What is the nature of children's trust in testimony? Is it based primarily on evidential correlations between statements and facts, as stated by Hume, or does it derive from an interest in the trustworthiness of particular speakers? In this essay, we explore these questions in an effort to understand the developmental course and cognitive bases of children's extensive reliance on testimony. Recent work shows that, from an early age, children monitor the reliability of particular informants, differentiate between those who make (...) true and false claims and keep that differential accuracy in mind when evaluating new information from these people. We argue that this selective trust is likely to involve the mentalistic appraisal of speakers rather than surface generalizations of their behavior. Finally, we review the significance of children's deference to adult authority on issues of naming and categorization. In addition to challenging a purely inductive account of trust, these and other findings reflect a potentially rich set of tools brought by children to the task of learning from people's testimony. Psychologists have emphasized children's acquisition of information through firsthand observation. However, many beliefs are acquired from others' testimony. In two experiments, most 4yearolds displayed sceptical trust in testimony. Having heard informants' accurate or inaccurate testimony, they anticipated that informants would continue to display such differential accuracy and they trusted the hitherto reliable informant. Yet they ignored the testimony of the reliable informant if it conflicted with what they themselves had seen. By contrast, threeyearolds were less selective in trusting a reliable (...) informant. Thus, young children check testimony against their own experience and increasingly recognise that some informants are more trustworthy than others. (shrink)

How do children acquire beliefs from testimony? In this chapter, we discuss children's trust in testimony, their sensitivity to and use of defeaters, and their appeals to positive reasons for trusting what other people tell them. Empirical evidence shows that, from an early age, children have a tendency to trust testimony. However, this tendency to trust is accompanied by sensitivity to cues that suggest unreliability, including inaccuracy of the message and characteristics of the speaker. Not only are children sensitive to (...) evidence of unreliability, but they are also sensitive to the positive reasons a speaker may have for the reliability of their testimony. Paul Appelbaum and colleagues propose four models of informed consent to research that deploys whole genome sequencing and may generate incidental findings. They base their analysis on empirical data that suggests that research participants want to be offered incidental findings and on a normative consensus that researchers incur a duty to offer them. Their models will contribute to the heated policy debate about return of incidental findings. We are skeptical that today’s medical ethics education adequately fosters future physicians’ commitment to beneficence, which is both rationally defensible and fundamentally consistent with patient autonomy. We use an ethical dilemma that was presented to a group of third-year medical students to examine how ethics education might be causing (...) them to give undue deference to autonomy, thereby undermining their commitment to beneficence. INTRODUCTION The right of patients to choose which treatments they prefer is rooted in today’s social mores and taught as a principle of medical ethics as respect for autonomy. Yet, when physicians use their clinical knowledge and skills to advance the well-being of their patients, there may be a conflict between patient autonomy and physician beneficence. We are skeptical that today’s medical ethics education adequately fosters a commitment to beneficence, which is both rationally defensible and fundamentally consistent with patient autonomy. I. An Ethical Dilemma The impetus for this paper arose when students who were completing their third clinical year discussed a real-life ethical dilemma. A middle-aged man developed a pulmonary hemorrhage while on blood thinners for a recently placed coronary stent. The bleeding was felt to be reversible, but the patient needed immediate intubation or he would die. The cardiologist was told that the patient previously expressed to other physicians that he never wanted to be intubated. However, the cardiologist made the decision to intubate the patient anyway, and the patient eventually recovered.[1] Students were asked if they believed that the cardiologist had acted ethically. Their overwhelming response was, “No, the patient should have been allowed to die.” We looked into how students applied ethical reasoning to conclude that this outcome was ethically preferred. To explore how the third-year clinical experience might have formed the students’ judgment, we presented the same case to students who were just beginning their third year. Their responses were essentially uniform in recommending intubation. While there is likely more than one reasonable view in this case, we agree with the physician and the younger medical students that intubation was the ethically appropriate decision and will present an argument for it. But first, we explain the reasoning behind the more advanced medical students’ decision to choose patient autonomy at the expense of beneficence. II. Medical Ethics Education and the Priority of Autonomy Beauchamp and Childress’s Principles of Biomedical Ethics, first published in 1979 and now in its 8th edition, is a significant part of the formal ethics education in medical school.[2] Students learn an ethical decision-making approach based on respect for four ethical principles: autonomy, beneficence, nonmaleficence, and justice. While Beauchamp and Childress officially afford no prima facie superiority to any principle, the importance of respect for patient autonomy has increased through the editions of their book. For example, early editions of their book opposed the legalization of physician-assisted death compared to recent editions that defended it.[3] As another example, Beauchamp and Childress make paternalism harder to justify by adding an autonomy-protecting condition to the list of conditions for acceptable paternalism.[4] Authority, they contend, need not conflict with autonomy—provided the authority is autonomously chosen.[5] “The main requirement,” they write, “is to respect a particular patient’s or subject’s autonomous choices, whatever they may be.[6] In the principlism of Beauchamp and Childress, autonomy now seems to have a kind of default priority.[7] However, the bioethics discourse has strong counternarratives, noting some movement to elevate the role of beneficence and to respect the input of stakeholders, including the family and the healthcare team. Ethics education achieves particular relevance in the third clinical year when students become embedded in the care of patients and learn from what has been called the informal curriculum. They observe how attending physicians approach day-to-day ethical problems at the patient’s bedside. In this context, students observe the importance of informed consent for serious treatments or invasive procedures, a practice that highlights the principle of patient autonomy. In both the formal and informal curriculum, medical students observe how, in the words of Paul Wolpe, “patient autonomy has become the central and most powerful principle in ethical decision-making in American medicine.”[8] In short, students appear to learn a deference for patient autonomy. This curricular shift in favor of autonomy coincides with legal developments that protect patients’ rights and decision-making with respect to their healthcare choices. The priority of autonomy in medicine benefits patients by reflecting their choices and, in some cases, their fundamental liberty. III. The Practice of Medicine and the Commitment to Beneficence There are many critiques of the dominant place that autonomy has in biomedical ethics,[9] especially considering that autonomy seems to be biased toward individualistic, Western, and somewhat American culture-driven values.[10] In addition, many bioethical dilemmas are cast as a conflict between autonomy and beneficence. Our point is that medical students bring to their study of medicine a commitment to beneficence that seems to be suppressed by practical ethics education. We think this commitment is rationally defensible and should be nurtured. It is striking that young medical students have a pre-reflective commitment to beneficence at all. For, as we mentioned, it is not just medicine but Western culture generally that prioritizes autonomy in settling ethical dilemmas. In wanting to act for the good of others (rather than simply agreeing to what others want), physicians are already swimming somewhat against the cultural tide.[11] However, doing so makes sense, given the nature of medicine and the profession of healing. When prospective medical students are asked why they wish to become physicians, the usual answer is some variation on caring for the sick and preventing disease. It is unlikely that a reason to become a physician is to respect a patient’s autonomy. It would be easy to dismiss medical students’ commitment to beneficence as a mere intuition and contrary to a more reasoned and deliberative approach. Beauchamp and Childress seem to minimize the value of physician intuition, stating that justifications for certain procedures are “…supported by good reasons. They need not rest merely in intuition or feeling.”[12] Henry Richardson writes that “situational or perceptive intuition…leaves the reasons for decision unarticulated.”[13] We think this is a crude and rather thin way of understanding intuition. Some bioethicists have defended intuition as essential to the practice of medicine and not something opposed to reason.[14] In the case we describe, we believe the ethical justifications s for the patient’s intubation are fundamentally sound: the patient did not have a “do not intubate” order written in the chart, the emergency intubation had not been foreseen, so the patient did not have the opportunity to consent to or reject intubation; the patient had consented to the treatment for his cardiac disease so his consent for intubation could have been assumed;[15] and the consequences of respecting his autonomy did not justify allowing him to die.[16] While it is possible to have more than one reasonable view on this case, we think the case for beneficence is strong and certainly should not be dismissed out of hand. We do not deny that if a patient makes a clearly documented, well-informed decision to forgo intubation that this decision ought to be respected by the physician (even if the physician disagrees with the patient’s decision). But, in this situation, as in many others in the practice of medicine, the patient’s real wishes and preferences are not well-articulated in advance. There are many cases where a physician acts based on what she believes the patient, or the surrogate, would want, sometimes in situations that do not allow much time for reflection. An example might be resuscitation of a newborn at the borderline of viability. In their ethics education, beneficence would mean acting first to save a life. If the patient or surrogate makes an informed decision to the contrary, a beneficent physician respects that autonomous decision. In the case presented, the patient expressed gratitude to the cardiologist when extubated. But what if he had expressed anger at the physician for violating his autonomy? There are those who could argue that not only was intubation ethically wrong but that the cardiologist put himself in legal jeopardy by his actions (especially if there had been a written refusal applicable to the specific situation). In the example we use, we point out that the cardiologist may not have escaped a lawsuit if the patient had died without intubation. His family, when hearing the circumstances, may have sued for failure to act and dereliction of the cardiologist’s duty to save him. Beyond a potential legal challenge for either action or inaction, there is an overriding ethical question the cardiologist had to address: what course would be most satisfying to his conscience? Would he rather allow a patient to die for fear of recrimination, or act to save his life, regardless of the personal consequences? In the absence of real knowledge about the patient’s considered wishes, it is most reasonable to err on the side of promoting patient well-being. A physician’s commitment to beneficence is not necessarily a way of undermining a patient’s autonomy. In acting for the patient's good, physicians are also acting on what it is reasonable to believe a patient (or most patients, perhaps) would want, which is obviously connected to what a patient does want. Pellegrino and Thomasma argue that beneficence includes respect for a patient’s autonomy since “the best interests of the patient are intimately linked with their preferences.”[17] Instead of conceptualizing ethical dilemmas in medicine as conflicts between autonomy and beneficence, it is possible that medical schools could teach students that truly practicing beneficence is a way of valuing patient autonomy, especially when the patient’s wishes are not specific to the situation and are not clearly expressed. CONCLUSION It is important for students and practicing physicians to understand the principle of respect for patient autonomy in a pluralistic society that demands personal self-determination. However, the role of the physician as a beneficent healer should not be diminished by this respect for autonomy. Respecting a patient’s autonomy is grounded in and manifested by physician beneficence.[18] That is, seeking what is good for the patient can only be good if it respects their personhood and dignity. We propose that a commitment to beneficence, incipient in young medical students, should be developed over time with their other clinical reasoning skills. Such a commitment need not be sacrificed on the altar of patient autonomy. Beneficence needs greater relative moral weight with students as they proceed in their ethics education. - [1] S. This article contends that the evolution toward interdisciplinary collaboration that we are witnessing in the sciences must also occur in the humanities to ensure their very survival. That is, humanists must be open to working with scientists and social scientists interested in similar research questions and vice versa. Digital humanities is a positive first step. Complexity science should be the next step. Even though much of the ground-breaking work in complexity science has been done in the natural sciences and mathematics, (...) it can, if critically adapted, provide the needed metaphor for a broad integration of disciplines, humanistic and otherwise. Given its almost a-disciplinary nature, a complexity approach to the research problems in the humanities necessarily breaks down silos. Moreover, it can restore and reframe the seamless intellectual fabric sought by researchers before the atomization of the various disciplines in the nineteenthcentury academy. (shrink)

Despite significant advances in various special areas in the study of language, the question of what the basic nature of the theory of a language is remains controversial and unclear. In this paper we propose to rectify this situation and argue for a general perspective — one which only a few theorists have explicitly endorsed — by showing that it is at once theoretically illuminating and empirically plausible. This perspective consists of the following claims: that the most basic theory of (...) a language is a theory of communication viz., of understanding and production; that a theory of communication in this sense presupposes a theory of thought; that a grammar is most fruitfully thought of as a component of a theory of communication; and that so-called theories of meaning form a rather heterogeneous group, some of which being fragments of grammars, others being theories of thought, and still others being what are sometimes referred to as theories of reference. Section 1 gives a brief overview. Section 2 seeks to motivate a distinction between building relations and making relations, and questions whether the deep structural similarities among (...) building relations has the methodological consequences that Bennett claims. Section 3 argues against the claim that considerations of ontological simplicity in theory choice are restricted to non-fundamental entities. Aristotle says that conclusions of practical syllogisms are actions that occur εὐθύς, which is normally translated to indicate temporal immediacy. Both aspects of this—that the conclusions are actions, and that they occur immediately—seem wrong. Interpreting εὐθύς as atemporal, specifically as indicating that nothing more is needed to explain the action, makes better sense of practical syllogisms and solves the problems raised by calling their conclusions actions.

This paper challenges Putnam's claim that his internal realism is a revival of Kant's empirical realism. I agree with Putnam that there are good reasons to revive Kant's rather neglected empirical realist doctrine. However, internal realism is not the way this should be done. At the center of the following discussion lies the important difference between Putman's "real within a scheme" model and Kant's assertion of the independent existence of empirical objects. The strategy for the paper is as follows. I (...) intend to first detail the real and important connections that exist between the analyses of experience offered by Putnam and Kant. These similarities should not be discounted. In fact, I think we can distinguish the two projects only if we first appreciate the conceptual overlap that naturally gives rise to the perceived union of the two programmes. I will then develop a representative response that is invoked commonly by Kantians who disagree with Putman's identification. This will be followed by a brief discussion concerning why this standard reply fails. I will conclude by canvassing a more powerful epistemological reason for dissociating the two programmes. This article was first published as “Notation atomique et hypothèses atomistiques”, Revue des questions scientifiques, 31 (1892), 391– 457. It is the second of a series of articles Duhem was to publish in the Catholic journal Revue des questions scientifiques, in which he presents his understanding of what can justifiably be said about the structure of chemical substances as captured by chemical formulas. The argument unfolds following a broadly historical development of events throughout the course of the century which was (...) coming to a close as he wrote. He later reflected in his classic The Aim and Structure of Physical Theories – based in large part on articles which had appeared in the Revue – that “To give the history of a physical principle is at the same time to make a logical analysis of it” (p. 269). Logical analysis clearly dominates in the present article. The historical context was elaborated considerably in a later work, Le mixte et la combinaison chimique: Essai sur l’évolution d’une idée, which did not lead him to retract any aspect of his earlier position but provided a broader setting in which it could be elaborated. In particular, the Aristotelian influence, which is only hinted at here in some of the formulations (see especially the beginning of section VII) without mentioning Aristotle by name, is explicit in the later work, making Duhem’s own ontological conception a little clearer. A discussion of stereoisomerism, conspicuously absent in the present article, is also integrated into the later book. The same holds for Avogadro’s hypothesis. (shrink)

Several authoritative sources have raised the possibility that computer counting and monitoring of work in automated workplaces will transform offices into electronic sweatshops. This paper examines this idea from the vantage point of industrial sociology and managerial theory. Five theoretical models are developed, each of which generates hypotheses about the contexts in which work monitoring becomes important. A brief history of clerical work is given which shows the antecedents of surveillance and work-measurement in this sphere, and a case study of (...) control in an automated office is presented in order to illustrate certain practical limitations on the use of computer surveillance. These insights are combined into a synthetic model which describes those contexts in which surveillance would be likely to result in speed-ups, and those where it would not. (shrink)

In three parts, this paper seeks 1) to provide a synopsis of Bernard Lonergan‟s proof for the existence of God as presented in chapter nineteen of Insight, 2) to explain how Lonergan later came to critique his approach in Insight 19 in light of subsequent philosophical developments, and 3) to assess the ongoing relevance of Lonergan‟s Insight 19 argument given that aforementioned critique.The issues discussed in this paper are important for a variety of reasons.First, Lonergan‟s argument for the existence of (...) God may in fact be a sound argument. Second, Lonergan prefaced his argument with the incredibly bold and enticing claim that while arguments for the existence of God are many, all such arguments are implicitly included in the general form of his own argument.And third, however one may assess the preceding claim, the second and third parts ofthis paper will raise fundamental questions regarding the function and existential significance of any philosophical proof for the existence of God, and by doing sowill contribute to contemporary discussions concerning the relevance of philosophical theology. The ‘universal cell reaction’ (UCR), a coordinated biphasic response to external (noxious and other) stimuli observed in all living cells, was described by Nasonov and his colleagues in the mid‐20th century. This work has received no attention from cell biologists in the West, but the UCR merits serious consideration. Although it is non‐specific, it is likely to be underpinned by precise mechanisms and, if these mechanisms were characterized and their relationship to the UCR elucidated, then our understanding of the integration (...) of cellular function could be improved. As a step towards identifying such mechanisms, I review some recent advances in understanding cell mechanics and the stress response and I suggest potentially testable hypotheses. There is a particular need for time‐course studies of cellular responses to different stimulus doses or intensities. I also suggest a correspondence with hormesis; re‐investigation of the UCR using modern biophysical and molecular‐biological techniques might throw light on this much‐discussed phenomenon. Philosophy and Kafka is a collection of original essays interrogating the relationship of literature and philosophy. The essays either discuss specific philosophical commentaries on Kafka’s work, consider the possible relevance of certain philosophical outlooks for examining Kafka’s writings, or examine Kafka’s writings in terms of a specific philosophical theme, such as communication and subjectivity, language and meaning, knowledge and truth, the human/animal divide, justice, and freedom.

This article combines an appreciation of several themes in Josh Reeves's Against Methodology in Science and Religion: Recent Debates on Rationality and Theology while arguing in favor of critical realism. The author holds that critical realism manages to combine the objective truth reached through inference and especially cognitive acts of judgment as well as the various, contingent historical contexts that also define where science is practiced. Reeves advocates a historical perspective, but this article claims that in order for critical realism (...) to be credible, a philosophical perspective must be maintained. (shrink)

Au-delà de la théorie du droit, les analyses originales et minutieuses exposées concernent également la théorie de l'éthique et la théorie de la science, qui ont aussi affaire à des règles ou « lois » et qui en (...) sont aussi restées à des vues sommaires bien peu satisfaisantes. En particulier, ces analyses mettent en lumière l'usage incongru de l'utilitaire éthique dans le domaine scientifique, les lois théoriques construites par le savant étant insidieusement assimilées à des règles pratiques « gouvernant » le monde, auxquelles la nature aurait à « obéir ». L'ouvrage explore, par ailleurs, les perspectives pragmatiques que la théorie des actes de langage ouvre à la théorie du droit: notamment, « édicter » du droit ne consiste pas à « dire » des règles, mais à prescrire leur observance; bien des faux problèmes découlent de ce que l'idée de prescriptif est confondue avec celle de normatif et aplatie en elle. Après un examen comparatif de l'interprétation des textes juridiques, des textes littéraires et théâtraux et des textes sacrés, l'ouvrage aborde la question cruciale, fort débattue, de la liberté de l'interprète juridique.
