Brand names constitute a form of value for commercial products, because they suppose a savings of search costs for the consumer. The law, as a consequence, has the obligation to protect brand names. But the number of attractive brand names is not infinite and sometimes companies seek brand names which are reminiscent of others. In this article a conflict between two companies for the distinctiveness of two brand names is addressed: one Spanish company used the English common noun doughnut for (...) a product similar to the American pastry, while the other company had already registered donut as a brand name, in addition to its variants. This second company sued the first on the grounds that the names were not distinctive. Here we offer the arguments presented to the judge in defense of the distinctiveness of doughnut and the judgment. (shrink)

In an analysis of three college lectures, Corts and Pollio found that figurative language and gesture often appeared together in ‘bursts’. These bursts were initially characterized as novel figurative expression that centered on the primary topic of the lecture. The current study is an attempt to provide clearer description of how and why figurative language and gesture so often appear together in academic discourse. In addition, this study extends earlier findings to additional speakers and academic disciplines to improve generalizability. In (...) accordance with Corts and Pollio, the bursts of figurative activity are predominately novel rather than cliched, coherent with a root metaphor, and centered around the main topics of the lecture. The present study adds that figures within bursts largely include analogies and metaphor that represent a concept whereas topical figures outside of bursts are descriptive phrases that often include other types of figures such as hyperbole, litote, etc. The regularity of such bursts suggests that they serve an important cognitive function independent of personal style of the lecturer or any demands of a particular academic field. Se busca una aproximación a la religiosidad juvenil en el marco de situaciones socio-culturales más estables. La secularización implica una pérdida del monopolio religioso por parte de la Iglesia y serias dificultades para la socialización religiosa de las generaciones jóvenes. Los estudios muestran un núcleo (que disminuye en cantidad) de catolicismo practicante y una tendencia hacia la des-institucionalización en amplios grupos: formas privadas de de-construcción y reconstrucción de lo religioso (a-eclesialidad) o la simple indiferencia ante todo planteamiento religioso (a-religiosidad). Asimismo (...) es posible detectar una cierta «búsqueda de iniciación» extramuros de la institución, y también en formas sociales de marginalidad. En un horizonte de futuro habría que contar con cambios de largo alcance en la sociedad europea (des-clericalización de la Iglesia) y mundial (globalización y defensa de los derechos humanos por parte de las religiones). Human Resources Practices and unions coexist in some organisations to manage the employment relationships of the workers. In this study, we analyse how the presence/absence of unions and HRPs are combined in private European organisations, and which of these combinations are related to higher levels of wellbeing and the quality of labor relations. Data come from 24,503 workers of private organisations, obtained from the Sixth European Working Conditions Survey. Latent profiles analysis and different analyses of the variance suggested four different (...) profiles. The profile with the greatest presence of HRPs and union presence is related to the highest levels of employees' wellbeing and quality of labor relations in organisations, whereas those organisations with a low level of union presence or HRPs reached the worst levels in employees' wellbeing and quality of labor relations indicators. The amount of information that is produced on a daily basis in the financial markets is vast and complex; consequently, the development of systems that simplify decision-making is an essential endeavor. In this article, several intelligent systems are proposed and tested to predict the closing price of the IBEX 35 index using more than ten years of historical data and five distinct architectures for neural networks. A multi-layer perceptron was the first step, followed by a simple recurrent neural network, a (...) gated recurrent unit network and two long-short-term memory (LSTM) networks. The results of the analyses performed on these models have demonstrated a powerful capacity for prediction. Additionally, the findings of this research point to the fact that the application of intelligent systems can simplify the decision-making process in financial markets, which is a substantial advantage. Furthermore, by comparing the predicted outcome errors between the models, the LSTM presents the lowest error with a higher computational time in the training phase. The LSTM was able to accurately forecast the closing price of the day as well as the price for the following one and two days in advance. In conclusion, the empirical results demonstrated that these models could accurately predict financial data for trading purposes and that the application of intelligent systems, such as the LSTM network, represents a promising advancement in financial technology. El presente ensayo tiene como meta rescatar, por medio de cuatro secciones, algunos de los problemas teóricos y prácticos que se dan en el campo de la Biología. En una primera parte y a modo de introducción, analizamos la vigencia científica del espíritu de Darwin a través de los trabajos de etología que han sido llevados a cabo durante este siglo. A continuación, hacemos una incursión histórica, creemos que a todas luces necesaria, con el fin de examinar los errores y (...) los logros pre y postdarvinistas obtenidos en la Biología y de este modo, en un tercer apartado, situar la aparición de la Sociobiología y entender sus implicaciones epistemológicas. En el ínterin ha sido necesario hablar de cuestiones tales como género, sexualidad, procreación... RESUMEN En este documento se presenta la traducción al español de la obra de teatro A lover of animals, escrita hace 120 años por Henry Stephens Salt, intelectual inglés activista por el trato justo hacia los humanos y los animales. Se introducen elementos que permiten al lector acercarse a la discusión planteada en la obra y se enfatiza en el personaje Claud Kersterman, médico y vivisector que expone una serie de ideas sobre la medicina, la ciencia y el valor de (...) los animales que se pueden apreciar en la actualidad. Finalmente, se resalta el valor que la literatura teatral puede tener para analizar discusiones como las que suscita el trato hacia los animales en contextos generales o particulares como el de la vivisección. ABSTRACT This document presents the Spanish translation of the play A lover of animals, written 120 years ago by Henry Stephens Salt, an English intellectual activist in favor of humans and animals being treated fairly. Elements are introduced which allow the reader to understand the discussion which is set out in the play. Emphasis is placed on the character of Claud Kersterman, a doctor and vivisector who states a series of ideas on medicine, science and the importance of animals, which can be appreciated nowadays. Finally, it is highlighted the significance that theatre literature can have to analyze discussions such as the ones given rise to by the way animals are treated in general or specific contexts such as vivisection. Is brain structure related to function? Can one predict the other? These are questions that are still waiting to be answered definitively. In this paper we seek to investigate these questions, in particular, we are interested in the relation between brain structure and theory of mind. ToM is defined as the ability to attribute mental states to others. Previous studies have observed correlations between performance on ToM tasks, and gray-matter size/volume in dorsomedial prefrontal cortex, temporoparietal junction and precuneus. Despite these (...) findings, there are concerns about false positive results and replicability issues. In this study we used two different tasks to evaluate ToM, Reading the Mind in the Eyes Test, and the Short Story Task. Performance in these tasks was correlated to brain anatomy measures including voxel-based morphometry and cortical thickness analysis, from ninety-one neurotypical participants. High-resolution structural brain images were acquired, and whole-brain and region of interest analyses were implemented. The analyses did not show statistically significant associations between ToM performance and brain structural measures after correction. Significant associations between performance on ToM tests and a widespread array of regions loosely associated with ToM were observed only for whole brain uncorrected analysis. These results do not replicate a previous study with neurotypical participants. We tested two different ToM tests, two different softwares for VBM and CT, and we used two samples, one with 91 and a sub-sample with 69 participants. Neither of these conditions made a difference in the results obtained. Consequently, these results suggest that if the population is neurotypical and homogenous, it is unlikely that a reliable association between brain anatomy measures and ToM performance, as measured with these tasks, may be found. El objetivo de este trabajo es dar una mirada a la manera en que Roig opera en los ámbitos categoriales. Nuestro propósito es observar cómo el autor critica, confecciona, articula, utiliza, crea y entrelaza categorías, es decir, hemos querido hacer un alto en los procedimientos estructurales de su filosofar, en sus operaciones. Sostenemos como hipótesis que el rearme categorial al que Roig apela en múltiples pasajes de su obra implica, como operación de base, un cambio en el reconocimiento del lugar (...) de enunciación, y que éste se juega en parte importante en el empadronamiento de las categorías. Distinguimos al menos cinco operaciones categoriales en su trabajo reflexivo, las cuales pueden rastrearse a lo largo de toda su obra: (1) rescate, (2) crítica (3) reemplazo, (4) reelaboración e (5) invención. The aim of this work is to give a glance to the way in which Roig operates at categorical levels. Our intention is to observe how the author criticizes, makes, articulates, uses, creates and interlaces categories, that is to say, we wanted to take a break in the structural procedures of his philosophising, in his processes. We support as hypothesis that the categorical rearmament to that Roig appeals in multiple passages of his work involves, as a base operation, a change in the recognition of the place of enunciation, and that it plays an important part in the registration of the categories. We distinguish at least five categorical operations in his reflective work, which can be traced back throughout all his work: (1) rescue, (2) critique, (3) replacement, (4) re-elaboration and (5) invention. La memoria plantea el complejo problema de la inserción del sujeto en su colectividad. Ella no es, ni puramente individual pues permite al sujeto incrustarse en el orden simbólico de la cultura y el tiempo, ni enteramente social pues aún la memoria compartida debe ser procesada por el individuo. La memoria es a la vez una experiencia del sujeto consigo mismo y una experiencia de la relación del sujeto con su Otro. Esto explica que nuestro punto de partida sea mostrar (...) aquello que en la memoria permite al sujeto engancharse al orden simbólico de la cultura, para luego examinar el campo de la experiencia actual de la memoria colectiva. Se intentará pues describir brevemente el pasaje de la memoria al recuerdo, del recuerdo al pasado y de esta a la historia, bajo una idea directriz: el pasado, que es indeterminado, sólo está disponible a través de la rememoración individual y colectiva, eso está claro; la cuestión a examinar será más bien las dificultades para elaborar el recuerdo. O trabalho, em sua íntegra, foi realizado tendo como entrevistado um jovem que se autodenomina gay e negro, oriundo do Rio de Janeiro, de classe social baixa, estudante de uma escola pública do ensino médio regular, situada em uma periferia de um município localizado no interior da Bahia. Na tessitura que segue, enfatizamos os marcadores sociais de gênero/sexualidade e raça/etnia. Esses marcadores apresentaram-se como desconforto para o sujeito entrevistado, visto que não atendem às caracterizações e práticas determinadas pela heteronormatividade. Assim, (...) constatamos que há um olhar hierarquizante e verticalizado envolvendo identidades outras assim como possibilidades de vivências afetivas e sexuais diferentes daquelas determinadas pelas normas sociais. Firm managers play an important role in the implementation of corporate social responsibility (CSR) actions. Education is emerging as the key factor in developing a sense of moral responsibility amongst the business students who will eventually become company managers and decision makers. The aim of this research is, thus, twofold. First, to analyze the existence of a direct positive correlation between university students’ perception of CSR and its impact on business performance; and second, to examine the extent to which two (...) factors (advantages brought by CSR and responsibilities toward stakeholders) act as mediation variables in the aforementioned correlation. The analysis was performed with a sample of 390 business‐related university students. Amongst the potential contributions made by this study we can highlight the possibility of knowing future managers’ way of thinking and of knowing the aspects where educational centers might improve their CSR teaching. It is well known that the formal system developed by Frege in Begriffsschrift is based upon the distinction between function and argument—as opposed to the traditional distinction between subject and predicate. Almost all of the modern commentaries on Frege's work suggest a semantic interpretation of this distinction, and identify it with the ontological structure of function and object, upon which Grundgesetze is based. Those commentaries agree that the system proposed by Frege in Begriffsschrift has some gaps, but it is taken (...) as an essentially correct formal system for second-order logic: the first one in the history of logic. However, there is strong textual evidence that such an interpretation should be rejected. This evidence shows that the nature of the distinction between function and argument is stated by Frege in a significantly different way: it applies only to expressions and not to entities. The formal system based on this distinction is tremendously flexible and is suitable for making explicit the logical structure of contents as well as of deductive chains. We put forward a new reconstruction of the function-argument scheme and the quantification theory in Begriffsschrift. After that, we discuss the usual semantic interpretation of Begriffsschrift and show its inconsistencies with a rigorous reading of the text. (shrink)

This paper delves into the character concept as applied to reproduction. Our argument is that the prevailing functional-adaptationist perspective falls short in explaining the evolution of reproductive traits, and we propose an alternative organismal-relational approach that incorporates the developmental and interactive aspects of reproduction. To begin, we define the functional individuation of reproductive traits as evolutionary strategies aimed at enhancing fitness, and we demonstrate how this perspective influences the classification of reproductive characters and modes, the comprehension of shared traits as (...) resulting from conflicts of evolutionary interest between individuals, and the explanation of reproductive diversity. After outlining the shortcomings of this framework, we introduce an organismal-relational approach grounded in evolutionary developmental studies of reproduction. This view provides a revised classification for reproductive characters and modes and offers a new understanding of interorganismal traits that takes into account their inherently relational nature. Lastly, we present the research agenda that emerges from this approach, which addresses the core explanatory gaps left by the adaptationist perspective, including the explanation of reproductive homologies and homoplasies, the developmental constraints associated with the evolution of reproductive modes, and the evolvability of reproductive characters. This paper examines evolutionary ontologies from Darwin’s work to the genesis and maturation of the Modern Evolutionary Synthesis, followed by the onset of the more inclusive framework of the Extended Evolutionary Synthesis. We show how, in an attempt to unify different biological fields under evolutionary principles, the first synthetic theory of evolution progressively disregarded the relevance of organismic-level properties and processes. Yet, failure to reduce the systemic nature and ecological dynamics of the organism (including properties of agency and organization) to (...) that framework raises some important drawbacks. In particular, the two fundamental dimensions of developmental and ecological dynamics were largely neglected. These are the ones that highlight the relational properties of organisms and lead to recent views in, respectively, Evo-Devo and Niche Construction Theory. On this account, we argue that these two aspects illuminate how, while the Modern Synthesis became increasingly reductionist and monistic, the Extended Synthesis is currently being constituted by a pluralistic array of models capable of accommodating different ontological levels, among which that of organisms stands out due to its flexibility and potential inclusiveness.
