Hillel Steiner’s applied theory of territorial rights is part of his broader left-libertarian theory of rights. Steiner believes that all individuals have the libertarian right to self-ownership and to an equal share of the value of (global) natural resources. He thus views territorial rights as being ultimately reducible to the lower-level rights of free and equal individuals. This view challenges most accounts of nationalism (and territorial collectivism) as well as the normative theories of state sovereignty based on them. It thus (...) offers new perspectives on such issues as secession, immigration, and global justice. This article showcases how these ideas generate normative guidelines for solving territorial disputes. Among his concrete institutional proposals, relevant for the contemporary debate, is a globally distributed universal basic income (UBI) funded by the global taxation of natural resources. (shrink)

This paper investigates the question of which place in the history of political ideas may be assigned to the Constitutional Debate in Herodotus’ _Histories_, 3.80-82. It is shown that the Herodotean debate represents the earliest extant example of a social theory, in which a variety of distinctly social ordering principles are weighed against each other with normative arguments and in isolation from all sorts of divine authorisations. The article divides into three parts. The first part gives an account of the (...) theoretical predecessors to the classical social theory first evidenced in the Constitutional Debate. The second part consists of an exposition of the socio-intellectual progressions clustered in the Herodotean debate, focussing on developments in constitutional thinking and argumentative evolvement. We explore the finite model theory of the characterisation theorems for modal and guarded fragments of first-order logic over transition systems and relational structures of width two. A new construction of locally acyclic bisimilar covers provides a useful analogue of the well known tree-like unravellings that can be used for the purposes of finite model theory. Together with various other finitary bisimulation respecting model transformations, and Ehrenfeucht–Fraïssé game arguments, these covers allow us to upgrade finite approximations for full bisimulation equivalence (...) towards approximations for elementary equivalence. These techniques are used to prove several ramifications of the van Benthem–Rosen characterisation theorem of basic modal logic for refinements of ordinary bisimulation equivalence, both in the sense of classical and of finite model theory.
