The Principle of Context and the Principle of Compositionality only conflict when they are construed as claims about the origin of meanings. I will clarify this point by means of an historical survey into the treatment that PCtxt receives in Frege's Grundlagen and in Wittgenstein's Tractatus. I will argue that Frege actually introduces non-equivalent formulations of PCtxt generating an unstable notion of meaning when related with PCmp. The Tractatus solves this imbalance by assuming both the contextuality and (...) the compositionality at the very core of the notion of meaning, thus by ruling out the claim of two separated —sensitive to collision— principles. My thesis is that in the stage of development of the Tractatus, Wittgenstein found a way to meet and fit together the tensions between PCtxt and PCmp emerging in Frege´s philosophy of language and detected by latter commentators. The prioritisation of scarce resources has a particular urgency within the context of the COVID‐19 pandemic crisis. This paper sets out a hypothetical case of Patient X (who is a nurse) and Patient Y (who is a non‐health care worker). They are both in need of a ventilator due to COVID‐19 with the same clinical situation and expected outcomes. However, there is only one ventilator available. In addressing the question of who should get priority, the proposal is made that (...) the answer may lie in how the pandemic is metaphorically described using military terms. If nursing is understood to take place at the ‘frontline’ in the ‘battle’ against COVID‐19, a principle of military medical ethics—namely the principle of salvage—can offer guidance on how to prioritise access to a life‐saving resource in such a situation. This principle of salvage purports a moral direction to return wounded soldiers back to duty on the battlefield. Applying this principle to the hypothetical case, this paper proposes that Patient X (who is a nurse) should get priority of access to the ventilator so that he/she can return to the ‘frontline’ in the fight against COVID‐19. Given the purpose of revealing what is right it is no coincidence that God advises people to do their work in consultation,. Indeed, consultation has been practiced in the life of societies since ancient times. The Prophet, too, adopted to do business by consulting people who were experts in the issues (...) that did not receive revelation throughout his life, and he carried out many practices in this regard. Thus, he left a very important legacy for Muslims to reach a maturity that can stand on their own feet and to have the ability to shape their future in the following processes. It is essential for Muslims to take care of this legacy left to them, to prevent the political power from turning into tyrannical structures, to participate in and contribute to the decision-making mechanisms/administration. Doing business in consultation maintains its importance today as it was yesterday. Therefore, it is our main goal to reveal what kind of principle consultation is in terms of functionality. While doing this, attention was paid to include concept analysis, historical and factual reality, and the reflections of the principle to the present day in the content of the text. As a method, document analysis, one of the qualitative research methods, was preferred. As a result, it has been seen that the consultation has a very strong ground in the context of psychology and sociology. In this respect, it has been identified that the consultation, which seems to have a universal quality, has very positive effects on individual and especially social/political understanding. Whereas indirect euthanasia is a common clinical practice, active euthanasia remains forbidden in most countries. The reason for this differentiation is usually seen in the principle of double-effect (PDE). PDE states that there is a morally relevant difference between the intended consequences of an action and merely foreseen, unintended side-effects. This article discloses the fundamental assumptions presenting the basis for this application of the PDE and examines whether these assumptions are compatible with the PDE. It is shown that neither (...) a liberal nor a utilitarian point of view makes the utilization of the PDE possible. In accordance with philosophical tradition, only within the doctrine of the sanctity of life does the PDE seem to be applicable. By analysing the premises of this doctrine, and comparing them with those of the PDE, the inconsistency of this idea is demonstrated. It is suggested that the role of the PDE in the current discussion on euthanasia is largely exaggerated. (shrink)

The context of the work is the analysis of African values. The significance is the avoidance of generalizations. There are cultures in Africa and not just one culture and in each culture, there is a diversity of clans. The analysis of African values ought to have universal relevance, hence the use of phenomenological-hermeneutical method. This is the first analysis of such a value in the Igbo cultural group. It is at the same time a contribution to an important and (...) often neglected aspect of development: human development. The personality of the individual is a fundamental principle. Solidarity, philosophically formulated, can be a norm that regulates people's behavior. The personality of the individual is a fundamental principle. A person is identified with his dignity. This dignity is enriched and thus matures through his openness to others and positive contribution to the development of their personality. In order to show that our principle is not a mere abstract idealization, the second part of the work is a hermeneutical analysis of solidarity as found among the Igbo of Nigeria. In the science of administrative and constitutional law, administration science and many other sciences, including political science, it is widely accepted that the basic, inherent feature of a municipality, deciding the essence of the territorial self-government unit as an entity of public administration, is the self-reliance it is entitled to. The self-reliance of territorial self-government units is even defined as a constitutional norm.In principle, self-reliance is perceived as a fundamental attribute of a decentralised public authority and constitutes one of (...) the fundamental systemic principles of the Republic of Poland. It was formulated expressis verbis in art. 165 par. 2 of the Constitution of the Republic of Poland, which states that the self-reliance of territorial self-government units is subject to judicial protection, meaning that TSGUs can defend themselves against illegal attempts, not grounded in the law to interfere in their self-reliance. This protection seems to encompass both the private-law and public-law spheres of territorial self-government activity.The essence and guarantees of territorial self-government units’ self-reliance also arise from other constitutional principles, including the aforementioned decentralisation principle, subsidiarity principle, separation of powers, supremacy of the nation and democratic state under rule of law.The goal of this article is to interpret the principle of municipal self-reliance in the context of constitutional principles of law, in the light of the Polish Constitution. The precautionary principle is frequently referred to in various momentous decisions affecting human health and the environment. It has been invoked in contexts as diverse as chemicals regulation, regulation of genetically modified organisms, and research into life-extending therapies. Precaution is not an unknown concept in medical contexts. One author even cites the Hippocratic Oath as a parallel to the precautionary principle.

The article discusses how the meaning of the principle of “non-resistance to evil by violence” was changing in L.N. Tolstoy's religious and philosophical teachings and how this principle was evaluated in Russian religious philosophy of the late XIX - early XX century. In the first version of Tolstoy’s teachings, set forth in the book “What is my faith?”, the principle of non-resistance was understood in a moral sense, as the norm for all people; its execution should lead (...) to the perfection of earthly life. This idea of L. Tolstoy was sharply criticised by his contemporaries, who noted that there was no truly religious content in Tolstoy’s teachings, it was turning into a utilitarian doctrine of the earthly progress of mankind. Given this criticism, Tolstoy in his later works changed his understanding of the principle of non-resistance. Drawing a distinction between two levels of human life - “animal” and divine, Tolstoy recognised the principle of non-resistance to the law as the divine life of a man. As a result, the principle of non-resistance has acquired a religious rather than moral meaning, since the transition of a man to a divine life means a mystical transformation of his being. He is aware of his super-spatial and super-temporary unity with all people and with all being, and therefore can evaluate the consequences of his actions not only in the limited sphere of his life, but also in all infinite being. In this regard, a person realizes the absolute superiority of good deeds over evil, even if the latter are committed to confront evil. It is shown that some critics of Tolstoy came to a similar understanding of the religious meaning of the principle of non-resistance at the end of their lives. (shrink)

In this article we critically examine the principle of equivalence of care in prison medicine. First, we provide an overview of how the principle of equivalence is utilized in various national and international guidelines on health care provision to prisoners. Second, we outline some of the problems associated with its applications, and argue that the principle of equivalence should go beyond equivalence to access and include equivalence of outcomes. However, because of the particular context of the (...) prison environment, third, we contend that the concept of “health” in equivalence of health outcomes needs conceptual clarity; otherwise, it fails to provide a threshold for healthy states among inmates. We accomplish this by examining common understandings of the concepts of health and disease. We conclude our article by showing why the conceptualization of diseases as clinical problems provides a helpful approach in the delivery of health care in prison. (shrink)

The principle of proportionality is used in many different contexts. Some of these uses and contexts are first briefly indicated. This paper focusses on the use of this principle as a moral principle. I argue that under certain conditions the principle of proportionality is helpful as a guide in decision-making. But it needs to be clarified and to be used with some flexibility as a context-dependent principle. Several interpretations of the principle are distinguished, (...) using three conditions as a starting point: importance of objective, relevance of means, and most favourable option. The principle is then tested against an example, which suggests that a fourth condition, focusing on non-excessiveness, needs to be added. I will distinguish between three main interpretations of the principle, some primarily with uses in research ethics, others with uses in other areas of bioethics, for instance in comparisons of therapeutic means and ends. The relations between the principle of proportionality and the precautionary principle are explored in the following section. It is concluded that the principles are different and may even clash. In the next section the principle of proportionality is applied to some medical examples drawn from research ethics and bioethics. In concluding, the status of the principle of proportionality as a moral principle is discussed. What has been achieved so far and what remains to be done is finally summarized. (shrink)

D’Arcy Thompson’sOn Growth and Formis one of the key works at the intersection of science and the imagination. This introductory essay explores the book and its context, drawing on archival sources to provide a unique perspective. It looks at Thompson’s own life and career, his experiences at University College, Dundee, and how he came to write the book. It describes the contents of the 1917 first edition (as many today are familiar only with the 1961 abridgement of the 1942 (...) second edition). It looks at the book’s initial reception, exploring the context of biological ideas of the time, particularly in regard to Thompson’s perceived opposition to Darwinian theory and the debate between vitalism and mechanism. It explores the early influence of the book on ecologists and systems theorists and other early attempts at mathematical biology, as well as its significant influence on artists and architects. It then describes the development of the second edition of the book and the subsequent increase of interest in his work from both artists and scientists. It concludes by summarizing recent initiatives in the D’Arcy Thompson Zoology Museum. (shrink)

_Purpose._ The authors of this paper seek to comprehend, on the basis of ethics of discourse and communicative philosophy, the dimensions of human existence in times of war. This involves solving the following research tasks: to show the importance of moral and ethical norms in the structure of human existence and to emphasize the need for their observance by a person in the realities of war; to find out what the role of responsibility and co-responsibility is in preserving the space (...) of human existence in times of war; to explore the influence of discourse on the establishment of rational and social dimensions of human existence, formation of communicative space of understanding. _Theoretical basis._ The ideas of communicative philosophy and principles of discourse ethics, focused on the problems of substantiating ethical norms and values in their relationship with the human life world, and its activities are underlying the research. The analysis of human existence in times of war was carried out considering the theoretical and methodological foundations of philosophical anthropology. _Originality._ It is substantiated that the recognition of the universality of moral norms and values, and the productive power of communication contribute to deepening the understanding of the complexity and versatility of human existence in times of war. It has been determined that human existence’s rational and moral dimensions acquire particular significance in the context of russian aggression against Ukraine. The role of discourse was defined for affirming the humanistic foundations of human existence, in achieving cohesion, interaction, social solidarity, which is a condition for human development as a collective and unique being. It is noted that in war conditions the value of individual forms of human existence is complemented by the obligatory responsibility and co-responsibility for a person, awareness of the significance of coexistence in a situation where there is a threat to human life. _Conclusions._ The study of human existence involves the use of the methodological potential of discourse ethics, the significance of the ideas of which is increasing in the modern world because of the dangers caused by russian aggression against Ukraine. The recognition of the power of universal moral norms and the productive power of communication results in the affirmation of the humanistic foundations of human existence, the formation of the communicative space of understanding and consent necessary for a person. In times of war, the need for communicative rationalization of human existence, awareness of the value of morality and human humanity becomes obvious. (shrink)

Explicit, quantitative procedures for identifying biodiversity priority areas are replacing the often ad hoc procedures used in the past to design networks of reserves to conserve biodiversity. This change facilitates more informed choices by policy makers, and thereby makes possible greater satisfaction of conservation goals with increased efficiency. A key feature of these procedures is the use of the principle of complementarity, which ensures that areas chosen for inclusion in a reserve network complement those already selected. This paper sketches (...) the historical development of the principle of complementarity and its applications in practical policy decisions. In the first section a brief account is given of the circumstances out of which concerns for more explicit systematic methods for the assessment of the conservation value of different areas arose. The second section details the emergence of the principle of complementarity in four independent contexts. The third section consists of case studies of the use of the principle of complementarity to make practical policy decisions in Australasia, Africa, and America. In the last section, an assessment is made of the extent to which the principle of complementarity transformed the practice of conservation biology by introducing new standards of rigor and explicitness. We offer a review of some of the most influential views on the status of Reichenbach’s Principle of the Common Cause (PCC) for genuinely indeterministic systems. We first argue that the PCC is properly a conjunction of two distinct claims, one metaphysical and another methodological. Both claims can and have been contested in the literature, but here we simply assume that the metaphysical claim is correct, in order to focus our analysis on the status of the methodological claim. We (...) briefly review the most entrenched or classical positions, including Salmon’s ‘interactive forks’, van Fraassen’s scepticism, and Cartwright’s generalisation of the fork criterion. We then go on to review the results of the ‘Budapest school’ on the existence of formally defined screening-off events for any correlation —by means of the ideas of probability space extensibility and (Reichenbachian common cause) completability. We distinguish the Budapest doctrine clearly from any of the classical conceptions, and thus present an overall framework for discussions of causal inference in quantum mechanics. The framework, however preliminary, is essential work for a thorough assessment of the conditions under which PCC may be a reliable tool for causal inference in a genuinely probabilistic (indeterministic) context. Public health ethics is a subfield of bioethics that focuses on population health. This study aims to conform the principles of biomedical ethics to Islamic values in the context of public health. It culturally helps to optimize health care delivery. The approach is based on the method of immanent critique. The principle of the common good in Islam has a rational justification to draw public interests and ward off harms. The rule of “no harm”, with an emphasis on (...) the preferability of preventing harm to increase benefits, is consistent with the principle of utility, intending to produce a maximum balance of benefit over harm in the context of public health. Thus, on the one hand, the government is obliged to prevent harm and improve public benefits and, on the other hand, as a steward of health and with reference to the article “limitation of the ownership dominance”, it has the right to protect public health with the least justifiable harm. Islam attention to human dignity, individual justice and good will in the rule of goodness implies that Islam, beyond distributive justice, knows that human flourishing and the cultivation of moral virtues are a requisite for the realization of social justice. The present study discusses about the adjustment of the principles of PHE to the principles of the Islamic jurisprudence and, at the same time, it explains why the optimal PH in Muslim societies requires research in order to define accurate indicators of benefit and harm based on the teachings of revelation and reason. Pauline Kleingeld has argued persuasively that Kant’s Principle of Autonomy draws an analogy between two relationships: 1) that between an individual agent and their maxim, and 2) that between a legislator and their legislation. She also suggests that Kant’s evolving views on the normative significance of popular elections made his analogy inapt, which explains its disappearance from his later writings. This comment concurs with Sorin Baiasu that the merits of Kant’s analogy were untouched by his evolving political views. The (...) analogy presupposes that when lawmakers legislate, they do so as representatives of the people, but even Kant’s mature writings posit that unelected lawmakers are representatives of the people in the necessary sense. Facts about whether a lawmaker acquired legislative authority by election, heredity, or conquest do have normative implications in the larger context of Kant’s political theory, but such facts are necessarily temporally upstream of the relation between legislator and legislation, just as facts about how an agent became rational are upstream of the relation between individual agent and maxim. Because the analogy focuses exclusively on these two relationships, it cannot be damaged by such upstream facts. Moreover, we should consider the possibility that Kant’s Principle of Autonomy compares a human will to the united general will of the people itself rather than to the will of a fallible public official or institution. On this alternative reading, it is even more clear that Kant’s evolving views on the significance of elections could have no possible relevance to the Principle of Autonomy. (shrink)

The principle of excluded middle is more important than is commonly believed for understanding Kant's overall philosophical project. In the article, this principle is examined in the following contexts: kinds of judgments, concepts of opposition, negation, and determination, and apagogic proof. It is first explained how the principle of excluded middle is employed by Kant in distinguishing between the kinds of judgment. Also called the principle of division, it is the principle of disjunctive and apodictic (...) judgments in Kant's famous table of judgments. Next, the Author shows which kind of opposition is related to the principle of the excluded middle. As a merely logical criterion of truth, this principle grounds the logical necessity of a cognition and plays an important role in the use of apagogical proofs. Then Kant's account of logical negation will be investigated briefly. Negative judgment with a negative copula indicates that something is not contained within the sphere of a given concept. This process occurs in accordance with the principle of excluded middle. Finally, an analysis is made of how Kant presents the metaphysical principle of thoroughgoing determination and its differences from the logical principle of excluded middle. (shrink)

The paper starts with a case study of a medium-sized company in which a strong and successful change in the organisational form and job design took place. A bureaucratic organisation with highly-specialised jobs was converted into a new organisation in which employees became much more autonomous in managing their own work. This not only entailed new techniques and managerial systems but also a new anthropological vision. Bureaucratic rules were reduced, but not eliminated completely, and management became less authoritarian. Employees could (...) therefore apply greater entrepreneurial spirit, developing their talents in pursuit of the company’s common goals. It is argued that this new organisational form is ethically superior to the old, and reflects the basic requirements of the principle of subsidiarity. The ethical principle of subsidiarity holds that a larger and higher-ranking body should not exercise functions which could be efficiently carried out by a smaller and lesser body; rather the former should support the latter by aiding it in the coordination of its activities with those of the greater community. While the principle has usually been applied in a political context, this paper explores the principle as a moral base for organisational forms within business organisations. Finally, the principle of subsidiarity is analysed in the context of business organisations and proposed as an ethical guideline for organisational forms. This would help to mitigate the effects of those bureaucracies in which individuals, with their dignity, freedom, diversity and capacity for undertaking business activities with entrepreneurial spirit, are often not fully appreciated. We presented a contextual statistical model of the probabilistic description of physical reality. Here contexts (complexes of physical conditions) are considered as basic elements of reality. There is discussed the relation with QM. We propose a realistic analogue of Bohr’s principle of complementarity. In the opposite to the Bohr’s principle, our principle has no direct relation with mutual exclusivity for observables. To distinguish our principle from the Bohr’s principle and to give better characterization, we change (...) the terminology and speak about supplementarity, instead of complementarity. Supplementarity is based on the interference of probabilities. It has quantitative expression trough a coefficient which can be easily calculated from experimental statistical data. We need not appeal to the Hilbert space formalism and noncommutativity of operators representing observables. Moreover, in our model there exists pairs of supplementary observables which cannot be represented in the complex Hilbert space. There are discussed applications of the principle of supplementarity outside quantum physics. (shrink)

This book, originally entitled _Why Men Fight_, is generally seen as the fullest expression of Russell's political philosophy. Russell argues that after the experience of the Great War the individualistic approach of traditional liberalism has reached its limits. Political theory must be based on the motivated forces of creativity and impulse rather than on competition. Both are best fostered in the family, in education, and in religion - each of which Russell proceeds to discuss. The ideas expressed in _Principles of (...) Social Reconstruction_ have greatly contributed to Russell's fame as a social critic and anti-war activist. The new introduction by Richard Rempel locates them in the context of Russell's other writings and show that neither his ideas nor his language have lost their force and topicality over the years. I first identify two distinct versions of this approach, and then consider the extent to which the principles of asymptotic safety, relative locality, and holography are supported by these versions. Bradley, who was influenced by Hegel and also reacted against utilitarianism, was recognised during his lifetime as one of the greatest intellectuals of his generation, and was the first philosopher to receive the Order of Merit, in 1924. In this major work, originally published in 1883, Bradley (...) discusses the basic principles of logic: judgment and inference. He rejects the idea of a separation between mind and body, arguing that human thought cannot be separated from its worldly context. In the second edition, published in 1922 and reissued here, Bradley added a commentary and essays, but left the text largely unaltered. Volume 1 contains Book 1 on judgment and Book 2 on inference. This article aims to expound the principle of justice, as a fundamental value and as an immanent category of law, as well as one of the fundamental human rights, prescribed and guaranteed by a myriad of international instruments and documents. After a brief historical account, by focusing on Article 40 of the Magna Carta Libertatum, which states that: “To No One Will we Sell, To No One Will we refuse or delay, right or justice”, this article claims to show (...) the importance of incorporation of this principle in the provisions of the Magna Carta and its impact on the development of theory and legislation in the past and present. Moreover, the article intends to explore the extent of influence that the priciple of justice has on the functioning of the law in general. Since justice implicates the permanent and constant will to render each person his due, and this achieved through equality, it results that justice means being equal. In this context, the article will explore the concept of equality as a precondition of justice, as well as the conditions and modalities for its implementation. Having in mind that the principle of justice is closely linked to the principle of equity, because equity precedes justice, or more precisely, equity is considered a source of justice, this article seeks to articulate the essential distinctions between these two concepts by focusing on their methods, i.e. in their approach for putting the idea of equality into action. _The purpose_ of the article is to clarify the philosophical principle of the local in the context of modern political governance. _The theoretical basis_ of the research embraces scenario analysis, dialectical and existential approaches, as well as philosophical anthropology and philosophy of communication. Local communities are a specific reflection of the connection between a person and a place. The specifics of the formation of a special mode of being, which forms and reproduces relations of loyalty, mutual understanding, and (...) a common feeling in the locus, are established. _Originality._ The article for the first time focuses on the anthropological content of local existence, which is the matrix of civil culture and the prospects of its integration into the global cultural space. _Conclusions._ Local identity as an object of purposeful formation in the conditions of nation-building requires considering the philosophical provisions that were introduced in the anthropological discourse. At the current stage, Ukrainian civil culture strives to invent specific local meanings of political identity in the conditions of external aggression. Its main components will be consensus, mutual respect, integrity, and the will to unite in order to protect statehood. Interdisciplinary meanings of locality form subject-object relations within which modern political management should be carried out. Taking into account the ethnic, cultural, and socio-functional, and role aspects of locality promises to ensure effective decision-making and increase the well-being of modern local communities. The political context of locality is formed based on the interaction of local political actors and institutions. Their examination within the framework of the case studies approach allows for empirically substantiating the local priorities of political actions. It also indicates the specific functionality of local political and administrative structures. at the local level, the discussed source of locality is the question of the origin or authenticity of the local population. For political governance, this is one of the meaningful contexts for justifying local autonomy or even sovereignty. (shrink)

Developing and implementing artificial intelligence (AI) systems in an ethical manner faces several challenges specific to the kind of technology at hand, including ensuring that decision-making systems making use of machine learning are just, fair, and intelligible, and are aligned with our human values. Given that values vary across cultures, an additional ethical challenge is to ensure that these AI systems are not developed according to some unquestioned but questionable assumption of universal norms but are in fact compatible with the (...) societies in which they operate. This is particularly pertinent for AI research and implementation across Africa, a ground where AI systems are and will be used but also a place with a history of imposition of outside values. In this paper, we thus critically examine one proposal for ensuring that decision-making systems are just, fair, and intelligible—that we adopt a principle of explicability to generate specific recommendations—to assess whether the principle should be adopted in an African research context. We argue that a principle of explicability not only can contribute to responsible and thoughtful development of AI that is sensitive to African interests and values, but can also advance tackling some of the computational challenges in machine learning research. In this way, the motivation for ensuring that a machine learning-based system is just, fair, and intelligible is not only to meet ethical requirements, but also to make effective progress in the field itself. The subject of this article is Leibnizian interpretation of the principle of reason. Although the German philosopher called it principium grande of his philosophy, we do not find its systematic exposition in Leibniz’s works. The main aim of my paper is to present a short exposition of the principle. The article consists of three parts: in the first I present systematic exposition of the principle of reason with particular emphasis on explication of terms “principle” and “reason,” (...) in the second, I show the origins of the principle, finally, in the third part, I discuss in detail three forms of it: the principle of sufficient reason, the principle of determining reason and the principle of rendering reason. I accept two main theses: firstly, a proper interpretation of this principle requires taking into account the whole context of Leibnizian philosophy, i.e. one cannot limit oneself (as it is usually happens among researchers) to only one discipline, e.g. logic. Secondly, the ultimate methodological and heuristical foundation of the principle of reason is Leibnizian metaphysics, especially natural theology. (shrink)

The standpoint of this article is, first and foremost, a historical one, giving an introductory outline of a general theory of thrift. More specifically, it aims at comparing the principle (or: principles) of economy of thought and the principle of “natural economy” to coin a short term.By way of a prologue, a historical and interpretative summary of events shows the consequences of a cultural fact which hallmarks the 14th century and, in itself, restores the first frank expression of (...) a principle of thrift, at once theoretical and practical, to its essential context, thus countering the in flation of abstract entities. Nevertheless, it would not appear, three centuries later, that the nosology of the Diafoirus, at which Moliere poked so much fun, had already adopted this precious standard for itself. (shrink)

Respect for autonomy is well known as a core element of normative views on good care. Most often it is interpreted in a liberal way, with a focus on independence and self-determination. In this article we argue that this interpretation is too narrow in the context of care in nursing homes. With the aim of developing an alternative view on respect for autonomy in this setting we described four interpretations and investigated the moral intuitions (i.e. moral judgements) of caregivers (...) regarding these approaches. We found that these caregivers seemed to value different notions relating to respect for autonomy under different circumstances. There was no significant difference in moral judgements between men and women or between doctors and nurses. We conclude that a multidimensional understanding of this principle would best fit this context. We end this article with a description of a modest theory of respect for autonomy in nursing homes. The concern of this essay is to reveal the way in which an architecture of Humean and Cartesian thought, taken for granted by both analytical and critical approaches to legal theory, has stood in the way of demonstrating that facts can be justifications of judicial decisions without recourse to an additional layer of moral or political justification. The inability to demonstrate the normativity of legal facts or state affairs has been the single most serious defect in traditions of pragmatic thought (...) about law (e.g. in legal realism and its contemporary descendants such as critical legal studies, feminist and critical race theory, socio-legal studies etc.). The analysis in this essay provides an argument for abandoning many taken for granted oppositions which inhibit pragmatic and realist approaches to law. These include the stark oppositions between: hermeneutic and causal explanation in law; reasons for decisions and reasons why decisions were reached; normative factors and pure fact etc. The author's chief concern is to demonstrate the possibility of uniting the logic of judicial reasoning with the logic of factual context, and to demonstrate that justification in law is not to be identified with the justification of ethical propositions. Distribution of responsibility is one of the main focus areas in discussions about climate change ethics. Most of these discussions deal with the distribution of responsibility for climate change mitigation at the international level. The aim of this paper is to investigate if and how these principles can be used to inform the search for a fair distribution of responsibility for climate change adaptation on the local level. We found that the most influential distribution principles on the international level were (...) in turn built on one or more of seven basic principles: (P1) equal shares, (P2) desert, (P3) beneficiary pays, (P4) ability, (P5) self-help, (P6) limited responsibility for the worst off, and (P7) status quo preservation. It was found that all the basic principles, but P1, P3, and P7, are to some extent translatable to local climate adaptation. Two major problems hamper their usefulness on the local level: (1) several categories of agents need to take on responsibility; and (2) emissions do not work as a base for all principles. P4, P5, and P6 are applicable to local adaptation without changes. P4 is of particular importance as it seems to solve the first problem. P2 is applicable only if the second problem is solved, which can be achieved by using risk of harm instead of emissions as the basis for desert. (shrink)

One of the still unsolved problems in liberal anarchism is a definition of social constituency in positive terms. Partially, this had been solved by the advancements of liberal discourse ethics. These approaches, built on praxeology as a universal framework for social formation, are detached from the need of any previous or external authority or rule for the discursive partners. However, the relationship between action, personal identity, and liberty within the process of a community becoming solely generated from the praxeological a (...) priori remains largely disputed. In order to develop a testable constitutional model, this study revises how the “ontological turn” was introduced into liberal theories and redefines the concept of liberty. Liberty is usually understood as a moral goal or measurement for just actions, as the generative principle of all social existence - individual and interpersonal. For this purpose, the function of performative contradiction within the mechanism of interpersonal “encounter”, as part of the co-generative process of the individual becoming and social formation was explored through the production of a game-based narrative historiography grounded on 19th century life writings. This narrative historiography was developed in the context of Swiss history, with a “design-based” research approach, and resulted in a prototype for networked storytelling through which the transformative learning process could be visible and the negotiation of competing individual visions of the future could be re-enacted. In Germany, Otfried Höffe has been a leading contributor to debates in moral, legal, political, and social philosophy for close to three decades. Höffe's work, brings into relief the relevance of these German discussions to their counterparts in English-language circles. In this book, originally published in Germany in 1990 and expanded since, Höffe proposes an extended and original interpretation of Kant‚ philosophy of law, and social morality. Höffe articulates his reading of Kant in the context of an account of (...) modernity as a "polyphonous project," in which the dominant themes of pluralism and empiricism are countered by the theme of categorically binding moral principles, such as human rights. Paying equal attention to the nuances of Kant's texts and the character of the philosophical issues in their own right, Höffe ends up with a Kantianism that requires, rather than precludes, a moral anthropology and that questions the fashionable juxtaposition of Kant and Aristotle as exemplars of incompatible approaches to ethical and political thought. In spite of its dominance, there are well-known problems with Rawls’s method of reflective equilibrium (MRE), as a method of justification in meta-ethics. One issue in particular has preoccupied commentators, namely, the capacity of this method to provide a convincing account of the objectivity of our moral beliefs. Call this the Lack-of-Objectivity Charge. One aim of this article is to examine the charge within the context of Rawls’s later philosophy, and I claim that the lack-of-objectivity charge remains unanswered. A (...) second aim of this article is to examine the extent to which, despite Rawls’s express intention to avoid reliance on Kant’s moral philosophy, supplementing Rawls’s political constructivism with some Kantian elements, in particular Kant’s idea of a universal principle of right, not only addresses some of the issues raised by the lack-of-objectivity charge, but also does so without compromising the ability of the Rawlsian account to accommodate the pluralism of conceptions of the good, which he takes to be a fact of modern democracies. I argue for a revised justificatory methodology, which combines Rawls’s MRE and Kant’s Critical Method. (shrink)

This important volume looks back to 1890 and -- 100 years later -- asks some of the same questions William James was asking in his Principles of Psychology. In so doing, it reviews our progress toward their solutions. Among the contemporary concerns of 1990 that the editors consider are: the nature of the self and the will, conscious experience, associationism, the basic acts of cognition, and the nature of perception. Their findings: Although the developments in each of these areas during (...) the last 100 years have been monumental, James' views as presented in the Principles still remain viable and provocative. To provide a context for understanding James, some chapters are devoted primarily to recent scholarship about James himself -- focusing on the time the Principles was written, relevant intellectual influences, and considerations of his understanding of this "new" science of psychology. The balance of this volume is devoted to specific topics of particular interest to James. One critical theme woven into almost every chapter is the tension between the role of experience (or phenomenological data) within a scientific psychology, and the viability of a materialistic (or biologically reductive) account of mental life. The aim of this work is to analyse the diffrerences between the formal structure of anticipation of perception in classical and in quantum context. I argue that a transcendental point of view can be supported in quantum context if objectivity is defined by an invariant anticipative structure, which has only a predictive character. The classical objectivity, which defined a set of properties having a descriptive meaning must be abandoned in quantum context. I will focus my analysis on (...) The paper delves into the methodological aspects of how foundational mathematical and physical tenets, most notably the principle of least action, are interpreted and assimilated within humanities discourse. The pursuit of the article’s objectives is driven by the necessity for a philosophical and methodological analysis of the current conceptual status of the principle of least action. This analysis is informed by cognitive-axiological and teleological imperatives of a “synthetic” development program for the principle. Any fundamental principle will (...) not have a definitive explanation, as otherwise it would not be fundamental, but in this case, some justification can be given based on deeper grounds discussed in the article. Drawing on the epistemological frameworks of French philosophers P. Hadot, E. Levinas, J. Bouveresse, and J.-T. Desanti, the article weaves together mathematical abstractions with human experience and philosophical doctrines with physical theories. J.-T. Desanti’s perspective on mathematical objects as an outcome of human activity is examined. Also scrutinized is B. Nicolescu’s concept of transdisciplinarity, which challenges the traditional subject-object dualism in science. The author’s methodological stance emerges from a dialectical viewpoint, one that eschews a simplistic dichotomy between materialism and idealism and is grounded in rigorous scientific inquiry and an exhaustive examination of the subject matter itself. The principle of least action, as a paramount principle in physics, is shown to exemplify a legacy of innovation, positioning it as both methodologically insightful and heuristically valuable. The paper also highlights how this principle diverges from the classical principle of economy. The broader goal – within the context of “sustainable development,” transdisciplinary studies, and creative industries – is to establish the principle of least action as a paradigmatic imperative for interaction within social and economic systems. The conclusions drawn from this study contribute to a deeper understanding of the principle’s essence, the nature of transdisciplinarity, and confront the vestiges of scientism in the humanities. Epistemic injustice is injustice to a person qua knower. In one form of this phenomenon a speaker’s testimony is denied credence in a way that wrongs them. I argue that the received definition of this testimonial injustice relies too heavily on epistemic criteria that cannot explain why the moral concept of injustice should be invoked. I give an account of the nature of the wrong of epistemic injustice that has it depend not on the accuracy of judgments that are used (...) or made in the process of deciding whether to listen to or trust a speaker, but on whether the basis of the decision about a speaker is their reliability or their identity, and the account explains why the latter is a moral wrong. A key difference between the two accounts is how they classify the use of true statistical generalizations connecting identity and reliability. The received view implies that this cannot be an injustice, while the view proposed here implies that it can. As such the new view appears to imply a conflict between moral and epistemic obligations: it is morally wrong to use true statistical generalizations in certain contexts, yet they are part of our evidence, and we are epistemically obligated to take all of our evidence into account. I reconcile these two thoughts without adopting the currently popular view that a belief’s being morally wrong makes it epistemically unjustified, and I argue that following the principle of total evidence encourages epistemic justice rather than thwarting it. The text examines the article 11 of the Universal Declaration on Bioethics and Human Rights of UNESCO that deals with the principle of non-discrimination and non-stigmatization. Both concepts are related to the theme of human dignity, while discrimination is an inherent part of stigma: stigma does not exist if there is no discrimination. In this context, this paper aims to study the relationship between stigma, discrimination and HIV / AIDS. The study argues that to loosen the bonds that (...) hold the subjects that are attached to them is necessary questioning the broader forces - social, cultural, political and economic - that structure stigma, stigmatization and discrimination as social processes directly linked to production and reproduction of structural inequalities. One of the goals of medicine is to improve well-being, in line with the principle of beneficence. Likewise, scientists claim that the goal of human embryonic stem cell research is to find treatments for diseases. In hESC research, stem cells are harvested from a 5-day-old embryo. Surplus embryos from infertility treatments or embryos created for the sole purpose of harvesting stem cells are used in the research, and in the process the embryos get destroyed. The use of human embryos (...) for research purpose raises ethical concern. In this context, the religious leaders play the role to be the moral compass and “reality check” to engage with the public. In Malaysia, the Ministry of Health has outlined the Guidelines for Stem Cell Research and Therapy, reflecting on Islamic principles. Since there has not been much focus on the viewpoints of other faiths in Malaysia, this study attempts to explore the ethical guiding principles deliberated by religious leaders from the Buddhist, Hindu and Catholic traditions and identify if there is a common ground between the mainstream religious views and principles of medical ethics, in relation to hESC research. Eleven religious leaders representing the Buddhist, Hindu and Catholic traditions were interviewed. Interestingly, though reasoning of religious leaders came from different angles, their underlying concerns revolve around the values of “do no harm” and “intention to save lives”. These values are also the key principles in medical ethics. The findings are applied to answer the question as to whether religious and medical guiding principles can co-exist and complement in ethical decision-making, without compromising the values. (shrink)
