In Critique and Disclosure, Nikolas Kompridis argues provocatively for a richer and more time-responsive critical theory. He calls for a shift in the normative and critical emphasis of critical theory from the narrow concern with rules and procedures of Jürgen Habermas's model to a change-enabling disclosure of possibility and the enlargement of meaning. Kompridis contrasts two visions of critical theory's role and purpose in the world: one that restricts itself to the normative clarification of the procedures by which moral and (...) political questions should be settled and an alternative rendering that conceives of itself as a possibility-disclosing practice. At the center of this resituation of critical theory is a normatively reformulated interpretation of Martin Heidegger's idea of "disclosure" or "world disclosure." In this regard Kompridis reconnects critical theory to its normative and conceptual sources in the German philosophical tradition and sets it within a romantic tradition of philosophical critique.Drawing not only on his sustained critical engagement with the thought of Habermas and Heidegger but also on the work of other philosophers including Wittgenstein, Cavell, Gadamer, and Benjamin, Kompridis argues that critical theory must, in light of modernity's time-consciousness, understand itself as fully situated in its time--in an ever-shifting and open-ended horizon of possibilities, to which it must respond by disclosing alternative ways of thinking and acting. His innovative and original argument will serve to move the debate over the future of critical studies forward--beyond simple antinomies to a consideration of, as he puts it, "what critical theory should be if it is to have a future worthy of its past.". According to musicologist Christopher Small, the treatment of music in musicology carries fundamentally flawed historical premises. Instead of focusing on music through art „objects“, anything understood as „music“ should be examined on the grounds of its spatiotemporal appearance, as a social activity of musicking and the unfolding event. The emphasis of the verb „musicking“ instead of the substantive „music“ signifies a reinterpretation of a static into a processual concept. According to Small, musical meaning is formed with regards to the time (...) and space of the immersive situation and the bodily encounter of participating individuals. This processual intervention over existing musical concepts through reinterpretation as „musicking“ opens the door to a broader philosophical scope. In order to approach two seemingly opposed interpretations of the subject matter mentioned above, I will attempt a reinterpretation of Small with reference to Arthur Schopenhauer’s concept of the „Will“, but with a more detailed emphasis on the expanded principle of the „Dyonisian“ and „Apollonian“ as suggested by Friedrich Nietzsche. I will further suggest some criteria for interpretation of any potential „musicking“ through several points of contention between Small’s musicology and Nietzsche’s philosophy. For this, I will utilize Nietzsche’s philosophical opposition between Being and Becoming serving as foundations of knowledge and art. The suggestion is that, while the entanglement of the Apollonian „image“ and the Dyonisian „rush“ enables the emergence of music as art, the foundation of Small’s „musicking“ lies in the non-ethical character of the Dyonisian—in what lies „behind“ the phenomenon and conceptualization of it. This ultimately questions the implication of music „as“ art, as it suggests that any justification thereof can not be considered outside of the subjective disposition encountering the event, nor beyond the individual disposition emerging within it. „Musicking“ doesn’t emerge with any cultural, social, symbolic or teleological purpose, but attains any one of these as soon as it’s designated „as-such“ by those principles that enable the concept to emerge in the first place. This, despite its broadly influential treatise, ultimately reveals the limits of Small’s „musicking“. (shrink)

This paper evaluates the significance of emperor Heraclius Constantine III, the eldest son of Heraclius, for Byzantium in times of political and military crisis. The first part examines how Heraclius established his family as an imperial dynasty of Byzantium between 613 and 622. The second section analyzes how the young emperor represented his father in Constantinople, while Heraclius waged war against the Persian Sasanids during the 620s. The final segment deals on the one hand with the joint rule of Heraclius (...) and his eldest son after Byzantine victories against the Persians and, on the other hand, with the growing influence of Heraclonas. Finally, the contribution explores Heraclius Constantine’s III role as Augustus senior after his father’s death in 641. The until now often understudied emperor was thereby of essential importance for Byzantium’s stability in the first half of the 7th century. (shrink)

The starting point for studying the Croatian constitutional democracy is the adoption of the Constitution of the Republic of Croatia on 22 December 1990. The said Constitution defines the system of government as semi-presidential and its authors state as their model the Constitution of the Fifth Republic. However, the importing, in 1990, of French constitutional provisions was not neutral since the original French constitutional text was stripped of institutional obstacles, constitutional institutions for opposing the will of the President of the (...) Republic, constitutional-law conditions for the Prime Minister's primacy in the political system in case of co-habitation and discrepancies between the parliamentary and the presidential majority. The text was complemented by constitutional norms unknown to the original. French constitutional norms had to be put to good use, interpreted in line with and legally adapted to the desired political goal, i.e., the establishment of an effective state government in which the primacy of the President of the Republic would assert itself over both the Government and the legislature. The myth on the semi-presidential system was drawn on for both the adoption of the provisions regulating the organisation of government in the 1990 Constitution of the Republic of Croatia and their amendment in 2000. Polazna točka izučavanja hrvatske ustavne demokracije donošenje je Ustava Republike Hrvatske od 22. prosinca 1990. godine. Oblik ustrojstva vlasti Ustava Republike Hrvatske određen je kao polupredsjednički sustav, a autori hrvatskog Ustava navode kao uzor Ustav Pete Republike. Uvoz francuskog ustavnog prava 1990. godine nije bio neutralan. Iz originalnog francuskog ustavnog teksta odstranjene su institucionalne prepreke, ustavne institucije za pružanje otpora volji predsjednika republike, a i ustavnopravni uvjeti za prednost predsjednika vlade u političkom sustavu u slučaju kohabitacije, nepodudarnosti parlamentarne i predsjedničke (...) većine. Tekst je nadograđen ustavnim normama nepoznatima originalu. Francuske je ustavne norme bilo potrebno instrumentalizirati, protumačiti i pravno prilagoditi poželjnom političkom cilju: uspostavi djelotvorne državne vlasti u kojoj se nadmoć predsjednika republike širi i na vladu i zakonodavnu vlast. Mit o polupredsjedničkom sustavu poslužio je i za usvajanje odredbi o ustrojstvu vlasti u Ustavu Hrvatske i prilikom izmjene tih odredbi Ustavnim promjenama iz 2000. godine. (shrink)

Despite seeming uniformity in the law, end-of-life controversies have highlighted variations among state brain death laws and their interpretation by courts. This article provides a survey of the current legal landscape regarding brain death in the United States, for the purpose of assisting professionals who seek to formulate or assess proposals for changes in current law and hospital policy. As we note, the public is increasingly wary of the role of organ transplantation in determinations of death, and of the variability (...) of brain death diagnosing criteria. We urge that any attempt to alter current state statutes or to adopt a national standard must balance the need for medical accuracy with sound ethical principles which reject the utilitarian use of human beings and are consistent with the dignity of the human person. Taking the ‘Fridays for Future’ movement as its starting point, this article conceptualizes and defends youth disobedience, understood as principled disobedience by legal minors. The article first argues that the school strike for climate can be viewed as civil disobedience. Then, the article distinguishes between various forms of youth disobedience (according to whether they involve child-specific issues or actions). Building on the democratic rationale for civil disobedience, the remainder of the article argues that there is a special justification for youth (...) disobedience. To show this, it argues that children are wrongfully excluded from political participation and that principled law-breaking can be an important remedy to this exclusion. The upshot is that adults should engage seriously and leniently with youth disobedience. (shrink)

This article explores contemporary biopolitics in the light of Michel Foucault's oft quoted suggestion that contemporary politics calls `life itself' into question. It suggests that recent developments in the life sciences, biomedicine and biotechnology can usefully be analysed along three dimensions. The first concerns logics of control - for contemporary biopolitics is risk politics. The second concerns the regime of truth in the life sciences - for contemporary biopolitics is molecular politics. The third concerns technologies of the self - for (...) contemporary biopolitics is ethopolitics. The article suggests that, in these events, human beings have become `somatic individuals': personhood is increasingly being defined in terms of corporeality, and new and direct relations are established between our biology and our conduct. At the same time, this somatic and corporeal individuality has become opened up to choice, prudence and responsibility, to experimentation, to contestation and so to a politics of `life itself'. L. Hardy has formulated an axiomatization program of quantum mechanics and generalized probability theories that has been quite influential. In this paper, properties of typical Hamiltonian dynamical systems are used to argue that there are applications of probability in physical theories of systems with dynamical complexity that require continuous spaces of pure states. Hardy’s axiomatization program does not deal with such theories. In particular Hardy’s fifth axiom does not differentiate between such applications of classical probability and quantum probability.

In the philosophy of memory, singularism is the view that episodic memories are singular mental states about unique personally experienced past events. In this paper, I present an empirical challenge to singularism. I examine three distinct lines of evidence from the psychology of memory, concerning general event memories, the transformation of memory traces and the minimized role temporal information plays in major psychological theories of episodic memory. I argue that singularist views will have a hard time accommodating this evidence, facing (...) a problem of transitional gradation. I then look at some potential consequences for the larger debate, highlighting the way in which singularism has featured in three important recent arguments in the philosophy of memory. (shrink)

In Tulving’s initial characterization, episodic memory was one of multiple memory systems. It was postulated, in pursuit of explanatory depth, as displaying proprietary operations, representations, and substrates such as to explain a range of cognitive, behavioural, and experiential phenomena. Yet the subsequent development of this research program has, paradoxically, introduced surprising doubts about the nature, and indeed existence, of episodic memory. On dominant versions of the ‘common system’ view, on which a single simulation system underlies both remembering and imagining, there (...) are no processes unique to memory to support robust generalizations with inductive potential. Eliminativism about episodic memory seems to follow from the claim that it has no dedicated neurocognitive system of its own. After identifying this under-noticed threat, we push back against modern eliminativists by surveying recent evidence that still indicates specialized mechanisms, computations, and representations that are distinctly mnemic in character. We argue that contemporary realists about episodic memory can retain lessons of the common system approach while resisting the further move to eliminativism. (shrink)

The Hard Question of memory is the following: how are memory representations stored and organized so as to be made available for retrieval in the appropriate circumstances and format? In this essay, I argue that philosophical theories of memory should engage with the Hard Question directly and seriously. I propose that declarative memory is a faculty performing a kind of cognitive triage: management of information for a variety of uses under significant computational constraints. In such triage, memory representations are preferentially (...) selected and stabilized, but also systematically modified and integrated into generalized, model-like representational structures. Further, I propose a hybrid theory of remembering, which takes into account both the nature of the cognitive processes underlying remembering and the norms that govern representational success in relevant cognitive/epistemic contexts. Should we learn from the past when it comes to the aims of schooling? One is compelled to take a position on the issue of educational aims and on whether the direction of current educational practices should be based on the original goals of schooling. This article deals with the goals of introducing compulsory schooling in two contexts – Prussia and the United States. It then compares these contexts to the current aims of schooling as envisioned by humanists who are (...) critically opposed to the newest educational approaches as well as to the classical ones. This article presents the normative solutions of humanist authors, mostly building on the legacy of Nel Noddings, as well as examples and “anti-examples” in a historical context. Ultimately, the article reopens a neglected yet necessary discussion about educational aims by reaching conclusions about what sort of inspiration can be taken from the historical aims of compulsory schooling. People can have or lack ‘integrity’. But can public institutions? It is common to speak of the ‘integrity’ of such institutions: in popular discourse, legal decisions, law and regulations, and also increasingly, political theory, and proximate disciplines. Such integrity is often said to be at risk of being ‘subverted,’ ‘corroded,’ and ‘corrupted,’ by both forces within and without. Furthermore, the implication is that this is a very worrying thing. The integrity of our institutions, at least, needs to be preserved, supported, (...) and defended; against money, politics, power, and populists. However, despite such common usage, the concept itself has attracted little theoretical reflection. What can it mean, if anything sensible, for an institution itself – instead of a person (or even say, a body, process, territory or a bridge) – to have ‘integrity’? And, why might it be so important? This is the subject of this paper. It puts forward a substantive moral conception of institutional integrity as the robust disposition of an institution to pursue its purpose efficiently, within the constraints of legitimacy, consistent with its commitments. It argues that it is important because it provides the strongest grounding for a ‘duty of support’ owed by citizens to the institution. The strength of such support owed also gives content to a scalar dimension of the institution’s normative legitimacy, that is, the ‘strength’ (or weakness) of such legitimacy. Further, it illustrates how such a conception of institutional integrity will helpfully advance the current debate regarding institutional corruption. (shrink)

The Galilean explanatory style is characterized by the search for the underlying structure of phenomena, the positing of "deep" explanatory principles, and a view of the relation between theory and data, on which the search for "crucial data" is of primary importance. In this paper, I trace the dynamics of adopting the Galilean style, focusing on the science of episodic memory. I argue that memory systems, such as episodic and semantic memory, were posited as underlying competences producing the observable phenomena (...) of memory. Considered in idealized isolation from other systems, episodic memory was taken to underlay the ability of individuals to remember events from their personal past. Yet, in reality, memory systems regularly interact, standing in many-to-many relations to actual memory tasks and experiences. Upon this backdrop, I explore a puzzle about the increasing prominence of the notion of autonoetic consciousness in Tulving's theory of episodic memory. I argue that, contrary to widespread belief, the prominence is not best explained by the purported essential link between autonoetic consciousness and episodic memory. Rather, it is explained by the fact that autonoetic consciousness, hypothesized to uniquely accompany episodic retrieval, was considered a source of crucial data, predictable only from theories positing a functionally distinct episodic memory system. However, with the emergence of a new generation of theories, positing wider memory systems for remembering and imagination, the question of the relation between episodic memory and autonoetic consciousness has been reopened. This creates a pressing need for de-idealization, triggering a new search for crucial data. (shrink)

We live, according to some, in the century of biology, where we now understand ourselves in radically new ways as the insights of genomics and neuroscience have opened up the workings of our bodies and our minds to new kinds of knowledge and intervention. Is a new figure of the human, and of the social, taking shape in the 21st century? With what consequences for the politics of life today? And with what implications, if any, for the social, cultural and (...) human sciences? These are the issues that are discussed in this article, which argues that a new relation is requred with the life sciences, beyond commentary and critique, if the social and human sciences are to revitalize themselves for the 21st century. It has become somewhat a commonplace in recent political philosophy to remark that all plausible political theories must share at least one fundamental premise, ‘that all humans are one another's equals’. One single concept of ‘basic equality’, therefore, is cast as the common touchstone of all contemporary political thought. This paper argues that this claim is false. Virtually all do indeed say that all humans are ‘equals’ in some basic sense. However, this is not the same sense. There are not (...) one but two concepts of basic equality, and they reflect not a grand unity within political philosophy but a deep and striking division. I call these concepts ‘Equal Worth’ and ‘Equal Authority’. The former means that each individual’s good is of equal moral worth. The latter means that no individual is under the natural authority of anyone else. Whilst these two predicates are not in themselves logically inconsistent, I demonstrate that they are inconsistent foundation stones for political theory. A theory that starts from Equal Worth will find it near impossible to justify Equal Authority. And a theory that starts from Equal Authority will find any fact about the true worth of things, including ourselves, irrelevant to justifying legitimate action. This helps us identify the origin of many of our deepest and seemingly intractable disagreements within political philosophy, and directs our attention to the need for a clear debate about the truth and/or relationship between the two concepts. In short, my call to arms can be summed up in the demand that political philosophers never again be allowed to claim ‘that all human beings are equals’ full stop. They must be clear in what dimension they claim that we are equals—Worth or Authority. (shrink)

Wittgenstein započinje svoja Predavanja o religioznom vjerovanju tvrdeći kako ne bi proturječio religioznoj osobi koja vjeruje u Strašni sud, iako on osobno ne dijeli takva uvjerenja. Kasnije izjavljuje kako nije siguran mogu li religiozni vjernici i pojedinci koji ne vjeruju istinski razumjeti jedni druge. Neki filozofi tumače ove primjedbe kao dokaz da je Wittgenstein smatrao kako su religijski i nereligijski diskursi nesumjerljivi, u tom smislu da nereligiozna osoba ne može razumjeti religioznu kada ova govori o svojim vjerovanjima, kao i da (...) su religiozna vjerovanja imuna na kritiku izvana kao posljedica te navodne nesumjerljivosti. Hilary Putnam je tvrdio da je Wittgenstein vjerovao kako dijalog između religioznih i nereligioznih osoba podrazumijeva određeno nesporazumijevanje, koje međutim nije posljedica nesumjerljivosti. Predlažem drugačije sagledavanje „nesuprotstavljenosti“ i Wittgensteinovog shvaćanja religioznog vjerovanja, pri čemu se slažem s Putnamom da se teza o nesumjerljivosti ne može pripisati Wittgensteinu. Recent scholarship emphasizes the scaffolding role of language for cognition. Language, it is claimed, is a cognition-enhancing niche ( Clark, 2006 ), a programming tool for cognition ( Lupyan and Bergen, 2016 ), even neuroenhancement ( Dove, 2019 ) and augments cognitive functions such as memory, categorization, cognitive control, and meta-cognitive abilities (“thinking about thinking”). Yet, the notion that language enhances or augments cognition, and in particular, cognitive control does not easily fit in with embodied approaches to language processing, or (...) so we will argue. Accounts aiming to explain how language enhances various cognitive functions often employ a notion of abstract representation. Yet, embodied approaches to language processing have it that language processing crucially, according to some accounts even exclusively, involves embodied, modality-specific, i.e., non-abstract representations. In coming to understand a particular phrase or sentence, a prior experience has to be simulated or reenacted. The representation thus activated is embodied (modality-specific) as sensorimotor regions of the brain are thereby recruited. In this paper, we will first discuss the notion of representation, clarify what it takes for a representation to be embodied or abstract, and distinguish between conceptual and (other) linguistic representations. We will then put forward a characterization of cognitive control and examine its representational infrastructure. The remainder of the paper will be devoted to arguing that language augments cognitive control. To that end, we will draw on two lines of research, which investigate how language augments cognitive control: (i) research on the availability of linguistic labels and (ii) research on the active usage of a linguistic code, specifically, in inner speech. Eventually, we will argue that the cognition-enhancing capacity of language can be explained once we assume that it provides us with (a) abstract, non-embodied representations and with (b) abstract, sparse linguistic representations that may serve as easy-to-manipulate placeholders for fully embodied or otherwise more detailed representations. In this paper, I argue that causal theories of memory are typically committed to two independent, non-mutually entailing theses. The first thesis pertains to the necessity of appropriate causation in memory, specifying a condition token memories need to satisfy. The second pertains to the explanation of memory reliability in causal terms and it concerns memory as a type of mental state. Post-causal theories of memory can reject only the first (weak post-causalism) or both (strong post-causalism) theses. Upon this backdrop, I (...) examine Werning’s (2020) causalist argument from probabilistic correlation. I argue that it doesn’t establish the necessity of appropriate causation and thus it can only target strong post-causalist theories. I end up by presenting some general considerations, suggesting that memories may not always be causally linked to past experiences. (shrink)

The human body was made legible long ago. But what of the human mind? Is it possible to ‘read’ the mind, for one human being to know what another is thinking or feeling, their beliefs and intentions. And if I can read your mind, how about others – could our authorities, in the criminal justice system or the security services? Some developments in contemporary neuroscience suggest the answer to this question is ‘yes’. While philosophers continue to debate the mind-brain problem, (...) a range of novel technologies of brain imaging have been used to argue that specific mental states, and even specific thoughts, can be identified by characteristic patterns of brain activation; this has led some to propose their use in practices ranging from lie detection and security screening to the assessment of brain activity in persons in persistent vegetative states. This article reviews the history of these developments, sketches their scientific and technical bases, considers some of the epistemological and ontological mutations involved, explores the ecological niches where they have found a hospitable environment, and considers some implications of this materialization of the readable, knowable, transparent mind. The cognitive potency of the human mind can be fully appreciated only if it is conceived of as a linguistic mind. This is the starting point of Nikola Kompa's investigation into the relationship between language and cognition. Underpinned by philosophical ideas from Plato to Ockham, and from Locke to Vygotsky, Kompa uses theories within the philosophy of language, mind, and cognitive science and draws on neuro-psychology and psycholinguistic studies to explore core ideas about language and cognition. How did language (...) transform our ancestors into creatures of considerable cognitive and social accomplishment? How does language augment cognition? Is language only a means of communicating our ideas or is a means of thinking itself? Her study has repercussions for a broad range of questions, from how humans differ from other animals and what a cognitive architecture looks like if it approximates the achievements of the human mind, to questions of education and cross-cultural communication. Theorizing and forming hypotheses about how language and cognition might have coevolved, how the availability of (symbolic) labels enhance various cognitive functions, what the cognitive function of inner speech might be and how inner speech and thought relate to each other, Kompa addresses the perennial philosophical question of what the benefits of having a language might be, and brings into sharper relief the intimate connection between linguistic and other cognitive functions. Informed by recent discussions on language evolution, labels, and inner speech, this timely contribution helps us understand more about how language changes the way we think. (shrink)

Ob Kunstwerke, im emphatischen Sinne des Wortes, in der Moderne überhaupt produziert werden können, hat Heidegger philosophisch in Zweifel gezogen. Sofern ästhetische Praxis an einem historischen Wahrheitsanspruch gemessen werden soll, muss ihre Bewertung letztlich prekär bleiben. Trotz dieser skeptischen Haltung Heideggers haben nicht nur Kunsttheoretiker, sondern auch zahlreiche Künstler und Schriftsteller seine Überlegungen nachhaltig rezipiert und in die Reflexion der eigenen Praxis eingebunden. Nikola Mirkovic folgt den Spuren von vier Lesern von Heideggers Kunstphilosophie, - Günther Anders, Heinrich Besseler, Paul (...) Celan und Peter Zumthor - die verschiedene Motive von Heideggers Denkens aufgreifen, kritisieren und weiterentwickeln. Erst durch die Transformation von Heideggers Grundbegriffen im Zuge der jeweiligen Architektur-, Literatur- und Musiktheorie zeigt sich ihr phänomenologisches Potential. (shrink)
