It is shown that a notion of natural place is possible within modern physics. For Aristotle, the elements—the primary components of the world—follow to their natural places in the absence of forces. On the other hand, in general relativity, the so-called Carter–Penrose diagrams offer a notion of end for objects along the geodesics. Then, the notion of natural place in Aristotelian physics has an analog in the notion of conformal infinities in general relativity.

The notion of “integrity” is currently quite common and broadly recognized as complex, mostly due to its recurring and diverse application in various distinct domains such as the physical, psychic or moral, the personal or professional, that of the human being or of the totality of beings. Nevertheless, its adjectivation imprints a specific meaning, as happens in the case of “scientific integrity”. This concept has been defined mostly by via negativa, by pointing out what goes against integrity, that is, through (...) the identification of its infringements, which has also not facilitated the elaboration of an overarching and consensual code of scientific integrity. In this context, it is deemed necessary to clarify the notion of “integrity”, first etymologically, recovering the original meaning of the term, and then in a specifically conceptual way, through the identification of the various meanings with which the term can be legitimately used, particularly in the domain of scientific research and innovation. These two steps are fundamental and indispensable for a forthcoming attempt at systematizing the requirements of “scientific integrity”. (shrink)

Estuda-se a percepção do tempo nos poetas augustanos, analisando-se as duas perspectivas fundamentais, a dos poetas epicuristas (Horácio, Ovídio, poetas elegíacos) e a dos poetas estóicos (Vergílio). Verifica-se que, embora dependam da teorização filosófica de origem grega, manifestam características pessoais que vão para além dela.

Durante o período colonial, milhares de artefatos culturais foram levados do continente africano pelos europeus. Nos últimos anos, a restituição de bens culturais tem chamado atenção de teóricos, governos, órgãos internacionais e regulamentações jurídicas. Contudo, há pouca informação sobre a forma como essa realidade se apresenta e é discutida. Este ensaio é uma proposta de investigação sobre a restituição dos bens culturais retirados no contexto do colonialismo, considerando a relação de países europeus com países africanos. Trata-se de analisar a constituição (...) do regime internacional de proteção e restituição do patrimônio cultural, seus princípios, limites e possibilidades, tendo em vista alguns casos de processos restitutivos realizados a partir da década de 1990 e suas narrativas. Em meio aos debates acerca da descolonização das relações entre ex-metrópoles e ex-colônias e os efeitos ainda presentes do colonialismo, este trabalho põe em marcha uma proposta teórico-metodológica que aposta no papel da memória e sua potência no que toca ao direito humano à cultura e à identidade. The theme of consent is, without question, associated with the origins of bioethics and is one of its most significant paradigms that has remained controversial to the present, as is confirmed by the proposal for its debate during the last World Congress of Bioethics. Seen broadly as a compulsory minimum procedure in the field of biomedical ethics, even today it keeps open the issues that it has raised from the start: whether it is really necessary and whether it can be (...) proven to be effective. My goal will be to attempt to determine the most genuine and relevant meaning of consent, going back from its present dominant normative meaning and, from there, identifying or simply sketching other possible forms of its expression in the world we live in, so as to justify its pertinence and validity. This objective will involve three stages: (1) ‘Consent’ as a privileged paradigm of bioethics (the ethical-juridical sense), (2) The symbolic value of ‘consent’ (the social-cultural sense), and (3) ‘Consent’ as promotion of the human (the humanistic-personal sense) .It is concluded that the common notion of normative consent is not the only one, nor does it hold universal validity; that, from a historical-cultural perspective, new expressions of consent appear, adapted to different social contexts and to possibly be implemented in developing countries; and, finally, that consent is strictly indispensable in situations of extreme dependence, in its symbolic relational character, in as much as it promotes ethical relationships among strangers and ensures that they remain so. Cultural diversity is an inescapable reality and a concern in many businesses where it can often raise ethical questions and dilemmas. This paper aims to offer suggestions to certain problems facing managers in dealing with cultural diversity through the inspiration of Thomas Aquinas. Although he may be perceived as a voice from the distant past, we can still find in his writings helpful and original ideas and criteria. He welcomes cultural differences as a part of the perfection of the universe. (...) His systemic approach leads one to place the problem in its proper context, and to reflect on it from the perspective of virtue ethics, with a central role for practical wisdom and giving primacy to neighborly love and natural moral law. Rather than a set of rigid standards with no consideration of diversity Aquinas focuses on the common human ground, which allows for the indispensable dialogue between different positions. When dealing with practical questions, the problem is one of finding the right balance between general principle and cultural specifics, tolerance, and dialogue, always guided by practical wisdom. In this way, Aquinas’ approach is neither rigid ethical universalism with no consideration for diversity nor moral relativism with no place for any transcultural and absolute morals. (shrink)

O presente artigo busca trazer à tona o problema da falta de interoperabilidade nos principais arranjos de pagamento de benefícios de alimentação concedidos aos trabalhadores, que hoje são fechados, prejudicando o trabalhador e o pequeno comerciante, reféns de altíssimas taxas transacionais cobradas pelos maiores operadores de benefícios, os quais dominam o mercado, permitindo a continuidade de grande ineficiência na política pública consubstanciada no já conhecido e consolidado Programa de Alimentação do Trabalhador (PAT). Além disso, este trabalho proporá encaminhamentos a esse (...) problema a partir de uma abordagem multidisciplinar e na utilização de métodos comparativos, estes consubstanciados na experiência anterior da abertura dos arranjos de pagamento de cartão, que promoveu a interoperabilidade no setor e proporcionou a diminuição das taxas transacionais nesse mercado ao longo dos anos. Também se utilizará do papel da literatura jurídica sobre regulação, tecnologia e interoperabilidade, e da literatura do campo das políticas públicas, especialmente na abordagem direito e políticas públicas, de forma a permitir seu endereçamento a futuros estudos que visem aprofundar a necessidade de otimização dessa política pública. The purpose of this succinct work is to present N. Machiavelli's classic republican view from his proposition of an inevitable paradox, the founding of an expansionist republic, difficult to govern, or the founding of a stable, but small and weak republic. Such a paradox, according to Machiavelli, should direct and condition all the constitutive devices of the republic when choosing what will be its destiny as a political body. The model of republic preferred by the Florentine will be the expansionist (...) model of Rome, leading him to assume all the devices that gave this republic its power. From this presentation of the Machiavellian proposition, we will analyse the assimilation of republican thought in England from the Elizabethan period, as well as the political-social scenario that exists there. This itinerary will allow us to understand, in general, why classical republicanism was received on English soil from the perspective of establishing a mixed, stable government, thus favouring the spread of the Venice myth as a serene republic and delaying the use, even that mitigated, of the republican presuppositions expressed in the Machiavellian work that directed towards a Roman model. Tencionamos, neste artigo, demonstrar os meandros constitutivos do que seja um formalismo moral em Immanuel Kant, tendo como pressuposto teórico sua compreensão de uma teoria da vontade. Este movimento de análise e demonstração teórica terá como fio condutor a ideia de autonomia que permeia a construção da vontade no formalismo kantiano, ou seja, a pressuposição de uma possível autonomia formal da razão é a base na qual se assenta a teoria moral deste pensador. Para execução de nossa pretensão será necessário (...) reconstituir os pontos nevrálgicos do que venha a ser uma teoria da vontade para em seguida analisar os pressupostos kantianos que realçam a centralidade da autonomia da razão na compreensão de uma vontade livre. Desta maneira, o que se pretende por em desnudo é a originalidade kantiana, em relação à tradição que promulga a vontade como marca da liberdade humana, a partir de seu pressuposto de autonomia formal na constituição moral do indivíduo humano. The intention of this brief article is to demonstrate, through the Machiavellian and Shakespearean analyzes, mediated by the latter's work, “The Merchant of Venice”, the contrast between the classical republican conception and the modern political ideal of freedom. We will take as a gauge the ideas of social belonging (religion, social recognition); legal constitution of rights (individual freedom), trying to understand how these aspects are constructed in the representations of the city of Venice by the two authors. For this undertaking, (...) it will be necessary to understand the Machiavellian understanding of the political and social structures that founded and sustained the Venice of his time. Then understand the scenario in which Shakespeare sees the Venice of his era, analyzing his work mentioned. Finally, we will try to demonstrate how one can extract from this intricate approximation subsidies to think the contrast between the traces of a classic republican thought and the incipient points of a modern conception of individual freedom. Nietzsche colocou-se como um antípoda a Platão. Mas em questões cosmológicas, o eterno retorno nietzschiano tem também alguns pontos em comum à cosmologia platônica descrita no Timeu. A finitude espacial, a ciclicidade cósmica e a ética cosmológica dizem respeito às semelhanças, já a infinitude temporal, a teleologia e a necessidade afastam os filósofos. Então, neste trabalho, aponto proximidades e afastamentos entre os dois filósofos em questões cosmológicas, além de sugerir alguma atualidade de suas concepções em relação à nossa ciência. System analyses deal with interrelationships between different variables that keep the system in balance. In many analysis of complex thinking, a system is viewed as a complex unit in which the ‘whole’ is not reduced to the ‘sum’ of its parts; the system becomes an ambiguous item because it consists of several entities that interact with unforeseen results or, in other words, it is situated at a transdisciplinary level, it is impossible for an area to have a complete reading of (...) its complexity. It was also mentioned that the concept of the open system best describes complexity by stating that ‘the laws of the organization are not equilibrium, but an imbalance that is restored or compensated for by stabilized dynamics’. This idea originated from the field of thermodynamics and the second law, in which the imbalance that it maintains allows the system for an apparent balance. This fragile steady state has something of a paradox, since the structures remain the same, but their constituents are changeable. The concept of open system undoes the door to a theory of evolution that can only derive from the interactions between a system and its ecosystem. Within this systemic approach, the focus of the analysis takes into account the ambiguity, multidisciplinary and complexity associated with system adjustment, i.e. it is intended to qualify an employee job based on their experience and knowledge as a measure of their impact on the organization performance. In spite of successful tests, the standard cosmological model, the $$\varLambda$$ CDM model, possesses the most problematic concept: the initial singularity, also known as the big bang. In this paper—by adopting the Kantian difference between to think of an object and to cognize an object—it is proposed a degree of scientificity using fuzzy sets. Thus, the notion of initial singularity will not be conceived of as a scientific issue because it does not belong to the fuzzy set of what is (...) known. Indeed, the problematic concept of singularity is some sort of what Kant called the noumenon, but science, on the other hand, is constructed in the phenomenon. By applying the fuzzy degree of scientificity in cosmological models, one concludes that cosmologies with a contraction phase before the current expansion phase are potentially more scientific than the standard model. At the end of this article, it is shown that Kant’s first antinomy of pure reason indicates a limit to our cosmological models. (shrink)

This paper stems from the current global worsening of the scarcity of resources for healthcare, which will deepen even more in future public emergencies. This justifies strengthening the reflection on the allocation of resources which, in addition to considering technical issues, should also involve ethical concerns. The two plans in which the allocation of resources develops—macro and micro—are then systematized, both requiring the identification of ethical criteria for the respective complex decision-making. Then, we describe how the complexity at the macro (...) level focuses on the joint consideration of the rectitude of the principles, the goodness of the ends, and the integrity—respectively the deontological, teleological, and procedural perspectives; and at the micro level, it focuses in prioritizing people, which can result in the exclusion of some, as happened with the elderly during peaks of COVID-19. The main objective of this article is to show that, in public health emergency situations, in which the daily criteria for prioritizing access to health care are not efficient, it is possible not only to ration the available means but also to rationalize them. We argue that rationing and rationalization are different concepts, entail different consequences, have different ethical foundations, and draw different guidelines for patient care. We apply them to the distribution of intensive care and vaccines to the elderly thus demonstrating the ethically legitimate domain of implementation of each of these two prioritization criteria. We conclude that rationalization respects more strictly the core ethical principles of our common morality. (shrink)

In a larger context of an egalitarian project which aims to reformulate capitalism a job guarantee program in the form of a State as an Employer of Last Resort is considered superior to Unconditional Basic Income by many, namely Alan Thomas. This article claims that most of the arguments used to assert the superiority of SELR fail their objective, for the following reasons: first, SELR falls short in its reformulation of capitalism because neither SELR nor UBI alone can euthanize the (...) rentier class. Second, most accounts are based on a flawed assumption that UBI leads to rampage inflation. Third, if macroeconomic considerations are not enough to justify implementing SELR over UBI, then insisting on the superiority of SELR can only stem from two types of moral reasons: on one hand from a perfectionist view of empowering the worst-off through labor and on the other from demands and obligations of reciprocity. We argue that these two moral-based reasons fall short of providing a justification for the superiority of SELR over UBI. We conclude our paper defending the possibility of conciliating the two policies. (shrink)

"Principe à valeur constitutionnelle en droit français, la sécurité juridique occupe une place centrale dans l'argumentaire du législateur aussi bien national qu'européen et se trouve au coeur de l'activité juridictionnelle. Dans une perspective économique du droit, les systèmes juridiques sont désormais eux-mêmes évalués à l'aune de la sécurité juridique, comme le démontrent les rapports "Doing Business", commandés par la Banque Mondiale depuis une dizaine d'années. Cependant, la crainte d'insécurité juridique semble ne jamais avoir été aussi forte. Elle est notamment révélée (...) par l'appel récurrent à la notion de sécurité juridique. La mondialisation et la "fondamentalisation" du droit amplifient le phénomène dans la mesure où l'exigence de sécurité se manifeste dans des contextes plus complexes de formation et d'application du droit. En parallèle, la notion d'insécurité juridique est évoquée en creux lors des travaux relatifs à la sécurité juridique. Or, cette dernière est le plus souvent envisagée à partir de la dénonciation de son contraire, l'insécurité juridique. Par conséquent, la sécurité juridique est envisagée de manière négative. Pourtant, l'insécurité juridique ne fait l'objet d'aucun travail conceptuel malgré son emploi généralisé. Sous l'égide de la Cour de cassation et de la Société de législation comparée, des juristes de plusieurs horizons se sont réunis à Paris le 22 mars 2021 pour mener une double analyse de cette notion dans un colloque intitulé "Insécurité juridique : l'émergence d'une notion? " Ils ont d'abord apprécié le recours à la notion d'insécurité juridique pour se livrer ensuite à un exercice prospectif, notamment au regard des nouveaux enjeux technologiques.". (shrink)

Neste breve artigo, argumentaremos que a pandemia da Covid-19, como outras na história humana, colocou em desnudo as bases da estrutura político-econômica moderna. Defenderemos que tais bases apoiam-se em dois esteios, uma noção política de ‘Estado’, ápice da organização humana, e uma concepção racionalista, técnica e produtiva, que promulga a possibilidade de resposta a qualquer crise surgida na sociedade. Como contrapondo a esta estrutura, apresentaremos a teoria maquiaveliana, que aponta para uma relação indelével entre política e fator natural, natureza e (...) sociedade. Nesta teoria, com uma concepção antropológica própria, as necessidades impostas pela natureza frente a ação humana são determinantes para se pensar a própria construção política. Como resultado, consideraremos ser necessário repensar a estrutura político-econômica moderna em seus pretensos mitos de incontestável avanço político, por meio do ‘Estado’, e inabalável base racional, principalmente técnico-produtiva, retomando o lugar de importância do fator natural para constituição de uma sociedade mais ‘humana’. This article explores Hannah Arendt's insights into the forms of social control operating especially in democracies, together with the possibility of resistance to such control. Since the way in which one defines freedom informs one's understanding of the techniques that suppress, regulate, and modify behaviour, the article begins by sketching Arendt's notion of freedom, and compares this to its liberal counterpart. That discussion leads to Arendt's conception of power, whose corollary is freedom, and whose suppression amounts to control. The institutional (...) and ideological infrastructure that accompanies the encroachment of ?the social? ? which Arendt links to the hegemony of liberalism ? is conceived as rendering the individual both powerless and apathetic. The article concludes with suggestions regarding resistance to modern forms of control, viewing Arendt's ontology as a source of tenable strategies for the deepening of democracy. (shrink)

The paper highlights the need to discuss the norm of reciprocity in the context of basic income experiments. Considering how the norm of reciprocity is an important objection to basic income, both at a normative level, but also in empirical discussions, a case is made for considering it in basic income experiments. The paper proposes several hypotheses on basic income and reciprocity and concludes with two distinct points: the first is focused on what in fact experiments could be telling us (...) about behaviours that seem relevant to reciprocity, and how this could enhance our understanding of both basic income and the norm of reciprocity. The second point is a reflection on how our theoretical debate is shaped on ideal settings, whereas experiments take place in real-world conditions, hence non-ideal ones. This reflection might contribute to the need to reframe our theoretical account of the norm of reciprocity. (shrink)

Preference queries from databases aim to retrieve the best answers w.r.t. user's requirements. The integration of preferences in database queries has known many advances in the last decade. Most of works however are based on comparative preference statements obeying more or less strong semantics. Representing and reasoning about comparative preference statements has also been widely investigated in Artificial Intelligence. In this paper, we bridge the two frameworks and develop a simple and unified framework to reason about preferences in database queries. (...) Central to the development of geology has been the growth of systematic empirical observation as a programme of scientific practice. Fieldwork has focused on many objects—strata, fossils, and landforms—and has issued in a variety of products, such as maps, sections, and monographs on regional geology, particular rock formations and fossils. Early in the nineteenth century, above all, many influential geologists sought to define their science as one exclusively of field observation, description, and the accumulation of data. This article aims to contribute to the existing literature on the virtues and challenges of political liberalism. It argues that the principle of reciprocity can only sustain political agreement under pluralism, if citizens share a relationship of civic friends, based on mutual recognition as equals (Lister in Anal Kritik 2011, pp. 91–112), a non-prudential concern for the interest of others (Leland and van Wietmarschen in J Moral Philos 14, 2017, pp. 142–167) and shared experiences that can foster interpersonal trust. Inasmuch (...) as this thicker definition of civic friendship is sound, and breeds a successful ground for civic reciprocity, it is argued that this renders the concept of civic reciprocity culturally sensitive in at least four ways: how citizens commit to reciprocity, what political values and institutional arrangements they deem reasonable and how they choose to cooperate are all influenced by culture. While this makes the project of multiculturalism more challenging, it does not make it impossible. Rather, it reminds us that while the formal requirement of reciprocity is important, it is a relational value anchored in how citizens relate to one another. Therefore, for multiculturalism to be successful, policies that strengthen ties of civic friendship need to be implemented. (shrink)
