A person sometimes forms moral beliefs by relying on another person''s moral testimony. In this paper I advance a cognitivist normative account of this phenomenon. I argue that for a person''s actions to be morally good, they must be based on a recognition of the moral reasons bearing on action. Morality requires people to act from an understanding of moral claims, and consequently to have an understanding of moral claims relevant to action. A person sometimes fails to meet this requirement (...) when she relies on another person''s moral testimony, and so there are moral limits on such reliance. (shrink)

Do citizens have an obligation to obey the law? This book differs from standard approaches by shifting from the language of obedience to that of deference. The popular view that law claims authority but does not have it is here reversed on both counts: law does not claim authority but has it. Though the focus is on political obligation, the author approaches that issue indirectly by first developing a more general account of when deference is due to the view of (...) others. Two standard practices that political theorists often consider in exploring the question of political obligation - fair-play and promise-keeping - can themselves be seen as examples of a duty of deference. In this respect the book defends a more general theory of ethics whose scope extends beyond the question of political obligation to questions of duty in the case of law, promises, fair play and friendship. In the spirit of James and Dewey, I ask what one might want from a theory of knowledge. Much Anglophone epistemology is centered on questions that were once highly pertinent, but are no longer central to broader human and scientific concerns. The first sense in which epistemology without history is blind lies in the tendency of philosophers to ignore the history of philosophical problems. A second sense consists in the perennial attraction of approaches to knowledge that divorce knowing subjects from (...) their societies and from the tradition of socially assembling a body of transmitted knowledge. When epistemology fails to use the history of inquiry as a laboratory in which methodological claims can be tested, there is a third way in which it becomes blind. Finally, lack of attention to the growth of knowledge in various domains leaves us with puzzles about the character of the knowledge we have. I illustrate this last theme by showing how reflections on the history of mathematics can expand our options for understanding mathematical knowledge. (shrink)

Although Joyce was losing his sight when he wrote Ulysses, Stephen's and Bloom's visual experiences are extraordinarily rich and complex. Absorbing the influences of popular visual attractions such as dioramas, stereoscopes and mutoscopes, their perceptions of Dublin are shaped by what Walter Benjamin calls 'unconscious optics'. Analyzing closely the texture of their impressions and of Joyce's prismatic narrative styles, Philip Sicker explores the phenomenon of sight from a wide-ranging set of perspectives: eighteenth-century epistemology, theories of the flaneur, Italian Futurist (...) art, photography, and the silent films Joyce watched in Dublin and Trieste. The concept of 'spectacle' as a mechanically-constructed visual experience informs Sicker's examination of mediated perception and emerges as a hallmark of modernist culture itself. This study is an important contribution to the growing interest in how deeply the philosophy and science of visual perception influenced modernism. (shrink)

Periodic and unexpected shortages of drugs, biologics, and even medical devices have become commonplace in the United States. When shortages occur, hospitals and clinics need to decide how to ration their available stock. When such situations arise, institutions can choose from several different allocation schemes, such as first-come, first-served, a lottery, or a more rational and calculated approach. While the first two approaches sound reasonable at first glance, there are a number of problems associated with them, including the inability to (...) make fine, individual patient-centered decisions. They also do not discriminate between what kinds of patients and what types of uses may be more deserving or reasonable than others. In this article I outline an ethically acceptable procedure for rationing drugs during a shortage in which demand outstrips supply. (shrink)

Hilbert's program attempts to show that our mathematical knowledge can be certain because we are able to know for certain the truths of elementary arithmetic. I argue that, in the absence of a theory of mathematical truth, Hilbert does not have a complete theory of our arithmetical knowledge. Further, while his deployment of a Kantian notion of intuition seems to promise an answer to scepticism, there is no way to complete Hilbert's epistemology which would answer to his avowed aims.

The idea that there should be no limits on freedom of discussion receives passionate defenses from some of the most thoughtful and eloquent writers in our language, for example, Milton's evidential transparence condition and Mill's condition of equal benefit. My interest lies in exposing the consequences of this view for the derivative value of free discussion. I'm going to be particularly concerned with those instances in which these conditions are problematic.

This first-of-its-kind national survey of 485 psychiatrists in nine states and the District of Columbia finds substantial evidence of clinicians being uninformed, misinformed, and misinforming patients of their gun rights regarding involuntary commitments and voluntary inpatient admissions. A significant percentage of psychiatrists did not understand that an involuntary civil commitment triggered the loss of gun rights, and the majority of psychiatrists in states with prohibitors on voluntary admissions and emergency holds were unaware that patients would lose gun rights upon voluntary (...) admission or temporary commitment. Moreover, the survey found evidence that psychiatrists may use gun rights to negotiate “voluntary” commitments with patients: 15.9% of respondents reported telling patients they could preserve their gun rights by permitting themselves to be voluntarily admitted for treatment, in lieu of being involuntarily committed. The results raise questions of whether psychiatrists obtained full informed consent for voluntary patient admissions, and suggest that some medical providers in states with voluntary admission prohibitor laws may unwittingly deprive their patients of a constitutional right. The study calls into question the fairness of state prohibitor laws as policy, and — at minimum — indicates an urgent need for psychiatrist training on their state gun laws. (shrink)

Arendt Contra Sociology re-assesses the relationship between Hannah Arendt's work and the theoretical foundations of sociology, bringing her insights to bear on key themes within contemporary theoretical sociology. Departing from the view of Arendt as a political theorist who sought to rescue politics from society, and political theory from the social sciences, this book re-examines her distinctions between labour, fabrication and action as a theory of the fundamental ontology of human societies, revisiting her criticism of the tendency of many sociological (...) paradigms to conflate the activity of fabrication with that of action. In a now famous thought experiment, Frank jackson asked us t0 imagine an omniscient scientist, Mary, who is coniincd in a black-and-white room and then released into the world 0f color . Assuming that she is omniscicnt in respect of all physical facts—roughiy, all the facts available to physics and all the facts that they in turn Hx or determine-physicalism would suggest that there is no new fact Mary can discover after emancipation; physicalism holds that all facts are physical in (...) the relevant sense . Yet we cannot help but feel that coming out of that room would be an occasion of dramatic enlightenment and, in particular, an occasion for learning facts to do with how red or yellow or blue 100ks or, as it is usually said, with what it is like t0 sec red or yellow or blue. Many in the black-and—whit<—: room knew all the physical facts about the world, where these may be taken to include three sorts of color facts: objcctual facts, as to what surface colors different objects have, assuming as I shall do throughout—that colors are properties of objects; intentional facts, as to which colors different objects 0r apparent objects are represented as having in the subjc-:ct’s experience, rightly or wrongly; and nonintentional facts, about what such color experiences are like in their effects on subiccts—wh<—:ther they are comforting, or arousing, or whatever. But, according to the argument, Mary didn’t know how any color looks or, equivalently, what color experience is like in itself, not just in its effects O1'1 subjects. This particular nonintentional fact about the quality of color c-zxpc-2ri<—:ncc-—this phenomenal fact, as it is often describcd—she did not. (shrink)

This book offers a roadmap for determining when and how to regulate risky reproductive technologies on behalf of future children. It starts by explaining our intuitive, but paradoxical, belief that reproductive choices can be both life-giving and harmful. Next, it recommends a case-by-case method for reconciling the interests of future children with the reproductive liberty of prospective parents. Finally, it applies this framework to four past and future medical interventions, including cloning and genetic engineering.
