Un large public apprécie en Gaston Bachelard le philosophe de la rêverie poétique et l'épistémologue. Ses oeuvres consacrées à la question du temps sont moins connues. Cet ouvrage se propose de montrer en quoi les données actuelles des neurosciences apportent un éclairage nouveau à cette réflexion. Nombre d'hypothèses formulées en neurobiologie et en neuroesthétique renforce la thèse bachelardienne de la discontinuité du temps vécu et la conception qu'avait le philosophe de "l'instant poétique".

In this paper we discuss an often-neglected topic in the literature on the ethics of voting. Our aim is to provide an account of what states are obligated to do, so that voters may fulfil their role as public decision-makers in an epistemically competent manner. We argue that the state ought to provide voters with what we call a substantive opportunity for competence. This entails that the state ought to actively foster the epistemic capabilities that are necessary to achieve competent (...) participation in political decision-making practices. (shrink)

The pluralist sheds the more traditional ideas of truth and ontology. This is dangerous, because it threatens instability of the theory. To lend stability to his philosophy, the pluralist trades truth and ontology for rigour and other ‘fixtures’. Fixtures are the steady goal posts. They are the parts of a theory that stay fixed across a pair of theories, and allow us to make translations and comparisons. They can ultimately be moved, but we tend to keep them fixed temporarily. Apart (...) from considering rigour of proof as a fixture, I discuss fixed models, invariant notions and fixed information about objects across theories. For nearly five years, bioethicists and neurologists debated whether Jahi McMath, an African American teenager, was alive or dead. While Jahi's condition provides a compelling study for analyzing brain death, circumscribing her life status to a question of brain death fails to acknowledge and respond to a chronic, if uncomfortable, bioethics problem in American health care—namely, racial bias and unequal treatment, both real and perceived. Bioethicists should examine the underlying, arguably broader social implications of what Jahi's medical treatment and experience (...) represented. On any given day, disparities in the quality of health care and health outcomes for people of color in comparison to whites are evidenced in American hospitals and clinics. These disparities are not entirely explained by differences in patient education, insurance status, employment, income, expressed preference for treatments, and severity of disease. Instead, research indicates that, even for African Americans able to gain access to health care services and navigate institutional nuances, disparities persist across a broad range of services, including diagnostic screening and general medical care, mental health diagnosis and treatment, pain management, HIV‐related care, and treatments for cancer, heart disease, diabetes, and kidney disease. In this study, we explore the role of Chief Executive Officers’ incentives, split between monetary and non-monetary, in relation to corporate social responsibility. We base our analysis on a sample of 597 US firms over the period 2005–2009. We find that both monetary and non-monetary incentives have an effect on CSR decisions. Specifically, monetary incentives designed to align the CEO’s and shareholders’ interests have a negative effect on CSR and non-monetary incentives have a positive effect on CSR. The study has (...) important implications for the design of executive remuneration plans, as we show that there are many levers that can affect the CEO’s decisions with regard to CSR. Our evidence also confirms the prominent role of the CEO in relation to CSR decisions, while also recognizing the complexity of factors affecting CSR. The subject of this paper is Rudolf Hermann Lotze’s concept of Geltung as him outlines it in the second Logik. This paper, through the notions of gnoseological immanentism and anti-psychologism, aims to shed light on the notion of validity. The Geltung’s concept is very interesting not only for the role that it plays in Lotze’s philosophy, but also for the importance that Lotze’s validityhas in the philosophical debate until the 1930s.

This article presents a fairness principle for evaluating decision-making based on predictions: a decision rule is unfair when the individuals directly impacted by the decisions who are equal with respect to the features that justify inequalities in outcomes do not have the same statistical prospects of being benefited or harmed by them, irrespective of their socially salient morally arbitrary traits. The principle can be used to evaluate prediction-based decision-making from the point of view of a wide range of antecedently specified (...) substantive views about justice in outcome distributions. In this paper we argue that transparency of machine learning algorithms, just as explanation, can be defined at different levels of abstraction. We criticize recent attempts to identify the explanation of black box algorithms with making their decisions (post-hoc) interpretable, focusing our discussion on counterfactual explanations. These approaches to explanation simplify the real nature of the black boxes and risk misleading the public about the normative features of a model. We propose a new form of algorithmic transparency, that consists in (...) explaining algorithms as an intentional product, that serves a particular goal, or multiple goals (Daniel Dennet’s design stance) in a given domain of applicability, and that provides a measure of the extent to which such a goal is achieved, and evidence about the way that measure has been reached. We call such idea of algorithmic transparency “design publicity.” We argue that design publicity can be more easily linked with the justification of the use and of the design of the algorithm, and of each individual decision following from it. In comparison to post-hoc explanations of individual algorithmic decisions, design publicity meets a different demand (the demand for impersonal justification) of the explainee. Finally, we argue that when models that pursue justifiable goals (which may include fairness as avoidance of bias towards specific groups) to a justifiable degree are used consistently, the resulting decisions are all justified even if some of them are (unavoidably) based on incorrect predictions. For this argument, we rely on John Rawls’s idea of procedural justice applied to algorithms conceived as institutions. (shrink)

:In this article, we begin by identifying three main neuroethical approaches: neurobioethics, empirical neuroethics, and conceptual neuroethics. Our focus is on conceptual approaches that generally emphasize the need to develop and use a methodological modus operandi for effectively linking scientific and philosophical interpretations. We explain and assess the value of conceptual neuroethics approaches and explain and defend one such approach that we propose as being particularly fruitful for addressing the various issues raised by neuroscience: fundamental neuroethics.

Ethical reflection on Artificial Intelligence (AI) has become a priority. In this article, we propose a methodological model for a comprehensive ethical analysis of some uses of AI, notably as a replacement of human actors in specific activities. We emphasize the need for conceptual clarification of relevant key terms (e.g., intelligence) in order to undertake such reflection. Against that background, we distinguish two levels of ethical analysis, one practical and one theoretical. Focusing on the state of AI at present, we (...) suggest that regardless of the presence of intelligence, the lack of morally relevant features calls for caution when considering the role of AI in some specific human activities. We argue that in extensive decision problems (extensive games with a single player) with imperfect recall care must be taken in interpreting information sets and strategies. Alternative interpretations allow for different kinds of analysis. We address the following issues: 1. randomization at information sets; 2. consistent beliefs; 3. time consistency of optimal plans; 4. the multiselves approach to decision making. The paper proposes an account of the rational response to higher‐order evidence whose key claim is that whenever we acquire such evidence we ought to engage in the inquiring activity of double‐checking. Combined with a principle that establishes a connection between rational inquiry and rational belief retention, the account offers a novel explanation of the alleged impermissibility of retaining one's belief in the face of higher‐order evidence. __Neurotechnology and Direct Brain Communication__ focuses on recent neuroscientific investigations of infant brains and of patients with disorders of consciousness, both of which are at the forefront of contemporary neuroscience. The prospective use of neurotechnology to access mental states in these subjects, including neuroimaging, brain simulation and brain computer interfaces, offers new opportunities for clinicians and researchers, but has also received specific attention from philosophical, scientific, ethical and legal points of view. This book offers the first systematic assessment of these (...) issues, investigating the tools neurotechnology offers to care for verbally non-communicative subjects and suggesting a multidisciplinary approach to the ethical and legal implications of ordinary and experimental practices. The book is divided into three parts: the first and second focus on the scientific and clinical implications of neurological tools for DOC patient and infant care. With reference to these developments, the third and final part presents the case for re-evaluating classical ethical and legal concepts, such as authority, informed consent and privacy. Neurotechnology and Direct Brain Communication will appeal to researchers and postgraduate students in the fields of cognitive science, medical ethics, medical technology, and the philosophy of the mind. There are three elements in this paper. One is what we shall call ‘the Hungarian project’. This is the collected work of Andréka, Madarász, Németi, Székely and others. The second is Molinini’s philosophical work on the nature of mathematical explanations in science. The third is my pluralist approach to mathematics. The theses of this paper are that the Hungarian project gives genuine mathematical explanations for physical phenomena. A pluralist account of mathematical explanation can help us with appreciating the significance of (...) the Hungarian project. The significance consists in the fruitfulness and spread of the project. The spread is wide because the explanations are written in the very familiar language of first-order logic with identity. For this reason, the explanation is understandable to many mathematicians. Because of the methodology adopted in the Hungarian project, the explanations are fruitful in another sense. In the Hungarian project certain questions are asked that would not be asked with a more usual methodology. The Hungarians are distinguished from other scientists in asking logical and mathematical questions, and these both deepen our understanding of the physical theories and induce further spread to mathematics and philosophy. It is often claimed that democratic voters have epistemic responsibilities. However, it is not often specified why voters have such epistemic responsibilities. In this paper, I contend that voters have epistemic responsibilities because voting is best understood as an act that bears assertoric force. More precisely, voters perform what I call an act of political advocacy whereby, like an asserter who states or affirms that something is the case, they state or affirm that a certain course of political action is (...) the one that should be followed or enacted. Consequently, the performance of acts of political advocacy such as voting should be understood as bounded by epistemic norms mirroring those binding the act of assertion and yield epistemic responsibilities mirroring the ones required to satisfy these norms. In the literature, there have been several methods and definitions for working out whether two theories are “equivalent” or not. In this article, we do something subtler. We provide a means to measure distances between formal theories. We introduce two natural notions for such distances. The first one is that of axiomatic distance, but we argue that it might be of limited interest. The more interesting and widely applicable notion is that of conceptual distance which measures the minimum number of (...) concepts that distinguish two theories. For instance, we use conceptual distance to show that relativistic and classical kinematics are distinguished by one concept only. (shrink)

After three proceedings in which neuroscience was a relevant factor for the final verdict in Italian courts, for the first time a recent case puts in question the legal relevance of neuroscientific evidence. This decision deserves international attention in its underlining that the uncertainty still affecting neuroscientific knowledge can have a significant impact on the law. It urges the consideration of such uncertainty and the development of a shared management of it.

This paper is a reflection on the potential of teaching methodologies that focus on the phenomenon of dissonance or cognitive conflict. In a multicultural and increasingly polarized society, the capacity to question one’s own beliefs and behaviors is certainly one of the skills that the educational system should promote, and the development of this competence is closely related to the effective control of the experience of dissonance originated by new information. Starting from a brief reconstruction of the pedagogical and psychological (...) literature on the subject, I will try to analyze the complexity of the phenomenon of cognitive dissonance by proposing an explanation of the contradictory results of empirical research, identifying as the main problematic nodes the emotional regulation of conflict and the role of the teacher as a facilitator of the process of conceptual change. By recognizing Immanuel Kant as the founder of the so-called being-knowing fallacy, the Italian new realism proposed and defended by Maurizio Ferraris argues for the autonomy of ontology from epistemology. The dependence of reality on our conceptual framework would in fact transform our world in a system of beliefs that loses its connection with the “hardness” of the given data. This paper discusses Ferraris’s claims by maintaining that they are based upon an insufficient reading of history of philosophy, particularly, upon (...) a misinterpretation of Kant’s philosophy. Firstly, we shortly analyze the relationship between transcendental philosophy and post-modernism through a comparison with Friedrich Nietzsche: we criticize their conflation. Secondly, we take into consideration Kant’s arguments about science and answer a particular objection of Ferraris by investigating how we can legitimately acquire knowledge in the deep past without contradicting Kantianism. In this sense, we believe that the new realism presents inconsistent arguments. (shrink)

Το είδος των επιγραφών επιβάλλει περιορισμούς στην ερμηνεία τους : δεν μπορούν να μας πληροφορήσουν ούτε για τη θέση των αγροικιών αλλά ούτε και για τη μορφή τους. Το γεγονός ότι υπάρχουν δεν πρέπει να μας κάνει να υποτιμήσουμε την σπουδαιότητα των ιδιωτικών αγροκτημάτων για τα οποία δεν διαθέτουμε κανένα παρόμοιο αρχείο. Β. Το έδαφος της Δήλου δεν ήταν λιγότερο πλούσιο από αυτό της (...) Ρήνειας και δεν είχε αποκλειστικό προορισμό την κτηνοτροφία : η αποκατάσταση της ID 452, 16-32 σε σχέση με την ID 467 βεβαιώνει την ύπαρξη ενός αμπελώνα στα Επισθένεια. Η έλλειψη μυλώνα στις αγροικίες της Δήλου δεν αποδεικνύει με κανένα τρόπο την απουσία καλλιέργειας δημητριακών αλλά πρέπει να συσχετισθεί με τον αριθμό των ατόμων που ζούσαν στις αγροικίες. This article highlights certain aspects of Rodolfo Sacco’s theoretical work on comparative law. Rather than offering an exhaustive discussion, it outlines key points in his intellectual journey to help the reader understand how certain themes gained prominence in his work. An outstanding figure in the comparative law community since the 1970s, he remained active until the end of his life, well into the twenty-first century. Through his many contributions to the field, Sacco took comparative law research in new directions. He (...) developed a more nuanced and complex analysis of the tasks of the comparative lawyer, elaborating an approach to comparison that does justice to the multiple components of all legal systems (“legal formants”) and their dynamics. We owe him a fine study of the silent, implicit dimensions of law that have a major impact on its application (“cryptotypes”), and a reflection on the relationship between law and language that shows how comparative law is deeply implicated in the process of translation. The intriguing issue of pain and suffering in patients with disorders of consciousness (DOCs), particularly in Unresponsive Wakefulness Syndrome/Vegetative State (UWS/VS) and Minimally Conscious State (MCS), is assessed from a theoretical point of view, through an overview of recent neuroscientific literature, in order to sketch an ethical analysis. In conclusion, from a legal and ethical point of view, formal guidelines and a situationist ethics are proposed in order to best manage the critical scientific uncertainty about pain and suffering in DOCs (...) and ensure the best possible care for the patient. Typical spatial descriptions, such as “The car is in front of the house,” describe the position of a located object (LO; e.g., the car) in space relative to a reference object (RO) whose location is known (e.g., the house). The orientation of the RO affects spatial language comprehension via the reference frame selection process. However, the effects of the LO's orientation on spatial language have not received great attention. This study explores whether the pure geometric information of the LO (e.g., (...) its orientation) affects spatial language comprehension using placing and production tasks. Our results suggest that the orientation of the LO influences spatial language comprehension even in the absence of functional relationships. (shrink)

Here, we provide an ethical analysis of discrimination in private insurance to guide the application of non-discriminatory algorithms for risk prediction in the insurance context. This addresses the need for ethical guidance of data-science experts, business managers, and regulators, proposing a framework of moral reasoning behind the choice of fairness goals for prediction-based decisions in the insurance domain. The reference to private insurance as a business practice is essential in our approach, because the consequences of discrimination and predictive inaccuracy in (...) underwriting are different from those of using predictive algorithms in other sectors. Here we focus on the trade-off in the extent to which one can pursue indirect non-discrimination versus predictive accuracy. The moral assessment of this trade-off is related to the context of application—to the consequences of inaccurate risk predictions in the insurance domain. (shrink)

In English, deictic verbs of motion, such ascomecan encode the perspective of the speaker, or another individual, such as the addressee or a narrative protagonist, at a salient reference time and location, in the form of an indexical presupposition. By contrast, Spanish has been claimed to have stricter requirements on licensing conditions forvenir(“to come”), only allowing speaker perspective. An open question is how a bilingual learner acquiring both English and Spanish reconciles these diverging language-specific restrictions. We face this question head (...) on by investigating narrative productions of young Spanish-English bilingual heritage speakers of Spanish, in comparison to English monolingual and Spanish dominant adults and children. We find that the young heritage speakers producevenirin linguistic contexts where most Spanish adult speakersdo not, but where English monolingual speakersdo, and also resemble those of young monolingual Spanish speakers of at least one other Spanish dialect, leading us to generate two mutually-exclusive hypotheses: (a) the encoding of speaker perspective in the young heritage children is cross-linguistically influenced by the more flexible and dominant language (English), resulting in a wider range of productions by these malleable young speakers than the Spanish grammar actually allows, or (b) the young Spanish speakers are exhibiting productions that are in fact licensed in the grammar, but which are pruned away in the adult productions, being supplanted by other forms as the lexicon is enriched. Given independent evidence of the heritage speakers' robust Spanish linguistic competence, we turn to systematically-collected acceptability judgments of three dialectal varieties of monolingual adult Spanish speakers of the distribution of perspective-taking verbs, to assess their competence and adjudicate between (a) and (b). We find that adultsaccept venirin contexts in which they do notproduceit, leading us to argue that (a)venirisnotobligatorily speaker-oriented in Spanish, as has been claimed, (b) adults may not producevenirin these contexts because they instead select more specific motion verbs, and (c) for heritage bilingual children, the more dominant language (English) may support the grammatically licensed but lexically-constrained productions in Spanish. Technological grounding helps explain why high-technology organizations often experience cultural integration problems following a merger. Examining the recent merger of US West and Qwest, this article analyzes how powerful actors strategically used the process of technological grounding to enroll a core technology to situate postmerger integration in technological terms, creating a discourse of inevitability that then justified publicly Qwest's (...) cultural domination of US West. The concept of the digital phenotype has been used to refer to digital data prognostic or diagnostic of disease conditions. Medical conditions may be inferred from the time pattern in an insomniac’s tweets, the Facebook posts of a depressed individual, or the web searches of a hypochondriac. This paper conceptualizes digital data as an extended phenotype of humans, that is as digital information produced by humans and affecting human behavior and culture. It argues that there are ethical obligations to persons (...) affected by generalizable knowledge of a digital phenotype, not only those who are personally identifiable or involved in data generation. This claim is illustrated by considering the health-related digital phenotypes of precision medicine and digital epidemiology. (shrink)
