Charles Eisenmann, dans un compte-rendu critique de la Pensée juridique, publié dans la Revue de droit public en 1961, écrivait : " On voudrait proclamer d'abord sans réserves, les rares qualités de l'ouvrage, qui en rendent la lecture très recommandable, en particulier pour ceux qui, jeunes ou juristes déjà formés, n'ont pas encore ou n'ont plus commerce très assidu avec la théorie ou la philosophie du droit. Ils prendront contact avec une pensée vivante et chaude, qui cherche avec ardeur, souplesse (...) et agilité." Les qualités qui ont conduit la Pensée juridique à être un des ouvrages de base de la formation théorique de toute une génération de juristes, celle des décennies 60-70, demeurent encore aujourd'hui intactes. C'est pourquoi il nous a paru souhaitable d'ouvrir la nouvelle collection des introuvables des éditions Panthéon- Assas par une réédition de l'ouvrage de Michel Virally. (shrink)

Deceptive communication and misinformation are crucial issues that are currently having a significant impact on social life. Parallel to the important work of identifying misinformation on digital platforms is understanding why such material proliferates. One approach to answering this question is to attempt to understand the values that are being targeted by misinformation as a means of interpreting the underlying social bonds that are at stake. This study examines the kinds of social bonds that are communed around and contested in (...) a corpus of YouTube video comments about the viral internet hoax ‘The Momo Challenge’. A social semiotic approach to ‘ambient affiliation’ is used to investigate how these bonds are negotiated in this digital discourse. This approach involves establishing the types of personae who were negotiating meaning in the comments on the basis of the values that they recurrently shared, deferred or disputed. The analysis suggests that, in addition to concern over whether Momo was real and dangerous, there was a deeper moral panic about parenting in the digital age and the legitimacy of institutions such as schools and media as brokers of knowledge. Theiler's virus is a picornavirus of mouse which causes an acute encephalomyelitis followed by a persistent infection of the white matter resulting in chronic inflammation and demyelination. This disease has been studied as a model for multiple sclerosis. Inbred strains of mice are either resistant--they clear the infection after the acute encephalomyelitis--or susceptible to persistent infection and demyelination. Susceptibility is a polygenic trait which has been analyzed using methods of association with “candidate” genes, and linkage analysis after a complete genome (...) scan. The H-2Db gene is responsible for an efficient CTL response which makes some strains resistant. Non H-2 genes responsible for the susceptibility of other strains have been mapped by linkage analysis to the Ifng and, possibly, the Mbp loci. The analysis of a set of congenic mice ruled out the possiblity that the relevant gene codes for interferon gamma, and showed that the region around Ifngprobably contains two susceptibility genes. The analysis of mutant mice showed further that the Mbp gene, which codes for the myelin basic protein, has a major effect on viral persistence. The global response to managing the spread of HIV has recently undergone a significant shift with the advent of ‘treatment as prevention’, a strategy which presumes that scaling-up testing and treatment for people living with HIV will produce a broader preventative benefit. Treatment as prevention includes an array of diagnostic, technological and policy developments that are creating new understandings of how HIV circulates in bodies and spaces. Drawing on the work of Michel Foucault, we contextualize these developments by linking (...) them to systems of governance and discursive subjectivation. The goal of this article is to problematize the growing importance of viral suppression in the management of HIV and the use of related surveillance technologies. For people living with HIV, we demonstrate how treatment-as-prevention’s emphasis on individual and collective viral load is transforming the performative dimensions of embodied risk, affect, subjectivity and sex. The focus of this article is a question that has been neglected in debates about digitalization: Could machines replace human scientists? To provide an intelligible answer to it, we need to answer a further question: What is it that makes (or constitutes) a scientist? I offer an answer to this question by proposing a new demarcation criterion for science which I call “the discoverability criterion”. I proceed as follows: (1) I explain why the target question of this article is important, (...) and (2) show that it leads to a variant of the demarcation problem of science. (3) By arguing that it is probably an essential feature of science that we can make scientific discoveries, I suggest a novel way of dealing with this problem by proposing a new demarcation criterion. Before introducing it, (4) I analyze an exemplary case of a real scientific discovery, and (5) argue that scientific discovery processes have a general underlying structure. (6) I introduce my discoverability criterion for science and present my master argument that helps us understand which criteria have to be fulfilled in order to decide whether machines can replace human scientists or not. This book addresses central issues in the philosophy and metaphysics of science, namely the nature of scientific theories, their partial truth, and the necessity of scientific laws within a moderate realist and empiricist perspective. Accordingly, good arguments in favour of the existence of unobservable entities postulated by our best theories, such as electrons, must be inductively grounded on perceptual experience and not their explanatory power as most defenders of scientific realism claim. Similarly, belief in the reality of dispositions such as (...) causal powers which ground the natural necessity of scientific laws must be based on experience. Hence, this book offers a synthetic presentation of an original metaphysics of science, namely a metaphysics of properties, both categorical and dispositional, while at the same time opposing strong versions of necessitarism according to which laws are true in all possible worlds. The main theses and arguments are clearly presented in a non-technical way. Thus, on top of being of interest to the specialists of the topics discussed, it is also useful as a textbook in courses for third year and more advanced university students. (shrink)

Il montre que la thèse défendue par cet auteur, tout en n'étant pas du néocréationisme, ne respecte pas suffisamment la diversité méthodologique du savoir. Jean Staune, en voulant dépasser le matérialisme actuel de la science, propose une certaine forme radicale de spiritualisme: plus précisément un certain platonisme scientifique.

In 1980, Michel Foucault began a vast project of research on the relationship between subjectivity and truth, an examination of conscience, confession, and truth-telling that would become a crucial feature of his life-long work on the relationship between knowledge, power, and the self. The lectures published here offer one of the clearest pathways into this project, contrasting Greco-Roman techniques of the self with those of early Christian monastic culture in order to uncover, in the latter, the historical origin of (...) many of the features that still characterize the modern subject. They are accompanied by a public discussion and debate as well as by an interview with Michael Bess, all of which took place at the University of California, Berkeley, where Foucault delivered an earlier and slightly different version of these lectures. Foucault analyzes the practices of self-examination and confession in Greco-Roman antiquity and in the first centuries of Christianity in order to highlight a radical transformation from the ancient Delphic principle of “know thyself” to the monastic precept of “confess all of your thoughts to your spiritual guide.” His aim in doing so is to retrace the genealogy of the modern subject, which is inextricably tied to the emergence of the “hermeneutics of the self”—the necessity to explore one’s own thoughts and feelings and to confess them to a spiritual director—in early Christianity. According to Foucault, since some features of this Christian hermeneutics of the subject still determine our contemporary “gnoseologic” self, then the genealogy of the modern subject is both an ethical and a political enterprise, aiming to show that the “self” is nothing but the historical correlate of a series of technologies built into our history. Thus, from Foucault’s perspective, our main problem today is not to discover what “the self” is, but to try to analyze and change these technologies in order to change its form. (shrink)

Este artículo se concentra en la recepción y el legado de Michel Foucault en el ámbito estadounidense, en particular en la Universidad de California, Berkeley (1980-1981 y 1983). Durante ese último año, Foucault formó un seminario de investigación dedicado a esbozar los primeros trazos de una “genealogía del biopoder”. Los trabajos en Berkeley tocaron diversos ejemplos. Sin embargo, ninguno de ellos fue directamente relacionado con lo que, sostengo, describe mejor el funcionamiento contemporáneo del biopoder; esto es, el dispositivo médico-sanitario, (...) o la “medicalización”. Se parte de dos premisas principales: (1) bajo el marco de una discusión acerca de los diversos usos del concepto de biopoder, busco poner de relieve su extraordinario potencial histórico crítico para comprender qué está pasando en este preciso momento; en otras palabras, abonar a eso que Foucault entendió por una “ontología de la actualidad”. (2) Hacer notar que es casi imposible comprender el funcionamiento de esta modalidad de ejercicio del poder sin la intervención del modelo médico, en la medida de su esfera de influencia en las sociedades actuales. Esto último se muestra en casos como el origen -y pervivencia- del Estado asistencial (welfare), los experimentos de eugenesia, las técnicas de reproducción asistida, las políticas públicas de combate a la propagación viral y el consiguiente “temor al contagio” poblacional, la explotación indiscriminada de los alimentos transgénicos y -de manera un poco más prolija-el papel de la medicina genómica preventiva. Cet ouvrage aborde la question de la réalité chez Bergson, en profitant de l’élan théorique qui se dégage de Durée et simultanéité, pour étendre l’enquête à d’autres passages canoniques du corpus. La thèse en est que loin de s’identifier à la mobilité ou au mouvant, par-delà la durée et sans même se confondre au réel, c’est la réalité qui se fait au sein de la métaphysique bergsonienne.

La question de ce petit livre est simple : peut-on aller au-delà du constat de crise et d'impuissance dont le philosophe se fait le prophète depuis plus d'un siècle? Peut-on parler de la science sans complexe d'infériorité, de Dieu sans obscurantisme, d'existence sans tomber dans la banalité du café du commerce, de politique sans consacrer le cynisme, de morale sans faire dans le sermon? Bref, la philosophie peut-elle aider à faire comprendre et à dépasser les apories du temps présent qu'elle (...) a fait siennes, comme un malade ressasse sa propre maladie pour se donner le sentiment qu'ainsi il peut la mettre à distance à défaut de la vaincre? Toutes ces questions sont aujourd'hui les nôtres, et il ne faut pas avoir peur de parler des grands problèmes qui agitent les hommes depuis l'aube des temps, car si la philosophie a un sens, c'est bien en ce qu'elle envisage les questions ultimes dans une plus ou moins grande systématicité selon les époques. When he formulated the program of neurophenomenology, Francisco Varela suggested a balanced methodological dissolution of the hard problem of consciousness. I show that his dissolution is a paradigm which imposes itself onto seemingly opposite views, including materialist approaches. I also point out that Varela's revolutionary epistemological ideas are gaining wider acceptance as a side effect of a recent controversy between hermeneutists and eliminativists. Finally, I emphasize a structural parallel between the science of consciousness and the distinctive features of quantum mechanics. (...) This parallel, together with the former convergences, point towards the common origin of the main puzzles of both quantum mechanics and the philosophy of mind: neglect of the constitutive blindspot of objective knowledge. Schopenhauer’s invective is legendary among philosophers, and is unmatched in the historical canon. But these complaints are themselves worthy of careful consideration: they are rooted in Schopenhauer’s philosophy of language, which itself reflects the structure of his metaphysics. This short chapter argues that Schopenhauer’s vitriol rewards philosophical attention; not because it expresses his critical take on Fichte, Hegel, Herbart, Schelling, and Schleiermacher, but because it neatly illustrates his philosophy of language.
