This work held an exhibition of the thinking of Robert Alexy concerning the relations between law and morality, which can be understood as an attempt to overcome the old quarrel between legal positivism and natural law. The author develops then a system that allows to appreciate the legal rulings according to their moral quality, depriving the legalitythose considered too unfair and correcting those considered reparable.

Em 1912, um conjunto de fragmentos de crânio, mandíbula e dentes foi apresentado na Inglaterra como pertencente a um ancestral do Homo sapiens. A nova espécie, batizada de Eoanthropus dawsoni – o “Homem de Piltdown” –, foi tratada como uma das descobertas mais extraordinárias da antropologia até então: finalmente, um hominídeo havia sido encontrado em solo inglês, e seu status era ainda maior por ser uma espécie da qual a nossa teria supostamente se originado. Quatro décadas depois, no entanto, a (...) fraude foi exposta: os vestígios do Homem de Piltdown haviam sido montados a partir de um crânio humano com mandíbula e dentes de orangotangos. As razões para a aceitação imediata da espécie entre os ingleses foram, provavelmente, as expectativas e os desejos de cientistas em ter o seu país como o berço da humanidade, e também o fato de que o espécime de Piltdown corroborava ideias aceitas na época a respeito da evolução humana. Apesar disso, como, então, sabemos hoje que o Homem de Piltdown é uma fraude? Argumentamos que a resposta a essa questão está no conceito de ceticismo organizado. O ceticismo organizado é um dos componentes do ethos científico propostos pelo sociólogo Robert Merton, um elemento institucional que envolve procedimentos de avaliação e revisão da prática e das ideias científicas feitas a partir de uma comunidade de investigação. No presente artigo, examinamos como o trabalho de uma comunidade de investigação foi fundamental para o desnudamento da farsa do Homem de Piltdown e, em um segundo momento, discutimos o que o ceticismo organizado pode nos ensinar a respeito da natureza da ciência e de nossos próprios processos de raciocínio cotidianos. Throughout the last decades, scientific and therapeutic communities have made common efforts to collect reliable information concerning the efficacy of psychotherapies. One of these initiatives has, recently, involved the psychodrama community and its desire to achieve progress in the validation of this therapy. Based on Robert Elliot's Hermeneutic Single Case Efficacy Design (HSCED), we followed five participants (3 women, 2 men, aged 27-48) of a psychodrama group over the course of their therapeutic process, which ranged from 24 months to (...) 5 years. We chose one of them for the single case study. Quantitative outcome measures included the Portuguese versions of the Revised Spontaneity Assessment Inventory, Clinical Outcome Routine Evaluation and the individualized Personal Questionnaire. Qualitative process measures included Helpful Aspects of Therapy Form and the Client Change Interview. Participants generally reported improvement in their personal therapeutic goals, decrease in symptoms and life problems, and some showed a marked increase in spontaneity levels. In the single case presented, these results are confirmed, and following decision criteria it is possible to assert that the participant improved in all the variables assessed and that therapy is the main cause of these changes. Furthermore, the participant frequently rated psychodrama sessions as being helpful and stated they had a transformational impact on his life. This research contributes towards validating psychodrama as an efficient therapeutic method, hopefully stimulating practitioners to integrate therapy and research - which, for years, were considered independent and incompatible - and to facilitate their use in a complementary way. In this paper, I shall examine attempts to furnish formal models for deductive scientific explanation. All such attempts have had certain defects. The most serious of these defects is to be found in the fact that the extant models seem to be formally restrictive in ways that do not allow any obvious generalization of their conditions which will encompass the full range of all those scientific explanations which must be considered plausible candidates for translation into deductive models.

The fact that simplicity has been linked with induction by many philosophers of science, some of whom have proposed or supported criteria of “inductive simplicity,” means that the problem must be given some serious attention. I take “inductive simplicity” as a title, however, only by way of concession to these historical treatments, since it is precisely the burden of my paper to show that there is no such thing. This book argues that the primary function of human thinking in language is to make judgments, which are logical-normative connections of concepts. Robert Abele points out that this presupposes cognitive conditions that cannot be accounted for by empirical-linguistic analyses of language content or social conditions alone. Judgments rather assume both reason and a unified subject, and this requires recognition of a Kantian-type of transcendental dimension to them. Judgments are related to perception in that both are syntheses, defined as the (...) unity of representations according to a rule/form. Perceptual syntheses are simultaneously pre-linguistic and proto-rational, and the understanding makes these syntheses conceptually and thus self-consciously explicit. Abele concludes with a transcendental critique of postmodernism and what its deflationary view of ontological categories—such as the unified and reasoning subject—has done to political thinking. He presents an alternative that calls for a return to normativity and a recognition of reason, objectivity, and the universality of principles. (shrink)

He shows us that the history of medicine is in no small part the history of learning that fewer and fewer things are somebody's "fault"; for example, for centuries we thought seizures were a sign of demonic possession. Yet, as he acknowledges, it's very hard, and at times impossible, to uncouple from our zeal to judge others and to judge ourselves. Sapolsky applies the new understanding of life beyond free will to some of our most essential questions around punishment, morality, and living well together. By the end, Sapolsky argues that while living our daily lives recognizing that we have no free will is going to be monumentally difficult, doing so is not going to result in anarchy, pointlessness, and existential malaise. Franklin and Pickering agree that scientists in an experimental sequence, like the one to be discussed here, choose to accept certain experiments and their results as crucial, but disagree as to whether such choice can be justified in terms of an on-line estimate of evidential reliability. This paper suggests that it is possible to define a position between Franklin 's Bayesian objectivism and Pickering's social constructivism. This position depends on considering the sequence of improvement in material technique and instrumentation as (...) more important than any measure of reliability determined merely from such factors as evidential spread in relevant sequences, a factor that neither Franklin nor Pickering takes sufficiently into account. In Howard Kahane's current reply to my previous discussion of Goodman's elimination rules, he suggests both that the notion of conflict required by the first elimination rule cannot be made clear, and that both proposed revisions of the second elimination rule are too strong [4]. These seem to me to be the points which require settlement, and I would like to discuss them in this paper.

In order to explain the behavior of a human organism, it is necessary to take its environment into consideration. Except for very severe psychotic withdrawal, this has been recognized as a near triviality since Aristotle. But although consideration of the environment may be necessary, it is not sufficient, and it is now generally conceded that a man's behavior cannot be explained solely from a consideration of his present environment and a history of his responses to past environments.

Moraine- a euphemism for the de-stabilizing referent of the writer-ly body as a “troubled and troubling landscape marked by cultural and historical signifiers, the body as flesh memory [...] the body as transitory” (Oliver, Author Statement). Moraine— a geological metaphor of the poet as a holder of memory, as an accumulation of rocks and debris carried along the edge, terminal, dropped at the foot of language (in language). “Flesh Memory” according to Akilah Oliver is "that which my body recalls [...] everything has to do with the task of remembrance and its narrative reinvention [...] I was always translating an idea of the world as it presented itself at any given time. Possessively AO calls it “habit radius” (a virtual fetish attribute) or an inescapable death presence that “confronts us with the paradox of an unattainable object [...] through it’s being unattainable” (Agamben, 27). A flirtation or dialogue with an unknowable thing and aporia utilized as investigative instrument to engage (death) while (in Southern California) we “perform reflexive motions,” cut lace snowflakes, imagine snow, and pay rent like “yeah, yeah” what else is new. And this too, fiction. The book I wish to right. The restored fallen, heroic. Did you expect a different grace from the world? Or upon exit? I’m working on “tough.” They think I am already. Sifting the rubble, rummaging through hoarded debris, skin sheds, memory-napping, and re-awoken (in flesh and) on terrain. “An investigative poetics seeks to unravel staid communities of thought and grasp at what might always be just beyond reach; a poetics of inquiry that lies between language as meaning, and language as rapturous entry into the world of posited ideas and idealism”( Levitsky). Something snaps. Lights blow out prior to embarking upon an investigative poetics. It begins with a question (often a sexy aporia) that leads to openings. "Every politics of memory [...] implies an intervention of the state. It's a state that legislates and acts with regard to the nonfinite mass of materials to be stored, materials which must be collected, preserved” (Derrida & Stiegler, 62). It seems poetic investigation already contains the potentiality of an (invisible) archive if the writer is “always writing” especially when not. Here’s my stupid digital romantic inclination: the living-body (of a poet) is a self-sustaining archive of non-finite memories. But not even I really believe that. AO innovated and sculpted an investigative poetic praxis. In a conversation with poet Rachel Levitsky, poetic-voice is viewed not as a precious identifier, but as a means to think through/about form, concluding that form is linked to framing. While poetic-voice may have tendency to precede form, it also erupts as a result of framing techniques. “They are frames that hold the shape of thinking (which is also to say of imagining) [...].”7 This reminds me of my rabbit who symmetrically chewed the corners of his hutch, which makes me wonder if it’s an expression of the shape of some animal anxiety tick I won’t ever have access to. Beyond the form/frame, death is an unoriginal yet unique limit; death is a damn deathless thing. It functions as a source of poetic investigation; that thing always “just beyond reach.” And how is death not a fetish (in this case an obsessive reverence for something non-material)? “Insofar as it [death] is a presence, a fetish [...] it is in fact something concrete and tangible; but insofar as it is the presence of an absence, it is, at the same time, immaterial and intangible, because it alludes continuously beyond itself to something that can never really be possessed [...] The fetish is [...] a sign of an absence, it is not an unrepeatable unique object; on the contrary, it is something infinitely capable of substitution, without any successive incarnations ever succeeding in exhausting the nullity of which it is the symbol” (Agamben, 33). AO utilized absence (the absent body [catapulted by the death of a beloved]) as an apparatus to investigate. Poetic voice is rendered as internal thought meanderings, a not-so-much confession, private/(pillow?) talk in the desire to be heard/witnessed by the referent and reader with an intent to absolve. The diminutive “i” bears a relation to poet Fanny Howe’s “little g God” in that “One of the (many) things I like about little g God is that you can have a vodka tonic while you talk to little g God, sing along to Bowie’s “I’m Afraid Of Americans,” and hum Coltrane’s “A Love Supreme,” though maybe not all at the same time” (Oliver, 2009). Towards the middle of the poem AO is at a used bookstore and remarks on the funny employment of death as a ‘plot mistress’ that ‘they’ (the dubious employed mystery authors) are ‘unable to grasp’, thereby giving death a mouthpiece, a modeling job, something to do to pass the time. from THE VISIBLE UNSEEN When I first saw graffiti, I recognized in it an ugly aesthetic, a dialectics of violence, a distortion of limbs, a hieroglyph. It was only later when I read the names of the dead that I then saw the path of ghosts charted there; its narrative of loss for the visible unseen whose place in history has been fictionalized and rendered unseen under the totalizing glare of history. Inscriptions, traces, specters. Graffiti begs a public face just as ghosts require non-ghosts (humans) to sense them. The “visible unseen” is a game of hide-and-seek between public viewer and graffiti-inscriber, an ephemeral-violent aesthetic on an ephemeral-policed canvas. Graffiti-inscribers already submit to being forgotten, expect to be washed away; perhaps it’s a holy urban mandala created by gangster-type monks without Buddhism. [...] in its refusal to disappear it forces a discourse in the public imagination we are forced to see what we would rather not, to make sense of an encoded language that we cannot read on the level of meaning. it irritates, forces its agency on us, speaks outside and beyond semiotic reach. An epic font-size pervading the public’s imagination, illegible, I could just close my eyes, remain passive, drive past, abandon it beyond reach, push it further away beyond death walls. In Barcelona I watched a clean up crew wash walls with an awesome water hose but I was more intrigued by their bodies; not a distortion of limbs, not hieroglyph but also not entirely legible; the laboring body permanently erasing specters of the city, and of course they knew it was also an invitation for the ghosts to return. Graffiti is death’s little sister, is also an aporia. [...] Graffiti (fr GK -graph(os), something drawn or written, to diagram or chart) attempts to stage the impossible: to erase the essence of its own subjectivity. Graffiti is a cartography of ghosts, a mapping of elegiac rapture (the transporting of a person from one place to another, as in heaven) and rupture (the state of being broken open.) Dwelling is a fiction stasis. [...] The notion of the past as being something done with, a look-back event, inhibits the possibility of reading graffiti as rapture, as rupture. If graffiti posits history as always in the process of becoming undone. [...] Because what is the body, if not also a complex temple, an unstable site through which to negotiate subjects, materiality, economies, gods, and modes of representations? The site where we are all already belated. Graphein meaning “to write.” “Derrida says every archive makes a law, and the law of genre is its own rupture” (Bloch, 39). However, graffiti is an (non/anti)-archive of erasure due to (the politics of) washing out its subjectivity, which only adds onto (or is symptomatic of) its character. The inhibition of “reading graffiti as rapture, as rupture” is partly due to it being a “look-back” event in that it’s process involves scratching through layers to reveal previous specters underneath. Graffiti (as an ancient genre) has always been a thing of ‘becoming undone’, and therefore ‘belated and always in arrival’ (Levitsky). It’s a Dionysian activity done at night with it’s back turned toward us. "The specter [...] is of the visible, but of the invisible visible, it is the visibility of a body which is not present in flesh and blood [...] appearing for vision, to the brightness of day [...] something becomes almost visible which is visible only insofar as it is not visible in flesh and blood. It is a night visibility. As soon as there is a technology of the image, visibility brings night. It incarnates in a night body, it radiates in a night light" (Derrida & Stiegler, 115). (shrink)

Background Education is a tool for the promotion of ethical skills that ensure the principles of conduct and the quality of care provided. The literature is still incipient in this theme; however, some studies point to education and ethical consultations as strategies to promote an ethical environment. Objective To map the interventions that aim to prospect the ethical environment in health services. Method Scoping review to answer the question “What interventions are being used by health professionals to prospect an ethical (...) environment in health services?” It occurred in the Medline (PubMed), CINAHL with Full Text (EBSCO), Scopus, Embase (Elsevier), and Web of Science databases in January 2023 by two reviewers, via the Rayyan platform. Articles with health professionals addressing interventions to prospect the ethical environment in any health service were included, without time frame. A form was used for data extraction and analysis occurred via Bardin content analysis. The review protocol was registered in the Open Science Framework. Results 2429 records were found; however, only 12 articles were included for analysis, these being randomized, cross-sectional, descriptive, and qualitative studies. Among the interventions, it was noticed that 58.3% ( n = 7) is about ethical education, 16.7% ( n = 2) about ethical guidelines and codes, 16.7% ( n = 2) about ethical reflection and leadership, and 8.3% ( n = 1) of ethical consultations. A theoretical map was elaborated, and four types of interventions were identified, based on ethical consultation, ethical education, guidelines and codes of ethics, reflection, and ethical leadership. Conclusions The interventions were considered effective to prospect the ethical environment in health services, and their effectiveness was evaluated by validated instruments, as well as through interviews and focus groups. Como instrumento da coleta de dados priorizou-se o uso de textos em três momentos, a saber: primeiro - dos tipos “resposta à pergunta o que é o Esclarecimento?; segundo - análises sobre o pensamento rousseauniano a partir dos textos “Emílio ou da educação” (...) e “Projeto de Educação” nas abordagens de Rousseau para suscitar debates sobre a educação humanista fundamentada na vivência do Contrato Social e nos fundamentos de uma educação para a sensibilidade do sujeito moderno; terceiro - discutir o legado das ideias iluministas no processo educacional na realidade brasileira. O presente artigo tem por objetivo compreender a origem dos conflitos sociais a partir da Teoria do Reconhecimento, do sociólogo e filósofo alemão Axel Honneth (2009), e as suas importantes contribuições para os estudos sobre o Sistema Socioeducativo, partindo do primado que, o desreconhecimento dos direitos dos adolescentes e jovens que se encontram em situação de vulnerabilidade e marginalização, muitas vezes, desde a mais tenra idade, é um fator importante e que dá origem a conflitos sociais. Para tanto, fundamentamos a (...) falta de reconhecimento dos direitos dos jovens a partir das três dimensões do Reconhecimento desenvolvidas pelo referido autor, a saber: o amor, o direito e a solidariedade. O nosso estudo, busca trabalhar o conceito de Socioeducação partindo da concepção de educação social analisando as possíveis raízes da violência que levam os jovens a delinquir, abordando o tema sob um paradigma neoliberal que visa à manutenção das desigualdades sociais e a valorização da estima meritocrática e compreende que a redistribuição surge como alternativa capaz de romper com tal exclusão tendo o seu alcance por meio da luta por Reconhecimento. The postphenomenological framework of concepts—and especially the version utilized by the founder of this school of thought, Don Ihde—has proven useful for puncturing others’ totalizing or otherwise overgeneralizing claims about technology. However, does this specialization in deflating hype leave this perspective unable to identify the kinds of technological patterns necessary for contributing to activist interventions and political critique? Put differently, the postphenomenological perspective is committed to the study of concrete human-technology relations, and it eschews essentialist and fundamentalizing accounts of technology. (...) Do these commitments render it incapable of providing general assessments of our contemporary technological situation? It is my contention that this perspective can indeed be useful for these kinds of critical projects. To do so, we must go beyond Ihde’s personal tendency to utilize postphenomenology mostly for deflating others’ hype, and explore this perspective’s distinctive potential for identifying ways that technologies can become set within problematic patterns of usage and design. My suggestion is that the postphenomenological notion of “multistability” can play a helpful role in these efforts, especially when combined with a conception of local, rather than totalizing, stabilizations of human-technology relationships. Martin Heidegger and Michel Foucault are two of the most important and influential thinkers of the twentieth century. Each has spawned volumes of secondary literature and sparked fierce, polarizing debates, particularly about the relationship between philosophy and politics. And yet, to date there exists almost no work that presents a systematic and comprehensive engagement of the two in relation to one another. _The World of Freedom_ addresses this lacuna.
