ABSTRACTThis article defends the importance of epistemic safety for legal evidence. Drawing on discussions of sensitivity and safety in epistemology, the article explores how similar considerations apply to legal proof. In the legal context, sensitivity concerns whether a factual finding would be made if it were false, and safety concerns how easily a factual finding could be false. The article critiques recent claims about the importance of sensitivity for the law of evidence. In particular, this critique argues that sensitivity does (...) not have much of an effect on the value of legal evidence and that it fails to explain legal doctrine. By contrast, safety affects the quality of legal evidence, and safety better explains central features of the law of evidence, including probative value, admissibility rules, and standards of proof. Emmanuel Levinas was a significant contributor to the field of philosophy, phenomenology and religion. A key interpreter of Husserl, he stressed the importance of attitudes to other people in any philosophical system. In this follow-up to the highly successful _Ethnography Unbound,_ Michael Burawoy and nine colleagues break the bounds of conventional sociology, to explore the mutual shaping of local struggles and global forces. According to Block, in cases of identity-crowding, something is consciously seen even though one cannot attend to it. In taking this view, Block is opposing a position I have taken in recent work (Tye 2009a, 2009b, 2010). Simon Evnine’s Making Objects and Events: A Hylomorphic Theory of Artifacts develops amorphic hylomorphism. I critically discuss three of its main themes. One theme is its attempt to do the work of form without forms. A second theme is the requirement that hylomorphs have ‘metabolisms at work’. A third theme is the use of artifacts as the paradigms for hylomorphs. I will raise some criticisms of each of these themes. Although the themes might at first appear disconnected, I believe the (...) third underwrites the first two. So the criticisms of the third theme also bear on the rest. (shrink)

Many Sides is the first full-length study of Protagorean antilogic, an argumentative practice with deep roots in rhetorical history and renewed relevance for contemporary culture. Founded on the philosophical relativism of Protagoras, antilogic is a dynamic rather than a formal approach to argument, focused principally on the dialogical interaction of opposing positions (anti-logoi) in controversy. In ancient Athens, antilogic was the cardinal feature of Sophistic rhetoric. In Rome, Cicero redefined Sophistic argument in a concrete set of dialogical procedures. In turn, (...) Quintilian inherited this dialogical tradition and made it the centrepiece of his own rhetorical practice and pedagogy. Many Sides explores the history, theory, and pedagogy of this neglected rhetorical tradition and, by appeal to recent rhetorical and philosophical theory, reconceives the enduring features of antilogical practice in a dialogical approach to argumentation especially suited to the pluralism of our own age and the diversity of modern classrooms. Antibiotic resistance threatens the capacity to treat life-threatening infections. If it is accepted that it will be many years until the production of new antibiotics overcomes current concerns with antibiotic resistance then ways to conserve the effectiveness of current antibiotics will have to be found. For many bacterial agents of infection levels of antibiotic resistance are directly dependent on the quantity of antibiotic prescribed. Antibiotics are currently underutilised in many parts of the world. If a just distribution of access to (...) antibiotics requires equal access for individuals with equal need irrespective of wealth then responding to this requirement of justice has the potential to shorten the effective life of currently available antibiotics. Increasing the range and numbers of individuals treated with antibiotics would seem to threaten sustainability and also potentially undermine the access of future generations to cost-effective treatments for bacterial infection. The control of antibiotic resistance requires that the determinants of infectious disease transmission are addressed, such as poor housing, education and nutrition as well as the provision of antibiotics. The apparent tension between intragenerational justice and sustainability diminishes when the account of distributive justice extends beyond access to antibiotics and includes plural entitlements. Controlling antibiotic resistance requires more than the redistribution or reduction of antibiotics. (shrink)

Although our eyes receive incomplete and ambiguous information, our perceptual system is usually able to successfully construct a stable representation of the world. In the case of ambiguous figures, however, perception is unstable, spontaneously alternating between equally possible outcomes. The present study compared EEG responses to ambiguous figures and their unambiguous variants. We found that slight figural changes, which turn ambiguous figures into unambiguous ones, lead to a dramatic difference in an ERP (“event-related potential”) component at around 400 ms. This (...) result was obtained across two different categories of figures, namely the geometric Necker cube stimulus and the semantic Old/Young Woman face stimulus. Our results fit well into the Bayesian inference concept, which models the evaluation of a perceptual interpretation’s reliability for subsequent action planning. The integration of reasoning and computation services across system and language boundaries has been mostly treated from an engineering perspective. In this paper we take a foundational point of view. We identify the following form of integration problems: an informal (mathematical; i.e, logically underspecified) specification has multiple concrete formal implementations between which queries and results have to be transported. The integration challenge consists in dealing with the implementation-specific details such as additional constants and properties. We pinpoint their role in safe (...) and unsafe integration schemes and propose a proof-theoretic solution based on modular theory-graphs that include the meta-logical foundations. This also gives a clean conceptual basis for earlier attempts that explain integration via “content/semantic markup”. (shrink)

Using critical discourse analysis this study analyzes how ideologies and national identities are discursively constructed through editorial and opinion commentaries in two English-language newspapers from China and Japan on an international incident involving the two countries. The first four editorials/opinions on the East China Sea trawler collision incident from the China Daily and Daily Yomiuri are analyzed. Findings show that a variety of discursive strategies are adopted by the newspapers to construct national identity and intergroup relations, including: 1) the discursive (...) categorization of group identity, 2) the discursive re-categorization of intergroup relations, and 3) the discursive re-categorization of intragroup relations. Even though both newspapers are products of globalization, and purport to target international and cosmopolitan audiences, the reporting of the East China Sea incident closely adheres to official narratives and discourses of the respective governments. Evidentialism is the view that epistemic justification supervenes on the evidence one has, whether or not that evidence consists of beliefs. The Great Pumpkin Objection says, of a response to skepticism, that those endorsing a silly view, such as belief in the Great Pumpkin, can offer exactly parallel responses to those who are skeptical of that view (the implication being that a response to skepticism that is so easily mimicked by defenders of silly views must be inadequate). Earl Conee argues (...) that, unlike other epistemological positions, evidentialism has a response to external world skepticism that cannot be mimicked by defenders of silly views. I argue that Conee is mistaken about this and that this has negative implications for the adequacy of evidentialist responses to skepticism. (shrink)
