Le projet phénoménologique, tel qu'il fut conçu par Edmund Husserl, se définit d'abord par le souci constant de dégager l'expérience intuitive au fondement de toute connaissance. Mais qu'est-ce que l'intuition originairement donatrice? Quel est le sens fondamental de l'empirie phénoménologique? Seule la réduction de tous les préjugés qui grèvent l'acception traditionnelle de l'intuition permet de redéployer son sens et corrélativement la consistance véritable du champ phénoménal. Mais si la réduction constitue donc la méthode d'un redéploiement de notre relation primordiale au (...) monde, elle est aussi la voie tout au long de laquelle le phénomène manifeste une profondeur toujours accrue et qui n'est pas dépourvue d'ambiguïté. Deliberative democracy grounds its legitimacy largely in the ability of speakers to participate on equal terms. Yet theorists and practitioners have struggled with how to establish deliberative equality in the face of stark differences of power in liberal democracies. Designers of innovative civic forums for deliberation often aim to neutralize inequities among participants through proportional inclusion of disempowered speakers and discourses. In contrast, others argue that democratic equality is best achieved when disempowered groups deliberate in their own enclaves before entering (...) the broader public sphere. Borrowing from each perspective, the authors argue that there are strong reasons to incorporate enclave deliberation among the disempowered within civic forums. They support this claim by presenting case study evidence showing that participants in such forums can gain some of the same benefits of deliberation found in more heterogeneous groups, can consider a diversity of viewpoints rather than falling into groupthink and polarization, and can persuade external stakeholders of the legitimacy of the group’s deliberations. In Memory of Ed PellegrinoEuthanasia in Belgium is not limited to terminally ill patients. It may be applied to patients with chronic degenerative diseases. Currently, people in Belgium wish to make it possible to euthanize incompetent patients who suffer from dementia. This article explains the Belgian law and then explores arguments for and against euthanasia of patients with dementia. It probes the dementia paradox by elucidating Dworkin’s distinction between critical and experiential interests, arguing that at the end-of-life this distinction is (...) not clearcut. It argues against euthanasia for patients with dementia, for respecting patients’ humanity and for providing them with more care, compassion, and good doctoring. (shrink)

Nagel’s official model of theory-reduction and the way it is represented in the literature are shown to be incompatible with the careful remarks on the notion of reduction Nagel gave while developing his model. Based on these remarks, an alternative model is outlined which does not face some of the problems the official model faces. Taking the context in which Nagel developed his model into account, it is shown that the way Nagel shaped his model and, thus, its well-known deficiencies, (...) are best conceived of as a mere by-product of his philosophical background. Questions concerning the role of doctors, abortion, mercy killings and genetics are troubling and highly problematic. They require a thorough examination and careful probing. This volume takes a step towards tackling them. Its design is both interdisciplinary and comparative, offerin g philosophical, legal and medical perspectives of scholars from North America, Europe and Israel who analyze how their respective countries try to cope with and find answers for pressing concerns.

If $\mathcal{F}$ is a filter on $\omega$, we say that $\mathcal{F}$ is Canjar if the corresponding Mathias forcing does not add a dominating real. We prove that any Borel Canjar filter is $F_{\sigma}$, solving a problem of Hrušák and Minami. We give several examples of Canjar and non-Canjar filters; in particular, we construct a $\mathsf{MAD}$ family such that the corresponding Mathias forcing adds a dominating real. This answers a question of Brendle. Then we prove that in all the “classical” models (...) of $\mathsf{ZFC}$ there are $\mathsf{MAD}$ families whose Mathias forcing does not add a dominating real. We also study ideals generated by branches, and we uncover a close relation between Canjar ideals and the selection principle $S_{\mathrm{fin}}$ on subsets of the Cantor space. (shrink)

The paper offers an account of the structure of information provided by models that relevantly deviate from reality. It is argued that accounts of scientific modeling according to which a model’s epistemic and pragmatic relevance stems from the alleged fact that models give access to possibilities fail. First, it seems that there are models that do not give access to possibilities, for what they describe is impossible. Secondly, it appears that having access to a possibility is epistemically and pragmatically idle. (...) Based on these observations, an alternative is developed. (shrink)

Assume that water reduces to H2O. If so water is identical to H2O. At the same time, if water reduces to H2O then H2O does not reduce to water–the reduction relation is asymmetric. This generates a puzzle–if water just is H2O it is hard to see how we can account for the asymmetry of the reduction relation. The paper proposes a solution to this puzzle. It is argued that the reduction predicate generates intensional contexts and that in order to account (...) for the asymmetry, we should develop conditions on the meanings of expressions that flank the reduction predicate in true reduction statements. Finally, it is argued that if we adopt this interpretation, we can illuminate the epistemological difference between reduced and reducing item commonly referred to in the literature. (shrink)

This paper contains a novel and coherent reading of Weberian ideal type construction, based on recent philosophical approaches to conceptual engineering. This reading makes transparent the dialectics of Weber's approach, resulting in a more nuanced interpretation of his methodological work. It will become apparent that Weber, when introducing his notion of an ideal type, did not merely summarize his views on methodology in the social sciences, but, rather, presented a two-step argument in favor of these views. The reconstruction will directly (...) bear on issues in the methodology of the social sciences. Weber not only presented a methodology that is, at some level of abstraction, strikingly similar to Carnapian explication (the canonical point of reference in the contemporary debate on conceptual engineering). He also diagnosed, in a systematic fashion, types of problems we face when dealing with ordinary and scientific concepts that play a key role in the description of social reality, and he foreshadowed what is today sometimes described as “debunking” projects. From a philosophy of science perspective, I propose Weber's view (on the reconstruction proposed here) as a serious candidate for an adequate theory of concept replacement in the social sciences. Valorising the biocultural heritage of common goods could enable peasant farmers to achieve socially and economically inclusive sustainability. Increasingly appreciated by consumers, peasant heritage products offer small farmers promising opportunities for economic, social and territorial development. Identifying the obstacles and levers of this complex, multi-scale and multi-stakeholder objective requires an integrative framework. We applied the panarchy conceptual framework to two cases of participatory research with small quinoa producers: a local fair in Chile and quinoa export production in Bolivia. In both (...) cases, the “commoning” process was crucial both to bring stakeholders together inside their communities and to gain outside recognition for their production and thus achieve social and economic inclusion. Despite the differences in scale, the local fair and the export market shared a similar marketing strategy based on short value chains promoting quality products with high identity value. In these dynamics of biocultural heritage valorisation, the panarchical approach revealed the central place as well as the vulnerability of the community territory. As a place of both anchoring and opening, the community territory is the privileged space where autonomous and consensual control over the governance of common biocultural resources can be exercised. This paper analyses J.S. Mill's theory on the relationships between individual autonomy and State powers. It will be argued that there is a significant discrepancy between Mill's general liberal statements aimed to secure individual largest possible autonomy and the specific examples which provide the government with quite wide latitude for interference in the public and private spheres. The paper outlines the boundaries of government interference in the Millian theory. Subsequently it describes Mill's elastic paternalism designed to prevent people from inflicting (...) harm upon others as well as upon themselves, from soft paternalism on issues like compulsory education to hard paternalism on very private matters such as marriage, having children, and divorce by consent. This paper reflects on the articles submitted for the Symposium Confronting the Internet’s Dark Side. I discuss some of the criticisms of the book’s theory and my treatment of hate speech. The responsibilities of Internet Service Providers and Web-Hosting Services are in the fore, arguing that as they are the gatekeepers, they need to be proactive far more than they are now. Can animals, and especially cattle, be the subject ofmoral concern? Should we care about their well-being?Two competing ethical theories have addressed suchissues so far. A utilitarian theory which, inBentham's wake, extends moral consideration to everysentient being, and a theory of the rights orinterests of animals which follows Feinberg'sconceptions. This includes various positions rangingfrom the most radical (about animal liberation) tomore moderate ones (concerned with the well-being ofanimals). Notwithstanding their diversity, theseconceptions share some common flaws. First, as anextension of primarily anthropocentric (...) theories (aboututility or rights) they still participate in the flawsof the original setting. Second, extending them tonon-human beings raises the problem of the borderwhich is to be drawn between what can be included inthe purview of moral consideration and what is leftoutside. Third, such theories are not able to distinguishbetween an ethics of wildlife and an ethics ofdomestic life, which too often leads to preposterousstatements. We would like to argue (i) that we should distinguishbetween environmental ethics (concerned withpopulations, species, biotic communities) and animalethics (where animals are taken into consideration individually);(ii) that individualist animal ethics are not relevantfor animal rearing; (iii) that animal rearing is a hierarchicalrelationship which rules are to be found in the fiction of a domesticcontract.Hence, we would like to construct a new conception ofthe ethics of the relation between men and the cattlethey breed based on the idea of a domestic contract.Our main assumption is Mary Midgleys's anthropologicalassumption, according to which human communities,since the Neolithic age, have always included variousanimals, so that relations of sociability have alwaysexisted between human beings and animals within thedomestic community (a mixed community). In order tospecify the hierarchical and non-egalitarian, butinclusive reciprocal obligations and relations insidesuch a community, we will elaborate on the notion ofa ``domestic contract'', an implicitly assumedidea traced back to Lucretius and whichwe will follow up to the physiocrats and Adam Smith.We will show that such an idea relies upon theassumption of communication between cattle farmer andanimals, of shared experience and exchanges betweenthe two parties. We will then show how modern factory,or battery animal farming, can be seen as unilaterallybreaking this domestic contract, forsaking ourduties towards domestic animals. (shrink)

This chapter considers eternity, duration, time, and their interrelations, and aims to resolve a paradox in Spinoza's theory of the mind's eternity. Spinoza's metaphysics of time includes an endless series of virtuous regresses. Spinoza characterizes duratio as a “magnitude. Spinoza says that duratio is “conceived as being greater or lesser, and as composed of parts”. Spinoza addresses time and its relation to duratio in the Metaphysical Thoughts. Spinoza accepts Suarez's view that “duratio and existence are only rationally distinct”. Spinoza holds, (...) with some of the Scholastic philosophers, that extrinsic denominations are mind‐made. Spinoza also uses geometrical construction as a model for thinking about the relationship between eternity and time. Flawed clinical practice guidelines may compromise patient care. Commercial conflicts of interest on panels that write treatment guidelines are particularly problematic, because panelists may have conflicting agendas that influence guideline recommendations. Historically, there has been no legal remedy for conflicts of interest on guidelines panels. However, in May 2008, the Attorney General of Connecticut concluded a ground-breaking antitrust investigation into the development of Lyme disease treatment guidelines by one of the largest medical societies in the United States, the Infectious Diseases (...) Society of America (IDSA). Although the investigation found significant flaws in the IDSA guidelines development process, the subsequent review of the guidelines mandated by the settlement was compromised by a lack of impartiality at various stages of the IDSA review process. This article will examine the interplay between the recent calls for guidelines reform, the ethical canons of medicine, and due process considerations under antitrust laws as they apply to the formulation of the IDSA Lyme disease treatment guidelines. The article will also discuss pitfalls in the implementation of the IDSA antitrust settlement that should be avoided in the future. (shrink)

Il s’agit toujours d’endiguer leur dangereux excès asymbolique en les déchiffrant, en leur imposant symboles et prédicats. Le présent essai propose une analyse d’ Un re (...) in ascolto [ Un roi à l’écoute ] d’Italo Calvino (1976), redéfinissant à nouveaux frais la notion de souveraineté afin de mieux comprendre la nature d’une telle stratégie herméneutique, et les raisons de son échec. Le souverain tel que nous le décrit Calvino est-il en mesure de conférer un sens à la musique et au chant en les intégrant au sein d’un système sémantique clos? Ou l’expérience musicale doit-elle au contraire être décrite comme fondamentalement incompatible avec une telle herméneutique totalisante, appelant une analyse fondée sur une vision pluraliste, horizontale, et non-hiérarchique des relations entre les différents modes d’expression artistique? Abstract The idea of ?election? cannot be approached, it seems, through traditional or classical philosophical conceptuality. This idea requires another type of discourse. Not simply because this idea refers to an entirely other body of texts, that of the Biblical tradition, but more radically since it commands another modality of thought which must at once suspend and pursue philosophical concepts to the point where they express themselves otherwise than according to the rationality of their own deployment. In truth, the idea (...) of ?election? calls thus for a redefinition of the rapport between singularity and universality, one no longer structured and circumscribed by ?truth?, but rather inspired by a novel and irreducible modality of ?justice?. A ?justice? which opens to the possibility for an ?ethics?, not as ?communicative dialogue?, ?mutual recognition? or a series of established and rationally grounded laws, but a ?place? of incessant and irresolute, non-intentional and unconditional exposition to the Other. How to measure performance in charitable organisations continues to excite interest among academics and practitioners. Despite the intellectual interest, little consensus has emerged as to what are the best measures of performance in charities. This is against the backdrop of an increased demand by donors and other stakeholders on charities to provide information on their performance. Building on prior studies, this paper examines the measures of performance in charities using a hybrid methodological approach which consists of 14 exploratory interviews and (...) a quantitative survey of 105 chief executive officers/board of trustees of large British charities. The results of factor analysis and internal reliability produced five broad measures of performance of charities: financial measures; client satisfaction; management effectiveness; stakeholder involvement; and benchmarking, indicating that the overall performance of charities is best measured by a set of factors that reflect the multiple and diverse stakeholders associated with charities. Further analysis using structural equation modelling corroborates the results that non-financial measures such as management effectiveness, stakeholder involvement and benchmarking are important to the performance of charities. To find adequate answers to a changing reality heavily influenced by advances in technology, medical professionals have developed and adopted an array of terms that have brought new concepts into the profession. “Dignity,” “vegetative state,” “futility,” “double effect,” and “brain death” have become indispensable words in the medical setting. In the following discussion, the attention is on terminology. If we believe in phenomenology, the assumption is that we should closely reflect on the words we use in all spheres of life, (...) especially in those that concern life and death. This article calls for a sincere discussion about these terms and concepts. The thesis put forward is that the language in the medical setting serves primarily the physicians, at times at the expense of the patients’ best interests. This language and the concepts it describes have generated an unhealthy atmosphere for patients, which might lead to undesirable actions at the end of patients’ lives. (shrink)

The aim of this essay is to reflect on the Millian, utilitarian argument from truth that is held as one of the most conspicuous answers to the question Why tolerate? This argument postulates that only in a free market of ideas may the truth be discovered. Even the most unpopular idea may contain some truth in it and may contribute to the advancement of knowledge. It further commands us to contest those opinions which are believed to be true vigorously and (...) earnestly to explore some further truth, and to acknowledge their false aspects. The results of free exchange of opinions will either confirm our idea, or bring some doubt to our attention, to cast accounts and maybe change our opinion, at least to some extent. After reflecting on some of the common arguments that are frequently mentioned in this connection, I discuss Mill's formulation of the Truth Principle as it came into expression in his writings. Here I reflect on his article "Law of Libel and Liberty of the Press" which did not receive adequate attention by scholars. I show that it is difficult to reconcile what Mill had to say in this article with what he later said in On Liberty. I further maintain that the Millian view of truth as superior to all other social values might endanger the very ground which the Truth Principle is intended to safeguard, i.e., tolerance. The holding of truth as the most important value might result in harming individuals, and in generating an atmosphere of intolerance. (shrink)

Framing effects occur when different descriptions of the same decision problem give rise to divergent decisions. They can be seen as a violation of the decisiontheoretic version of the principle of extensionality (PE). The PE in logic means that two logically equivalent sentences can be substituted salva veritate. We explore what this notion of extensionality becomes in decision contexts. Violations of extensionality may have rational grounds. Based on some ideas proposed by the psychologist Craig McKenzie and colleagues, we contend that (...) framing effects are justified when the selection of one particular frame conveys choice relevant information. We first discuss this idea from a philosophical point of view, and proceed next to formalize it first in the context of the Bolker–Jeffrey decision theory. Finally, we extend the previous analysis to non-expected utility theories using the Biseparable Preference model introduced by Ghirardato and Marinacci (2001) and therefore show that the analysis is independent of the assumptions of Bayesian decision theory. Recently, a time-honored assumption has resurfaced in some parts of the free will debate: if past divine beliefs or past truths about what we do depend on what we do, then these beliefs and truths are, in a sense, up to us; hence, we are able to act otherwise, despite the existence of past truths or past divine beliefs about our future actions. In this paper, I introduce and discuss a novel incompatibilist argument that rests on. This argument is interesting (...) in itself, for it is independent of a number of assumptions about the nature of God that have played an essential role in the classical defense of incompatibilism about divine foreknowledge and human free will. The goal of this paper is to reconstruct Nagel’s approach to idealization in the sciences and present his views as a viable option. In a nutshell, the theory that emerges can be described as follows: There are various types of idealization, which can be found in theoretical and experimental laws, and which, according to Nagel, play various important epistemic roles. In particular, they help organize complex knowledge and allow for approximations to truth. A cognate of idealization, which Nagel does not (...) refer to under this label but describes in terms of assimilation to the familiar and in terms of analogy, is key to scientific models, whose value is primarily heuristic in nature. The fact that theories involve idealization supports an instrumentalist perspective on science, a perspective which also determines a particular scope of the account of idealization. By these lights, particular types of questions simply do not arise, for instance: questions pertaining to the alleged peculiarity of scientific representation, the truth of law statements, etc. (shrink)

In this paper, I discuss a view proposed by Carl Hempel in his paper Reduction: Ontological and Linguistic Facets, published in 1969. Here, Hempel suggested that questions regarding the identification of mental states with physiological states, the relation between sociological phenomena and individual behavioral states, and between biological and physicochemical states should be given what he calls a ‘linguistic’ interpretation. His main point is that whether or not an object is physical or biological depends on how it is, or can (...) be, described. In this paper, I wish to, firstly, explicate Hempel's suggestion, and, secondly, explore one argument in favor of Hempel's account. I will suggest that there is at least one use of the term ‘physical’ in philosophical discourse (and, for that matter, of related terms such as ‘biological’, ‘mental’, ‘natural’ etc.) that should be cashed out in linguistic or representational terms.
