El presente artículo busca señalar la existencia de dos conflictos, al menos, que se presentan en Colombia. El primero es un conflicto directo mayoritariamente sufrido en zonas rurales. El segundo es un tele-conflicto. De su raíz griega es un conflicto que se vive desde lejos (tele). Este último, si bien es virtual, produce efectos reales en los sujetos con un alto poder de decisión, especialmente en zonas urbanas. Con ello se busca señalar el rol de los medios como condición de (...) posibilidad para la existencia del conflicto, pero no sólo debido al uso (abuso) que se pueda dar de ellos para la continuación del conflicto, sino por la misma manera en que es medializado. Para ello se analiza como caso empírico la refrendación de los acuerdos de paz de La Habana entre el estado colombiano y la guerrilla de las FARC-EP. Para ello se hará un análisis fenomenológico de la manera en que los medios interactúan con el sujeto. Con ello se busca observar el rol constitutivo de los medios de la experiencia humana. Con este punto como pivote, se señala la existencia de los dos conflictos previamente nombrados. (shrink)

“Pueblo” puede tener múltiples significados. Para el derecho moderno, es el significante que intenta justificar la existencia y obediencia del régimen legal vigente. Como apelación a una particular filosofía política, el “pueblo” que fundamenta lo jurídico se determina por la mera coexistencia en un territorio regido por una soberanía. Una noción de “pueblo” divergente, y que por tanto se rehúsa a confirmar sobre sí el estado de cosas actual, es posible y, en términos de conflicto político, necesaria. Por eso, presentamos (...) al concepto de pueblo desde Ernesto Laclau y Enrique Dussel como esencia de lo político y como potencialidad de organización de los excluidos contra el orden social vigente. En el presente texto se realiza un análisis sobre la utilidad del método de los experimentos mentales en filosofía. Dicha utilidad se da en tanto que el experimento usado sea legítimo, esto es, que cumpla con ciertas exigencias teóricas. Sin embargo, la utilidad de tal método se ve afectada por la proliferación de experimentos mentales ilegítimos. Tomando como referencia un tipo específico de experimentos mentales ilegítimos, el texto se propone presentar una explicación al anterior fenómeno basada en la relación de (...) las nociones de conocimiento y necesidad lógica. Igualmente, se presentan dos formas posibles de evitar el recurso excesivo a experimentos mentales de poca utilidad. (shrink)

Available in English for the first time, this much-anticipated translation of Enrique Dussel's _Ethics of Liberation_ marks a milestone in ethical discourse. Dussel is one of the world's foremost philosophers. This treatise, originally published in 1998, is his masterwork and a cornerstone of the philosophy of liberation, which he helped to found and develop. The obscured and ignored origins of Modernity lie outside the Western tradition. _Ethics of Liberation_ is a monumental rethinking of the history, origins, and aims of ethics. Perhaps the hottest topic in the philosophy of chemistry is that of the relationship between chemistry and physics. The problem finds one of its main manifestations in the debate about the nature of molecular structure, given by the spatial arrangement of the nuclei in a molecule. The traditional strategy to address the problem is to consider chemical cases that challenge the definition of molecular structure in quantum–mechanical terms. Instead of taking that top-down strategy, in this paper we face the problem (...) of the reduction of molecular structure to quantum mechanics from a bottom-up perspective: our aim is to show how the theoretical peculiarities of quantum mechanics stand against the possibility of molecular structure, defined in terms of the spatial relations of the nuclei conceived as individual localized objects. We will argue that, according to the theory, quantum “particles” are not individuals that can be identified as different from others and that can be reidentified through time; therefore, they do not have the ontological stability necessary to maintain the relations that can lead to a spatially definite system with an identifiable shape. On the other hand, although quantum chemists use the resources supplied by quantum mechanics with successful results, this does no mean reduction: their “approximations” add certain assumptions that are not justified in the context of quantum mechanics or are even inconsistent with the very formal structure of the theory. The very idea of promulgation has been given little to no treatment in the philosophy of law. In this exploratory essay, I introduce three possible theories of promulgation: the ‘no-theory theory’ (which treats promulgation as a matter of particular contexts), the ‘conveyance theory’ (which treats promulgation as a function of intellectual good faith interpreters), and ‘agonistic theory’ (which treats promulgation as indistinguishable from propaganda). I suggest that (at least) three kinds of models are consistent with the theories, and can potentially (...) help us understand when law is successfully promulgated in particular legal contexts: the spread model, the chain model, and the memetic model. I end the paper by comparing the two theories with respect to a case study. Throughout I will show that the conveyance and agonistic theories have a serious advantage over the no-theory theory, in that they allow us to comparatively examine the epistemic weaknesses of diverse theories about the grounding of law on the basis of their contents. Uncovers the truth behind the ideas, struggles, and eventually success of Black and Puerto Rican Nationalists regarding key feminist issues of the 1960s, 1970s, and 1980s While most people believe that the movement to secure voluntary reproductive control for women centered solely on abortion rights, for many women abortion was not the only, or even primary, focus. Jennifer Nelson tells the story of the feminist struggle for legal abortion and reproductive rights in the 1960s, 1970s, and early 1980s through (...) the particular contributions of women of color. She explores the relationship between second-wave feminists, who were concerned with a woman's right to choose, Black and Puerto Rican Nationalists, who were concerned that Black and Puerto Rican women have as many children as possible “for the revolution,” and women of color themselves, who negotiated between them. Contrary to popular belief, Nelson shows that women of color were able to successfully remake the mainstream women's liberation and abortion rights movements by appropriating select aspects of Black Nationalist politics—including addressing sterilization abuse, access to affordable childcare and healthcare, and ways to raise children out of poverty—for feminist discourse. While it is philosophically contested whether nonlinguistic animals can have conceptual capabilities, it is also philosophically contested whether one can even empirically test for such capabilities. I draw from Sellars’ work on psychological nominalism to develop an empirically tractable means of distinguishing between tasks that require conceptual capabilities and those that do not. Tasks that require conceptual capabilities are those that require awareness of abstract relations, whereas tasks that can be solved merely through Sellarsian picturing do not. I argue that (...) relational matching-to-sample tasks cannot be solved through picturing and therefore require awareness of the abstract relations of same and different. Crows and amazons have both been able to succeed at relational matching-to-sample tasks; therefore, there are at least some nonlinguistic animals that have conceptual capabilities. Finally, I consider the objection that one cannot attribute conceptual capabilities without also attributing knowledge, and Sellarsian conditions for knowledge are beyond the capabilities of any nonlinguistic animal. In response, I argue that Sellarsian conditions for knowledge only require an implicit grasp of the is/looks distinction and empirical work with chimpanzees on their understanding of the appearance/reality distinction demonstrates that they can meet this standard. Therefore, language is not necessary for meeting Sellarsian conditions for knowledge. (shrink)

: Prenatal and preconceptual testing and screening programs provide information on the basis of which people can choose to avoid the birth of children likely to face disabilities. Some disabilities advocates have objected to such programs and to the decisions made within them, on the grounds that measures taken to avoid the birth of children with disabilities have an "expressive force" that conveys messages disrespectful to people with disabilities. Assessing such a claim requires careful attention to general considerations relating meaning, (...) intention, and social practices; it has only begun to receive such attention. Building on work by Allen Buchanan, who has challenged this claim, I further consider the disabilities advocates' objection, ultimately concluding that it is misplaced; neither individual actions nor general practices of this type necessarily express disrespectful messages. En una de sus formulaciones más simples, la tesis quineana de la equivalencia empírica entre teorías sostiene que dada una teoría T que dé cuenta del conjunto de observaciones O, es posible que haya otra teoría T* lógicamente incompatible con T, pero empíricamente equivalente, i. e. da cuenta del mismo conjunto O de observaciones. El propósito de este ensayo será el de examinar el impacto de esta tesis frente a la del realismo científico ingenuo, reformulándola en términos más precisos y (...) examinando su plausibilidad. La conclusión será que la tesis de la equivalencia empírica no es una tesis lógico-filosófica como aquellas sobre las que se basa (subdeterminación de las teorías por la experiencia, holismo epistemológico), sino que su carácter es práctico y condiciona sobre las actuales capacidades para observar y testar; también se explotará esta consecuencia para mostrar cómo podría darse cabida a un tipo de realismo a pesar de las tesis quineanas. Este artículo aborda los efectos del voto preferente en el sistema de partidos políticos colombiano a la luz de las elecciones al Senado de la República entre el año 2006 y 2018. Específicamente se pregunta por los incentivos institucionales para los actores políticos en relación con la reputación partidista o personal y sus efectos reales en el comportamiento electoral de los partidos políticos. Teórica y metodológicamente se parte del paradigma post-positivista, de un enfoque neoinstitucional desde la elección racional y de (...) una metodología mixta, que combina instrumentos y técnicas cualitativas con indicadores cuantitativos. Se identifica la estructura de incentivos del sistema electoral colombiano a partir de las normatividades legales utilizadas y se utilizan indicadores cuantitativos para analizar el comportamiento de los actores políticos en relación con dichos incentivos. Este ejercicio se fundamenta en la necesidad de realizar un estudio sistemático y prolongado en el tiempo de los efectos de la Reforma Política del 2003, especialmente de uno de sus instrumentos con mayor influencia en las decisiones políticas de maximización de beneficios y disminución de costos: el voto preferente. La idea es ir articulando las propuestas sobre la alienación que han elaborado Rahel Jaeggi y Axel Honneth, desarrolladas a partir de un filósofo presuntamente ajeno a la teoría crítica, a saber, Martín Heidegger, e irnos desligando de estos autores a medida que vamos perfilando el concepto. Pretendemos ofrecer un análisis estructural del concepto que permita identificar ciertos rasgos (...) básicos que después sirvan para elaborar un diagnóstico de las patologías sociales en el mundo contemporáneo. I discuss two claims defended in Fischer’s recent work. The first is the default status of compatibilism. This is part of a conception of our agency and moral responsibility as being independent of the truth or the falsity of the thesis of determinism. I try to further bolster Fischer’s arguments in favor of this position. The second is Fischer’s defense of the narrative conception of moral responsibility, according to which the value of self-expression supports and explicates the value of being (...) morally responsible. I argue that the cases and insights taken to support the idea that our lives have a distinctive kind of narrative value are best accounted for in other terms. (shrink)

An article by Luigino Bruni and Robert Sugden published in this journal argues that market relations contain elements of what they call ‘fraternity’. This Response demonstrates that my own views on interpersonal relations and markets – which originated in the feminist analysis of caring labour – are far closer to Bruni and Sugden's than they acknowledge in their article, and goes on to discuss additional important dimensions of sociality that they neglect.

En este texto se aborda el vínculo entre la estructura narrativa de la memoria colectiva (Halbwachs, 2004b) y la dimensión hermenéutica de la ciudadanía (Valderrama, 2010), desde los hallazgos de la investigación denominada Configuraciones de memoria colectiva en participantes del Programa Prensa Escuela entre 2015 y 2019. Para estos efectos, se aplicó una metodología cualitativa, de diseño de revisión documental, y se analizaron los textos de jóvenes, recopilados en la publicación anual El Taller. Se identificó que los temas desarrollados en (...) las narraciones en los cuales se vincula la memoria colectiva y la ciudadanía son identidad y territorio, marcos comunes de pensamiento y reconstrucción del pasado. De esta manera, la narración facilita el reconocimiento de la realidad y sus problemáticas, toda vez que los jóvenes asistentes al Programa podían expresar su percepción del mundo, confrontar elementos de su entorno y darle lugar al otro. Estos textos adquieren resonancia en cuanto entra la hermenéutica a tender puentes para la comprensión del mundo y en el caso de la ciudadanía para la construcción de nuevos modos de convivir. Mostraremos que el desacuerdo entre pesimistas y optimistas sobre la resolución racional de los desacuerdos profundos no se ubica en el nivel del contenido, de lo que están diciendo, sino en uno diferente. Para mostrar por qué es así, proponemos detenernos en el funcionamiento lógico-semántico del término clave en este desacuerdo: “racional”. Iniciaremos con el repaso de algunos argumentos que pesimistas y optimistas han esgrimido en su discusión, y comprobaremos la diferencia de estándares ya mencionada (sección 1); luego, nos detendremos (...) en las particularidades lógico-semánticas de “racional”, y explicitaremos lo que hacen los hablantes cuando realizan movidas lingüísticas con él (sección 2); y para finalizar, volveremos sobre el desacuerdo entre pesimistas y optimistas, y mostraremos por qué, a pesar de la diferencia, permanece como un desacuerdo genuino y es importante seguir inmiscuidos en esta discusión. El análisis lógico-semántico nos mostrará que “racional” no es usado para describir un estándar de racionalidad independiente de cualquier contexto, sino para expresar ciertas actitudes respecto de lo que decimos o hacemos. A pesar de la diferencia de estándares, pesimistas y optimistas siguen inmiscuidos en un desacuerdo genuino porque discrepan acerca de ciertas actitudes que hay que adoptar con respecto a, en este caso específico, los DP. The work originating from the thoughts of Martin Heidegger is of unique depth, covering the most varied aspects of our experience. One of them refers to the ways of being that share everyday experience. In this context, the still young professor Heidegger, as a student and teacher, in Freiburg, Germany, focused on the theme of the factual experience of life through the phenomenon of Christian religiosity. Such reflections contributed to the elaboration especially of three lectures that together constitute volume 60 (...) of his Complete Works – Phenomenology of religious life. Thus, in this article, based on the work, we seek to reflect on the how of the religious experience in a situated way. With this, we first address the issue of the factual experience of religious life and how it occurs in the world. In the second moment, through the interpretation of the Pauline Epistles, the daily occurrence of the phenomenon of proclamation is presented and from this the becoming Christian arising from the original religious experience experienced by the apostle Paul. In the United Nations' Universal Declaration of Human Rights a quite large number of things are said to be ‘human rights’ and though in that Declaration the term ‘inalienable’ is not used to describe the rights in question it has been so used by commentators—at least with respect to some of the rights enumerated. I shall forgo asking the prior question as to whether any such thing as a human right exists and ask simply whether any such thing as an (...) inalienable right exists. This essay articulates a double helix at work in Badiou’s thought on politics as a condition of philosophy and philosophy as such by focusing on what Badiou calls “the Idea of communism” and we will call “the communism of the Idea.” The former refers to communism as an Idea par excellence, while the latter concerns the Idea as a philosophical communism. The first section of the essay unpacks the Idea of communism as a composite interaction of politics, history, and subjectivity (...) insofar as each of these elements cannot be taken in themselves. Contrary to post-ideology, Badiou condemns the claim that we should live without an ideological framework insofar as this asks us to live without an Idea. The second section will focus on the communism of the Idea as the result of Badiou’s broader philosophical project and its major Platonic gestures. Badiou’s broader concerns pertain to the commitment to live with an Idea as finite, infinite, and transfinite to the endpoint that philosophy itself is characterized to be destined for communism. The crux that anyone can become a serious philosopher if, to paraphrase Diotima in Plato’s Symposium, they gracefully lend themselves to the process of truths as their fundamental commitment. In this paper we examine Husserl’s ethics contribution to the understanding of human action determined by self-responsibility. We admit that self-responsibility is that ‘capacity’ of any subject to take a reflective stance on himself and his life. In this sense, the subject only experiences fully being responsible when guides his reason in the multidimensionality of his actions, aiming at a personal and cultural renewal. To show this, we firstly analyze the project of renewal of man and culture in the personalist (...) ethics proposed by Husserl, viewed from the history of parricide Karamazov. Secondly, we inquire about one of the two dimensions of human personality, self-awareness and presence of oneself, to approach the complex intentional act in which this selfconsciousness takes place. Thirdly, we analyze how the ability of self-determination, the other key dimension of the person, makes possible the self-appraisal by which the new man values his actions, motives, means and ends. We conclude that the self guides his life in full participation and emotional manifestation out of experiences that strengthen the ‘self’ and the ‘us’. (shrink)
