplos tomados del reciente debate sobre los biobancos.ABSTRACT: Analogies are frequently used in bioethics. As they are particularly effective as rhetorical tools, it is essential to determine under which conditions they can be said to be a legitimate discursive resource. In this paper we distinguish between nondiscursive uses and discursive uses of analogies and, within the latter, between explanatory uses and argumentative uses. Taking this classification as a basis, we provide different sets of criteria for determining whether or not a particular analogy constitutes a legitimate discursive resource. In distinguishing between legitimate and illegitimate analogies, we briefly illustrate our classification by some examples from recent literature on biobanks. (shrink)

This paper examines ethical violations committed by Certified Public Accountants in Puerto Rico in the 2002–2010 period and the related disciplinary actions taken by the local regulatory bodies. The institutional settings for the accounting profession in PR are different from those of the United States. Ethical complaints are investigated by the PR Society of CPAs and evaluated based on the Code of Professional Conduct of the American Institute of Certified Public Accountants, although most CPAs in PR are not affiliated with (...) the AICPA. Our study is based on data provided by the PR Society of CPAs that is not publicly available. We examine the association between the occurrence of the ethical violations and certain variables such as gender, type of practice performed by the CPA, and whether the CPA participates in a peer review program. Results of a multiple correspondence analysis suggest that not being a member of the AICPA, practicing as a sole practitioner, and not participating in a peer review program seem to be more associated with the occurrences of ethical violations by CPAs. We compare our findings with prior research on ethical infractions committed by CPAs in the United States and find some differences attributable to the institutional settings in PR. Overall, our results suggest the importance of codes of conduct in the accounting profession and compliance with such ethical guidelines by practicing accountants. (shrink)

Julio Cortázar, en cambio, no sólo mantuvo su adhesión al proyecto socialista y reivindicó la libertad y la autonomía de los intelectuales, sino que, además, quiso ser el Guevara de las letras y propuso una poética para la política: el socialismo sólo podría ser —desde su perspectiva— si sabía ser poesía. En su Crítica de la Razón Pura, Kant discute dos doctrinas de origen aristotélico: la definición de la verdad como adaequatio intellectus et rei y la doctrina de los trascendentales, condensada en la fórmula quodlibet ens est unum, verum, bonum. El filósofo español Antonio Millán-Puelles ha llevado a cabo en dos de sus libros un examen del valor de esta discusión kantiana. El objetivo de este trabajo es comentar el análisis de Millán-Puelles y completar algunos de sus puntos con objeto (...) de mostrar su interés filosófico y su originalidad. (shrink)

Kant seldom uses the name «pneumatology» to designate the science of the immortality of the soul. But in many occasions he deals in an original way with the concept meant by the name. In this paper the four senses in which Kant understands this concept are distinguished and explained, namely: pneumatology as the idea of a possible science; pneumatology as a natural disposition; theoretical-dogmatic or doctrinal pneumatology; and practical-dogmatic or authentic pneumatology. The different cognitive value granted by Kant to the (...) doctrines about immortality assembled under the various senses of the concept of pneumatology is likewise considered. (shrink)

El célebre argumento ontológico de la existencia de Dios -así denominado por Kant-, toca, sin duda, el nervio central de la Metafísica. No es por ello extraño que, desde que lo propuso Anselmo de Canterbury, pocos filósofos hayan dejado de ocuparse de ese razonamiento. Y tampoco resulta sorprendente que sean muchas y diversas las objeciones que contra él se han suscitado y muchas también, y distintas, las explicaciones que ha recibido a su favor. A la vista de tan variadas y (...) dispares polémicas, ¿cabe señalar con precisión en qué consiste propiamente este argumento de la existencia de Dios? ¿Es posible ordenar sistemáticamente las razones que se aducen tanto en su recusación como en su defensa? Responder a estos interrogantes es la tareamás inmediata que se intenta en este libro. Pero la respuesta que se busca no puede por menos de plantear esta nueva y fundamental cuestión: ¿cuáles on los supuestos últimos en los que descansa la prueba ontológica? El análisis expuesto en esta obra señala que, en discusión de este argumento, se halla entrañado, en verdad, un conjunto de problemas cuya indagación ha constituido desde siempre el objeto de estudio de la ciencia del ser. Este libro se presenta, pues, como una introducción a los problemas capitales de la Metafísica, que toma como hilo conductor el examen del argumento ontológico de la existencia de Dios. Quizás en ningún otro asunto aparece de forma más terminante la oposición entre el ser y el no ser. Buenaventura de Bagnorea lo expresó bellamente: Dios, «el ser purísimo, no se presenta al entendimiento sino poniendo totalmente en fuga al no ser». (shrink)
