En partant des différentes questions soulevées par le retour ad fontes, l’article cherche à préciser la portée politique de l’implantation de la jurisprudentia cultior qui fut bien plus qu’une conquête philologique. Think of the last thing someone did to you to seriously harm or offend you. And now imagine, so far as you can, becoming fully aware of the fact that his or her action was the causally inevitable result of a plan set into motion before he or she was ever even born, a plan that had no chance of failing. Should you continue to regard him or her as being morally responsible—blameworthy, in this case—for what he or she did? (...) Many have thought that, intuitively, you should not. Recently, Alfred Mele has employed this line of thought to mount what many have taken to be a powerful argument for incompatibilism: the “Zygote Argument”. However, in interesting new papers, John Martin Fischer and Stephen Kearns have each independently argued that the Zygote Argument fails. As I see it, the criticisms of Fischer and Kearns reveal some important questions about how the argument is meant to be—or how it would best be—understood. Once we make a slight (but important) modification to the argument, however, I think we will be able to see that the criticisms of Fischer and Kearns do not detract from its substantial force. This study argues that the notion of transparency requires reconsideration as an essence of ethical agency. It provides a brief explication of the concept of transparency, rooted in the principle of human dignity of Immanuel Kant, and suggests that it has been inadequately appreciated by media ethics scholars and instructors more focused on relatively simplistic applications of his categorical imperative. This study suggests that the concept's Kantian roots raise a radical challenge to conventional understandings of human interaction and, by extension, (...) what it means to exercise freedom. This article is one of the first sociological explorations of power struggles between intellectuals where matters of life and death are literally at stake. It counters the prevailing tendency within sociology to study intellectuals within confined academic institutions where power struggles are limited to matters of symbolic and institutional recognition. This study explores the conflict between collaborationist and Resistance intellectuals at the end of the Second World War in France, and it focuses in particular on the purge of collaborationist intellectuals (...) which culminated in several high profile trials. This article shows that the arguments and meta-arguments put forward in these trials led to broader intellectual debates outside the courtroom. These debates not only centred on the notion of the writer’s responsibility, but also dealt with anxieties about the disintegrative forces of modern society. Whereas collaborationist intellectuals portrayed their writing as either separate from politics or rescuing a defunct or degenerate nation, Resistance intellectuals such as Jean-Paul Sartre were keen to portray collaborators as outsiders, both socially and sexually, lacking in social integration and subservient to a strong external force. The Resistance intellectuals saw the notion of individual responsibility not as antithetical but as integral to the remaking of the French nation, and this concept would become the cornerstone of the reshaping of the intellectual landscape in the post-war era in France. An emerging discourse about automated agricultural machinery imagines farms as places where farmers and workers do not need to be, but also implicitly frames farms as intolerable places where people do not want to be. Only autonomous machines, this story goes, can relieve farmers and workers of this presumed burden by letting them ‘farm at a distance’. In return for this distanced autonomy, farmers are promised increased control over their work-life balance and greater farm productivity from letting ‘smart’ robots assume (...) control over the operational environment. Drawing upon the ways that these machines are promoted by manufacturers in various media, we trace the nascent contours of what we term a liberatory sociotechnical imaginary for agricultural automation across three cases—automated milking systems, self-driving tractors, and robotic strawberry pickers. We show how promises for new freedoms and autonomy are flexibly deployed to respond to distinct frictions that farmers, workers, and even farm animals experience in different modes of industrial agriculture. However, underlying these promises is the purposefully understated self-interest of manufacturers, who stand to gain further control over farms if automated technologies assume a central role in agriculture. Through the liberatory rhetoric, we contend, the imaginary seeks to enroll farmers into a socio-technical network that creates new relations of dependence upon the companies who design, sell, maintain, and often retain ownership over automated technologies. While potentially powerful, this imaginary may nonetheless fail to coalesce as farmers, workers, and agroecosystems exert their own agency on automated imaginaries and technological futures for agriculture. We need an adequate account of the basing relation if we want to have a satisfactory account of doxastic justification, which we should want to have. Tschacher and Haken have recently applied a systems-based approach to modeling psychotherapy process in terms of potentially beneficial tendencies toward deterministic as well as chaotic forms of change in the client’s behavioral, cognitive and affective experience during the course of therapy. A chaotic change process refers to a greater exploration of the states that a client can be in, and it may have a potential positive role to play in their development. A distinction is made between on the one hand, (...) specific instances of instability which are due to techniques employed by the therapist, and on the other, a more general instability which is due to the therapeutic relationship, and a key, necessary result of a successful therapeutic alliance. Drawing on Friston’s systems-based model of free energy minimization and predictive coding, it is proposed here that the increase in the instability of a client’s functioning due to therapy can be conceptualized as a reduction in the precisions with which the client’s prior beliefs about themselves and their world, are held. It is shown how a good therapeutic alliance results in the emergence of a new hierarchical level in the client’s generative model of themselves and their relationship with the world. The emergence of this new level of functioning permits the reduction of the precisions of the client’s priors, which allows the client to ‘open up’: to experience thoughts, emotions and experiences they did not have before. It is proposed that this process is a necessary precursor to change due to psychotherapy. A good consilience can be found between this approach to understanding the role of the therapeutic alliance, and the role of epistemic trust in psychotherapy as described by Fonagy and Allison. It is suggested that beneficial forms of instability in clients are an underappreciated influence on psychotherapy process, and thoughts about the implications, as well as situations in which instability may not be beneficial for therapy, are considered. The title reflects my conviction that, viewed semantically,modal logic is fundamentally dialogical; this conviction is based on the key role played by the notion of bisimulation in modal model theory. But this dialogical conception of modal logic does not seem to apply to modal proof theory, which is notoriously messy. Nonetheless, by making use of ideas which trace back to Arthur Prior (notably the use of nominals, special proposition symbols which ‘name’ worlds) I will show how to lift the dialogical (...) conception to modal proof theory. I argue that this shift to hybrid logic has consequences for both modal and dialogical logic, and I discuss these in detail. (shrink)

This paper reports on the findings of the third in a series of surveys of large U.S.-based and multinational corporations on their ethics statements. Focusing on four types – values statement, corporate credo, code of ethics and Internet privacy policy – we find growth in the use of these statements over the last decade. We discuss the external communication of these statements, including the avenues that are now used for promotion and their intended audiences. While the subjective experience of insight during problem solving is a common occurrence, an understanding of the processes leading to solution remains relatively uncertain. The goal of this study was to investigate the restructuring patterns underlying solution of a creative problem, and how providing cues to solution may alter the process. Results show that both providing cues to solution and analyzing problem solving performance on an aggregate level may result in restructuring patterns that appear incremental. Analysis of performance on an (...) individual level provides evidence for insight-like solution patterns. However, no evidence is found for a relationship between an individual’s restructuring pattern and their subjective experience of insight during problem solving. (shrink)

This is the long-awaited first offering by the well-known feminist theologian, a professor of religion at Carleton College and a past president of the Catholic Theological Socity of America.

What part should description play in coming to judgment? Questions about genre have become more important in religious ethics as many seek to reform “thin” models of ethical arbitration by recourse to artistic, literary, and historical descriptions in their texts. In this book discussion, I explore what the consequences would be of pursuing this reform by turning to social anthropology—a discipline that relies on extensive empirical descriptions. I do this by considering the anthropology of ethics: a movement that seeks, for (...) the first time, to devote systematic and sustained attention the moral lives of ethnographic informants. I focus on the ways that authors within this field attempt to arrive at more realistic portraits of the different ways societies play out the familiar ethical themes of freedom, responsibility, suffering and agency. Their work challenges religious ethicists to consider what ethical conversation across these differences would look like, and thus to reconsider the relationship between description and judgment in their work. Visual forms of episodic memory and anticipatory imagination involve images that, by virtue of their perspectival organization, imply a notional subject of experience. But they contain no inbuilt reference to the actual subject, the person actually doing the remembering or imagining. This poses the problem of what (if anything) connects these two perspectival subjects and what differentiates cases of genuine memory and anticipation from mere imagined seeing. I consider two approaches to this problem. The first, exemplified by Wollheim and Velleman, (...) claims that genuinely reflexive memories and anticipations are phenomenally unselfconscious, with the co-identity of the notional and actual subjects secured by a determinate causal history. The second approach posits some distinctive phenomenal property that attaches to genuinely reflexive memories and anticipations and serves to experientially conflate the notional and actual subject. I consider a version of the second approach, derived from Kierkegaard’s discussions of phenomenal contemporaneity, and argue that this approach can better account for the possibility of affective alienation from the selves we were and will be: the way in which our sense of self and awareness of our causal history can sometimes come apart. These breakthroughs are discussed relative to the ethical and economic implications for the insurance industry. Individual's privacy rights and rights to employment must be weighed against the insurers desire for better estimates of future loss costs associated with health, life and other insurances.
