In his invited essay for Business & Society’s 60th anniversary, Archie B. Carroll refers to human rights as “a topic that holds considerable promise for CSR [corporate social responsibility] researchers in the future.” The objective of this article is to unpack this promise. We discuss the momentum of business and human rights in international policy, national regulation, and corporate practice, review how and why BHR scholarship has been thriving, provide a conceptual framework to analyze how BHR and corporate social responsibility (...) relate to each other, and provide a research agenda outlining how BHR can expand business and society scholarship in general and one of its foundational constructs, CSR, in particular, beyond the current confines of the business and society field. In this volume of essays, Howard Wettstein explores the foundations of religious commitment. His orientation is broadly naturalistic, but not in the mode of reductionism or eliminativism. This collection explores questions of broad religious interest, but does so through a focus on the author's religious tradition, Judaism. Among the issues explored are the nature and role of awe, ritual, doctrine, religious experience; the distinction between belief and faith; problems of evil and suffering with special attention to the Book of (...) Job and to the Akedah, the biblical story of the binding of Isaac; the virtue of forgiveness. One of the book's highlights is its literary approach to theology that at the same time makes room for philosophical exploration of religion. Another is Wettstein's rejection of the usual picture that sees religious life as sitting atop a distinctive metaphysical foundation, one that stands in need of epistemological justification. The late 20th century saw great movement in the philosophy of language, often critical of the fathers of the subject-Gottlieb Frege and Bertrand Russell-but sometimes supportive of (or even defensive about) the work of the fathers. Howard Wettstein's sympathies lie with the critics. But he says that they have often misconceived their critical project, treating it in ways that are technically focused and that miss the deeper implications of their revolutionary challenge. Wettstein argues that Wittgenstein-a figure with whom (...) the critics of Frege and Russell are typically unsympathetic-laid the foundation for much of what is really revolutionary in this late 20th century movement. The subject itself should be of great interest, since philosophy of language has functioned as a kind of foundation for much of 20th century philosophy. But in fact it remains a subject for specialists, since the ideas are difficult and the mode of presentation is often fairly technical. In this book, Wettstein brings the non-specialist into the conversation (especially in early chapters); he also reconceives the debate in a way that avoids technical formulation. Diaspora, considered as a context for insights into Jewish identity, brings together a lively, interdisciplinary group of scholars in this innovative volume. Readers needn't expect, however, to find easy agreement on what those insights are. The concept "diaspora" itself has proved controversial; _galut, _the traditional Hebrew expression for the Jews' perennial condition, is better translated as "exile." The very distinction between diaspora and exile, although difficult to analyze, is important enough to form the basis of several essays in this fine (...) collection. "Identity" is an even more elusive concept. The contributors to _Diasporas and Exiles _explore Jewish identity—or, more accurately, Jewish identities—from the mutually illuminating perspectives of anthropology, art history, comparative literature, cultural studies, German history, philosophy, political theory, and sociology. During the last years, there has been an increasing discussion on the role of business in human rights violations and an increase in human rights litigation against companies. The result of human rights litigation has been rather disillusioning because no corporation has been found guilty and most cases have been dismissed. We argue that it may nevertheless be a useful instrument for the advancement of the business and human rights agenda. We examine the determinants of successful human rights litigation in (...) terms of judicial, educational, and regulatory effects. This article reviews more than 40 corporate foreign direct liability cases and their effects on corporate human rights policies and conduct. The review shows that most corporations adjusted their human rights policies and adopted additional measures to cope with human rights issues during or shortly after the legal proceedings. Opening legal channels for human rights litigation may be one way for governments to incentivize firms to respect human rights. These findings have implications for the United Nations Guiding Principles on Business and Human Rights as well as on our interpretation of the most recent U.S. Supreme Court decision in Kiobel v. The nature of reference, or the relation of a word to the object to which it refers, has been perhaps the dominant concern of twentieth-century analytic philosophy. Extremely influential arguments by Gottlob Frege around the turn of the century convinced the large majority of philosophers that the meaning of a word must be distinguished from its referent, the former only providing some kind of direction for reaching the latter. In the last twenty years, this Fregean orthodoxy has been vigorously challenged (...) by those who argue that certain important kinds of words, at least, refer directly without need of an intermediate meaning or sense. The essays in this volume record how a long-term study of Frege has persuaded the author that Frege's pivotal distinction between sense and reference, and his attendant philosophical views about language and thought, are unsatisfactory. Frege's perspective, he argues, imposes a distinctive way of thinking about semantics, specifically about the centrality of cognitive significance puzzles for semantics. Freed from Frege's perspective, we will no longer find it natural to think about semantics in this way. (shrink)

ABSTRACT:Do corporations have a duty to promote just institutions? Agreeing with Hsieh’s recent contribution, this article argues that they do. However, contrary to Hsieh, it holds that such a claim cannot be advanced convincingly only by reference to the negative duty to do no harm. Instead, such a duty necessarily must be grounded in positive obligation. In the search of a foundation for a positive duty for corporations to further just institutions, Stephen Kobrin’s notion of “private political authority” offers a (...) promising connecting point. Political authority implies political responsibility; Political obligation, however, includes more than merely not doing any harm—it is essentially positive obligation. The implications of the new political responsibilities of multinational corporations may even go far beyond the particular duty to promote just institutions; they may be symptomatic for a much more profound shift from an individual to a collective age. It has long been urged against traditional theism, very long indeed, that God’s perfections—specifically in the domains of goodness, knowledge and power—are logically incompatible with the existence of unwarranted human suffering. It has almost equally long been urged that the problem is illusory—or at least surmountable; the tradition of theodicy must be only moments younger than the problem. The debate is a philosophical classic, with many ingenious moves on both sides, and epicycles galore. But whatever one’s view on the details (...) of the debate, it is difficult—and I think unwise—to resist the sense that evil presents a real and indeed substantial problem for the Western religious tradition. A distinction is developed between two uses of definite descriptions, the "attributive" and the "referential." the distinction exists even in the same sentence. several criteria are given for making the distinction. it is suggested that both russell's and strawson's theories fail to deal with this distinction, although some of the things russell says about genuine proper names can be said about the referential use of definite descriptions. it is argued that the presupposition or implication that something fits the description, present (...) in both uses, has a different genesis depending upon whether the description is used referentially or attributively. this distinction in use seems not to depend upon any syntactic or semantic ambiguity. it is also suggested that there is a distinction between what is here called "referring" and what russell defines as denoting. definite descriptions may denote something, according to his definition, whether used attributively or referentially. ABSTRACT:Increasingly, global businesses are confronted with the question of complicity in human rights violations committed by abusive host governments. This contribution specifically looks at silent complicity and the way it challenges conventional interpretations of corporate responsibility. Silent complicity implies that corporations have moral obligations that reach beyond the negative realm of doing no harm. Essentially, it implies that corporations have a moral responsibility to help protect human rights by putting pressure on perpetrating host governments involved in human rights abuses. This (...) is a controversial claim, which this contribution proposes to analyze with a view to understanding and determining the underlying conditions that need to be met in order for moral agents to be said to have such responsibilities in the category of the duty to protect human rights. In this article, I will argue that it is time to rethink and reconfigure some of the established assumptions underlying our conception of moral responsibility. Specifically, there is a mismatch between the individualism of our common sense morality and the imperative for collaborative responses to global problems in what I will call the “collective age.” This must have an impact also on the way we think about the responsibility of corporations. I will argue that most plausibly we ought to reframe (...) corporate responsibility as a conception of collaborative responsibility. Such a conception of collaborative responsibility is characterized by five key elements: first, it is based on the moral imperative for collaboration. Second, it shifts emphasis from commission to omission. Third, it is not only negative but also, and perhaps essentially, positive responsibility. Fourth, it is political responsibility. And finally, it is, most basically, human rights responsibility. (shrink)

I argue that theological doctrine, the output of philosophical theology, is not a natural tool for thinking about biblical/rabbinic Judaism. Fundamental to my argument is the claim that there is a tension between constellations of theological doctrine of medieval vintage and the primary religious literature---the Hebrew Bible as understood through, and supplemented by, the Rabbis of the Talmud. This tension is a product of the genesis of philosophical theology, the application of Greek philosophical thought to a very different tradition, one (...) that emerged from a very different world. • When one reflects on the range of actual cases in which forgiveness seems appropriate, it’s really a subset of them that involve moral wrongdoing. When one thinks of the domestic context, e.g., where forgiveness, apology, and the like are very common, painfully common, much of what is at issue are not serious moral wrongs but rather slights, insensitivities like inappropriate tones of voice (sometimes even marginally so). Or consider philosopher’s reactions to the slights involved in how their work is (...) criticized or underappreciated. (shrink)

Wittgenstein speaks of the fog that surrounds the workings of language. Our ways of thinking about reference contribute generously to the fog. While a full discussion would constitute a book-length project, my aims here are quite limited. I want to have a look at the idea that reference is a relation between a piece of language and a piece of reality. The idea might seem unexceptional and unexceptionable; names, for example, name things, and “relation” seems just right. But there is (...) casual relation-talk, and then more serious talk of a genuine relation, one that requires the existence, in every case, of a referent. Referential expressions, I’ll argue, sometimes lack such a relatum, and other timeswhen in some straightforward way there is such a thingit’s quite difficult to know what we are talking about. Charles Griswold’s seminal work, Forgiveness, is the focus of the present essay. Following Griswold, I distinguish the relevant virtue of character from something that is more like an act or process. The paper discusses a number of hesitations I have about Griswold’s analysis, at the level both of detail and of underlying conception.

More and more companies are publicly taking a stand on social and political issues such as gay marriage legislation. This paper argues that this type of engagement, which can be called “corporate political advocacy,” raises new conceptual and normative challenges especially for theories of corporate responsibility. Furthermore, it poses practical challenges for managers who are confronted with it. This paper addresses all three challenges: first, it defines and conceptualizes corporate political advocacy and distinguishes it from other forms of corporate political (...) involvement. Second, it makes normative sense of corporate advocacy as an element of corporate responsibility. Third, it reflects on the practical implications for managers dealing with this issue. (shrink)
