Primatological and archaeological evidence along with anthropological accounts of hunter-gatherer societies indicate that lethal between-group violence may have been sufficiently frequent during our ancestral past to have shaped our evolved behavioral repertoire. Two simulations explore the possibility that heroism (risking one's life fighting for the group) evolved as a specialized form of altruism in response to war. We show that war selects strongly for heroism but only weakly for a domain-general altruistic propensity that promotes both heroism and other privately costly, (...) group-benefiting behaviors. A complementary analytical model shows that domain-specific heroism should evolve more readily when groups are small and mortality in defeated groups is high, features that are plausibly characteristic of our collective ancestral past. This article focuses on the problem of criminal liability for unlawful engagement in economic activities, analyses the emergence and development of this norm in criminal law and the ways of its optimal explanation. Special attention is paid to the problem of identification of illegality of activities, based on specific tax and economic regulation. The study concludes that criminal liability must be limited to a violation of fundamental requirements for the legality of business, and does not include particular abuses occurring in (...) legal business. The author also deals with the criteria of delimitation of criminal and administrative liability for unlawful engagement in economic activities. Under Article 202(1) of the Criminal Code of the Republic of Lithuania, application of criminal liability is limited by two alternative conditions: either a person illegally undertakes activity in entrepreneurial way or on a large scale. According to the paper, the above-mentioned regulation lacks clarity and leads to the risk of unfounded prosecutions. The author gives practical examples, where on the basis of inexplicable criterion of an entrepreneurial way, criminal charges are filed in respect of petty economic activities. Such practice is incompatible with the purposes and principles of criminal law. The paper proposes to delete the criterion of an entrepreneurial way from the definition, leaving the possibility of criminal liability only in case of large scale illegal economic activity. The article also substantiates the conclusion that prohibited business activities provided for in Article 202(2) of the Criminal Code actually defies logical explanation and should be removed from the regulation. At the end of the article, the author offers a sample of optimal legal wording of unlawful engagement in economic activities in criminal law. (shrink)

This article is dedicated to Nikolai O. Lossky’s intuitivism and personalism and their significance in the context of Russian philosophy. The author demonstrates how Lossky’s study of Russian philosophy influenced his work and allowed him to take a second look at a number of philosophical issues, indicating ways to develop them further. As a result of his research, Lossky discovered ideas close to his own in the works of various other Russian philosophers. Lossky became especially interested in two authors, Vladimir (...) S. Solovyov and Fyodor M. Dostoevsky. He created interpretations that examined Solovyov’s philosophy and Dostoevsky’s works from the positions of intuitivism and personalism. The study of Russian thought Lossky undertook in his book History of Russian Philosophy gave him a strong impetus for developing his own philosophical views, which were aimed at bringing philosophy and religion into closer proximity. We propose that a top priority of the cerebral cortex must be the discovery and explicit representation of the environmental variables that contribute as major factors to environmental regularities. Any neural representation in which such variables are represented only implicitly (thus requiring extra computing to use them) will make the regularities more complex and therefore more difficult, if not impossible, to learn. The task of discovering such important environmental variables is not an easy one, since their existence is only indirectly (...) suggested by the sensory input patterns the cortex receives – these variables are “hidden.” We present a candidate computational strategy for (1) discovering regularity-simplifying environmental variables, (2) learning the regularities, and (3) using regularities in perceptual and decision-making tasks. The SINBAD computational model discovers useful environmental variables through a search for different, but nevertheless highly correlated functions of any kind over non-overlapping subsets of the known variables, this being indicative of some important environmental variable that is responsible for the correlation. We suggest that such a search is performed in the neocortex by the dendritic trees of individual pyramidal cells. According to the SINBAD model, the basic function of each pyramidal cell is (1) to discover and represent one of the regularity-simplifying environmental variables, and (2) to learn to infer the state of its variable from the states of other variables, represented by other pyramidal cells. A network of such cells – each cell just attending to representation of its variable – can function as a sophisticated and useful inferential model of the outside world. (shrink)

The authors investigated the relevance of consequentialism in commercial space exploration as well as in the actively developing space market. The authors conclude that space expansion and colonization of space objects will lead to a revision of the foundational consequentialism provisions. Consequentialism, formed during the history of terrestrial civilization, loses its effectiveness under conditions of space commercialization. The basics of planetary thinking are different from those of cosmic thinking. Therefore, considering the meaning of the terms “cosmic expansion” and “colonization of (...) the cosmos” through the existing theory of consequentialism faces serious contradictions. There is a range of problems that are not explored in modern philosophy and ethics due to the lack of an empirical basis for philosophical analysis. (shrink)

National scientists have elaborated the reform's gist, approaches, stages and consequences in the Ukrainian agricultural sector during the XX - XXI centuries. These studies have been conducted by N. Zhulkanych, S. Zhyvora, M. Zyza, M. Lendiel, E. Mazur, O. Malyarchuk, V. Nechytailo and many others. The paper aims to perform the comprehensive study of general trends and peculiar features of the agricultural development of the Ukrainian SSR in 1963-1990 and to define actual advances and drawbacks on the basis of analysis (...) of historical records and scientific literature. The object of research is agriculture as part of socialist economy in the USSR. The subject of research is the implementation features of agricultural policy of the Soviet power in the Ukrainian SSR, using the Western region of the Republic as an example. The economic strategy of the Soviet power involved a long-term industrialization of the agricultural sector. A distinguishing feature of the industrialization process was the use of systems of machinery in all branches of agriculture. The technological chain had to embrace the process from the sporadic application of machinery to the overall mechanization and automation of crop and livestock farming. The industrial background of production predetermined the implementation of the system of machinery with extensive power consumption, i.e. with the new technical bases. The resolutions of the March Plenum of the CPSU Central Committee defined the economic priorities and capacity development of the Republic. Capital investments were the economic basis for the increase of production potential of collective and state farms, solution of social problems in rural regions. The land productivity was increased mainly by means of land reclamation and production chemization, use of organic and mineral fertilizers, pesticides, fungicides, etc. The supply of mineral fertilizers increased, but most of them were of low quality, non-concentrated and unbalanced in nutritional ingredients. In its turn it caused irreparable damage to the environment and polluted agricultural products with chemicals. The chemization undermined the population health and disrupted the ecological balance. Despite ultimate achievements in the rise of the industrial level of agriculture of the Ukrainian SSR, it didn't meet the needs of collective and state farms. A great number of labour-intensive processes in animal and crop farming were performed manually. In state farms, contrary to collective farms, the stock of tractors was newer, but much smaller. For many years the USSR was in the top ten countries of the world in terms of consumption of energy and proteins, contained in food products per capita. However, the food patterns were inconsistent with the scientifically grounded norm. Structural imbalance of the food ration was the manifestation of the food crisis in the USSR. To meet primary needs of Soviet citizens in food products the May Plenum of the CPSU Central Committee adopted the "Food Program of the USSR for the Period until 1990 and Measures of Its Implementation". The main issue of the Food program was to increase grain harvest. Grain production was the basis for food and fodder supply of the country. Alongside with a substantial increase in food products output in public economy the attention was given to the development of subsidiary individual holdings and fruit-and-vegetable cooperatives. The cooperatives and subsidiary holdings produced a great number of dairy and meat products, vegetables and fruits both for their own needs and for sale in collective farm markets. The state food program predetermined the solution of agricultural problems by means of formerly used methods. The major problem of agriculture had to be solved by means of increase in the gross grain harvest. Thus, the implementation of agricultural policy of Soviet power in the Ukrainian SSR lead to great changes in agricultural production. At that time there appeared such new branches of economy specialized in services to agricultural production as waterworks and land reclamation, feed mill industry, farm building, machine engineering for animal farming and fodder production, procurement of agricultural products and agricultural processing. The study of this policy implementation proves that the average annual rates of agricultural production increased but they were inconsistent with high investments. On the one hand, the Food program testified the "food crisis in the USSR", demonstrating the lag of the world socialist community from capitalist states. On the other hand, it had to increase the level of food self-sufficiency, decrease the procurement of agricultural products from abroad and promote the solution of the world food problem in general. This article addresses the famous 1910 debate between Vladimir F. Ern and Semyon L. Frank centered around the problem of identifying the distinguishing features of Russian philosophy. The debate was a continuation of Ern’s debates with Russian philosophers associated with the international journal Logos (Sergei I. Hessen, Fyodor A. Stepun, Boris V. Yakovenko, and others). The author shows that Ern’s understanding of an original Russian philosophy is organically related to his overall philosophical doctrine. As for Frank, his views during the (...) 1910s on the distinguishing features of Russian philosophy were different in nature. It is worth noting that in the 1920s articles written during his émigré period, Frank’s views on the distinguishing features of Russian philosophy undergo a decisive change. Frank’s new ideas about Russian philosophy turn out to be extremely close to those of his late opponent, both on the whole and in the details. At the same time, Frank’s overall philosophical views do not undergo as dramatic a change and develop in a fully evolutionary mode. The author attempts to identify the reason for these changes. Many nuclear proteins have been found recently to interact with short conserved sequences which are involved in regulating the transcription of various genes. Nuclear transcription factors may be arbitrarily subdivided into two groups, ubiquitous and tissue‐specific. The transcription of one gene is usually regulated by several factors which interact with different sequences located either in the promoter region of the gene or outside it. The appearance or disappearance of transcription factors for some genes corresponds to certain phases of cell differentiation (...) or dedifferentiation and even to individual stages of the cell cycle. Оцінений потенціал нарощування власного видобутку газу із традиційних та нетрадиційних джерел з урахуванням природно-ресурсних, технологічних, соціально-економічних, управлінських і геополітичних факторів. Окреслені шляхи розвитку розвідки, видобутку, транспортування, зберігання й дистрибуції природного газу. Обґрунтована необхідність розширення та організаційно-правового оформлення міжнародного співробітництва зі світовими ТНК у цих сферах. Підкреслено критичну значущість для України активної політики енергоефективності й газозаміщення.

A careful evaluation of well-documented historical data, along with ancient and modern theological writings, reveals the matriarch Rebekah as one of the most important and controversial individuals of the biblical narrative. Her exceptional beauty, hospitality, morality, faithfulness and sacrificial love were highly admired and praised as iconic by ancient historians, philosophers, the Hebrew community, the Church Fathers and numerous other scholars; yet, some theologians and clerics of the past few 100 years have depicted Rebekah in a negative light. This article (...) intends to highlight this contradiction for the contemporary community of believers by providing an insightful description of the ancient hermeneutics of Rebekah's story. It further aims to encourage biblical scholars to methodologically re-evaluate Rebekah's life, investigating possible reasons as to why the positive image of Rebekah has been overturned in recent years, and thereby determine the cause of such a conceptual paradigm shift in interpreting this key biblical narrative. We discuss several problems in quasiclassical physics for which approximate solutions were recently obtained by a new method, and which can also be solved by novel versions of the Born–Oppenheimer approximation. These cases include the so-called bouncing ball modes, low angular momentum states in perturbed circular billiards, resonant states in perturbed rectangular billiards, and whispering gallery modes. Some rare, special eigenstates, concentrated close to the edge or along a diagonal of a nearly rectangular billiard are found. This kind of state (...) has apparently previously escaped notice. The relevance of the problem under study is due to the need to improve the practical skills and competencies of students in the course of training in order to prepare them for competition with other job seekers in employment. In this regard, this article is aimed at identifying the expediency of students’ participation in competitive selections and grants as a factor that creates conditions for effective practice-oriented learning. The leading method for the study of this problem is a pedagogical experiment, (...) which allows us to comprehensively consider the relationship between students’ participation in competitions and their further self-realization and development as young professionals. The article presents the results of monitoring the behavior of students who received an offer to participate in the university-wide competitive selection of student projects, implemented as part of the Program for Supporting Applied Research and Development of Students and Postgraduates of Petrozavodsk State University. The materials of the article can be useful for teaching staff in building a scheme for teaching students and services involved in the recruitment of personnel for large and medium-sized companies that require young professionals to have practical work skills, teamwork skills and creativity. This anthology of philosophical texts by Greek and Roman authors brings together works from the late fifth century BC to the sixth century AD that comment on major aesthetic issues such as the perception of beauty and harmony in music and the visual arts, structure and style in literature, and aesthetic judgement. It includes important texts by Plato and Aristotle on the status and the role of the arts in society and in education, and Longinus' reflections on the sublime in (...) literature, in addition to less well-known writings by Philodemus, Cicero, Seneca, Plotinus, Augustine and Proclus. Most of the texts have been newly translated for this volume, and some are available in English for the first time. A detailed introduction traces the development of classical aesthetics from its roots in Platonism and Aristotelianism to its ultimate form in late Antiquity. (shrink)

Статья посвящена анализу богословского ландшафта в современной социальной и церковной сферах. Эволюционирующая социальная динамика требует переоценки обоснования и дискурса, используемых для поддержки теологических взглядов, по сравнению с более ранними периодами. Уникальные характеристики современного российского культурного и исторического контекста вносят изменения в роль богословия и придают его природе более неопределенный и спорный характер, влияя на его статус и место в общественной сфере. В рамках данной работы я попытаюсь сформулировать перспективу, направленную на раскрытие богословской стратегии в форме аналогического и мирного видения.

The modern Lithuanian legal doctrine recognises that criminal liability is a last resort (ultima ratio) protecting the society from various law violations. This idea has got deep roots in criminology and is obviously based on the position of rational approach towards the state criminal policy. However, it is not clear whether it is of obligatory legal status to the legislature and the courts. This article attempts to present the idea of a last resort as a concept based on the constitutional (...) principles of the rule of law, justice, proportionality and rationality in the legislation and case law. The author concludes that the main precursors of the ultima ratio principle are the German legal doctrine of protection of legal goods (Rechtsgüterschutz) and Harm principle respected in the common law tradition, as well as the need for protection of human rights in the democratic world. These concepts raise the duty of the legislator to justify the act of criminalisation by legitimate purpose and to comply with certain constitutional limits of application of criminal law. The idea of criminal liability as a last resort is recognised both in the jurisprudence of the Constitutional Court (obiter dictum) and in the practice of the Supreme Court of Lithuania reasoning particular decisions in criminal cases, especially delimiting criminal and other types of legal liability. The author concludes that the fact of discrepancy of criminal law to ultima ratio test can be one of the arguments in support of its objection to the Constitution and even the European Convention on Human Rights and Fundamental Freedoms. At the same time, the author of the article has found that many norms of the Criminal Code are in conflict with the idea of a last resort. (shrink)

Evasion of value added tax (VAT) is a pressing criminal justice problem; however, there still are no theoretical studies on the specific nature of this offense and the basis of its legal evaluation. This article is an attempt to explain the preconditions of the origin of this type of fraud and its connection with the Value Added Tax Law, to formulate the conceptual understanding of the offense, to reveal the important aspects of its legal evaluation and to discuss relevant examples (...) from the case-law. The preconditions of VAT fraud lie in the legal nature of tax administration and the particularity of VAT regulation creating opportunities to abuse the right of deducting the overpayment from the budget or reducing the tax payable. The system of tax crimes stipulated in the Criminal Code is not sufficient to properly assess the impact and danger of VAT fraud. The judicial practice considering VAT deception as property fraud is theoretically justified and welcome. (shrink)

The article discusses the current topic of international interuniversity exchanges in the field of theater education. The subject of the study is the interaction of theater schools in Russia and China within the framework of the experimental Russian–Chinese theater and educational project of the Central Academy of Drama and the Russian State Institute of Performing Arts. The project has been implemented since 2015. According to the terms of the project, Russian and Chinese teachers of acting and special disciplines work together (...) in St. Petersburg and Beijing. Upon graduation, students receive diplomas from two universities recognized in both countries. The author, a direct participant of the project, analyzes the results of this experiment from the position of compliance with the principles and requirements of the dialogue of cultures.  The novelty of the research lies in the substantiation of the cultural value, the prospects of the modern version of the interaction of theater schools in Russia and China. The results of the study were the following conclusions: in the implementation of the Russian-Chinese theater and educational project, all the basic conditions are present and fulfilled, which make it possible to determine the events, events and their results that took place within the framework of the project as a full-fledged dialogue of cultures. Today, as never before, there are points of contact and mutual enrichment of the cultures of Russia and China. There are mutually significant cultural ties, dialogue and interaction of cultures. This variant of intercultural interaction is also productive from the point of view of innovation, creating a unique field of cross-cultural experiments. (shrink)

The relevance of the research reflects the unity of the requirements of the Beijing Philosophical Congress "Learning to be a man" and the anniversary report of the "Rome Club" "Come On! Capitalism, myopia, population and destruction of the planet", which the transformation processes of the socio-sphere are revealed from the standpoint the need for a radical breakdown of the spiritual and moral world of man and his worldview. The foundation of these transformations is the transition in education, as the hippocrine (...) of our knowledge, the source that quenches thirst in them to the "new Enlightenment" as a decisive factor in the learning of a person to be him. This determined the purpose and objectives of the article. The purpose of the article is to substantiate the natural and necessary character of the formation of the "new Enlightenment", to reveal the architectonics of its content. Research objectives : in the context of the goal to uncover the factors that determine the need for a transition in education to the "new Enlightenment", its qualitative difference from the Enlightenment of the 17th-18th centuries; to characterize the new content of "connectedness" in education based on the use of new information technologies; analyze the process of formation of a new spiritual and moral outlook of a specialist on the universal values of humanity; focus the learner’s attention on focusing knowledge of sustainable development as a determining factor of the global problems of mankind through the interrelation of academic disciplines; an important component presents the demand for the formation of a new integral thinking, innovative in its essence and qualitatively different from the analytical one. It is noted that the transition to the path of integral thinking contributes to the connection, coordination and organization into a single whole of the fragments of the object under study. Such thinking is characterized by stability, reliability, variability; it is original in its connections with science and education, and methodological influence on individual and social consciousness. Integral thinking reflects a qualitatively new level of intelligence. Research methods: to achieve the stated goal and constructive solution of the tasks, the article used the method of abduction, analysis and synthesis, historical and logical, synergistic approach. The results of the research: a new paradigm of education is represented – the noospheric-information one corresponding to the factuality of the “new Enlightenment”, as its ability to reproduce itself on a changing scale. The change in the scale of the socio-sphere is due to its globalization processes. The content of the “new Enlightenment” is explicated as a qualitatively new level of formation of students' sustainable knowledge based on the integral innovative type of thinking based on the information resources of society, the use of modern educational technologies, as well as on the values of society, as the quintessence of its wisdom and public intelligence. Conclusions. Thus, the formation of a "new Enlightenment" is natural and necessary. This follows from the requirements of the “learn to be human” program, as well as from the development of an internally ordered education process. “New Enlightenment” also has an attribute of uniqueness, since it does not have anything to compare with, identify; it is an objective, essential, unique phenomenon; it is single, relative, determined by the previous development of education. It is based on the processes of intellectualization, innovation, informational content, humanism and is capable of solving constructively the tasks facing society. (shrink)
