The right to ‘domestic remedies’, which ideally connects ‘subsidiarity’ and ‘embeddedness’ of the ECHR in the legal systems of member States, is deemed to play a crucial role for the Strasbourg machinery survival as well as for an effective protection of human rights, especially in the field of the ‘reasonable-time’ requirement. In this respect the Italian case seems an excellent test. Once a compensatory remedy was introduced in the Italian legal system by Law No. 80 of 2001 (the ‘Pinto Act’), (...) it soon appeared that such a remedy could be considered ‘effective’ in so far as it was implemented in accordance with the ECtHR’s jurisprudence. Therefore a legal tool for the interaction between ECtHR and Italian courts had to be found. Nevertheless, the results of this interaction might suggest that the domestic remedy has neither increased the protection of the reasonable-time requirement in Italy nor is it the final solution to the ECtHR’s overload. Do scientific theories limit human knowledge? In other words, are there physical variables hidden by essence forever? We argue for negative answers and illustrate our point on chaotic classical dynamical systems. We emphasize parallels with quantum theory and conclude that the common real numbers are, de facto, the hidden variables of classical physics. Consequently, real numbers should not be considered as ``physically real" and classical mechanics, like quantum physics, is indeterministic.

Science is the practice that provides the most epistemically warranted claims that can be made, and involves the possibility that explanatory theories will eventually be replaced by better ones. In the case of Psychology, the process of formulating theories through the scientific method has been difficult and has generated concern among scientific psychologists. Thus, in 1978 Meehl published a seminal text about the weakness of psychological theories, which has had a great influence to this day, with different authors describing a (...) theoretical crisis in Psychology. This manuscript reviews the current panorama of the situation, characterizing the crisis, the associated factors and the proposals to solve it. In relation to the factors associated with the crisis, the youth of Psychology, the emphasis on data, problems in the definitions of constructs and their measurement, and difficulties in determining causality in Psychology are highlighted. With respect to the solutions, the proposals for including training in theory construction in the study plans, the integration of interdisciplinary skills, the theory formation cycle, and the formation of theories are reviewed. It is concluded about the need to include theoretical training within university curricula, as well as the possibility that Theoretical Psychology is a viable specialization for psychologists. Plus qu'une theorie de la connaissance, c'est donc une theorie complete de l'esprit humain et de ses multiples fonctions (...) que nous livre l'ouvrage. Cette nouvelle edition de la Recherche de la verite donne a lire pour la premiere fois dans un format accessible a tous, un texte majeur de la pensee moderne, heritier de l'age classique et annonciateur des Lumieres: les textes sont etablis a partir des deux dernieres editions de 1700 et 1712 revues par Malebranche lui-meme, et des trois premiers volumes des oeuvres Completes publiees sous la direction d'Andre Robinet; l'orthographe a ete modernisee. La ponctuation a fait l'objet d'une revision systematique; les textes cites en langue etrangere ont ete traduits ou retraduits, et leurs references mises a jour afin de tenir compte des editions les plus recentes. Enfin, le lecteur trouvera, dans ce premier volume, une presentation eclairante de cette oeuvre par Jean-Christophe Bardout, offrant ainsi des grilles de lecture et de comprehension de cet ouvrage majeur du XVIIe siecle, qui n'avait jusqu'alors fait l'objet d'aucune etude specifique. ABSTRACT The article aims to examine the behavior of contemporary speech genre theory in the analysis of Pauline epistles. The genre of letters is conceived within its original communicative purpose, limited to sender and receivers, whereas the epistle refers to the letter read outside of its original context, considered as literature. The research corpus is composed of the Corinthian epistles of the New Testament, which are accepted as authored by the Apostle Paul. They are selected due to their shared audience, (...) enabling a comparison of production context aspects in the apostle’s writings over time. Research findings include: letters that acquire new meanings, when transformed into epistles with a broader readership; the epistle genre, despite undergoing significant modifications, remains recognizable to present-day readers due to its macrostructure; the social role and communicative intent of the sender that result in alternating usage of formal and informal language, as well as variations in discourse person. Contemporary experimental research has emphasised the role of centrally generated signals arising from premotor areas in voluntary muscular force perception. It is therefore generally accepted that judgements of force are based on a central sense, known as the sense of effort, rather than on a sense of intra-muscular tension. Interestingly, the concept of effort is also present in the classical philosophy: to the French philosopher Maine de Biran [Maine de Biran . Mémoire sur la décomposition de la pensée , Vrin, (...) Paris ], the sense of effort is the fundamental component of self-experience, the landmark of the exercise of the will. In the present review, after a presentation of the nature and neurophysiological bases of effort sensation, we will examine its possible involvement in the neurocognitive process of agency. We will further focus on delusions of alien control in schizophrenic patients. Experimental data suggest that these patients have an abnormal awareness of effort caused by cerebral anomalies in the frontal and parietal lobes. (shrink)

On a longtemps considéré qu'un seul archonte éponyme de Delphes avait porté le nom de Kléophanès. C'est cet état des connaissances que présente G. Daux, en 1943, malgré les remarques de R. Flacelière (Chronologie delphique L27, 172/ 1 av. J.-C.). En 1949, la publication d'un texte daté par un archonte Kléophanès et attribué au IIIe siècle relança la question du nombre des éponymes de ce nom et des textes qui pouvaient être attribués à l'année de leur magistrature. Grâce à une (...) nouvelle édition des trois textes en suspens et au réexamen des différents critères de datation disponibles, nous proposons de corriger la Chronologie delphique en ajoutant deux archontes nommés Kléophanès au IIIe siècle av. J.-C. : -G27, 2e quart du IIIe siècle (?), connu par FD III 3, 82 ; -K41, 2e moitié du IIIe siècle (?), connu par FD III 4, 427 V. Le texte BCH 63 (1939), p. 160, doit sans doute être attribué à K41 plutôt qu'à G27. L'archontat L27 demeure documenté par la liste chronologique des proxènes et par trois actes d''affranchissement, mais perd un de ses bouleutes. (shrink)

Cet article est consacré au problème du rapport entre l’entrelacement des genres (συμπλοκὴ τῶν εἰδῶν) et le logos dans le Sophiste. Après avoir brièvement présenté le problème, je discute, dans la première partie, différentes solutions proposées par les commentateurs. Je cherche à montrer qu’aucune de ces solutions n’est pleinement satisfaisante. Dans la deuxième partie, je propose une nouvelle solution au problème de la συμπλοκὴ τῶν εἰδῶν fondée sur une distinction entre deux types de logos, le logos dialectique et le logos (...) doxique. Dans la troisième partie, je cherche à justifier textuellement cette solution en recourant à la fois au texte du Sophiste lui-même et à la dernière partie du Théétète. Dans ma conclusion, je suggère que la distinction entre logos dialectique et logos doxique correspond à une différence qui traverse toute l’œuvre de Platon, à savoir la différence entre connaissance et opinion. / This paper deals with the problem of the συμπλοκὴ τῶν εἰδῶν in the Sophist. In the first part, after a brief presentation of this problem, I discuss different solutions which have been proposed in the recent literature. I try to show that none of them is entirely satisfying. In the second part, I propose and explain a new solution based on a distinction between two types of logos : dialectical logos and doxastic logos. In the third part, I try to justify this solution on the basis of some passages of the Sophist and of the final part of the Theaetetus. To conclude, I suggest that the distinction between dialectical logos and doxasticlogos matches the difference between knowledge and belief made by Plato in his dialogues. (shrink)

What do the works that were discussed during the sessions of the “College of Sociology” tell us today? By examining the respective influences of Roger Caillois and Georges Bataille, this article aims to show that the dialogue that brought them together, and that would eventually separate them, is rooted in nineteenth-century philosophical debates. Considering a broader theoretical horizon as a framework for the College of Sociology, this article also aims to offer a reading of why such eclectic interests crossed paths (...) during its sessions. This analysis is carried out following the question that, in our opinion, motivated the Caillois/Bataille debate: what institution could subvert the principle of the teleological progress of modernity? In short, through the study of the Caillois/Bataille discussions and disagreements, this article aims to underline some limits that led to the dissolution of the College of Sociology. (shrink)

The main aim of the present paper is to show, by means of a dialogical study, that the notion of judgemental equality of Constructive Type Theory, which in this theory furnishes the criterion of identity of a type, can be understood from the game-theoretical point of view as the result of a specific form of dialogical interaction governed by the development rule known as formal rule or Socratic rule, which prescribes the use of copy-cat moves. It will be shown, as (...) an example, how to develop the core of a winning strategy for Per Martin-Löf’s demonstration of the Axiom of Choice, who based his proof in the judgemental equality between the function in the antecedent and the function occurring in the consequent of the axiom. The belief that the spirits of the dead can return to haunt the living exists either as a tenet or as a marginal conviction in all civilizations, whether ancient or modern. More often than not, the dead do not return to reunite the living with their loved ones but rather to lead them into some dreadful snare, entrapping them with disastrous consequences. To be sure, all the departed may return, but some are predestined to haunt: the dead who have been (...) shamed during their lifetime or those who took unspeakable secrets to the grave. From the brucolacs, the errant sprits of outcasts in ancient Greece, to the ghost of Hamlet’s vengeful father, and on down to the rapping spirits of modern times, the theme of the dead—who, having suffered repression by their family or society, cannot enjoy, even in death, a state of authenticity—appears to be omnipresent on the fringes of religions and, failing that, in rational systems. It is a fact that the “phantom,” whatever its form, is nothing but an invention of the living. Yes, an invention in the sense that the phantom is meant to objectify, even if under the guise of individual or collective hallucinations, the gap that the concealment of some part of a loved one’s life produced in us. The phantom is, therefore, also a metapsychological fact. Consequently, what haunts are not the dead, but the gaps left within us by the secrets of others.Because the phantom is not related to the loss of a loved one, it cannot be considered the effect of unsuccessful mourning, as is the case of melancholics or of all those who carry a tomb within themselves. It is the children’s or descendants’ lot to objectify these buried tombs through diverse species of ghosts. What comes back to haunt are the tombs of others. The phantoms of folklore merely objectify a metaphor active within the unconscious: the burial of an unspeakable fact within the loved one.Here we are in the midst of clinical psychoanalysis and still shrouded in obscurity, an obscurity, however, that the nocturnal being of phantoms can, paradoxically, be called upon to clarify. El presente artículo desarrolla la comprensión marceliana de la esperanza como fruto de una experiencia de comunión intersubjetiva. De tal modo que la esperanza nos abre un nuevo horizonte de sentido para el itinerario vital, anunciando ya una plenitud intersubjetiva imperecedera. Así, podremos reconocer una fuente de renovación personal y comunitaria en la vivencia de la intersubjetividad, como condición metafísica de la existencia personal que responde a la profunda exigencia de trascendencia del hombre.

De los tres modos de acercamiento entre el pensamiento de Gilles Deleuze y el idealismo alemán señalados por Amanda Núñez García, en los que priman, respectivamente, Fichte, Kant y Schelling, el presente trabajo se propone proseguir la segunda vía y, rastreando las fuentes de las afirmaciones deleuzianas relativas al tiempo como fisura en la identidad subjetiva, mostrar la existencia de una concepción del cogito distinta de la cartesiana, en la cual el yo no consigue identificarse plenamente consigo mismo. Mostraremos asimismo (...) que dicha concepción encuentra su origen en la paradoja del sentido interno kantiana, se continúa en Hölderlin y llega hasta Deleuze, y que el elemento clave para pensar esta torsión es el tiempo como forma pura y vacía. Tomaremos como punto de partida el análisis de la tercera síntesis pasiva del tiempo desarrollada por Deleuze en _Diferencia y repetición_ para luego examinar la letra de Kant y de Hölderlin con el objetivo de reconstruir la posición deleuziana. On verra comment les disciples Thomas d’Aquin introduisent un nouveau concept, celui d’ advertentia spécifiquement conçu pour caractériser l’accès cognitif privilégié que nous avons à nos propres actes mentaux. Les dominicains du XVI e siècle adoptent à ce titre une position très proche de celle de Descartes, du moins d’un (...) point de vue phénoménologique, en faisant de l’ advertentia le critère de la mens. Resumen La argumentación es una forma de discurso en la que un hablante defiende una postura en una discusión. El presente trabajo se enfoca en la complejidad argumentativa y los recursos evaluativos y evidenciales que caracterizan las disputas de niños de diverso nivel socioeconómico. Se analizaron 94 disputas entre niños de 4 años y otros niños (5 a 10 años) en situaciones de juego espontáneo registradas en hogares de sectores socioeconómicos medio y bajo. El análisis identificó diferencias marginales en la (...) complejidad argumentativa entre los grupos. Por su parte se hallaron diferencias significativas en recursos de evaluativos de emocionalidad y en los evidenciales deónticos y exclamativos a favor de los sectores de nivel socioeconómico bajo. Los sectores medios registraron un mayor empleo de expresiones de causalidad y conectores. Los resultados se discuten a la luz de los hallazgos de investigaciones previas. Abstract Argumentation is a type of discourse in which a speaker defends a claim in a discussion. The present work focuses on the argumentative complexity and the evaluative and evidential resources that characterize the disputes of children of different socioeconomic levels. We analyzed 94 disputes between 4-year-old children and other children (5 to 10 years old) in situations of spontaneous play registered in homes of middle and low socioeconomic status (SES). The analysis identified marginal differences in argumentative complexity between the groups. On the other hand, significant differences were found in evaluative expressions of emotion and in deontic and exclamatory evidential markers, more frequently used by the low SES group. The mid SES group tends to use a higher number of expressions of causality and connectors. The results are discussed with reference to the findings of previous research. (shrink)

This essay confronts Heidegger′s and Lukács′s thinking regarding several fundamental ontological questions. Some considerations are presented on the concepts of “In-der-Welt-Sein” and “das Ansichseiende” , on the role of labour in the evolution of mankind, on the importance of causality for both philosophers and – last but not least – on the relationship between science and philosophy. Special emphasis is given to the Heideggerian concept of “Geworfenheit” and also to Lukács′s critique of that concept. The opposition between Heidegger′s hermeneutics and (...) Lukács′s ontological-genetic method takes centre stage in this confrontation. (shrink)

Les premiers travaux réalisés sur les effets du confinement du printemps 2020 sur les enfants ont établi que ceux qui étaient en résidence alternée l’avaient mieux vécu que les autres. L’objectif de cet article est de comprendre pourquoi. À partir de l’enquête Sapris et plus particulièrement du sous-échantillon des enfants âgés de 8-9 ans des cohortes Elfe et Epipage2, nous comparons les conséquences du confinement sur les enfants selon la structure familiale dans laquelle ils vivaient. Continu dans les familles nucléaires, (...) le temps familial est habituellement beaucoup plus fractionné entre les résidences des parents pour les enfants de familles séparées. Le confinement est venu transformer les expériences habituelles du temps familial pour les enfants, aussi bien dans son organisation que dans sa texture. Il a modifié leur cadre de vie ordinaire, en réorganisant leurs occupations au quotidien et en modifiant leurs relations avec leurs parents. En observant particulièrement les différences apparues entre les résidences alternées qui ont continué et celles qui ont été interrompues, nous montrons que si les mouvements réguliers des enfants ont pu constituer une respiration bienvenue pour les différents acteurs concernés, les alternances interrompues ont ouvert des espaces exceptionnels dans lesquels il a été possible de renouer avec des formes passées de continuité familiale. The present work proposes to examine the problem of the empirical thing in itself and the objective sensation as an access route to the concrete content of empirical reality in Kant’s transcendental philosophy. The main notion of ‘empirical thing in itself’, offered by Gerold Prauss’ interpretation, provides a key to understand and solve central problems of transcendental philosophy. Nevertheless Prauss’s position still exhibits certain imperfections that might lead any lecture of Kant towards a phenomenalist understanding. In order to avoid this (...) misleading, it will be intended to complement Prauss’s interpretation, analyzing the objectivity of sensation, trying within to restore the objectivity of appearance. Finally, it will be possible to make an evaluation about advantages and limits of Prauss’s hermeneutical reconstruction of this problematic. (shrink)

Dabei hat seine eigenständige Synthese der Ideen Descartes’ mit theologischen Positionen, vor allem Augustins, in der Folgezeit großen Einfluß ausgeübt. In seinem Hauptwerk, der Recherche de la vérité, entwickelt Malebranche als erster die cartesische Philosophie zu einem einheitlichen, in sich geschlossenen System weiter. Von den sechs Büchern der Recherche ist das wichtigste - und zugleich der Höhepunkt der Philosophie Malebranches - das hier dargebotene (...) dritte Buch vom Verstand oder vom reinen Geist. La justificación del ejercicio de la crítica como un derecho fundamental en todo ordenamiento democrático viene despertando mayor interés en los últimos tiempos. El presente trabajo se propone analizar este tema desde la democracia deliberativa de J. Habermas, mostrando algunas similitudes, pero también señalando las diferencias conceptuales con la teoría crítica. La idea es identificar el alcance de la herencia conceptual de la Escuela de Frankfurt en la política deliberativa habermasiana, una conexión que en esta teoría siempre resulta solo implícita (...) pero no explícitamente reconocida como condición de validez y legitimidad democrática del ordenamiento político.
