Posner characterizes the current preoccupation with moral and constitutional theory as an evasion of the real need of American law, which is for a greater understanding of the social, economic, and political facts out of which great legal controversies arise, and advocates a rebuilding of the law on the basis of systematic empirical inquiry.

This article explores three distinct approaches to politics identified by Deleuze and Guattari. I argue that they consistently privilege a 'problematic' approach entailing individuals and associations establishing norms on the basis of the potential they possess within a concrete situation, and that this implies resistance to both the 'theorematic' politics they associate with statist philosophy and struggles aiming to alter the 'axiomatic' determination induced by global forces of capital. While this resistance necessarily proceeds in relation to established notions of identity (...) and value, it must also do more than aim for the establishment of particular institutional 'constants,' including particular democratic procedures and human rights. This paper advances reasons why lucid dreaming is considered problematic to the psychoanalytic venture. It is shown that the conscious thought mechanism of lucid dreaming is obstructive and in opposition to the repressed and therefore conflictual within the unconscious parameters. A negative value is attached to the mechanism of lucid dreaming which is presented as an ill-advised endeavor that undermines meaning through its promotion of conscious interference and ego inhibition of dream symbolism. Viewed as a deterrent to self-knowledge and the (...) interpretative process of working through, lucid dreaming does not advance an authentic inner presentation and is therefore of no interest to the betterment of the psyche. Legal scholarship exploring the nature of evidence and the process of juridical proof has had a complex relationship with formal modeling. As evident in so many fields of knowledge, algorithmic approaches to evidence have the theoretical potential to increase the accuracy of fact finding, a tremendously important goal of the legal system. The hope that knowledge could be formalized within the evidentiary realm generated a spate of articles attempting to put probability theory to this purpose. This literature was both insightful (...) and frustrating. Much light was shed on the legal system, but it also quickly became evident that the tools of probability theory were in many ways ill-constructed for the task. Fundamental incompatibilities between the structure of legal decision making and the extant formal tools were identified, and it became evident that many of the purported explanations of legal phenomena were internally inconsistent. As a consequence, interest in this type of formal modeling declined, and attention was directed toward different kinds of explanations of the phenomena. Perhaps under the influence of a recent trend toward various types of formal modeling in legal scholarship, a recent burst of articles, rather than attempting to explain the macro structure of trials, which was the previous object of interest, attempts to quantify the probative value of various items of evidence in ways consistent with the formal features of various probability theories, and then to study decision making from that perspective. For example, the value of evidence is often purported to be its likelihood ratio, that is, the probability of discovering or receiving the evidence given a hypothesis (e.g., the defendant did it) divided by the probability of discovering or receiving the evidence given the negation of the hypothesis (the defendant didn't do it). Alternatively, the value of evidence is purported (more contextually) to be the information gain it provides, defined as the increase in probability it provides for a hypothesis above the probability of the hypothesis based on the other available evidence. Both conceptions then assume that all of the various probability assessments conform or ought to conform to the dictates of Bayes' theorem (that maintains consistency among such assessments); empirical studies are then done testing the extent to which this is so and proposing how the law can increase the probability that it is so. The general criticisms of using Bayes' theorem as a formal model of juridical proof are well known and were integral to the last wave of interest in formal modeling of the evidentiary process. This paper thus for the most part puts aside that more general issue, and focuses specifically on mathematical modeling of the value of particular items of evidence. The paper demonstrates that formal modeling has only limited value in explaining the value of legal evidence, much more limited than those constructing and discussing the models assume, and thus that the conclusions they draw about the value of evidence are unwarranted. This is done through a discussion of four recent examples that attempt to quantify evidence relating to, respectively, carpet fibers, infidelity, DNA random-match evidence, and character evidence used to impeach a witness. This article thus makes two contributions. First, and most importantly, it is another demonstration of the complex relationship between algorithmic tools and legal decision making. Second, at a minimum it points out serious pitfalls for analytical or empirical studies of juridical proof. (shrink)

At the end of his life, Michel Foucault wrote of ‘problematization’ as what he had done all along. Yet some commentators see a ‘new’ Foucault emerging together with this term. This essay accepts the last hypothesis and connects it with the French scene, where problematization was already familiar, and its use under tension. Starting with Bachelard, problematization was related with a polemic epistemological stance, but its reprise by Gilles Deleuze turned it into an affirmative theme dramatizing the (...) creation of problems. Situating Foucault’s problematization in this philosophical line permits us to develop the relation he proposed between problematization and the test of contemporary reality on the thinker. This paper will put problematization itself to the test of our present, that is, to the prospect of the social-ecological devastation associated with climate disorder. Both following and betraying Foucault with the help of Whitehead and Haraway, problematization will then be related to the power of sensible events, a power which requires allowing oneself to be touched, and allowing what touches us the power to modify the relation we entertain to our own reasons. Background: Ethical dilemmas are an integral part of medicine. Whether physicians actually feel that they have made ethically problematic treatment decisions or choices in their work is largely unknown. Identifying physicians with ethical problems, and the types of problems and underlying factors, might benefit organisational and educational efforts to help physicians solve ethical dilemmas in a constructive way. We investigated how the frequency and types of ethically difficult treatment decisions vary by specialty.Method: A mail survey of all non-retired Finnish physicians (...) was conducted in 2004. Of those who had made any ethically problematic treatment decisions, the types of decisions and reasons given for these decisions were asked for. Factor analysis was used to investigate clustering of ethically problematic treatment decisions, and logistic regression to investigate the effect of specialty, adjusted for age and gender.Results: Psychiatrists experienced ethically problematic treatment decisions most frequently, followed by pulmonologists, internists and neurologists. Problems were reported least often by pathologists, laboratory physicians and ophthalmologists. Overtreatment was more common than undertreatment in most specialties, with the exception of psychiatrists who emphasised undertreatment and patient rights issues.Conclusion: Physicians of different specialties differ significantly regarding frequency and types of ethically problematic treatment decisions they have made. Psychiatrists differ from all other specialists in reporting more undertreatment and patient rights issues. Experiencing ethically problematic decisions might affect the quality of care and physician well-being in many ways. The findings could be useful for both under- and postgraduate ethics education. To address the growing costs associated with chronic illness care, many countries, both developed and developing, identify increased patient self‐management or self‐care as a focus of healthcare reform. Health coaching, an implementation strategy to support the shift to self‐management, encourages patients to make lifestyle changes to improve the management of chronic illness. This practice differs from traditional models of health education because of the interactional dynamics between nurse and patient, and an orientation to care that ostensibly centres and empowers patients. The theoretical underpinnings of coaching reflect these differences, however in its application, the practices arranged around health coaching for chronic illness self‐management reveal the social regulation and professional management of everyday life. This becomes especially problematic in contexts defined by economic constraint and government withdrawal from activities related to the ‘care’ of citizens. In this paper, we trace the development of health coaching as part of nursing practice and consider the implications of this practice as an emerging element of chronic illness self‐management. Our purpose is to highlight health coaching as an approach intended to support patients with chronic illness and at the same time, problematize the tensions contained in (and by) this practice. The outbreak of COVID-19 has greatly affected university students’ studies and life. This study aimed to examine the possible mediating role of psychological capital and the moderating role of academic burnout in the relationship between problematic social media usage and anxiety among university students during COVID-19. A total of 3,123 undergraduates from universities in Shanghai participated in an online survey from March to April 2020. The results showed that problematic social media usage among university students predicted their levels of anxiety. (...) Mediation analysis indicated that psychological capital mediated the relationship between problematic social media usage and anxiety. Furthermore, for university students whose academic performance had been affected by the COVID-19 pandemic, the effects of both problematic social media usage and the psychological capital on anxiety were moderated by academic burnout. For university students whose academic performance was not affected by the COVID-19 pandemic, academic burnout moderated the effects of psychological capital but not the effects of problematic social media usage on anxiety. The results highlighted the underlying mechanisms in the relationship between problematic social media usage and anxiety. These findings provide practical insights into the development and implementation of psychological interventions when facing a pandemic. (shrink)

This paper discusses the problematic and sometimes implicit nature of some central notions and criteria used in debates about inclusion (or exclusion) of health care services in the health care benefit package. An analysis of discussions about four health care services—lungtransplantation, statins, (sildenafil (viagra) and rivastigmine—illustrates a case-by-case approach and inconsistent use of criteria, which present a challenge to develop a decision-making procedure in which important criteria or central notions can be discussed explicitly.

BackgroundProblematic pornography use is considered an addictive behavior, which is an important clinical issue. Despite considerable research interest in problematic pornography use worldwide, to the best of our knowledge, there are no extant studies on the subject in Japan. Therefore, despite the fact that many people in Japan use pornography, the difference between problematic and non-problematic users among Japanese people is not known.ObjectiveThis study aimed to identify the characteristics of problematic pornography use among Japanese students, to the best of our (...) knowledge. Specifically, we examined general psychopathological symptoms, sexual compulsivity, depression, anxiety, and low effortful control.MethodsThe participants were 150 college students aged 20–26 years at a university in midland Japan. An online questionnaire was administered that included items on pornography usage patterns, impaired control of pornography use, sexual compulsivity, depression, anxiety, and effortful control.ResultsMost men and approximately one-third of women used pornography at least once in the past month. Some users reported significant daily-life problems due to difficulty in controlling pornography use. Participants with impaired control of pornography use had higher depression, anxiety, and sexual compulsivity, and lower effortful control than pornography users without impaired control.ConclusionSome Japanese students reported significant daily-life problems due to impaired control of pornography use. The characteristics of individuals with impaired control are consistent with previous studies. The results of this study suggest that individuals with impaired control may have poor mental health, and that there is need for further research and development of treatment systems to manage this issue in Japan. Further research exploring a more varied sample in Japan is required to effectively examine problematic pornography use. (shrink)

From the Church Fathers to the nineteenth century, countless libraries bear witness to the quarrels in which scholars, using the exegetical and philological techniques of their times (notably those of etymology), had striven to make out the Adamic vestiges which have remained intact in post-Babelian languages. For them, languages were to remain outside historical time. However, at the same time there existed other currents of knowledge. Authors use diverse metaphors – bodily, botanical, etc. – to formulate a dynamic history of (...) languages. Through the evocation of a few problematic metaphors, which create relationships between diverse forms of temporality employed to indicate the historicity of languages, this study underlines the tensions which presided over the genesis and the early development of linguistic knowledge. The Adamic language, endlessly appealed to, was also regularly called into question, and even outright rejected. No matter: recovering the purity of these origins managed to work as a powerful impetus for historic scholarship, and not only in the seventeenth century. In this article, Hans Schildermans suggests practices of study as a way for universities to respond to socio-ecological questions, issues, and problems related to the Anthropocene. He elaborates the concept of study practices by drawing on traditional pragmatic notions, such as problematic situation and problematization, as these are articulated in John Dewey's theory of inquiry. Prompted by concerns about the closed problem–solution nexus, as well as questions concerning the (egological) worldview underlying this theory, Schildermans aims to reread these ideas (...) through the lens of contemporary authors such as Isabelle Stengers. In doing so, he articulates the educational dynamics of practices of study that address problematic situations, with specific attention to matters of educational futurity. In other words, centrally important to this analysis is the question of how these practices of study participate in a world in-the-making by activating possible futures — or, to formulate it somewhat differently, how practices of study give shape to a pragmatics of a world to-be-made. In his lectures on pragmatism, William James famously proposed that the question of ‘the one and the many’ constitutes the most central of all philosophic problems, and that it is ‘central because so pregnant’. Prompted by James’ proposition, this article explores the intimately political connection in James’ thought between his pluralistic metaphysics and the nature of the problematic as a generative force that impregnates worlds and thoughts with differences: what I here call ‘the pluralistic problematic’. Exploring the generative significance of (...) the problematic in James’ philosophy, I propose that, where James is concerned, the pluriverse has a thoroughly problematic mode of existence. And pluralism, rather than a celebration of the many, rather than a philosophical exposition on multiple worlds and ontologies, or a theory of the organisation of a diverse polis, is first and foremost a pragmatics of the pluriverse – a political, experimental and pragmatic response to the ongoing insistence of the pluralistic problematic. In this article I want to reconstruct some threads of the recent discussions on pragmatism and genealogy. As a starting point for this discussion, I will discuss Koopman’s proposal of a division of labor between genealogy and pragmatism. While preserving his emphasis on the centrality of problematization in genealogical inquiry, I will try to challenge his ideas about the incompatibility between genealogies that problematize, and genealogies that vindicate. In the subsequent parts of the paper, I aim at developing the (...) hypothesis about the compatibility between problematization and vindication by discussing two different pragmatist approaches to genealogy: Hans Joas’s genealogy of human rights, and Mathieu Queloz’s pragmatic genealogy. In the final part of the article, I will sketch a possible contribution to the understanding of the normative status of genealogies, by focusing on Dewey’s concept of evaluation. More specifically, I hope to show that evaluative genealogy inquiries can preserve their sui generis normative force, without being reduced to a tool for defending and backing ready-made moral and political positions. ABSTRACT Background: Experiencing ethical problems requires both ethically problematic situations and ethical sensitivity. Ethically problematic treatment decisions are distressing and might reflect health care quality problems. Whether all physicians actually experience ethical problems, what these problems are and how they vary according to physician age, gender and work sector are largely unknown. Methods: A mail survey of all non‐retired physicians licensed in Finland (n = 17,172, response rate 75.6%). Results: The proportion of physicians reporting having made ethically problematic treatment decisions (...) decreased in linear fashion from 60% at ages below 30 years to 21% at ages over 63 years. The only problem that did not decrease in frequency with age was having withdrawn necessary treatments. Women and primary care physicians reported problematic decisions most often, although gender differences were small. Primary care physicians most often reported having performed too many investigations or having pressured patients, whereas hospital physicians emphasized having withdrawn necessary treatments. Performing unnecessary treatments or investigations was explained by pressure from patients or relatives, and performing too few treatments or investigations was explained by inadequate resources. Conclusions: In general, young physicians felt pressured to do too much, whereas older physicians felt they could not do enough due to inadequate resources. Older physicians might be less exposed to ethically problematic situations, be more able to handle them or have lower ethical sensitivity. Young physicians could benefit from support in resisting pressure to perform unnecessary treatments, whereas older physicians might benefit from training in recognizing ethical issues. (shrink)

The past two decades have seen the extensive privatisation and marketisation of health care in an ever reaching number of developing countries. Within this milieu, medical tourism is being promoted as a rational economic development strategy for some developing nations, and a makeshift solution to the escalating waiting lists and exorbitant costs of health care in developed nations. This paper explores the need to problematize medical tourism in order to move beyond one dimensional neoliberal discourses that have, to date, dominated (...) the arena. In this problematization, the paper discusses a range of understandings and uses of the term ‘medical tourism’ and situates it within the context of the neoliberal economic development of health care internationally. Drawing on theory from critical medical anthropology and health and human rights perspectives, the paper critically analyzes the assumed independence between the medical tourism industry and local populations facing critical health issues, where social, cultural and economic inequities are widening in terms of access, cost and quality of health care. Finally, medical tourism is examined in the local context of India, critiquing the increasingly indistinct roles played by government and private sectors, whilst linking these shifts to global market forces. The article analyzes literature addressing the problem of reality in modern anti-realist theories. The purpose of the review is to expand the circle of researchers, including not only representatives of analytical philosophy, but also those of the phenomenological tradition, since the principle of phenomenological reduction corresponds to the general conceptual attitude of anti-realists, and in methodological terms, phenomenology more consistently implements the program of anti-realism. The principle of anti-realist philosophy is shown as exemplified in solutions of the “difficult problem of (...) consciousness” within analytical philosophy and also in the development of a phenomenological attitude. Such a combination of two, by far the most respectable, philosophical schools makes it possible to more accurately determine the contribution of theorists of both directions to the theory of reality, to identify problematic nodes, internal disagreements and points of intersection of the ideas of phenomenologists and representatives of analytical philosophy in understanding the nature of reality. The works of modern researchers of the problems of reality R. Berghofer, V. Vasyukov, Ya. Ishihara, V. Ladov, L. Makeeva, R. Pils, A. Fursov, D. Chalmers and many others, as well as the works of E. Husserl, W. Quine, H. Putnam’s works, which have become philosophical classics, allow us to clarify the ideas about reality that have developed in the anti-realist discourse from different sides. New studies of the principle of phenomenological reduction by Yu. Himanka and the origins of the formation of phenomenological philosophy by N.V. Motroshilova make it possible to clarify the contribution of phenomenologists to the anti-realist tradition. (shrink)

The article analyzes one of the fundamental rights – the right to maintenance, which proper implementation ensures normal development of the child. This right matches with the duty of parents to maintain their minor children. Paragraph 6 of Article 38 of the Constitution of the Republic of Lithuania states that parents have a duty to educate their children to be honest people and loyal citizens, supporting them until adulthood. The obligation to maintain children is established in the first 3.192 Article (...) paragraph of the Civil Code of the Republic of Lithuania, and the responsibility for avoiding to maintain a child is provided in Article 164 of the Criminal Code. The article discusses the fact that the analysis of criminal law rate is not precise enough. Article 164 of the Criminal Code does not match with the child maintenance methods specified in the CC Article 3.196 paragraph 1. Since criminal liability is only for judgment in default in civil cases, a person shall only be liable for breaking the right to maintain a child, provided in the CC 3.196 paragraph 1. This article deeply analyzes the problematic qualification aspects of the avoidance to maintain a child. Some alternative ways of child maintenance are mentioned, as can be chosen from other law instruments (bailiffs, Guarantee child support fund) and it leads to the ultima ratio principle. On the other hand, it is not required to seek alternative remedies for affected interests, and it is possible to initiate a pre-trial investigation. Therefore, this article seeks to identify specific civil and criminal law rules delimitation. Avoidance of child maintenance is an ongoing crime. The main problem in legal practice is to determine an end of this ongoing criminal conduct. The practice of the Supreme Court of Lithuania is not unanimous. In some cases, the end of this ongoing conduct is considered to be a moment when the past judgment has entered into force, in other cases – the moment of indictment. These positions are criticized by many authors and it is suggested to follow the Supreme Court’s practice, according to which the moment when a judgment of conviction for the criminal act is passed should be considered as an end of an ongoing criminal conduct. Analizar epistemológicamente los problemas de salud requiere incorporar la epistemología a los programas de posgrado en ciencias de la salud. Con el propósito de caracterizar los campos problemáticos que fundamenten el diseño de un programa académico para el curso de epistemología en ciencias de la salud se realizó un estudio con el enfoque de la hermenéutica gadameriana en tres etapas. El punto de partida expone la concepción de hombre, conocimiento y epistemología. El horizonte de comprensión se elaboró con tendencias epistemológicas (...) hegemónicas. La fusión de horizontes integró las características de los siguientes campos problemáticos: epistemología de las ciencias de la salud, lógica de las ciencias de la salud, tendencias epistemológicas en ciencias de la salud, problemas epistemológicos de las ciencias de la salud. Se concluye que los campos problemáticos descritos introducen al estudiante a la reflexión de su práctica científica mediante el análisis racional, axiológico y crítico. Analyzing health problems from an epistemological point of view requires epistemology to be included on health sciences postgraduate courses programs. Aimed at characterizing the problematic fields used as basis for the design of a health sciences epistemology academic program, a study with an approach to Gadamer hermeneutics in three stages was carried out. The starting point shows man, knowledge and epistemology conceptions. The comprehension horizon was made with epistemological-dominant trends. The horizons merge included characteristics from the following problematic fields: health sciences epistemology, health sciences logic, epistemological trends in health sciences, health sciences epistemological problems. It was reached the conclusion that the described problematic fields introduce students to their scientific practice reflection through a rational, axiological and critical analysis. (shrink)

This paper summarizes the longstanding debate over psychology's fragmentation by illustrating two principal impediments to the fostering of consensus and unity. The paper then discusses the important benefits of past dialogue concerning these issues, suggesting that some progress has been made in dealing with problems of disunity and fragmentation, particularly at the metatheoretical and philosophical levels. This article examines a select sample of popular magazines and self-help books to address the question: How is premenstrual syndrome constructed discursively as a legitimate disease worthy of medical attention and public discussion? The author finds that some women have been active participants in the construction of PMS as a medical disease. In particular, she finds that accounts of women's experiences of premenstrual symptoms figure prominently in the rhetorical legitimation of PMS as a medical phenomenon in the popular press and (...) self-help books. At the same time, the author examines the gendered assumptions about gender, health, and normality that underlie how women's “experiences” are incorporated into the construction of PMS. In particular, she asks whose experience is part of the medical legitimation of premenstrual symptoms and argues that the case of PMS illustrates the need for feminists to problematize biological as well as social experiences. Both in criminal law science and in the judicial practice there are a lot of discussions as to what should be considered as the beginning and end of human life. Birth and death are not instantaneous acts, but rather processes made up of time-spans that can be construed as evidence of the beginning or end of a human life. From a biological point of view the human life is a constant, continuous metabolic process after cessation of which the human life (...) also ceases. These circumstances very much aggravate the definition of criteria of the moments of beginning and end of human life. There are disagreements in the criminal law science with respect to from which moment the human life is to be protected by the criminal law. Herewith this presupposes also the other problematic question—what is to be considered a “living human” as a homicide subject (a victim). Complication of the said question is also determined by the fact that it is related not only to legal but also to medical, religious, and moral aspects. This article exactly analyses certain aspects of the beginning and end of human life in the context of the homicide composition attributes. (shrink)

In the 21st Century, Modern Japanese Philosophy is a subject broadly studied in Thailand. However, many of Thai students and scholars are still confused about Modern Japanese Philosophy. This article has 2objectives 1.) To provide an argument on Modern Japanese Philosophers to clarify the scope of understanding that leads to distinguishing between what modern Japanese Philosophy is and what generally for others context of Japan 2.) To motivate for doing Modern Japanese Philosophy regarding today’s digitalized and globalized environment. Facing and (...) acknowledging the present reality, thinkers are looking “deep within” for philosophy to recollect and retrieve it for human beings, who think while living and live while thinking. The very act of living originally entails the act of philosophizing Nishida Kitaro, a father of Modern Japanese Philosophy Thought about “what it means to be a Modern Japanese Philosophy?”. Globalization noted that each culture must fully develop its uniqueness to become a meaningful constituent of the larger digital and global world. If each culture instead of diluting itself, unfolds itself in a more“universal” way, the more global significance will contribute. This article is carefully philosophized and analyzed. It is a welcome addition to the field of intercultural and Modern Japanese Philosophy. It also will be recommended for all students of philosophy, religious studies, researchers, and teachers in these fields for effective learning, teaching, and research in Modern Japanese Philosophy in the digital era and globalization. I argue for a new broad-based form of critical inquiry which I refer to as genealogical pragmatism. This conception of critical inquiry combines the genealogical emphasis on problematization featured in Michel Foucault's work with the pragmatist emphasis on reconstruction featured in John Dewey's work. Rather than being understood as two opposed forms of critique and inquiry, as is commonly supposed, I demonstrate that problematization and reconstruction fit together quite well. The work of problematization invites the response of (...) reconstruction just as the work of reconstruction requires the motivation supplied by problematization. This combination of genealogy and pragmatism not only yields an effective conception of critical inquiry, but also helps repair crucial deficits in both genealogy and pragmatism as they currently stand on their own. The international technology assessment movement represents a noteworthy attempt at understanding and mastery of technological progress by modem industrial society. This paper explains why Technology Assessment has enjoyed marginal success. TA has patterned its methodology after the technologies it must evaluate. More fundamentally it has sought philosophical support from the same positivistic assumptions on which science based technology is grounded. Because positivism perpetuates the error that scientific technology is intelligible in terms independent of the political and economic context, TA itself (...) is deprived of substantive criteria which could form the basis of a critique of technology. BackgroundRecently there have been growing concerns about problematic mobile phone use by adolescent populations. This study aimed to address this concern through a study of severity and correlates of problematic mobile phone use with a sample of Hong Kong adolescents.MethodsData were collected from a sample of adolescents from three local secondary schools using a measuring scale designated for Chinese adolescents. Participants were allocated into groups of “problematic users” and “non-problematic users” based on the number of occurrence of symptoms due to (...) excessive and maladaptive use of mobile phone and possible functional impairments caused by problematic mobile phone use. A group of “at-risk users” was identified. A sample-based examination on distribution of these three groups of users was conducted via frequency counts and percentage calculation. A series of t-test were performed to make comparisons between “problematic” and “non-problematic” groups on selected personality and health related variable. Risk and protective factors were identified via correlational analysis and logistic regression analysis.ResultsUnder a more stringent cut-off criterion of four or more reported symptoms plus one or more reported functional impairments, 22.9% of the adolescents participating in this study could be classified as problematic mobile phone users. However, a more lenient criterion reported a substantially more severe prevalence rate. A new group of “at-risk” adolescents was identified with such a discrepancy of prevalence rate. Gender difference, some risk and protective factors were also identified for developing this technology-related problem.Discussion and ConclusionsAdolescents who are vulnerable to suffer from this technology-related problem deserve more attention from helping professionals. Results of this study throw some insights on how to identify problematic mobile phone user applying a criterion-referenced approach. This study echoes a recent call for adopting a developmental perspective in understanding this problem and conducting research in this area. Anchored on present findings, effective interventions to tackle this rising problem among adolescents are suggested. (shrink)

Behavioral paternalism raises deep concerns that do not arise in traditional welfare economics. These concerns stem from behavioral paternalism’s acceptance of the defining axioms of neoclassical rationality for normative purposes, despite having rejected them as positive descriptions of reality. We argue that behavioral paternalists have indeed accepted neoclassical rationality axioms as a welfare standard; that economists historically adopted these axioms not for their normative plausibility, but for their usefulness in formal and theoretical modeling; that broadly rational individuals might fail to (...) satisfy the axioms for various reasons, making them unpersuasive as normative criteria; and that even if their violation did constitute irrationality, that would not justify paternalists’ choosing among inconsistent preferences to define an individual’s “true” preferences. The article presents the results of an analysis of perceptions of migrants in press releases and regulatory documents of law enforcement and civil government agencies. We considered these texts within the framework of a "soft" constructionist approach, as a tool for problematizing the social process and one of the key ways of producing the discourse of power. The purpose of the study was to use a combination of quantitative content analysis and discourse analysis to identify the "equivalence chains" that give (...) meanings to the nodal sign "migration" in the texts of power. The objectives of the study were to collect a text array relevant to the topic and determine the social context in which the migrant is placed: the spaces in which they are present, the actions of which they are the subject and object. In most of the 548 texts reviewed, the migrant is presented as a suspicious, impersonal object of state paternalism. The most extensive category of social actions in which a migrant acts as a subject are crimes, mainly related to violation of the regime of stay in the Russian Federation. The most common actions committed against a migrant are inspections and raids, as well as various kinds of punishment. The subject of action against a migrant in regional government texts is not the Main Directorate for Migration Affairs of the Ministry of Internal Affairs of the Russian Federation, but the Main Directorate for Public Order Maintenance, the Prosecutor's Office of the Russian Federation, and the courts. The article proposes a hypothesis according to which law enforcement agencies use press releases simultaneously as a way to problematize migration and maintain public attention to it. Having monopolized the problem, the Ministry of Internal Affairs, the Prosecutor's Office, and the courts use it to repeatedly "sell" this issue to the public through the only tool available to them - symbolic and physical violence.
