The present reply to Peter Schaber’s critique of my paper Achtung und ihre moralische Bedeutung argues, first, that Schaber has no good grounds for maintaining that we have an obligation to respect every human being. Second, it explains why respect is not a fruitful attitude to take in the face of social divisions.

Bittner argues in his paper that the idea of a general duty to respect persons is of much less importance than some moral philosophers think. If respect plays a role in our lives it is mainly appriciation respect persons have to merit. Respecting persons as such is, Bittner thinks, not just irrelevant, but also incompatibel with personal relations. Against this it is argued that respect for persons should be seen as the basic moral duty we have towards persons. (...) And in addition, it is argued, that you can only be a proper friend of someone, if the relation to her or him is based on moral respect. (shrink)

The volume brings together a collection of original papers on some of the main tenets of Joseph Raz's legal and political philosophy: Legal positivism and the nature of law, practical reason, authority, the value of equality, incommensurability, harm, group rights, and multiculturalism. James Griffin and Yael Tamir raise questions concerning Raz's notion of group rights and its application to claims of cultural and political autonomy, while Will Kymlicka and Bernhard Peters examine Raz's theory of multicultural society. Lukas Meyer investigates the (...) applicability of the notion of harm in the intergenerational context. Other papers are devoted to fundamental theoretical tenets of Raz's work. Hillel Steiner and Andrei Marmor examine Raz's account of value pluralism and incommensurability in light of what these authors consider to be goods whose equal distribution must be valued for its own sake. Robert Alexy and Timothy Endicott discuss traditional issues of jurisprudence and legal philosphy with special attention to Raz's contribution. Rüdiger Bittner, Bruno Celano, and J. E. Penner discuss and criticize aspects of Raz's theory of practical reason. Jeremy Waldron presents a critique of Raz's interpretation of authority.This volume concludes with a chapter by Joseph Raz in which he responds to arguments in the foregoing essays. (shrink)

What may we believe? What ought we to do? These two questions, which are intended as a subtle contemporary version of the questions that concerned Kant, set the parameters of the diverse activities of the Eighth Triannual International Congress, GAP.8, of the German Gesellschaft für Analytische Philosophie (Society for Analytic Philosophy, GAP), held at the University of Konstanz at September 17–20, 2012. These questions remain central systematic questions of theoretical and practical philosophy.The six articles collected here are the main papers (...) presented at that congress. They can be divided into two groups. First, there are Peter M. S. Hacker’s opening lecture, Ulrich Blau’s Erkenntnis lecture which was sponsored by Springer Publishers, and Roy Sorensen’s closing lecture. I argue in this paper that moral philosophers need to incorporate into their teaching and writing a number of empirical findings on ethical practices. Principal among these is clearer guidelines on speaking out against wrongdoing, as well as the development of codes of ethics that have been proven to work. The adoption of the critical thinking and the analytical methodology of other disciplines is also suggested. Several benefits will result. The most noticeable will be a strengthening of ethical practices and (...) behavior in the institutions and organizations with which we live and work. A second benefit will be the education and employment of a body of people—graduates in moral philosophy—with the skills and knowledge to bring about, and further strengthen, this enhanced ethical environment. A third benefit will be the matching of the claims of philosophical thought with actual reality. (shrink)

Widespread tax evasion and avoidance have recently led to both significant reforms of international tax governance and increased attention from theorists of global tax justice. Against the background of an analysis of the double challenge of effectiveness and distribution facing the taxation of multinational enterprises, this paper puts forward a taxonomy of recent contributions of the tax justice literature. This taxonomy not only opens up an original angle of interpretation on global tax justice, but also provides a vantage point from (...) which to evaluate recent reforms by the Organisation for Economic Co-operation and Development. The function of rationality in A Theory of Justice (1971), which is of paramount importance for John Rawls’ (1921–2002) project, is often criticised as ambiguous.David Gauthier, for example, claims that Rawls develops principles for recipients who essentially share his intuitions of morality, without managing to prove theirvalidity. In Political Liberalism (1993), Justice as Fairness (2001) and other writings Rawls himself embarks upon the task to throw more light on this issue, making the Kantian distinction between ‘rational’ and ‘reasonable’. I intend (...) to demonstrate that in A Theory of Justice the formulation and the compliance with the principles of justice are based on the interaction between the rationality, represented in the idea of the good, and the sense of justice of individuals. There is a pedagogical method of bringing undergraduate students to conceive the body–soul question. Similarly, there is a simple philosophical argument in defense of the existence of the soul via contemporary autobiographical stories, recent neuroscientific literature, and Socrates’s distinction between condition and cause in Plato’s Phaedo. This method has proved helpful in enabling students to gain access to the mystery and grandeur of the body–soul question and its foundational importance with respect to ethics and, indeed, to the meaning of life. There must be a revival of collaboration between neuroscientists and philosophers to coauthor papers that explicitly challenge the materialist assumptions in the fields of neuroscience and psychology.
