Une première approche voudrait réunir la justice prédictive et le droit international de l’investissement sous la même bannière, cette matière visant à apporter un cadre juridique stable à l’investisseur étranger face au comportement possiblement imprévisible de l’État d’accueil de l’investissement. Or, le processus d’ open data des décisions arbitrales, au sens large, est loin d’être achevé alors que subsiste la confidentialité des délibérés, ce qui tronque inévitablement l’échantillon de données exploité par les outils de justice prédictive. En outre, l’arbitrage relatif (...) aux investissements étrangers est un contentieux complexe caractérisé par une immense multiplicité de faits et de règles de droit applicables, rendant ainsi les combinaisons de données déclinables à l’infini et, conséquemment, les pronostics plus instables. Ces constats successifs ne nous dispenseront pas, toutefois, d’émettre quelques recommandations au cas où notre propre pronostic sur la justice prédictive et l’arbitrage international relatif aux investissements étrangers serait, dans les années à venir, déjoué. The seemingly "inextricable" mutual entanglement of history and the play of power dissolves itself when thinking, under the sway of technique, moves beyond the horizon of metaphysic, and turns to question the unconcealment of being, that is, when man lets time become the law of his essence. Only so would a history, i.e. freedom, happen again, and rescue modern man from his otherwise destinyless age.

This paper argues that besides mechanistic explanations, there is a kind of explanation that relies upon “topological” properties of systems in order to derive the explanandum as a consequence, and which does not consider mechanisms or causal processes. I first investigate topological explanations in the case of ecological research on the stability of ecosystems. Then I contrast them with mechanistic explanations, thereby distinguishing the kind of realization they involve from the realization relations entailed by mechanistic explanations, and explain how both (...) kinds of explanations may be articulated in practice. The second section, expanding on the case of ecological stability, considers the phenomenon of robustness at all levels of the biological hierarchy in order to show that topological explanations are indeed pervasive there. Reasons are suggested for this, in which “neutral network” explanations are singled out as a form of topological explanation that spans across many levels. Finally, I appeal to the distinction of explanatory regimes to cast light on a controversy in philosophy of biology, the issue of contingence in evolution, which is shown to essentially involve issues about realization. In topological spaces, the relation of extended contact is a ternary relation that holds between regular closed subsets A, B and D if the intersection of A and B is included in D. The algebraic counterpart of this mereotopological relation is the notion of extended contact algebra which is a Boolean algebra extended with a ternary relation. In this paper, we are interested in the relational representation theory for extended contact algebras. In this respect, we study the correspondences between point-free (...) and point-based models of space in terms of extended contact. Thought is the primary force of humans for their survival, it consists in the use of knowledge and beliefs to determine the most appropriate action in the current situation according to a rationally inspired treatment. The usual knowledge used in practical life is based on models that are representative of reality, such as descriptions and pairs of opposites. We discuss here our thesis that these types of representations of knowledge induce restrictive effects on thought. Indeed, in particular, these two types (...) have specific characteristics that lead to binding effects on thinking such as limitation and influence. The result is a decrease in the capacity of being a rational autonomous agent harmful to one's own interests, which is characterized by deleterious behaviors: lack of reflection (resulting in), inaction, submission, imitation, being just a follower, persuasion by one's group, confusion, handing over to others... However, types of representations that are hardly more complex allow for a better consideration of one's preferences, including a type of representation that enables to move away from couples of opposites by adding neutrality, which produces a distancing from the immediacy of choices (and contrary binary alternatives) while facilitating personal appreciation. This type is in line with the mechanism for finding an optimal solution based on preferential weighting, which is one of the most widely used cognitive operations in human life. We indicate here that this type of representation is typical of neutrosophy, which is an extension of the dialectical thinking of Western philosophy. (shrink)

We want to highlight the strong link between learning systems such as deep learning neural networks and neutrosophy. The latter is above all a representation considering a neutral state which is at the heart of many phenomena of reality as well as mathematical and information theories. Here, we start from the recent understanding of neural networks, which considers their internal functioning and the learning that characterizes them as based on adapted representations (both of the information to be processed and of (...) the task to be performed) that are in fact optimal compressions. Compression means discriminating the similar and the different between cases by identifying representative characteristics through focusing on the most significant and rejecting of the rest. These three operations of neural processing, learning and compression owe their existence to non-linear treatments which essentially amount to distinguishing a neutral zone between two filtered zones, corresponding to the neutrosophical approach. This article presents the Arabic text of al-Q's short geometric treatise, The Book of the centres of the tangent circles on lines, by the method of analysis, with translation and a mathematical commentary. In this treatise al-Q solves by analysis an ordered set of eight problems where the goal is to locate, on a given line, the centre of a circle which is tangent to two given elements, which may be points, straight lines or circles. For example, in the first (...) problem he wanted to find the centre of a circle which contains two given points. In fact, al-Q establishes the locus of the solutions, and this locus can be a straight line or a conic. The treatise is reminiscent of one of the purposes of al-Q's work on the perfect compass, namely to assign to the conics the status of regular lines. (shrink)

Animal research suggests that central serotonergic neurons are involved in behavioral suppression, particularly anxiety-related inhibition. The hypothesis linking decreased serotonin transmission to reduced anxiety as the mechanism in the anxiolytic activity of benzodiazepines conflicts with most clinical observations. Serotonin antagonists show no marked capacity to alleviate anxiety. On the other hand, clinical signs of reduced serotonergic transmission (low 5-HIAA levels in the cerebrospinal fluid) are frequently associated with aggressiveness, suicide attempts, and increased anxiety. The target article attempts to reconcile such (...) human and animal findings by investigating whether anxiety reduction or increased impulsivity is more Likely to account for animal behavioral changes associated with decreased serotonergic transmission. The effects of manipulating central serotonin in experimental anxiety paradigms in animals (punishment, extinction, novelty) are reviewed and compared with the effects of antianxiety drugs. Anxiety seems neither necessary nor sufficient to induce control by serotonergic neurons on behavior. Further evidence suggests that behavioral effects of anxiolytics thought to be mediated by decreases in anxiety are not caused by the ability of these drugs to reduce serotonin transmission. Blockade of serotonin transmission, especially at the level of the substantia nigra, results in a shift of behavior toward facilitation of responding. This behavioral shift is particularly marked when there is competition between acting and restraining response tendencies and when obstacles prevent the immediate attainment of an anticipated reward. It is proposed that serotonergic neurons are involved not only in behavioral arousal but also in enabling the organism to arrange or tolerate delay before acting. Decreases in serotonin transmission seem to be associated with the increased performance of behaviors that are usually suppressed, though not necessarily because of the alleviation of anxiety, which might contribute to the suppression. Longtemps considéré comme de « piètre fiabilité » par rapport au récit parallèle des livres de Samuel et des Rois, ces livres apparaissent aussi sans originalité littéraire par rapport notamment à l'art consommé des récits des livres de Samuel. Dans le sillage de l'Art du récit biblique, de Robert Alter, Ph. Abadie tente de faire ressortir la richesse et la variété des procédés d'écriture qui font du (...) livre des Chroniques une œuvre littéraire véritable. Celle-ci tient fondamentalement à un projet global que révèlent et confirment des « unités kérygmatiques » structurantes et l'ordonnancement de grands ensembles selon divers procédés : technique de répétition et système de périodisation chronologique notamment.It is still paradoxical to recognize the statute of literary work for the books of Chronicles. Long time considered as of “poor reliability” in comparison with the parallel history of the books of Samuel and Kings, these books also seem to be without literary originality in comparison with, notably, the consummate art of the narratives in the books of Samuel. In the wake of “The Art of Biblical Narrative” by Robert Alter, Ph. Abadie tries to bring out the richness and the variety of the writing procedures that make the book of Chronicles a truly literary work. It fundamentally holds to a global project that reveals and confirms some “kerygmatic unities,” structuring and ordering great ensembles according to diverse procedures: especially a technique of repetition and system of chronological periodisation. Besides mechanistic explanations of phenomena, which have been seriously investigated in the last decade, biology and ecology also include explanations that pinpoint specific mathematical properties as explanatory of the explanandum under focus. Among these structural explanations, one finds topological explanations, and recent science pervasively relies on them. This reliance is especially due to the necessity to model large sets of data with no practical possibility to track the proper activities of all the numerous entities. The paper first defines topological explanations (...) and then explains why topological explanations and mechanisms are different in principle. Then it shows that they are pervasive both in the study of networks—whose importance has been increasingly acknowledged at each level of the biological hierarchy—and in contexts where the notion of selective neutrality is crucial; this allows me to capture the difference between mechanisms and topological explanations in terms of practical modelling practices. The rest of the paper investigates how in practice mechanisms and topologies are combined. They may be articulated in theoretical structures and explanatory strategies, first through a relation of constraint, second in interlevel theories, or they may condition each other. Finally, I explore how a particular model can integrate mechanistic informations, by focusing on the recent practice of merging networks in ecology and its consequences upon multiscale modelling. Several disputes about the nature of experience operate under the assumption that experiences have parts, including temporal parts. There's the widely held view, when it comes to temporal experiences, that we should follow James' exhortation that such experiences aren't mere successions of their temporal parts, but something more. And there's the question of whether it is the parts of experiences which determine whole experiences and the properties they have, or whether the determination goes instead from the whole to the parts, (...) as holists have it. But what are parts, or temporal parts, of experiences exactly—what does it mean to say that an experience is “part” of another? Are the participants in those disputes talking about the same thing—is there a univocal notion of “experiential part” available? Are there different kinds of experiential parts? And if there are, is there a systematic way of carving them out? More importantly, how should we conceive of the temporal parts of experiences, and how can we establish that experiences really do have temporal parts, against those who reject the notion? (shrink)

Kant’s analysis of the concept of natural purpose in the Critique of judgment captured several features of organisms that he argued warranted making them the objects of a special field of study, in need of a special regulative teleological principle. By showing that organisms have to be conceived as self-organizing wholes, epigenetically built according to the idea of a whole that we must presuppose, Kant accounted for three features of organisms conflated in the biological sciences of the period: adaptation, functionality (...) and conservation of forms..Kant’s unitary concept of natural purpose was subsequently split in two directions: first by Cuvier’s comparative anatomy, that would draw on the idea of adaptative functions as a regulative principle for understanding in reconstituting and classifying organisms; and then by Goethe’s and Geoffroy’s morphology, a science of the general transformations of living forms. However, such general transformations in nature, objects of an alleged ‘archaeology of nature’, were thought impossible by Kant in the §80 of the Critique of judgment. Goethe made this ‘adventure of reason’ possible by changing the sense of ‘explanation’: scientific explanation was shifted from the investigation of the mechanical processes of generation of individual organisms to the unveiling of some ideal transformations of types instantiated by those organisms. A full understanding of emotions and emotion characteristics can only be reached when their dynamic nature is taken into account. As such, a primary objective of the present study is to describe and account for variability in temporal profiles of experienced emotional intensity. Participants were asked to make detailed drawings of intensity profiles of recently experienced episodes of anger, sadness, joy and affection. Functional data analysis revealed three features that together accounted for 84% of the total variability: (i) steepness at (...) onset; (ii) skewness; and (iii) the number of peaks. Emotions differed with regard to the first two features, with the rise at onset being steeper for sadness and joy and affection being the most negatively skewed emotion under study. Individual differences regarding each of the three features were found, however, they did not strongly generalise across emotions. (shrink)

Wat dacht Nietzsche, die niet bepaald positief stond ten opzichte van het christendom, eigenlijk over Jezus? Er wordt immers wel beweerd dat je, wat je verder ook van het christendom denkt, onmogelijk tegen Jezus kunt zijn. In zijn vroege werk noemt Nietzsche hem inderdaad 'de edelste mens'. Maar later heeft hij het over 'een grote egoïst' en in 'Der Antichrist' zegt hij zelfs dat Jezus 'een idioot' was. Wat betekent dat allemaal precies binnen het denken van een filosoof die vaak (...) niet rechtstreeks zegt wat hij eigenlijk bedoelt? Kunnen deze gedachten voor ons vandaag nog iets betekenen? Lepers heeft het volledige oeuvre van Nietzsche onderzocht op uitspraken en beschouwingen over en rond de figuur van Jezus. Dat voert hem tot genuanceerde, soms (schijnbaar?) tegenstrijdige, maar altijd uitdagende antwoorden op de vraag wie en wat Jezus in Nietzsches ogen was en wat hij vanuit dat perspectief voor ons zou kunnen zijn. This article discusses how Liang Shuming’s Eastern and Western Cultures and Their Philosophies adopted a genealogical mode of textual authorization which took shape in its depiction of Chinese history as a failure to live up to an ideal way of life imagined by Confucius. Implied in this discourse was the idea that Liang himself had been the first Confucian to understand what Confucius had truly meant. This genealogical discourse authorizing Liang and his text by linking them directly to Confucius was (...) further strengthened by a rhetoric which naturalized the discourse passed down from Confucius to Liang, distinguishing it from other forms of discourse seen as artificial. Finally, the text’s genealogical discourse also managed to incorporate the May Fourth critique of Confucianism by rejecting the historical manifestations of Confucianism before salvaging an ideal imagined by Confucius which was presented as uncontaminated by history and Confucianism’s enmeshment with state power.
