In the year ending March 2020, an estimated 773,000 people in England and Wales were sexually assaulted. These types of crimes have lasting effects on victims’ mental health, including depression, anxiety, and post-traumatic stress disorder. There is a large body of literature which identifies several factors associated with the likelihood of the victim reporting a sexual assault to the police, and these differences may be due to rape myth stereotypes which perpetuate the belief that rape is only “real” under certain (...) conditions. Less is known, however, about the effect these rape myths and stereotypes have on the investigation process itself and the subsequent police outcomes assigned to sex offences. This study aimed to address this gap, providing a profile of all RASSO (rape and serious sexual offences) committed over a 3-year period in one English police force, the police outcomes of these offences, and whether any offences, suspect, or victim variables were associated with different outcomes, in particular the decision to charge or cases where victims decline to prosecute. In line with previous research, the majority of victims were female while the majority of suspects were male, and the most frequent victim–suspect relationship was acquaintance, followed by partner/ex-partner. Charge outcomes were more likely in SSOs and less in rape offences, more likely with stranger offences and less likely than offences committed by partners/ex-partners and relatives, and some non-white suspects were more likely to be charged than suspects of other ethnicities, including white suspects. Victim attrition was more likely in cases where the suspect was a partner or ex-partner and least likely where the suspect was a stranger, more likely in SSOs than in rape cases, and more likely when the victim ethnicity was “other”. Law enforcement should be aware of the potential biases, both relating to rape myths and stereotypes and to the biased treatment of victims and suspects based on demographic characteristics, and work to eliminate these to ensure a fairer and more effective RASSO investigative process. Miranda Fricker maintains that testimonial injustice is a matter of credibility deficit, not excess. In this article, I argue that this restricted characterization of testimonial injustice is too narrow. I introduce a type of identity-prejudicial credibility excess that harms its targets qua knowers and transmitters of knowledge. I show how positive stereotyping and prejudicially inflated credibility assessments contribute to the continued epistemic oppression of marginalized knowers. In particular, I examine harms such as typecasting, compulsory representation, and epistemic exploitation and (...) consider what hearers are obligated to do in response to these injustices. I argue that because epistemic harms to marginalized knowers also arise from prejudicially inflated assessments of their credibility, the virtue of testimonial justice must be revised to remedy them. We present a proof of the equivalence between two deductive systems for constructive necessity, namely an axiomatic characterisation inspired by Hakli and Negri's system of derivations from assumptions for modal logic , a Hilbert-style formalism designed to ensure the validity of the deduction theorem, and the judgmental reconstruction given by Pfenning and Davies by means of a natural deduction approach that makes a distinction between valid and true formulae, constructively. Both systems and the proof of their equivalence are formally (...) verified using the state-of-the-art proof assistant Coq. The proof approach taken throughout the paper unveils the use of some alternative proof methods that allow for a smooth transition from the high-level mathematical proofs to their mechanised counterparts. Expanding Miranda Fricker's (2007) concept of epistemic injustice, recent accounts of agential epistemic injustice (Lackey, 2020; Medina, 2021; Pohlhaus, 2020) have focused on cases in which the epistemic agency of individuals or groups is unfairly blocked, constrained, or subverted. In this article I argue that agential epistemic injustice is perpetrated against marginalized groups not only when their group epistemic agency is excluded, but also when it is included but receives defective uptake that neutralizes their capacity to resist epistemic oppression. (...) I identify two harms that such injustice inflicts on marginalized groups: epistemic disempowerment and critical defanging of resistant epistemic group agency. My analysis shows how the harms of agential epistemic injustice can occur through unfair epistemic exclusions in group dynamics, but also through forms of inclusion in group dynamics that distort or coopt the epistemic agency of the group. Following Emmalon Davis (2018) and her analysis of epistemic appropriation, I argue that the harms of agential epistemic injustice can occur when the resistant epistemic resources of a marginalized group are appropriated in a way that disempowers them and critically defangs their resistant epistemic agency. I use Taylor Rogers’ (2021) analysis of the epistemic appropriation of “#MeToo” and “intersectionality” to show how epistemic disempowerment and critical defanging work in unjust epistemic group dynamics. The article offers a diagnosis of the failures of epistemic responsibility involved in agential epistemic injustice, and some suggestions for resisting those failures and working toward more responsible and just epistemic group dynamics. There is an ongoing debate in medicine about whether patients have a ‘right not to know’ pertinent medical information, such as diagnoses of life-altering diseases. While this debate has employed various ethical concepts, probably the most widely-used by both defenders and detractors of the right is autonomy. Whereas defenders of the right not to know typically employ a ‘liberty’ conception of autonomy, according to which to be autonomous involves doing what one wants to do, opponents of the right not to (...) know often employ a ‘duty’ understanding, viewing autonomy as involving an obligation to be self-governing. The central contribution of this paper is in showing that neither view of autonomy can reasonably be said to support the extreme stances on the right not to know that they are sometimes taken to. That is, neither can a liberty view properly defend a right not to know without limits, nor can a duty view form the basis of an absolute rejection of the right not to know. While there is still theoretical distance between these two approaches, we conclude that the views are considerably closer on this issue than they first appear, opening the way for a possible compromise. This article discusses five attempts at justifying the provision of welfare on Kantian grounds. I argue that none of the five proposals is satisfactory. Each faces a serious challenge on textual or systematic grounds. The conclusion to draw from this is not that a Kantian cannot defend the provision of welfare. Rather, the conclusion to draw is that the task of defending the provision of welfare on Kantian grounds is a difficult one whose success we should not take for granted.

Along with Einstein and Darwin, Newton is one of the few scientists known to almost every member of the population. This paper reports on a study of ethical decision-making in a fair trade company. This can be seen to be a crucial arena for investigation since fair trade firms not only have a specific ethical mission in terms of helping growers out of poverty, but they tend to be perceived as (and are often marketed on the basis of) having an "ethical" image. Eschewing a straightforward test of extant ethical decision models, we adopt Thompson''s proposal for a more contextualist understanding (...) rooted in ethnographic data. Our findings suggest that the fair trade mission of the firm is experienced as an over-riding ethical claim, which is often invoked to justify potentially ethically questionable decisions. Moreover, decision precedents emerge which can mean that the decision process is bypassed or hurried through. Finally we provide evidence that the significance of these precedents, and indeed, even moral intensity itself, could be actively shaped and constructed by organization members to support different, even shifting, conceptions of what is a morally acceptable decision for a fair trade company to make. The article explores the textual construction of gender categories in the political discourse of Simón Bolívar by means of a close critical reading of his seminal writings made public between 1812 and 1820. The historical and political processes known as Latin American independence constitute a moment of radical transformation. It was during this period that the questions of political rights, nationality and citizenship were most open to debate throughout the continent. The article shows how the category woman is constructed ambiguously (...) in Independence/anti-colonial discourse, how gender is employed to create hierarchical systems of social organization to legitimate the exercise of power by an elite of white creole men and how myth is deployed in order to reinforce gender hegemonies. It will be shown that in Bolívar's writings colonial relations are recast as family relations and political independence from Spain legitimated in terms of sexual difference and masculine domination. In researching women’s involvement in economic crime, the concept of the ‘economic’ is problematic. Women’s crime for economic gain and women’s crime in economic terms are inadequately catered for. In reviewing criminologists’ uses of the notion of ‘economic crime’ I suggest that criminological understandingin relation to crime for economic gain is poor and that gender freedom/blindness/specificity variously operate. This article provides an original feminist reading of contemporary work on crime and markets and rational choicetheory and relates this to feminist economic (...) critiques in order to achieve agendering of the economy. The broad aims of the article are to illustratethe problematics of economic classifications and definitions in criminologyand to mount an argument that suggests the whole notion of the economic within criminology demands (feminist) critique. Then we identify neuropsychological anomalies that could produce the unusual experiences that may lead, in turn, to the delusions in our battery. However, we argue against Maher's view that delusions are false beliefs that arise as normal responses to anomalous experiences. We propose, instead, that a second factor is required to account for the transition from unusual experience to delusional belief. The second (...) factor in the etiology of delusions can be described superficially as a loss of the ability to reject a candidate for belief on the grounds of its implausibility and its inconsistency with everything else that the patient knows, but we point out some problems that confront any attempt to say more about the nature of this second factor. Howard Robinson’s “revised causal argument” for the sense-datum theory of perception combines elements from two other arguments, the “original” causal argument and the argument from hallucination. Mark Johnston, however, has argued that, once the nature of the object of hallucinatory experience is properly addressed, the errors in hallucination-based arguments for conjunctivist views of perception like the sense-datum theory become apparent. I outline Robinson’s views and then consider the implications of Johnston’s challenge for the revised causal argument.

Being human while trying to scientifically study human nature confronts us with our most vexing problem. Efforts to explicate the human mind are thwarted by our cultural biases and entrenched infirmities; our first-person experiences as practical agents convince us that we have capacities beyond the reach of scientific explanation. What we need to move forward in our understanding of human agency, Paul Sheldon Davies argues, is a reform in the way we study ourselves and a long overdue break with (...) traditional humanist thinking. Davies locates a model for change in the rhetorical strategies employed by Charles Darwin in _On the Origin of Species_. Darwin worked hard to anticipate and diminish the anxieties and biases that his radically historical view of life was bound to provoke. Likewise, Davies draws from the history of science and contemporary psychology and neuroscience to build a framework for the study of human agency that identifies and diminishes outdated and limiting biases. I offer an analysis of the role played by consideration of an item's functions when it is judged aesthetically. The account applies also to artworks, of which some serve extrinsic functions (such as the glorification of God and the communication of religious lore) and others have the function of being contemplated for their own sake alone. Along the way, I deny that aesthetic judgements fit the model of judgements either of free beauty or of dependent beauty, given how these two (...) came to be described in the early twentieth century. A persistent boast of the historical approach to functions is that functional properties are normative. The claim is that a token trait retains its functional status even when it is defective, diseased, or damaged and consequently unable to perform the relevant task. This is because historical functional categories are defined in terms of some sort of historical success -- success in natural selection, typically -- which imposes a norm upon the performance of descendent tokens. Descendents thus are supposed to perform (...) the associated task even when they cannot. The conceit, then, is that malfunctions are explicable in terms of historical success. The aim of this paper is to challenge this conceit. My thesis is that the historical approach to functions lacks the resources with which to account for the possibility of malfunctions. If functional types are defined in terms of historical success, then tokens that lack the defining property due to defect, and tokens that have lost the defining property due to disease or damage, are excluded from the functional category. Historically based malfunctions, in consequence, are impossible. The historical approach is no better than its non-historical competitors in accounting for the presumed normativity of functional properties. (shrink)

According to the Balinese expert, Dr. Anak Agung Mad ´e Djelantik, “no writings about aesthetics specifically as a discipline exist in Bali.”1 The arts are discussed in ancient palm leaf texts, but mainly in connection with religion, spirituality, ceremony, and the like. However, there are famous accounts by expatriate Westerners and anthropologists.2 There have also been collaborations between Balinese and Western scholars.3 In addition, there is a significant literature written in Indonesian by Balinese experts, beginning in the 1970s.4 Considerable experience (...) of the culture is necessary to appreciate the full detail of these analyses and to be able to understand the arts from a Balinese perspective. I attempt neither task in this paper. What I have written is addressed more to the cultural tourist than the anthropologist. Tourists are often captivated by the colorful opulence of Balinese culture and the centrality of art to the daily lives of ordinary Balinese. At the same time, all but the most indifferent or obtuse cannot fail to notice that the Balinese attitude to the arts is sometimes strangely different from our own Western culture. In following sections, I outline what is likely to strike non-Balinese as puzzling or unique in the Balinese attitude to and treatment of the arts. I focus on four areas: the relation between art and religion and between art and community, the competitive aspect of the arts, and the high value placed on novelty, innovation, and adaptation. I begin, though, by discussing notions that are foundational in Balinese aesthetics. (shrink)
