Public benefit corporations are National Health Service, that is, state, entities whose function to provide healthcare in discharge of public duties. If we regardvalue as the output of such organisations, it seems logical to connect the values of the organisation to thevalue produced by such organisations. But, on closer examination there are competing underlying logics in play: (1) those based on promoting organisational efficiency and efficacy; and (2) those based on the idea of building service provision around the clinician–patient relationship. (...) Underlying these logics are differing value sets. These clash. Because of the clashing of underlying moral frameworks the connection between values andvalue becomes hard, if not impossible. This paper argues that (1) the clash in these moral frameworks must be addressed by the organisation rather than between individuals or groups of individuals within the organisation; (2) alloying duties within hybrid professionals submerges but does not resolve these conflicts; (3) one approach could be to impose on the organisation itself an ethical imperative to promote, enhance and protect from deterioration the welfare of the patients; (4) a board ethics committee is a possible organisational structure that could transparently and fairly balance clashes within the competing moral frameworks in a way that could reconcile the competing logics and (5) if such conflicts can be better resolved at the organisational level what the organisation must do to achieve its objectives will become clearer because what needs to be valued would naturally emerge connecting values,value and what is valued. Students display resistance, including academic dishonesty, at all educational levels. In the present study, we qualitatively examined the extent and incidence of academic misbehaviors by 101 US college students. Using a combination of self-reported closed- and open-ended questions, we developed a multi-faceted understanding of how students perceived their own classroom misbehaviors to avoid work as being original, clever, deceptive, and unethical. Questions pertaining to possible prevention, impact on grade, and repetition of the misbehavior were also included. Further, environmental contributors of (...) such behavior were explored, inclusive of the teacher, curriculum, larger school/institutional reasons, peers, and out-of-school issues. Thematic analyses identified distinct themes related to each factor, with poor time management emerging as a salient antecedent across factors. The present study also reviews and provides strategies to improve time management among students to mitigate future instances of academic misbehavior. (shrink)

Academic research studies examining the ethical attitudes and behaviors of salespeople have produced several frameworks that explore the ethical decision-making processes to which salespeople adhere when faced with ethical dilemmas. Past literature enriches our understanding; however, a critical review of the relevant literature suggests that an emotional route to salesperson ethical decision-making has yet to be explored. Given the fact that individuals’ emotional capacities play an important role in decision-making when faced with an ethical dilemma, there is a need for (...) empirical research in this area. We address this issue by outlining and testing an emotion-based model to study the ethical attitudes and behaviors of salespeople in a relational selling context. Building on the cognitive-affective model proposed by Gaudine and Thorne (J Bus Ethics 31:175–187, 2001 ), we outline a framework that incorporates higher order prosocial emotions: capacity for concern and capacity for guilt. Students display resistance in the classroom in numerous ways, often in the form of academic misconduct. Some argue that resistance can reflect cleverness and creativity, rather than apathy. This investigation aimed to develop a psychometric tool to examine classroom resistance as well as identify individual and situational determinants of the same. Data from 853 participants was collected on measures of resistance behaviors in educational contexts and their environmental contributors, creativity, personality, and deception. Further, participants indicated their frequency of resistance across (...) two time periods: kindergarten through middle school, and high school through college. Exploratory and confirmatory factor analyses identified a robust three-factor structure for the Classroom Resistance Scale, comprising Test-Oriented Cheating, Blatant Academic Dishonesty, and Unethical Shortcuts. The person-situation analysis indicated that students who engaged in resistance shared some consistent characteristics: they were more likely to be closed to new experiences, unimaginative, more extraverted, and highly influenced by their peers. Moreover, the frequency of classroom resistance increased in higher grades as compared to lower ones. Implications of spillover effects of academic dishonesty into the workplace are discussed, in addition to suggestions for future research. (shrink)

This article focuses on three recent controversies in which Žižek has been embroiled and for which he has taken positions that rest on the notion of antagonism. His views on Eurocentrism, the European refugee crisis and trans politics have been the subject of notable disapproval, if not denunciation. Critics reproach him for being Eurocentric, racist and transphobic, charges which he has repeatedly countered. The article will examine the differing theoretical and political positions in these debates, underlining what Žižek’s critics miss (...) or misunderstand about his notion of antagonism. While I side firmly with Žižek on the substance of these issues, I nonetheless consider the extent to which at least part of the disagreement here centres on the performative rather than the strictly “theoretical”: Might his critics be reacting to his overexposure? Could such overexposure be interpreted as an attempt at having the last word? And to what extent does the antagonistic form of Žižek’s interventions militate against their theoretical content? This essay traces the parallel, but unrelated, evolution of two sets of reactions to traditional idealist history of science in a world-historical context. While the scholars who fostered the postcolonial approach, in dealing with modern science in the non-West, espoused an idealist vision, they nevertheless stressed its political and ideological underpinnings and engaged with the question of its putative Western roots. The postidealist history of science developed its own vision with respect to the question of the global spread of modern (...) science, paying little heed to postcolonial debates. It then proposes a historiographical approach developed in large part by historians of South Asian politics, economics, and science that, without compromising the preoccupations of each of the two groups, could help construct a mutually comprehensible and connected framework for the understanding of the global workings of the sciences. We present evidence that preschool children oftentimes understand disjunctive sentences as if they were conjunctive. The result holds for matrix disjunctions as well as disjunctions embedded under every. At the same time, there is evidence in the literature that children understand or as inclusive disjunction in downward-entailing contexts. We propose to explain this seemingly conflicting pattern of results by assuming that the child knows the inclusive disjunction semantics of or, and that the conjunctive inference is a scalar implicature. We make (...) two assumptions about implicature computation in the child: that children access only a proper subset of the adult alternatives, and that children possess the adult capacity to strengthen sentences with implicatures. As a consequence, children are expected to sometimes not compute any implicatures at all, but in other cases they are expected to compute an implicature that is different from the adult implicature. We argue that the child’s conjunctive strengthening of disjunctive sentences realizes the latter possibility: the adult infers that the conjunction is false but the child infers that the conjunction is true. This behaviour is predicted when our assumptions about child development are coupled with the assumption that a covert exhaustive operator is responsible for strengthening in both the child and the adult. Specifically, children’s conjunctive strengthening is predicted to follow from the same mechanism used by adults to compute conjunctive free choice implicatures in response to disjunctive permission sentences. We furthermore argue that this parallel between the child and the adult extends to disambiguation preferences. In particular, we present evidence that children prefer to strengthen disjunctions to conjunctions, in matrix and embedded positions ; this result mirrors previous findings that adults prefer to compute free choice, at the root and under every. We propose a disambiguation strategy that explains the preference for conjunctive strengthening – by both the child and the adult – even though there is no general preference for exhaustification. Specifically, we propose that the preference for a conjunctive strengthening follows from a pragmatic preference for a complete answer to the Question Under Discussion. (shrink)

The COVID-19 pandemic resulted in an abrupt change in routines and livelihoods all around the world. This public health crisis amplified a number of systemic inequalities that led to populations needing to grapple with universally difficult truths. Yet some individuals, firms, and countries displayed resilient and creative responses in coping with pressing demands on healthcare and basic sanity. Past work has suggested that engaging in creative acts can be an adaptive response to a changing environment. Therefore, the purpose of this (...) paper is to describe how entities at the personal, community, and national levels cultivated and expressed creativity in an effort to make meaning during COVID-19. By overlaying the Four C model of creativity on such responses, we aim to (a) to connect mini, little, Pro, and Big creative behaviors with our attempts to make meaning of the ongoing COVID-19 pandemic, and (b) to suggest how engaging in creative expression can be used to guard against the adverse consequences of this outbreak. Acknowledging that this time has been and continues to be distressing and filled with uncertainty, we propose some ways of making sense of current events by applying original thinking across domains. Further, we propose how engaging in creativity can serve to buffer against the negative effects of living through the pandemic. (shrink)

This paper aims to understand the kind of activities that industrial actors develop in order to protect their enterprises during industrial crisis conditions. A series of political unrest, insurgency, economic turmoil, deadly earthquakes, and economic embargo at the Indo- Nepal boarder escalated the industrial crisis in Nepal. The quest for sustainability of enterprises during the enduring nature of the crisis stimulated for a more detail conversation and survey. A perceptual survey of industrial actors accompanying conversation therein indicates that trade union (...) and association leaders develop positive attitude and advance specific activities for protecting their enterprises during industrial crisis conditions. The study finds that an empathic nature helps to develop a positive attitude among the industrial actors, which seems contributory for enterprises to survive during crisis conditions. The actors tend to positively perceive significance of specific activities under the conditions of difficulties and hardships and enhance immunity to the industrial crisis. This paper argues that the empathic nature of the industrial actors becomes more effective to safeguard the pluralistic interests of the stakeholders of the enterprise than the self- centric nature of the actors. The actors are not only engaged in safeguarding their claims on the industry but are also contributing—beyond their routine work—positively to strengthen the enterprise immunity during difficulties. This paper concludes with an insight of shifting managerial attention from the generic concepts like cost minimisation and product differentiation to the concepts of regularity in supply of goods and services in the business network by expanding the scope of industrial relations vertically and horizontally. The empathic nature of industrial actors enhances the effectiveness of the general system theory and social network theory by developing understanding of the role of industrial actors’ relations in sustaining and operationalizing a business network under organizational crisis conditions. This article claims that, despite their critical-political stances, three current and influential theoretical frameworks – intersectionality, decoloniality, and ‘Indigenous localism’ – unconsciously accept global capitalism. The article focuses on the work of Crenshaw, Mignolo, Coulthard, and Tuck and Yang, respectively, to argue that, by ascribing to identity politics (intersectionality), a pluriversal politics of authenticity (decoloniality), and a decentralized ‘incommensurability’ (Indigenous localism), each engages in the culturalization and/or localization of politics – one that disavows the dimension of political economy, and because (...) of that, one that conforms well with, and poses no threat to, capitalist liberal globalization. The article concludes by reflecting on what such disavowal says about our late capitalist times, as well as the potentialities and perils of a contemporary subaltern anti-capitalist politics. Business leadership increasingly requires a master’s degree in business and graduate management admission test scores continue to be an important component of applications for admission to such programs. Given the ubiquitous use of GMAT scores as gatekeepers for business leadership, GMAT scores are likely to influence organizational ethical behavior through gender, cultural, and other biases in the GMAT. There is little prior literature in this area and we contribute by empirically documenting that GMAT scores are negatively related to the cultural (...) dimensions of masculinity and power distance and are positively related to math literacy, uncertainty avoidance, and individualism. We estimate that cultural factors may account for as much as an 80-point difference in cross-national mean GMAT scores which are also related negatively to local language literacy, national educational spending, wealth per capita, wealth inequality, and gender development. Most interestingly, we also find a significant negative association of GMAT scores with ethical orientation. These findings have important implications for business schools and corporate ethics and leadership. (shrink)

Used wisely the concepts of race and ethnicity in research have great potential, but used unwisely they can do immense damage. We need to consider the potential issues that might require a change of emphasis or application of ethics in a multi-ethnic society. Doing no harm (non-maleficence) is the most important ethical pillar in the ethnicity and health field. Ethnic differences can be used in damaging ways. Without the ethic of beneficence in place it is better not to draw attention (...) to ethnic differences. Respect is the pre-condition for autonomy. Autonomy of ethnic minority populations to live in their own traditional way is not easy to achieve in multi-ethnic societies. There are difficult issues in multi-ethnic societies that require great sensitivity to create a sense of fairness and justice. Justice is the core value that underpins equity. There is a deep paradox – to promote equality, we may need to treat people and groups unequally. Ethical codes need to be modified to emphasize the importance of including ethnic minority populations in research and not bypassing them, as has been happening. It is correct, for example, that potential research participants' personal details are guarded. If such a person, however, does not read it may be unethical to send written information about a project. It may be more ethical to tele phone or even call at the doorstep of such a person. The history of racism in research is worrying, not least the fear that it might return. We need a governing code of conduct. Ethical research can help ethnic minority groups to move from the shadows of society and participate in a vibrant, healthy, multi-ethnic society. (shrink)

Epidemiology relies upon variables that help differentiate populations by health status, thereby refining public health and health care policy, and offering insights for medical science. Race and ethnicity are powerful tools for doing this. The prerequisite for their responsible use is a society committed to reducing inequalities and inequities in health status. In recent months, pharmaceutical manufacturers have brought legal challenges to a provision of the 2022 Inflation Reduction Act (IRA) empowering the federal government to negotiate the prices Medicare pays for certain prescription medications. One key argument made in these filings is that price negotiation is a “taking” of property and violates the Takings Clause of the US Constitution. Through original case law and health policy analysis, we show that government price negotiation and even price regulation of goods and services, including (...) patented goods, are constitutional under the Takings Clause. Finding that the IRA violates the Takings Clause would radically upend settled constitutional law and jeopardize the US’s most important state and federal health care programs. (shrink)

Maximize Presupposition! is an economy condition that adjudicates between contextually equivalent competing structures. Building on data discovered by O. Percus, I will argue that the constraint is checked in the local contexts of embedded constituents. I will argue that this architecture leads to a general solution to the problem of antipresupposition projection, and also allows I. Heim’s ‘Novelty/Familiarity Condition’ to be eliminated as a constraint on operations of context change.

This article maps the Manvantara section of the Mārkaṇḍeya Purāṇa to reveal a patronymic pattern at play which is key to understanding the interplay between the mythologies of Goddess and Sun found in the Mārkaṇḍeya. It explains why the Devī Māhātmya occurs, especially in the Manvantara, which has puzzled scholars since colonial times. The article argues that the compositional strategy was implemented to present the Goddess as an analog to Viṣṇu, Manu, Sun, and the Indian king, all paragons of preservation.

To note that the study of Sanskrit narrative literature, in particular the Epics and Purāṇas, has been plagued with the propensity towards diachronic dissection would be little more than a truism in most scholarly circles. Yet it is with this truism we are forced to begin as we strive to shed the old skin of colonial era receptions of these texts. While there have been notable efforts made to embrace Sanskrit narrative as synchronic wholes, there isn’t much in the way (...) of a systematic methodology for doing so. This paper, therefore, is aimed at charting a methodology for synchronic study of Sanskrit narrative literature, paying particular attention to narrative frames. It advances five avenues of thematic import based on the structure of Sanskrit narrative: inception import, association import, exposition import, framing import, and impetus import. Examples are primarily drawn primarily from the Mahābhārata and the Mārkaṇḍeya Purāṇa. Background‘The Clinical Ethics Advisory Group’ (CEAG) is the clinical ethics support body for Newcastle upon Tyne Hospitals National Health Service Foundation Trust. A significant change in CEAG’s way of working occurred over the past 5 years as a result of Court decisions, increasing public expectations and an increase in CEAG’s paediatric case flow.PurposeReview historical data: (a) as a useful benchmark to look for the early impact of significant service changes and (b) to seek possible reference (‘sentinel’) cases for use with (...) a posited practical (casuistic) case-based reasoning model.MethodsAudit of the minutes of the first 22 years’ meetings was undertaken by the two chairs of CEAG over that period of time.Results223 matters discussed: 86 Trust policy issues; 117 clinical cases (84 adult (32 urgent), 33 child (8 urgent)); 12 CEAG procedural issues and 8 UK Clinical Ethics Network ‘round robin’ cases. The range of topic areas was wide. A broad range of ethical structures were deployed, principlism predominated. Quality was subjectively assessed by each reviewer, but different methods were used. This proved highly concordant between the two reviewers. 47% (105/223) of discussions were ‘excellent’ (*A4C4–A4C4) and 70% (156.5/223) ‘good’ or better (*A4C4–A3C3). By meeting the criteria of ‘excellent’ and ‘prospective’, 92/223 (41%) of matters were deemed potentially suitable as sentinel cases.ConclusionsThe audit provides a rich vein of information. There is demand for CEAG’s services, workload is becoming more complex. Formal funding for such services seems justified. (shrink)

According to one view of linguistic information, a speaker can convey contextually new information in one of two ways: by asserting the content as new information; or by presupposing the content as given information which would then have to be accommodated. This distinction predicts that it is conversationally more appropriate to assert implausible information rather than presuppose it. A second view rejects the assumption that presuppositions are accommodated; instead, presuppositions are assimilated into asserted content and both are correspondingly open to (...) challenge. Under this view, we should not expect to find a difference in conversational appropriateness between asserting implausible information and presupposing it. To distinguish between these two views of linguistic information, we performed two self-paced reading experiments with an on-line stops-making-sense judgment. The results of the two experiments—using the presupposition triggers the and too—show that accommodation is inappropriate relative to non-presuppositional controls when the presupposed information is implausible but not when it is plausible. These results provide support for the first view of linguistic information: the contrast in implausible contexts can only be explained if there is a presupposition-assertion distinction and accommodation is a mechanism dedicated to reasoning about presuppositions. In a bid to curb the spread of COVID-19 in 2020, several countries implemented lockdown procedures to varying degrees. This article sought to examine the extent to which country-level strictness, as measured by the Government Response Stringency Index, moderated the relationship between certain cultural dimensions and estimates of national innovation. Data on 84 countries were collated for Hofstede’s cultural dimensions, and from the Global Innovation Index. Owing to the robust relationships between innovation and the dimensions of uncertainty avoidance, power distance, (...) and individualism, these were used in moderation analyses. In general, power distance was inversely related to innovation, whereas individualism was directly related to it. Results indicated that collectivist and high power distance countries showed lower innovation, irrespective of levels of government stringency as a response to COVID-19. On the other hand, among individualistic and low power distance countries, lower innovation was associated with increased stringency. Higher innovation was observed when such countries had a less severe government response. The dimension of uncertainty avoidance was not significantly associated with innovation at the country level. The implications of lockdowns on general innovation, its inputs, and outputs are discussed in the context of cultural dimensions and country-level policies. (shrink)

It is shown how Sri Caitanya breathes a new spirit into philosophy and religion by transcending the narrow and mutually conflicting 'isms' and dogmas and reconciling them in a higher synthesis by means of the concept of the absolute as Bhagavan and the doctrine of Acintya-bhedabheda or inconceivable identity-indifference. The importance of Bhakti as the exclusive means of attaining God is His highest and sweetest form is stressed. Prema or divine love is distinguished from eroticism and established as the highest end. The doctrine of Rasa or transcendental relish is explained and Parakiya Rasa is established as the highest Rasa. (shrink)

Rural queer studies, viewed through the lens of relational agriculture, offer critiques of heteropatriarchal norms in farming and highlight strategies used by queer farmers to manoeuvre discrimination and thrive in rural areas. This paper responds to recent calls for further scrutiny of the experiences of gender and sexually underrepresented groups in community-supported agriculture (CSA). It investigates the empowerment of rural queer people in CSA Guadiana, South Portugal, through the experiences of 12 queer members. I collected data through participant observation, semi-structured (...) interviews and a focus group and analysed them through open coding, followed by focused coding. Results indicate that CSA Guadiana, despite not originally designed for this purpose, facilitates various forms of empowerment and active engagement among queer members, particularly influenced by the leadership of queer producers and recurrent gatherings in queer-owned farmland. Three key lessons of queer empowerment in CSA Guadiana emerge from the analysis and contribute to debates on the politics of recognition, queer community action and visibility in the rural context: (i) self-confidence to perform queerness may be restricted to a selective rural community; (ii) partnerships between producers and co-producers may enable reciprocal queer empowerment; and (iii) queer leadership in agri-food community action may quietly represent gender and sexual diversity in the countryside. These findings offer the rural queer literature novel insights into the complexities, contradictions and limitations of empowerment experienced by queer farmers, artisanal food producers and consumers in a rural CSA. Community-supported agriculture (CSA) initiatives are spaces where diverse work relations are performed. From a postcapitalist perspective, these initiatives attempt to create alternative-capitalist and non-capitalist work relations next to capitalist ones. While analyses of work relations in CSA abound, it remains uncertain how such diversification is made possible and how it is shaped by the micro-politics of and power relations in these initiatives. This paper addresses this gap by analysing how power shapes transformations to postcapitalist work relations in CSA. It provides (...) substantial empirical evidence of multiple manifestations of power enabling or constraining postcapitalist work relations through a comparative case study of three CSA initiatives in Portugal. Results show that while CSA creates postcapitalist work relations that are non-alienated, non-monetised and full of care, they insufficiently unmake unbalanced power relations established in capitalist work relations. This paper argues that, when establishing postcapitalist work relations, the selected CSA initiatives could benefit from actively deconstructing internal hierarchies, de-centralising decision-making power from farm owners and addressing oppressive power relations that are ossified in their local and cultural context. It draws on the work of Lacan and Žižek, and on psychoanalytic postcolonial and feminist scholarship.

This paper presents and examines the interreligious philosopher-theologian Raimon Panikkar’s proposal of ‘Cosmic Confidence’ in interreligious spirituality and another dialogue theologian Paul Knitter’s critique on it. Their conversation is to be situated in a wider issue of the relation between pluralism and justice. The paper proceeds in three parts. The first part summarily presents the context and direction of Panikkar’s pluralistic vision, particularly with a focus on his central insight of cosmic confidence. The second part indicates a challenge to Panikkar’s (...) cosmic confidence in terms of a preferential option for the poor – a spirit, of course, of liberation theology, but also that gets reflected in the challenge thrown by Knitter. And the final part deals with some implications of their mutual dialogue for the issue of pluralism, justice and reconciliation. (shrink)

There is a growing need to identify what really can converge classroom learning to the real-life practising of ethical principles. We examine if the effectiveness of ethics education can be improved through meditation-based mindfulness intervention. Our baseline experiment is a procedurally modified version of the anagram exercise (Ruedy and Schweitzer 2010) for measuring unethical behaviour. We introduce a brief meditation intervention to induce instant mindfulness. Our findings indicate substantive evidence confirming the positive effect of the state of mindfulness on ethical (...) behaviour. Subjects in the meditation group engage in more low-level cheating compared to the control group who cheated more severely. Gender and academic grade do not influence ethical behaviour. Mindfulness fosters composure, mental poise, and a conducive environment for upholding ethical values, as indicated by a lower incidence of cheating in our study. We propose to promote a learning environment with mindfulness intervention in educational programmes. (shrink)
