The Chief Enforcement Officer and Insolvency in Israeli Law.Pablo Lerner - 2006 - Theoretical Inquiries in Law 7 (2):565-596.
Israeli enforcement law uses both direct and indirect enforcement — the former via attachment of assets, and the latter via imprisonment of the debtor. The use of indirect enforcement via imprisonment is problematic, as it violates the basic rights of the debtor. I will argue that in response to this problem, the law created a framework for the "debtor of limited means." I will demonstrate that not only does this create an improper definition of the task of the Chief Enforcement (...)

Using History and Philosophy of Science to Promote Students’ Argumentation.Pablo Antonio Archila - 2015 - Science & Education 24 (9-10):1201-1226.
This article describes the effect of a teaching–learning sequence based on the discovery of oxygen in promoting students’ argumentation. It examines the written and oral arguments produced by 63 high school students in France during a complete TLS supervised by the same teacher. The data used in this analysis was derived from students’ written responses, audio and video recordings, and written field notes. The first goal of this investigation was to provide evidence that an approach combining history and philosophy of (...)

  5. Why the Court Should Free Happy.Gary Comstock, Adam Lerner & Peter Singer - 2022 - Inside Sources.
Should the law recognize an elephant’s right to be released from solitary confinement? The New York State Court of Appeals—the highest court in the State of New York—will consider this question on May 18. At issue is an Asian elephant named Happy. But happy she is not. Every human being has a right to bodily liberty because they have strong interests that this right protects. Since Happy has the same strong interests, the Court should recognize Happy’s right to be freed (...)

Pollution, profits, and stakeholders: The constraining effect of economic performance on CEO concern with stakeholder expectations. [REVIEW]Robert S. Dooley & Linda D. Lerner - 1994 - Journal of Business Ethics 13 (9):701 - 711.
This study examined the constraining effect of economic performance on the relationship between CEO stakeholder orientations and four pollution performance categories. Economic performance was found to moderate the relationship for two of the four categories. Additionally economic performance was found to consistently interact with some CEO stakeholder orientations and not others. Overall the results suggest that CEO concern with stakeholder expectations is in large part moderate by the economic performance of the firm.

Distributed leathership epistemological bases: The case of education research.Pablo López - 2013 - Cinta de Moebio 47:83-94.
The article reviews research between 1999 and 2013 with the aim of knowing the epistemological foundations of research on distributed leadership, with special interest in education studies. We conclude it is an area in developing, with potential, but its empirical foundations are weak and methodological strategies are not always explicit, making it difficult to evaluate their findings somewhat. With respect to the theoretical basis, much of the research finds their sustenance in Engeström’s activity theory and Hutchins’s distributed cognition. The importance (...)

We begin by a summary of the standardized version of the model of the interaction between scientific activities and values (elaborated fully in Lacey and Mariconda, 2015), and based on it we argue that there is a profound incoherence in the self- understanding of the modern scientific tradition, and that the main options actually available to ensure continuity with the positive realizations of this tradition can be well represented by two sorts of ideal types that we name, respectively,“commercially orientated technoscience” (...)

Future pandemics and the urge to ‘do something’.Adam Lerner & Nir Eyal - forthcoming - Journal of Medical Ethics.
Research with enhanced potential pandemic pathogens (ePPP) makes pathogens substantially more lethal, communicable, immunosuppressive or otherwise capable of triggering a pandemic. We briefly relay an existing argument that the benefits of ePPP research do not outweigh its risks and then consider why proponents of these arguments continue to confidently endorse them. We argue that these endorsements may well be the product of common cognitive biases—in which case they would provide no challenge to the argument against ePPP research. If the case (...)

Revolutionary Love: A Political Manifesto to Heal and Transform the World.Michael Lerner - 2019 - University of California Press.
From social theorist and psychotherapist Rabbi Michael Lerner comes a strategy for a new socialism built on love, kindness, and compassion for one another. _Revolutionary Love_ proposes a method to replace what Lerner terms the "capitalist globalization of selfishness" with a globalization of generosity, prophetic empathy, and environmental sanity. Lerner challenges liberal and progressive forces to move beyond often weak-kneed and visionless politics to build instead a movement that can reverse the environmental destructiveness and social injustice caused (...)

    Justice and Self-Interest: Two Fundamental Motives.Melvin J. Lerner & Susan Clayton - 2011 - Cambridge University Press.
This volume argues that the commitment to justice is a fundamental motive and that, although it is typically portrayed as serving self-interest, it sometimes takes priority over self-interest. To make this case, the authors discuss the way justice emerges as a personal contract in children's development; review a wide range of research studying the influences of the justice motive on evaluative, emotional and behavioral responses; and detail common experiences that illustrate the impact of the justice motive. Through an extensive critique (...)

    Emotions, Science, and Generativity. A Husserlian Perspective.

    Interfering with divinely imposed suffering.Berel Dov Lerner - 2000 - Religious Studies 36 (1):95-102.
In the course of presenting his celebrated 'vale of soul-making' theodicy, John Hick claims that in a world where all human suffering is either justly deserved divine punishment or imposed by God for the spiritual growth of the sufferer, people would lack opportunity to be involved in genuine acts of deep compassion. I argue that the relief of divinely imposed suffering can be a morally valuable and spiritually beneficial activity, and mention ideas from the Jewish tradition which suggest that it (...)

The contributors to this volume are internationally renowned scholars from psychology, business, and law. They examine the role of justice motivation in a wide variety of contexts, including workplace violence, affirmative action programs, helping or harming innocent victims and how people react to their own fate. Contributors explore fundamental issues such as whether people's interest in justice is motivated by self-interest (...)

A critical analysis of definitions of health as balance in a One Health perspective.Henrik Lerner - 2019 - Medicine, Health Care and Philosophy 22 (3):453-461.
Definitions of health in terms of some kind of balance form a category of their own within the sphere of health definition. Such definitions have their roots in the beginnings of scientific medicine, and popular versions are common among lay people. It has even been claimed that balance is fundamental to health for all species. Several present-day definitions of health in terms of balance are presented here. Particular attention is given to the call for a definition of health applicable to (...)

What should our theorizing about social justice aim at? Many political philosophers think that a crucial goal is to identify a perfectly just society. Amartya Sen disagrees. In The Idea of Justice, he argues that the proper goal of an inquiry about justice is to undertake comparative assessments of feasible social scenarios in order to identify reforms that involve justice-enhancement, or injustice-reduction, even if the results fall short of perfect justice. Sen calls this the “comparative approach” to the theory of (...)

Are some of our concepts innate or are they all learned? What role do our bodies play in cognition? Can neuroscience help us understand the mind? Can cognitive science help us understand human morality? The volume contains two accessible essays on each topic, each advocating for an opposing (...)

This book offers a systematic and critical discussion of Peter Winch's writings on the philosophy of the social sciences. The author points to Winch's tendency to over-emphasize the importance of language and communication, and his insufficient attention to the role of practical, technological activites in human life and society. It also offers an appendix devoted to the controversy between the anthropologists Marshall Sahlins and Gananath Obeyesekere regarding Captain James Cook's Hawaiian adventures.
