Non-medical or Social egg freezing (oocyte cryopreservation) is currently a controversial topic in Islam, with contradictory fatwas being issued in different Muslim countries. While Islamic authorities in Egypt permit the procedure, fatwas issued in Malaysia have banned single Muslim women from freezing their unfertilized eggs (vitrified oocytes) to be used later in marriage. The underlying principles of the Malaysian fatwas are that (i) sperm and egg cells produced before marriage, should not be used during marriage to conceive a child; (ii) (...) extraction of mature egg cells from single women being unacceptable; and (iii) fertility preservation in anticipation of late marriage is a conjecture that has not yet occurred. Ovarian tissue freezing can potentially be a more Shariah-compliant alternative to social egg freezing, because once the frozen ovarian cortical tissue sections have been re-transplanted back into the woman, mature egg cells can readily be produced, collected, and fertilized by the husband’s sperm only during the period of marriage contract (′akd al-nikāḥ). Unlike accidental mix-ups with frozen eggs, muddling of lineage (nasab) would be automatically avoided in ovarian tissue freezing due to immunological rejection. However, upon critical analysis based on Qawā’id Fiqhiyyah (Islamic Legal Maxims), Maqāṣid-al-Shariah (Higher Objectives of Islamic Law), and Maslaḥah-Mafsadah (benefits versus harmful effects on society), elective ovarian tissue freezing by healthy single women for social reasons would likely be a highly contentious and controversial issue within Muslim communities that may conflict with conservative social-religious norms. This thus needs further debate among Islamic jurists in dialogue with medical doctors and biomedical scientists. (shrink)

Having constituted a new epoch in human history and a new religiouspolitical order, the revealed religions challenged the tradition of Greek philosophy to adjust to, investigate, and make intelligible a religiouspolitical order based on prophecy, revelation, and the divine law. The challenge led certain Arab and Muslim philosophers to reassess the relative distance between the thought of the Greek masters, and the doctrines propagated by the revealed religions, and to make use of such works as Plato's Republic and Laws, rather (...) than Aristotle's Politics, when offering a philosophic account of the new religious–political phenomenon and of such new disciplines as the science of the divine law and the science of revealed theology. Les religions révélées, en inaugurant une ère nouvelle dans l'histoire humaine et un nouvel ordre “religio-politique”, ont constitué un défi pour la tradition de la philosophie grecque. Celle-ci devait s'adapter a un ordre religio-politique fondé sur la prophétie, la révélation et la loi divine, en faire un objet d'investigation et le rendre intelligible. Ce défi conduisit certains philosophes arabes et musulmans à réévaluer la distance qui sépare la pensée des maîtres grecs des doctrines propagées par les religions révelées. Il les conduisit aussi à faire usage d'oeuvres telles que la République et les Lois de Platon, plutôt que la Politique d'Aristote dans leur effort de rendre compte philosophiquement du phénomène religio-politique nouveau et des nouvelles disciplines telles que la science de la loi divine et la science de la théologie révélée. In this work, Muhsin Mahdi--widely regarded as the preeminent scholar of Islamic political thought--distills more than four decades of research to offer an authoritative analysis of the work of Alfarabi, the founder of Islamic political philosophy. This article proposes an analysis of changes implemented during Malaysia's Prime Minister Abdullah Ahmad Badawi's administration (20032003), which displayed bias against changes and introduced schemes to justify the systems it upheld. Transmutations wrought during Abdullah's tenure may have been neither substantial nor totalizing, but within the conservative paradigm which had long gripped national politics, Abdullah's deviations were significant nevertheless.

Although medical confidentiality is widely recognized as an essential principle in the therapeutic relationship, its systematic and coherent practice has been an ethically challenging duty upon healthcare providers due to various concerns of clinical, moral, religious, social, ethical and legal natures. Medical confidentiality can be breached to protect the patient and/or others if maintaining confidentiality causes serious harm. Healthcare professionals may encounter complicated situations whereby the divulgence of a patient’s confidential information may pose a threat to one party whereas the (...) concealment of such information may cause harm to another. After deliberating on the Islamic concept of harm (ḍarar), this paper focuses on the dual duty and conflicts of interests faced by healthcare professionals in the practice of medical confidentiality. Referring to serious infectious diseases with a special mention of AIDS, this study also provides discourse on how healthcare professionals deal with difficult scenarios of conflicts of interests and ethical dilemmas. The aim of present paper is to introduce the concept of ‘expressive perception’ in Ernst Cassirer’s philosophical mythology. Having Cited Dorothy Emmet’s methodological objection, the author, by recalling Kantian aspect of Cassirer’s thought and referring to the concept of ‘expressive perception’, would make an attempt to reply on his part: according to Cassirer, this level of perceptive experience is the origin of the mythical form of thinking as a whole and, at the same time, is the original and irreducible altogether. Thus, taking ‘mythical thought’ as an independent form of thinking, beside the ‘critical-empirical’ form of thinking, is, for one thing, completely cogent; for another, due to its dependency upon expressive form of perception, mythical thought would never be quite omitted, rather, keep living latently beneath the skin of mental life. In addition, author explains how much Cassirer owes, regarding to the concept of ‘expressive form of perception’, to Max Scheler. Avoiding to elaborate on Scheler’s detailed argument, Cassirer relies strongly on the consequences Scheler draws from his considerations in his work ‘Wesen und Formen der Sympathie’. Restating Scheler’s argument briefly should help in understanding Cassirer’s idea. (shrink)

Artificial womb technology for extracorporeal gestation of human offspring (ectogenesis or ectogestation) has profound ethical, sociological and religious implications for Muslim communities. In this article we examine the usage of the technology through the lens of Islamic ethico-legal frameworks specifically the legal maxims (al-Qawaid al-Fiqhiyyah) and higher objectives of Islamic law (Maqaṣid al-Shariah). Our analysis suggests that its application may be contingently permissible (halal) in situations of dire need such as sustaining life and development of extremely premature newborns, for advancing (...) fetal medicine and avoiding maternal co-morbidities during fetal treatment, and for enabling motherhood for women without functional wombs, or who face grave medical risks in pregnancy. However, its application may be proscribed (haram) for enabling healthy women to avoid pregnancy and childbirth, or to achieve parenthood equity. Specification of these views to particular policy, legal contexts and Fatwa will require multidisciplinary Shariah-based bioethical deliberations between jurists, policymakers, and scientists. In recent years, preimplantation genetic testing (PGT) of IVF embryos have gained much traction in clinical assisted reproduction for preventing various genetic defects, including Down syndrome. However, such genetic tests inevitably reveal the sex of IVF embryos by identifying the sex (X and Y) chromosomes. In many countries with less stringent IVF regulations, information on the sex of embryos that are tested to be genetically normal is readily shared with patients. This would thus present Muslim patients with unintended opportunities for (...) sex selection based on personal or social biases without any pressing need or valid medical reason. Additionally, there are other patients who claim using PGT for preventing genetic defects as a pretext or “convenient excuse,” with a secret intention to do sex selection when it is banned in their home country. Currently, non-medical sex selection is a highly-controversial and hotly debated issue in Islam, because there is generally a strong preference for having sons over daughters due to widespread cultural norms of elderly parents depending on their sons for financial support, as well as the need for male heirs to continue the family lineage within the backdrop of local patriarchal cultures. There is a risk of gender imbalance and social disequilibrium occurring in Islamic societies due to prevalent sex selection. Hence, the question is whether opportunistic sex selection with PGT would contravene Islamic ethics and principles, which will thus be discussed here. (shrink)

This book, first published in 1957, is the study of 14th-century Arab historian Ibn Khaldun, who founded a special science to consider history and culture, based on the philosophy of Plato and Aristotle and their Muslim followers. In no other field has the revolt of modern Western thought against traditional philosophy been so far-reaching in its consequences as in the field of history. Ibn Khaldun realized that history is more immediately related to action than political philosophy because it studies the (...) actual state of man and society. He found that the ancients had not made history the object of an independent science, and thought it was important to fill this gap. A factual acquaintance with the conclusions of Ibn Khaldun's reflections on history is not the same as the full comprehension of their theoretical significance. When these fundamental questions are answered, it becomes possible to pose the specific question of the relation of Ibn Khaldun's philosophy of history, or his new science of culture, to other practical sciences and, particularly, to the art of history. After an exposition of the major trends of Islamic historiography, part of this book attempts to answer this question through the analysis of the method and intention of the sections of the 'History' where Ibn Khaldun himself examines the works of major Muslim historians, shows the necessity of the new science of culture, and distinguishes it from other practical sciences. Applying the dormitory system for thousands of santri (student of Islamic boarding school in Indonesia), Quranic pesantren (Islamic boarding school) has been considered as one of the main culprits in the spread of the coronavirus disease 2019 (COVID-19). Such assumption is created solely from the applicable health protocols and protective measures to avoid COVID-19 transmission in pesantren. As a matter of fact, pesantrens are known to have applied a distinctive way of coping with COVID-19. This study aims to elucidate the (...) theology of health of Quranic pesantren in the face of COVID-19. Research data were generated through observational method on three Quranic pesantrens in Yogyakarta, interviews with caregivers, the COVID-19 task force of the pesantren, santri and documentation related to the handling of COVID-19 in the three pesantrens. The results showed that the Quranic pesantren as a subculture has a distinctive way of dealing with COVID-19 pandemic by integrating modified health protocols in accordance with the actual conditions of the pesantren and by applying rituals of Islamic spirituality by reciting verses of the Qur’an, salawat (prayers for the Prophet), prayers and hizib (prayer for salvation and rejecting calamities). Three pesantrens chose these methods by drawing on the belief that COVID-19 is God’s creature and, thus, it only works on God’s orders and will stop if God wills. In line with this, this study suggests a method for handling COVID-19 by not only emphasising the health protocols and medical procedures but also taking into account the importance of local wisdom. Contribution statement: This article contributes to the strategy of COVID-19 handling by combining the health protocols of COVID-19 and the applicable local wisdom, such as religious ritual as practiced by numerous pesantren in Indonesia. This study provides a detailed description of ways in which Muslim astronomers handled the Greek astronomical legacy, reassessed its cultural and philosophical implications in light of their religiously-inspired world view, and proposed to modify it.

This article examines the relationship between religion, tradition and identity as seen from the myth about eclipses in a village in Central Java. Javanese people in rural areas still hold beliefs passed down from their ancestors about eclipses, both lunar and solar eclipses. Using a qualitative approach, the results of the study showed that the villagers believe that eclipses occur because of evil giants called buto named Batara Kala who try to devour the sun or the moon. This natural phenomenon (...) is believed to bring disaster to pregnant women and livestock. To fight the disaster, they must perform certain ceremonies or rituals. Based on ethnographic studies, this research provides an overview of eclipse mythology for Javanese locals and analyses it from identity theory. This shows that mythical rituals reflect a continuous identity formation. Although the traditions associated with these myths to some extent transcend the boundaries of the Islamic religion, they remain unchallenged. CONTRIBUTION: This research suggests that myths play an important role in the life and identity of the people who believe in them and perform the rituals associated with them. (shrink)

This article studies Ibn al-Haytham’s treatment of the common notions from Euclid’s Elements (usually referred to today as the axioms). We argue that Ibn al-Haytham initiated a new approach with regard to these foundational statements, rejecting their qualification as innate, self-evident, or primary. We suggest that Ibn al-Haytham’s engagement with experimental science, especially optics, led him to revise the framing of Euclidean common notions in a way that would fit his experimental approach.

The adoption of halal practices in the food and beverage industry is crucial for ensuring compliance with Islamic principles and meeting the growing demand for halal products. This qualitative study explores the perspectives of food and beverage producers and halal authorities on the implementation of halal practices in supply chain management. Focus group discussions were conducted with nine industry participants under the auspices of the Indonesian Institute for the Study of Food, Drugs, and Cosmetics (LPPOM). The discussions aimed to identify (...) behaviors and actions in adopting halal practices based on personal perceptions. The focus group discussions were recorded, transcribed, and analyzed to identify patterns and classify ideas into categories. The findings reveal nine key indicators of halal practice adoption behavior, including purchasing halal raw materials, managing warehouse storage areas, maintaining personal hygiene, managing the cleanliness of facilities and equipment, controlling the sourcing of halal materials, controlling the production process, disseminating halal information, conducting internal audits, and managing financial transactions. The study highlights the importance of these practices in preventing contamination, ensuring strict production processes, promoting effective communication, and maintaining financial transparency. The insights gained from this exploratory research contribute to a deeper understanding of halal practice adoption behavior and support the development of conceptual models for halal supply chain management in the food and beverage industry. This paper explores the representation of Laji’een and Muhajireen in Jordan News Agency. It uses the headlines of a 2.5 million word corpus of Arabic news articles in a time span of 5 years from 2012 to 2016. Chronologically analyzing the headlines shows a change in the representation of and attitudes towards refugees and migrants over the investigated period. The analysis of the headlines shows that 2012 starts with providing the assistance to the refugees then at a later stage of (...) 2012 and in 2013 and 2014, the language is shifted to calling for assistance to the country to contribute to solving the problem. In 2015, the language is changed to be more alerting about the scarce in funding. In 2016, the headlines have changed the focus to Europe due to the migration of the refugees. This motivates the National News Agency of Jordan to highlight the suffering of Europe because of the refugees despite having the capacity and resources to host the migrant refugees. The paper concludes that language in general, and the language of media in particular can change the attitudes of people and governments toward critical issues and phenomena like migration and asylum. The paper describes the design of an intelligent tutoring system for teaching Introduction to Computer Science-a compulsory curriculum in Al-Azhar University of Gaza to students who attend the university. The basic idea of this system is a systematic introduction into computer science. The system presents topics with examples. The system is dynamically checks student's individual progress. An initial evaluation study was done to investigate the effect of using the intelligent tutoring system on the performance of students enrolled in computer science (...) curriculum at Al-Azhar University, Gaza. Decolonization and Psychoanalysis challenges traditional psychoanalytic frameworks by revisiting Lacan's conceptualization of the materiality of speech through a decolonial lens. Ahmad Fuad Rahmat explores how Lacan's ideas about the symbolic order and its historical development are intertwined with colonial assumptions, and proposes that rethinking these assumptions can pave the way for a decolonial psychoanalysis. The book explores how Lacan uses Freud's Jewishness as a marginalized perspective that reveals the excluded dimensions of signification within the symbolic order, and examines James Joyce's (...) anti-colonial politics and its significance for Lacan's conception of the sinthome. The critique extends to Slavoj Žižek's Eurocentric readings of Malcolm X as a foil with which colonized speech could be conceived as 'symbolic dispossession.' Finally, it reframes the gap by understanding global capitalism as a mode of exchange to advocate for a decolonial psychoanalysis that focuses on the gaps and non-spaces of transmission as opposed to a like for like export of the clinic from the center to the periphery. Decolonization and Psychoanalysis will be of great interest to psychoanalysts and to academics and scholars of psychoanalytic studies, critical theory and cultural studies. (shrink)
