We study the one-seller/two-buyer bargaining problem with negative identity-dependent externalities with an alternating offer bargaining model in which new owners of the object have the opportunity of resale. We identify the generically unique subgame perfect equilibrium outcome. The resale opportunity increases the competition among the buyers and therefore benefits the seller. When competition between buyers is very fierce, the seller may prefer to respond to bids rather than to propose an offer herself: a first-mover disadvantage.

Why would anyone purchase expensive, natural resource-intensive, and seemingly obsolete material carriers of music when streaming providers provide unlimited access to over 40 million songs for a small monthly fee? As I will show, we can no longer assume that contemporary interest is driven solely by a collector’s market or because of the audible qualities of the vinyl listening experience, and must attend to the many ways people engage with record objects today – and by extension, the vinyl record as (...) an ontological multiple. Through an analysis of Record Store Day 2015 and affiliated phenomena including YouTube unboxing videos, other social media activity and the Discogs resale market, I will demonstrate that the vinyl record gains value when the lived experience of materiality becomes an event and enables the performance of self in social contexts. As I will show, while certain types of actors have appreciably benefitted from the recent revival of interest in vinyl (e.g. brick and mortar stores, mastering engineers, manufacturing plants, and ancillary service industries), others have not to the same extent (e.g. musicians, independent record labels). Earlier work has tended to view Delos as an entrepôt for the larger Hellenistic grain trade, but during the years of independence the island relied on the import of grain to satisfy local demand, and this was certainly the more important aspect of the trade in grain, at least from the Delians' point of view. This study explores several issues connected with the local supply of grain. From prices for grain reported in inscriptions and estimates of the local population, the (...) aggregate annual demand for grain is estimated, and the price structure of grain derived; the ratio of wheat and barley prices on Delos is found to differ considerably from that known from Athens and Roman Egypt. The shortage of 282 B.C., assumed by earlier scholars from prices recorded for that year, is shown instead to be a period of atypically low prices. The impact of the sailing season on shipments of grain is explored, and an annual rhythm in grain prices and availability linked to the closure of the sea and the agricultural year is revealed. The Delians tried to reduce the impact of these fluctuations by the public purchase of grain on an irregular basis in the late fourth and third century, as attested through public loans; by the last quarter of the third century they had established a regular sitōnia fund to buy grain for resale at reduced prices. Comparison of funds available, grain prices, and the estimated aggregate demand suggest that the Delian sitōnia was able to cover a significant fraction of local demand; this contrasts with evidence from other cities. Some of the implications of these results for our understanding of the Hellenistic economy are briefly explored. (shrink)

It is a guilty secret that many college professors sell the complimentary desk copies that they receive from textbook publishers for cash. This article attempts to shed light on the undercover practice by looking at the resale of complimentary textbooks by faculty from four perspectives. Part One provides an overview of the college textbook industry, the business reasons that motivate publishers to provide complimentary desk copies to faculty, and the economic consequences of the entry of the textbooks into the (...) used book market. Part Two examines the legal characteristics of complimentary desk copies in terms of their ownership and any contractual duties that may arise from their receipt. Part Three looks at legislative efforts to curb the practice, and Part Four reviews university policies addressing the issue. In Part Five, the ethical implications of faculty selling desk copies are examined, with a special focus on this practice in a business school. The Conclusion considers the future of the sale of complimentary copies in light of the move to e-books and other initiatives by authors and textbook publishers to circumvent the practice. (shrink)

Proliferation of data processing and data storage devices in the Internet of Things poses significant privacy risks. At the same time, faster and faster use-cycles and obsolescence of devices with electronic components causes environmental problems. Some of the solutions to the environmental challenges of e-waste include mandatory recycling schemes as well as informal second hand markets. However, the data security and privacy implications of these green policies are as yet badly understood. This paper argues that based on the experience with (...) second hand markets in desktop computers, it is very likely that data that was legitimately collected under the household exception of the Data Protection Directive will “leak” into public spheres. Operators of large recycling schemes may find themselves inadvertently and unknowingly to be data controller for the purpose of Data Protection law, private resale of electronic devices can expose the prior owner to significant privacy risks. In the United States, property rights are afforded protection, but moral rights are not. Up until 1989, the United States adamantly refused to join the Berne Copyright Convention, the first multilateral copyright treaty, now ratified by seventy-eight countries. The American government refused to comply because the Berne Convention grants moral rights to authors. This international policy was—and is—incompatible with United States copyright law, which recognizes only economic rights. Although ten states have enacted some form of moral rights legislation, federal copyright (...) laws tend to prevail, and those are still wholly economic in their motivation. Indeed, the recent pressure for the United States to agree, at least in part, to the terms of the Berne Convention came only as a result of a dramatic increase in the international piracy of American records and films.In September 1986, Senator Edward M. Kennedy of Massachusetts first introduced a bill called the Visual Artists Rights Act. This bill attempts to amend federal copyright laws to incorporate some aspects of international moral rights protection. The Kennedy bill would prohibit the intentional distortion, mutilation, or destruction of works of art after they have been sold. Moreover, the act would empower artists to claim authorship, to receive royalties on subsequent sales, and to disclaim their authorship if the work were distorted.4 This legislation would have prevented Clement Greenburg and the other executors of David Smith’s estate from authorizing the stripping of paint from Several of Smith’s later sculptures so that they would resemble his earlier—and more marketable—unpainted sculptures. Such moral rights legislations would have prevented a Japanese bank in New York from removing and destroying a sculpture by Isamu Noguchi simply because the bank president did not like it. And such legislation would have prevented the United States government from destroying Tilted Arc. 4.
