Like blood, health care is too precious, intimate, and corruptible to entrust to the market.The hospice movement in the United States is approximately 40 years old. During these past (...) four decades, the concept of holistic, multidisciplinary care for patients who are suffering from a terminal illness has evolved from a modest, grassroots constellation of primarily volunteer-run and community-governed endeavors to a multimillion dollar industry where the surviving nonprofits compete with for-profit providers, often publicly traded, managed by M.B.A.-trained executives, and governed by corporate boards. Philosophy, accordingly, requires not only emotional sensitivity but an understanding of the emotions, not as curious but marginal psychological phenomena but as the very substance of life. Many people recognize that governments can play salutary roles in relation to markets by “overseeing” market behavior from “above,” or supplying foundational “rules of the game” from “below.” It is probably no accident that these widely recognized roles also sit comfortably with traditional conceptions of government and market, pursuant to which people tend categorically to distinguish between “public” and “private” spheres of activity. There is a third form of government action that receives less attention than forms and, however, possibly owing (...) in part to its straddling the traditional public/private divide. We call it the “government as market actor” form, whereby government instrumentalities pursue traditionally “public” ends through traditionally “private” means. Inattention to this pervasive form of government action might signal a theoretical blind spot attending the public/private distinction itself. At least as importantly, however, this inattention also denies us a practical opportunity: it prevents our more fully exploiting the government role in question. This Article, part of a larger project, aims to encourage fuller theoretical appreciation and wider practical use of the role we identify. It first offers a provisional taxonomy of recurrent forms that the government market actor role appears to take, affording a wealth of illustrative case studies in so doing. It then envisions additional good that governments might do, simply by extending their market acting roles to spheres in which they have yet to be fully utilized. MinerAs several contemporary writers have noted, Giambattista Vico defends the idea of practical knowledge, a type of knowledge that cannot be fully expressed by propositions and defies reductions to method. 1 The defense of practical knowledge, against Descartes and the rise of objectifying science, is most clearly articulated in a group of Vico’s early writings: the oration (...) De nostri temporis studiorum ratione (1709), the metaphysical book De antiquissima Italorum sapientia ex linguae latinae originibus eruenda (1710), and two rejoinders (Prima and Seconda risposte) to critics of the De antiquissima. In these texts Vico criticizes Cartesian method in terms that remind us of Aristotle, or at least the Aristotle of the Nicomachean Ethics and Politics. “If you were to import the geometrical method into practical life, you would do no more than exhaust yourself in becoming a rational lunatic” (A 7.5). 2This comment and many others like it seem to suggest that Vico is an “Aristotelian,” but any simple classification is problematic. In the same text in which Vico defends the Aristotelian topos he also announces that “the true and the made are convertible” (verum et factum convertuntur). The emphasis on the [End Page 53] role of “making” in truth seems incompatible with the Aristotelian idea of phronesis, whose knowledge is associated with praxis and cannot be reduced to techne. It would be simpler if Vico distinguished between a realm in which the verum-factum principle applied and one in which prudentia was supreme. However, Vico not only situates mathematics and experimental science within the metaphysical framework governed by verum-factum, but also implies strong connections between making and ethics. The prominence Vico assigns to making in all areas of human endeavor gives him a distinctly modern appearance in the fashion of Bacon, Galileo, and Hobbes.This gives rise to both hermeneutical and philosophical problems. Is Vico simply hesitating between the old and new? In this tribute to the work of Robert Solomon, I address a topic that occupied him frequently in the last 20 years of his life, and about which he wrote a book and several articles: the relation(s) between the emotions and justice as a personal virtue. I hope to clarify Solomon’s views using three distinctions that seem implicit in his writings, among (1) justice as general virtue and justice as a particular virtue, (2) objective justice and justice as a (...) virtue, and (3) an emotion and a passion. Using these three distinctions and a fourfold schema of emotional objects that seems implied by the foregoing discussion, I argue that an account of emotions like Solomon’s, which construes emotions as in crucial ways like judgments, contains resources for grasping in some detail how particular emotions are related to the virtue of justice. There are a number of different versions of Reductive Nominalism, versions distinguished by the way in which each accounts for facts about having and sharing properties. This chapter discusses three broad varieties of Reductive Nominalism: Predicate Nominalism, Class Nominalism, and Resemblance Nominalism. Class Nominalism identifies properties with classes or sets. Resemblance Nominalists come in two sub‐varieties, depending on whether they take the resemblance relation to hold between particular properties (called 'tropes') or particular things that have properties (ordinary particulars). Trope Theory (...) comes in two varieties depending on whether one plumps for universals. It should not be difficult to see that Extreme Resemblance Nominalism is faced with Class Nominalism's extensionality problems, both the problem of contingent predication and the co‐extensive property problem. Resemblance Nominalists can reply by insisting on a distinction between a priori or conceptual equivalence and metaphysical equivalence. In that famous art i c l e , Davidson put forw a rd the bold conjecture that meanings are satisfaction conditions, and that a Tarskian theory of truth for a language is a theory of meaning for that language. (...) In “Meaning and Truth,” Davidson proposed only that a Tarskian truth theory is a theory of meaning. But in “Theories of Me a n i n g and Learnable Languages,” he argued that the finite base of a Tarskian theory, together with the now familiar combinatorics, would explain how a language with unbounded expre s s i ve capacity could be learned with finite means ( Davidson    ). This certainly seems to imply that learning a language is, in p a rt at least, learning a Tarskian truth theory for it, or, at least, learning what is specified by such a theory. Davisdon was cagey about committing to the view that meanings actually a re satisfaction conditions, but subsequent followers had no such scru p l e s . We can sum this up in a trio of claims: Davidson’s Conjecture () A theory of meaning for L is a truth-conditional semantics for L. () To know the meaning of an expression in L is to know a satisfaction condition for that expression. () Meanings are satisfaction conditions. For the most part, it will not matter in what follows which of these claims is at stake. Developmental biology has resurfaced in recent years, often without a clearly central role for the organism. The organism is pulled in divergent directions: on the one hand, there is an important body of work that emphasizes the role of the gene in development, as executing and controlling embryological change; on the other hand, there are more theoretical approaches under which the organism disappears as little more than an instance for testing biological generalizations. I press here for the ineliminability of the (...) organism in developmental biology on explanatory grounds. I examine classical work concerned with growth and development, particularly in Drosophila and C. elegans. Some of this work is suggestive of modular development, and accordingly suggests a level below that of the organism as being explanatory. These are not the only type of case. There are other equally well-established results, which indicate greater integration in the developing organism. Though with a modular organization the organism can be thought of as made up of its constituent traits, and though the explanations of these traits may lie in terms of cells or genes, even with modular development the explanations of "genetic" differences require an appeal to the organism. With non-modular organization the organism has an even more central role. This does not mean that these genetic or cellular contributions are unreal in any way, or that development requires some sort of vitalistic contribution; but the genetic contributions make sense only as constituents of the organism, embedded in a larger organic context. The Endosomal Sorting Complexes Required for Transport (ESCRTs) drive membrane remodeling in a variety of cellular processes that include the formation of endosomal intralumenal vesicles (ILVs) during multivesicular body (MVB) biogenesis. During MVB sorting, ESCRTs recognize ubiquitin (Ub) attached to membrane protein cargo and execute ILV formation by controlling the activities of ESCRT‐III polymers regulated by the AAA‐ATPase Vps4. Exactly how these events are coordinated to ensure proper cargo loading into ILVs remains unclear. Here we discuss recent work documenting the (...) ability of Bro1, an ESCRT‐associated Ub‐binding protein, to coordinate ESCRT‐III and Vps4‐dependent ILV biogenesis with upstream events such as cargo recognition. Abstract: In Chapter 4 of his "Self-Deception Unmasked" (SDU), Al Mele considers several (attempted) empirical demonstrations of self-deception. These empirical demonstrations work under the conception of what Mele refers to as the 'dual-belief requirement', in which an agent simultaneously holds a belief p and a belief ~p. Toward the end of this chapter, Mele considers the argument of one biologist and anthropologist, Robert Trivers, who describes what he takes to be an evolutionary explanation for coming to form false beliefs. (...) Mele argues briefly that Trivers's account is no more explanatory than a similar one that does not include the dual-belief requirement. I present a case describing Trivers' analysis, show how Mele might reply to it. After briefly explaining Mele's sufficient conditions for entering self-deception from Chapter 3 of SDU, I'll consider what it means to hold the dual-belief. I'll then consider what I take to be a class of cases of self-deception which rely on genetic determinism, which I take to satisfy the dual-belief condition. (shrink)

No dialogue between the religions without investigation of the foundation of the religions." Hans Küng's oft-quoted dictum proves even more apposite in the current international situation. Whether or not the September 11, 2001, tragedy and its aftermath (...) can be accounted for in religious terms, there has been a widespread perception that they were part of the conflict between Islam and the West and that this "clash of civilizations" has deep roots in different religious worldviews.Hindsight now shows us that "smart bombs" and armies do not and cannot resolve political problems in Afghanistan and Iraq or spread democracy in the world no matter how one judges the morality of these wars. The question then arises whether there are other ways and means to achieve world peace and reconciliation, to bring about healing among nations, and whether religions can be counted among these. More specifically, if religions can be harnessed to this task, which elements of the "foundation of the religions"—to use Hans Küng's words—need to be investigated in the dialogue among religions in order to bring about reconciliation among religions that in turns leads to reconciliation among nations?This essay explores how Buddhists and Christians can together serve the cause of peace and reconciliation among nations. I will first reflect on the nature, strategies, and spirituality of reconciliation. Yet, religion is arguably the most powerful and effective institutional force for peace and reconciliation. To see how religion can bring this gift of peace to the world and achieve this task of global healing, a brief consideration of the nature and process of reconciliation is helpful.Etymologically, reconciliation means to cause two estranged persons or groups to meet each other again (re-, again + concilium, meeting). By extension, it means to resolve a dispute and to re-establish friendship and harmony, or, at a minimum, peaceful coexistence between opposed individuals or groups.2Reconciliation is both a process and a state of affairs. As process, it sets into motion a complex of agencies and strategies that cannot be used as a universally applicable recipe but requires appropriate tailoring to diverse contexts.3 The process includes certain intermediate stages as conditions of possibility for achieving the desired result. As a personal and sociopolitical state of affairs, reconciliation is an ever-fragile and elusive reality. Ultimately, because of human propensities toward violence and domination, total reconciliation and perfect peace is not achievable by human efforts but is hoped and prayed for as an eschatological gift bestowed by God or as a transcendent blessing beyond this world. William Hasker has been one of the most trenchant and insightful critics of the revival of Molinism. He has focused on the “freedom problem”, a set of challenges designed to show that Molinism does not secure a place for genuinely free human action. These challenges focus on a key element in the Molinist story: the counterfactual conditionals of creaturely freedom. According to Molinism, these conditionals have contingent truth-values that are knowable to God prior to His decision of what world to (...) actualize. This divine “middle knowledge” is supposed to enable God to execute a detailed plan for world history without any loss of creaturely freedom. Hasker has argued that this middle knowledge nonetheless deprives us of the power to do otherwise than we do, a crucial element in human freedom and responsibility. I hope to accomplish three things in this paper. First, I want to step back a bit and explore the nature of the conditionals of creaturely free decision-making, bringing out some of the difficulties in delimiting their scope and nature. Second, I will explore the implications of different answers to an important question that has not been addressed in the literature: whether we have counterfactual power over the conditionals of divine freedom. And, third, I would like to recommend to Molinists a revision that offers a solution to the freedom problem. (shrink)

One of the gaps in the current international marketing literature is in the area of consumer ethics. Using a sample drawn from Japanese consumers, this study investigates these individuals' reported ethical ideology and their perception of a number of different ethical situations in the realm of consumer behavior. Comparisons are then made across several demographic characteristics. The results reveal differences which provide theoretical support for expanded research in the area of cross-cultural/cross-national consumer ethics and highlight the need for managers to (...) consider possible differences in the ethical behavior of consumers when entering a new international market. In the beginning, there was the DN (Deductive Nomological) model of explanation, articulated by Hempel and Oppenheim (1948). According to DN, scientific explanation is subsumption under natural law. Individual events are explained by deducing them from laws together with initial conditions (or boundary conditions), and laws are explained by deriving them from other more fundamental laws, as, for example, the simple pendulum law is derived from Newton's laws of motion.

For all of the emphasis on quality improvement—as well as the acknowledged overlap between assessment of the quality of healthcare services and clinical ethics—the quality of clinical ethics consultation has received scant attention, especially in terms of empirical measurement. Recognizing this need, the second edition of Core Competencies for Health Care Ethics Consultation identified four domains of ethics quality: (1) ethicality, (2) stakeholders’ satisfaction, (3) resolution of the presenting conflict/dilemma, and (4) education that translates into knowledge. This study is the (...) first, to our knowledge, to directly measure all of these domains. Here we describe the quality improvement process undertaken at a tertiary care academic medical center, as well as the tools developed to measure the quality of ethics consultation, which include post-consultation satisfaction surveys and weekly case conferences. The information gained through these tools helps to improve not only the process of ethics consultation, but also the measurement and assurance of quality. (shrink)

According to that prejudice, it goes without saying that there is something wrong with it, even if it is difficult to put one's finger on it. To be called "sentimental" is to be ridiculed, or dismissed. Sentimentality is a weakness, it suggests hypocrisy. Or, perhaps it is the fact that sentimental people are so... so embarrassing. (How awkward it is talking or sitting next to someone weeping or gushing, when one is dry-eyed and somber.) Or, perhaps it is the well-confirmed fact that sentimentalists have such poor taste, and sentimental literature is, above all, literature that is cheap, superficial, and manipulative—in other words, verbal kitsch. Such mawkish literature jerks tears from otherwise sensible readers, and sentimentalists are those who actually enjoy that humiliating experience. Perhaps that is why Oscar Wilde thought that sentimentalists were really cynics ("Sentimentality is merely the bank holiday of cynicism").2 Or, perhaps what bothers us is what bothered Michael Tanner, that sentimental people indulge themselves in their feelings instead of doing what should be done.3 It is often said that the problem is that sentimentality and sentimental literature alike give us a false view of the world, distort our thinking and substitute a "saccharine" portrait of the world in place ofwhat we all know to be the horrible realities. Moreover, as Jefferson more than merely suggests, the "simple-minded sympathies " ofsentimentality might actually promote fascism and racism. Mary Midgley similarly suggests that sentimentality leads to brutality.4 But Philosophy and Literature, © 1990, 14: 304-323 Robert C. Solomon305 even where sentimentality is a harmless diversion—a Daphne du Maurier novel on a sad Saturday afternoon—it seems to be all but agreed that sentimentality is no virtue even ifit is not, like cruelty and hypocrisy, intrinsically vicious. Something is wrong with sentimentality; the only question is, what is it that is wrong? In this essay, I will argue that there is nothing wrong with sentimentality. Of course, like any quasi-ethical category, it admits of unwarranted excesses and hypocritical abuses, and is prone to various pathological distortions. But the prejudice against sentimentality, I want to argue, is ill-founded and in fact is an extension ofthat all-too-familiar contempt for the passions in Western literature and philosophy. Our disdain for sentimentality is the rationalist's discomfort with any display of emotion, warranted as well as unwarranted, appropriate as well as inappropriate. It is as ifthe very word, "sentimentality," has been loaded with the connotations of "too much"—too much feeling and too litde common sense and rationality, as if these were opposed instead of mutually supportive. It is as if sentimentality and its sentiments are never warranted and always inappropriate. The word has come to be used as the name of a deficiency or a weakness if not, as some critics have written, a malaise. But I take sentimentality to be nothing more nor less than the "appeal to tender feelings," and though one can manipulate and abuse such feelings (including one's own), and though they can on occasion be misdirected or excessive, there is nothing wrong with them as such and hence nothing (in that respect) wrong with literature that provokes us, that "moves" us, to abstract affection or weeping. Sentimentality implies no deficiency in one's rational faculties and does not imply any inappropriateness, unwillingness, or lack of readiness to act. Sentimentality does not involve any distortion of the world and it does not impede but rather prepares and motivates us to react in "the real world." Phenomenologists usually insist that their approach involves going “back” to and “starting” with technoscientific experience—that is, returning to the actual existing or living through of technoscientific life—after centuries of privileging the analysis of how things are “objectively” known and denigrating accounts of how they are “subjectively” lived with. But then who says this and how is this understood? “Who” is really a phenomenologist, when so many diverse thinkers claim the title? This is a sustained critique of materialism. The contributors offer arguments from conscious experience, rational thought, the interaction of mind and body, and the unity and persisting identity of human persons, and develop a wide range of alternatives.

For-profit managed care organizations face decisions about cost sharing that can involve a tradeoff between the interests of investors and the interests of patients. No successful business can ignore the interests of its investors, but moral philosophy points to ethical reasons for managed care organizations to make patients’ health, rather than investors’ profit, their primary goal. One reason is the ethical obligation of all businesses to avoid wrongful exploitation of vulnerable customers. An insurance company’s cost-sharing policy can exploit customers either (...) by collecting an unfairly large amount of money from them or by unfairly deterring them from making claims for resources they medically need. Another reason stems from the fact that managed care organizations’ profits derive in part from the existence of artificial barriers to access to medicine, notably including patents. Putting a fence around a water well in the desert is legitimate only if doing so facilitates a financial arrangement that maximizes people’s access to water they need. Likewise, patents and other artificial barriers to access to medically necessary drugs are legitimate only if they are used to help finance access to medical resources people need. For these reasons, managed care organizations should make cost-sharing decisions that maximize the sustainable availability of effective drugs to patients who need them. (shrink)
