In the course of the fourth and fifth centuries, the colonate developed from a legal principle to a legal institution. The original soil bond (origo) was transformed into a legal status (condicio). These structures of legal, social and economic organisation were already in place when the Vandals conquered North Africa in the 430s. The arrivals thus inherited a functioning system, and since they changed very few of the structures they found in North Africa, they kept the colonate more or less (...) as they found it. The aim of this study is to substantiate this thesis of the Vandal settlement and the continuation of the colonate and to present it on the basis of Roman laws. To this end, the legal sources are compared with the literary testimonies of the bishops Victor of Vita and Augustine, and the Tablettes Albertini are included in the analysis. The considerations on the continuity of the colonate are embedded in the overall context of the general legal development of the law on the colonate. With this paper, the author concludes his studies on the further development of the colonate in the post-Roman kingdoms. (shrink)

A familiar slogan in the literature on temporal experience is that ‘a succession of appearances, in and of itself, does not amount to an experience of succession’. I show that we can distinguish between a strong and a weak sense of this slogan. I diagnose the strong interpretation of the slogan as requiring the support of an assumption I call the ‘Seems→Seemed’ claim. I then show that commitment to this assumption comes at a price: if we accept it, we either (...) have to reject the extremely plausible idea that experience is as it seems, or we are forced to provide an account of temporal experience that isn’t compatible with the phenomenology. I conclude by noting that the only plausible interpretation of the slogan is the weak interpretation, and outline a positive account of temporal experience, according to which an appearance of succession requires a succession of appearances. In this paper, I want to make two main points. The first point is methodological: Instead of attempting to give a classical analysis or reductive definition of the term “expertise”, we should attempt an explication and look for what may be called symptoms of expertise. What this comes to will be explained in due course. My second point is substantial: I want to recommend understanding as an important symptom of expertise. The notion of common morality plays a prominent role in some of the most influential theories of biomedical ethics. Here, I focus on Beauchamp and Childress’s models in the fourth and fifth edition of Principles of Biomedical Ethics as well as on a revision that Beauchamp proposed in a recent article. Although there are significant differences in these works that require separate analysis, all include a role for common morality as starting point and normative framework for theory construction in combination (...) with a coherence theory of moral justification. I defend to some extent the existence and empirical significance of common morality, as delineated by Beauchamp and Childress in different versions, but criticize its normative role. It is neither convincing as a moral foundation nor well compatible with a standard coherentist justification. I suggest that the authors should give up the foundational account for a more modest account of common morality as resource of well-established moral insights and experiences, which have proved generally valid but neither sufficient nor infallible. Beauchamp’s latest proposal appears as a step in this direction; indeed, it may be the beginning of the end of his common-morality theory. (shrink)

This article considers how the new finds have affected one's view of Empedocles, and suggests how interpretation of that material might help solve some longstanding problems about the structure and content of Empedocles' writings. A basic account of the teachings of Empedocles would distinguish between two main components. On the one hand, there is a “Presocratic” physics, including a theory of principles, a cosmology, and a biology. On the other hand, there is a mythical law, clearly inspired by Orphic or (...) Pythagorean legends, which imposes on guilty gods a punishment consisting in their transmigration through a series of mortal beings. The purpose of this article is to show that Empedocles has the habit of referring to divine entities of his physical system both in a physical and in a mythological way and that his uses of the word daimon form part of this twofold language. There are two different varieties of question concerning the unity of consciousness: questions about unity at a time, and unity over time. A recent trend in the debate about unity has been to attempt to provide a ‘generalized’ account that purports to solve both problems in the same way. This attempt can be seen in the accounts of Barry Dainton and Michael Tye. In this paper, I argue that there are crucial differences between unity over time and unity at a (...) time that make it impossible to provide a generalized account of unity. The source of these crucial differences is the phenomenon of the ‘continuity of consciousness’. I argue that accounts of unity over time have to provide an account of this continuity, and that there is no phenomenon analogous to continuity in the case of unity at a time. Attention to the continuity of consciousness reveals crucial structural differences between the two varieties of unity. These structural differences make it impossible to provide a generalized account of unity. I show that the problems faced by Dainton’s and Tye’s accounts in the light of the structural differences make their accounts of unity appear far less appealing than they might initially have looked. I conclude by noting that, in the light of the important differences between the two varieties of unity, it is a mistake to attempt to model accounts of unity over time on accounts of unity at a time. Competence to enact responsible practices, such as recycling waste or boycotting irresponsible companies, is core to learning for responsibility. We explore the role of apps in learning such responsible practices ‘in the wild,’ outside formal educational environments over a 3-week period. Learners maintained a daily diary in which they reflected on their learning of responsible practices with apps. Through a thematic analysis of 557 app mentions in the diaries, we identified five types of app-agency: cognitive, action, interpersonal, personal development, and (...) material. Findings were interpreted from an actor-network perspective using the lens of ‘translation.’ To understand how apps enabled the learning of responsible practices, we analyzed app agency throughout four moments of translation: problematization, interessement, enrolment, and mobilization. Based on our analysis of how students’ app mentions changed over time, we further theorize learning as a sequence of subtranslations that form the larger translation process: learning as translation(s). Each subtranslation cycle is centered on enrolling a different set of human and nonhuman actors, with their competence, into the network. We contribute to the learning for responsibility field by showcasing how app-enabled learning may create real-life actor networks enacting responsibility, and by priming an actor-network pedagogy for ‘learning in the wild.’ We also contribute to the actor-network learning discussion by conceptualizing heterogeneous human–nonhuman competence and the first processual model of learning as translation(s). At the centre of responsible management (RM) learning is the development of managerial competence for ethics, responsibility, and sustainability (ERS). Important contributions have been made from each: the ethics, responsibility, and sustainability disciplines. However, we are yet to integrate these disciplinary contributions into a comprehensive interdisciplinary RM competence framework that corresponds to the interdisciplinary nature of RM challenges. We address this priority in this paper and report on the findings of an integrative structured literature review of 224 management competence articles (...) across the ERS disciplines. Our thematic template analysis has produced an interdisciplinary RM competence framework of three layers of personal, behavioural, and intellectual competences and independent and interdependent competence dimensions. The resulting 3 × 2 competence matrix framework accommodates 33 interdisciplinary ERS competence themes and 90 subthemes in the six competence domains of _being_ and _becoming_, _acting_ and _interacting_, _knowing_ and _thinking_. To the RM discussion, we contribute an interdisciplinary competence framework that enables the development of responsible managers who tackle the inherently interdisciplinary issues of RM. The pathologization of women’s depression covers over the social and institutional causes of that symptomology. Insofar as patriarchal values continue to devalue and debase women and mothers in ways that colonize psychic space, and depression becomes a cover for what I call ‘social melancholy.’ This is not the melancholy of traditional psychoanalysis, but a form of melancholy that results from oppression, domination, and the colonization of psychic space. Social melancholy differs from both Freud’s notion of melancholy in that it is (...) the result of social factors that constitute the depressed subject as ashamed and lacking agency. Crucial to my analysis is a distinction between shame and guilt missing from traditional psychoanalytic accounts of melancholy and depression. (shrink)

Deepfakes are fake recordings generated by machine learning algorithms. Various philosophical explanations have been proposed to account for their epistemic harmfulness. In this paper, I argue that deepfakes are epistemically harmful because they undermine trust in recording technology. As a result, we are no longer entitled to our default doxastic attitude of believing that P on the basis of a recording that supports the truth of P. Distrust engendered by deepfakes changes the epistemic status of recordings to resemble that of (...) handmade images. Their credibility, like that of testimony, depends partly on the credibility of the source. I consider some proposed technical solutions from a philosophical perspective to show the practical relevance of these suggestions. (shrink)

My essay is framed by Hypatia's first special issue on Motherhood and Sexuality at one end, and by the most recent special issue (as of this writing) on the work of Iris Young, whose work on pregnant embodiment has become canonical, at the other. The questions driving this essay are: When we look back over the last twenty-five years, what has changed in our conceptions of pregnancy and maternity, both in feminist theory and in popular culture? What aspects of feminist (...) debates from the 1970s and 1980s are still relevant today? And, how might what appear to be radical shifts in popular perceptions of pregnancy actually continue traditional values that objectify and “abjectify” the maternal body?Here, I will focus on three central elements of the revaluation of pregnancy and maternity as they show up in feminist philosophy and in popular culture: 1. The relationship between pregnancy and sexuality, both in terms of pregnant sexuality and in terms of the pregnant body as sexual object; 2. The “choice” to become a mother as a “feminist choice”; 3. In [STU 00, KUT 03] we introduced a family of ‘modal' languages intended for talking about distances. These languages are interpreted in ‘distance spaces' which satisfy some of the standard axioms of metric spaces. Among other things, we singled out decidable logics of distance spaces and proved expressive completeness results relating classical and modal languages. The aim of this paper is to axiomatize the modal fragments of the semantically defined distance logics of [KUT 03] and give a new proof of (...) their decidability. (shrink)

Following Max Horkheimer, I will first attempt to reconstruct an anthropology that essentially wants to be understood as critical social research. I will then pursue the question of humanism in critical theory. In doing so, I want to show that a reference to a normatively substantive humanism does actually exist in critical theory. On the other hand, I want to show that this humanism is anything but unambiguously and systematically formulated but has been reflected and articulated differently by different representatives (...) of critical theory. The two examples I will refer to here are Theodor W. Adorno and Erich Fromm. I will define Adorno’s humanism as ‘dialectical humanism’, whereas Fromm’s humanism could be described as ‘emphatic humanism’. My reading, however, attempts to interrogate the two positions as to their complementarity. Not ‘Adorno or Fromm’, but ‘Adorno and Fromm’ is the motto that guides me. Finally, I will relate this complementary reading of both approaches in such a way that the possibility of a ‘Critical Humanism’ can be derived from it, which above all also wants to be understood as a sociological research program. How is metaphysics related to the empirical sciences? Should metaphysics in general be guided by the sources, methods and results of the sciences? And what about the special case of the metaphysics of the social world: should it likewise be guided by the sources, methods and results of the social sciences? In her paper “Social Science as a Guide to Social Metaphysics?”, K. Hawley raises the question: If we are sympathetic to the project of naturalising metaphysics, how should we approach (...) the metaphysics of the social world? She proceeds by discussing three approaches to social metaphysics: inference to the best explanation from current social science, descriptive conceptual analysis, and normative, especially ‘ameliorative’ projects. At the end of her discussion, she reaches a rather pessimistic conclusion, especially as regards the IBE approach: “a number of phenomena indicate that the prospects for securely basing social metaphysics via inference to the best explanation from social science are currently faint. […] We need to look elsewhere if we are to develop a metaphysics of the social world.” In my comments on her paper, I try to re-animate the program of an inductive metaphysics by defending the idea that the method of inference to the best explanation should be the central method of justification for metaphysics in general and for social metaphysics in particular. Although much of the growing literature on organizational identity implicitly recognizes the normative nature of identity, the ethical implications of organizational identity work and talk have not yet been explored in depth. Working from a meta-ethical perspective, we claim that the dynamic, processual, and temporal activities recently associated with organizational identity always have an ethical dimension, whether "good" or "bad." In order to describe the ethical dimensions of organizational identity, we introduce the balance theory of practical wisdom as a theoretical (...) framework, and connect this theory to existing organizational identity concepts. We present an empirical case focused on an international paint company to illustrate the relevance of this theory for empirical organizational identity research. Our intention is to expand existing theory by bringing an aspect of organizational identity that has been tangentially acknowledged to the forefront, and by identifying it as a fruitful avenue for future theory development as well as empirical research. Almost all set theorists pay at least lip service to Cantor’s definition of a set as a collection of many things into one whole; but empty and singleton sets do not fit with it. Adapting Dana Scott’s axiomatization of the cumulative theory of types, we present a ‘Cantorian’ system which excludes these anomalous sets. We investigate the consequences of their omission, examining their claim to a place on grounds of convenience, and asking whether their absence is an obstacle to the (...) theory’s ability to represent ordered pairs or to support the arithmetization of analysis or the development of the theory of cardinals and ordinals. In [14], we studied the computational behaviour of various first-order and modal languages interpreted in metric or weaker distance spaces. [13] gave an axiomatisation of an expressive and decidable metric logic. The main result of this paper is in showing that the technique of representing metric spaces by means of Kripke frames can be extended to cover the modal (hybrid) language that is expressively complete over metric spaces for the (undecidable) two-variable fragment of first-order logic with binary pred-icates interpreting the (...) metric. The frame conditions needed correspond rather directly with a Boolean modal logic that is, again, of the same expressivity as the two-variable fragment. We use this representation to derive an axiomatisation of the modal hybrid variant of the two-variable fragment, discuss the compactness property in distance logics, and derive some results on (the failure of) interpolation in distance logics of various expressive power. Recent advances in evolutionary biology and ethology suggest that humans are not the only species capable of empathy and possibly morality. These findings are of no little consequence for theology, given that a nonhuman animal as a free moral agent would beg the question if human beings are indeed uniquely created in God's image. I argue that apes and some other mammals have moral agency and that a traditional interpretation of the imago Dei is incorrectly equating specialness with exclusivity. By (...) framing the problem in terms of metaphor, following the work of Paul Ricoeur and Sallie McFague, I propose that the concept of the imago Dei could be extended to accommodate moral species other than our own. Occam’s razor directs us to adopt the simplest hypothesis consistent with the evidence. Learning theory provides a precise definition of the inductive simplicity of a hypothesis for a given learning problem. This definition specifies a learning method that implements an inductive version of Occam’s razor. As a case study, we apply Occam’s inductive razor to causal learning. We consider two causal learning problems: learning a causal graph structure that presents global causal connections among a set of domain variables, and learning (...) context-sensitive causal relationships that hold not globally, but only relative to a context. For causal graph learning, Occam’s inductive razor directs us to adopt the model that explains the observed correlations with a minimum number of direct causal connections. For expanding a causal graph structure to include context-sensitive relationships, Occam’s inductive razor directs us to adopt the expansion that explains the observed correlations with a minimum number of free parameters. This is equivalent to explaining the correlations with a minimum number of probabilistic logical rules. The paper provides a gentle introduction to the learning-theoretic definition of inductive simplicity and the application of Occam’s razor for causal learning. (shrink)

Neither legalistic gender-neutral categories nor prior feminist theories adequately capture all of the gender dynamics of child sexual abuse. Surveys of 923 young adults, 88 of whom reported sexual contact with adults before they were 16, complemented by intensive follow-up interviews with 18 reporting contact, reveal that gendered constructions of sexuality and dominance make the experience of abuse significantly different for boys and girls. Girls nearly always had contact with men and tended to experience it as harmful abuse. Boys were (...) more likely to have contact with women than with men; they generally interpreted contact with women as consensual, but their contact with men as abusive. Extensions of feminist gender analysis are required to explain these patterns. (shrink)

Every materially adequate explication of the concepts ``picture''and ``the pictorial'' has to appeal to syntactical properties.From the available definitions, a conception of syntax is extractedthat is applicable to symbol systems of any sort. Against thisbackground, it is shown that a non-semantical characterization ofthe pictorial is mandatory. Finally, specific syntactical featuresare explicated that recommend themselves as necessary conditions forthe application of the concept of a picture.

Arguments from analogy are pervasive in everyday reasoning, mathematics, philosophy, and science. Informal logic studies everyday argumentation in ordinary language. A branch of fuzzy logic, approximate reasoning, seeks to model facets of everyday reasoning with vague concepts in ill-defined situations. Ways of combining the results from these fields will be suggested by introducing a new argumentation scheme—a fuzzy analogical argument from classification—with the associated critical questions. This will be motivated by a case study of analogical reasoning in the virtual friendship (...) debate within information ethics. The virtual friendship debate is a disagreement over whether virtual friendships are genuine friendships. It will be argued that the debate could move away from its current impasse, caused by unproductive metaphysical and logical assumptions, if extant arguments are reinterpreted as fuzzy analogical arguments from classification, and subjected to a new set of critical questions which would replace the quest for facts of essence about friendship with an emphasis on empirical data, persuasion, and definitional power. In some worlds he rejected the baptism, got married, had a daughter, Anna, and ended up as an indebted alcoholic ex‐Pinkerton agent. In the Comstock world, Anna is renamed Elizabeth in order to conceal her true origins. Wittgenstein did not claim that the ordinary language concept ‘game’ cannot be defined: he claimed that there are multiple definitions that can be adopted for special purposes, but no single definition applicable to all games. I will defend this interpretation of Wittgenstein’s position by showing its compatibility with a pragmatic argumentative view of definitions, and how this view accounts for the diversity of disagreeing game definitions in definitional disputes.

In this essay, the enlightenment is not considered as a bygone age, but as a systematic epistemological, moral and political program that can, in principle, be pursued at any time. Since Kant has done most to clarify this program, his philosophy may serve as a starting point for discussion of the questions: How do the leading ideas of the enlightenment hang together? How are they justified?

Sequential von Neumann–Morgernstern (VM) games are a very general formalism for representing multi-agent interactions and planning problems in a variety of types of environments. We show that sequential VM games with countably many actions and continuous utility functions have a sound and complete axiomatization in the situation calculus. This axiomatization allows us to represent game-theoretic reasoning and solution concepts such as Nash equilibrium. We discuss the application of various concepts from VM game theory to the theory of planning and multi-agent (...) interactions, such as representing concurrent actions and using the Baire topology to define continuous payoff functions.
