Although the study of moral judgment has gained in popularity in the field of psychology in recent years, little research has focused on confidentiality dilemmas in the context of moral judgment. Yet clinicians regularly face such dilemmas, which often arise in emotionally charged contexts. This study assesses the role of emotions in responses to these confidentiality dilemmas. A total of 186 participants studying psychology at different universities in Quebec were randomly assigned to one of three groups in an experimental design (...) (dramatic audio modality, neutral audio modality, text modality) and responded to confidentiality dilemmas by choosing between protecting or lifting confidentiality. Also taken into consideration were participants’ positioning on a continuum ranging from deontology to utilitarianism, based on their response to sacrificial dilemmas. The hierarchical multiple linear regression model used indicates a significant contribution from responses to sacrificial dilemmas, perceived emotional intensity of confidentiality dilemmas and training obtained in the field of ethics and deontology. The analysis further reveals the moderating effect of exposure to the experimental condition on the relationship between the tendency towards utilitarianism and the propensity to waive confidentiality in a psychotherapeutic relationship. These results have practical implications for psychology curricula, where situation scenarios with ecological validity could enhance ethics training. (shrink)

ABSTRACTThis article defends the importance of epistemic safety for legal evidence. Drawing on discussions of sensitivity and safety in epistemology, the article explores how similar considerations apply to legal proof. In the legal context, sensitivity concerns whether a factual finding would be made if it were false, and safety concerns how easily a factual finding could be false. The article critiques recent claims about the importance of sensitivity for the law of evidence. In particular, this critique argues that sensitivity does (...) not have much of an effect on the value of legal evidence and that it fails to explain legal doctrine. By contrast, safety affects the quality of legal evidence, and safety better explains central features of the law of evidence, including probative value, admissibility rules, and standards of proof. In recent years, the debate on the problem of causal exclusion has seen an ‘interventionist turn’. Numerous non-reductive physicalists (e.g. Shapiro and Sober 2007) have argued that Woodward's (2003) interventionist theory of causation provides a means to empirically establish the existence of non-reducible mental-to-physical causation. By contrast, Baumgartner (2010) has presented an interventionist exclusion argument showing that interventionism is in fact incompatible with non-reductive physicalism. In response, a number of revised versions of interventionism have been suggested that are compatible with (...) non-reductive physicalism. The first part of this paper reconstructs the definitional details of these modified interventionist theories. The second part investigates whether the modification proposed in Woodward (2011) is not only compatible with, but moreover supports non-reductive physicalism. In particular, it is examined whether that newest variant of interventionism allows for empirically resolving the problem of causal exclusion as envisaged by Shapiro, Sober and others. (shrink)

Emmanuel Levinas was a significant contributor to the field of philosophy, phenomenology and religion. A key interpreter of Husserl, he stressed the importance of attitudes to other people in any philosophical system. For Levinas, to be a subject is to take responsibility for others as well as yourself and therefore responsibility for the one leads to justice for the many. He regarded ethics as the foundation for all other philosophy, but later admitted it could also be the foundation for theology. (...) In this follow-up to the highly successful _Ethnography Unbound,_ Michael Burawoy and nine colleagues break the bounds of conventional sociology, to explore the mutual shaping of local struggles and global forces. In contrast to the lofty debates between radical theorists, these nine studies excavate the dynamics and histories of globalization by extending out from the concrete, everyday world. The authors were participant observers in diverse struggles over extending citizenship, medicalizing breast cancer, dumping toxic waste, privatizing nursing homes, the degradation (...) of work, the withdrawal of welfare rights, and the elaboration of body politics. From their insider vantage points, they show how groups negotiate, circumvent, challenge, and even re-create the complex global web that entangles them. Traversing continents and extending over three years, this collaborative research developed its own distinctive method of "grounded globalization" to grasp the evaporation of traditional workplaces, the dissolution of enclaved communities, and the fluidity of identities. Radical ecology typically brings to mind media images of ecological activists standing before loggers' saws, staging anti-nuclear marches, and confronting polluters on the high seas. Simon Evnine’s Making Objects and Events: A Hylomorphic Theory of Artifacts develops amorphic hylomorphism. I critically discuss three of its main themes. One theme is its attempt to do the work of form without forms. A second theme is the requirement that hylomorphs have ‘metabolisms at work’. A third theme is the use of artifacts as the paradigms for hylomorphs. I will raise some criticisms of each of these themes. Although the themes might at first appear disconnected, I believe the (...) third underwrites the first two. So the criticisms of the third theme also bear on the rest. (shrink)

Most anyone interested in such topics as creation mythology, Jungian theory, or the idea of "secret teachings" in ancient Judaism and Christianity has found "gnosticism" compelling. Yet the term "gnosticism," which often connotes a single rebellious movement against the prevailing religions of late antiquity, gives the false impression of a monolithic religious phenomenon. Here Michael Williams challenges the validity of the widely invoked category of ancient "gnosticism" and the ways it has been described. Presenting such famous writings and movements (...) as the Apocryphon of John and Valentinian Christianity, Williams uncovers the similarities and differences among some major traditions widely categorized as gnostic. He provides an eloquent, systematic argument for a more accurate way to discuss these interpretive approaches.The modern construct "gnosticism" is not justified by any ancient self-definition, and many of the most commonly cited religious features that supposedly define gnosticism phenomenologically turn out to be questionable. Exploring the sample sets of "gnostic" teachings, Williams refutes generalizations concerning asceticism and libertinism, attitudes toward the body and the created world, and alleged features of protest, parasitism, and elitism. He sketches a fresh model for understanding ancient innovations on more "mainstream" Judaism and Christianity, a model that is informed by modern research on dynamics in new religious movements and is freed from the false stereotypes from which the category "gnosticism" has been constructed. Founded on the philosophical relativism of Protagoras, antilogic is a dynamic rather than a formal approach to argument, focused principally on the dialogical interaction of opposing positions (anti-logoi) in controversy. In ancient Athens, antilogic was the cardinal feature of Sophistic rhetoric. In Rome, Cicero redefined Sophistic argument in a concrete set of dialogical procedures. In turn, (...) Quintilian inherited this dialogical tradition and made it the centrepiece of his own rhetorical practice and pedagogy. Many Sides explores the history, theory, and pedagogy of this neglected rhetorical tradition and, by appeal to recent rhetorical and philosophical theory, reconceives the enduring features of antilogical practice in a dialogical approach to argumentation especially suited to the pluralism of our own age and the diversity of modern classrooms. Environmental pragmatists such as Ben Minteer and Bryan Norton have argued that there is an anti-democratic strain to be found in the work of some nonanthropocentrists. I examine three possible sources of the pragmatists’ concern: the claim that nonanthropocentrists know the political truth, the claim that those who disagree with their basic principle should be excluded from discussions of policy and the claim that their basic principle is self-evident. This article outlines the work of a group of US mathematicians called the American Postulate Theorists and their influence on Tarski's work in the 1930s that was to be foundational for model theory. The American Postulate Theorists were influenced by the European foundational work of the period around 1900, such as that of Peano and Hilbert. In the period roughly from 1900???1940, they developed an indigenous American approach to foundational investigations. This made use of interpretations of precisely formulated axiomatic theories (...) to prove such metatheoretic properties as independence, consistency, categoricity and, in some cases, completeness of axiom sets. This approach to foundations was in many respects similar to that later taken by Tarski, who frequently cites the work of American Postulate Theorists. Their work served as paradigm examples of the theories and concepts investigated in model theory. The article also examines the possibility of a more specific impetus to Tarski's model theoretic investigation, arising from his having studied in 1927???1929 a paper by C. H. Langford proving completeness for various axiom sets for linear orders. This used the method of elimination of quantifiers. The article concludes with an examination of one example of Langford's methods to indicate how their correct formulation seems to call for model-theoretic concepts. (shrink)

Taking a cue from Bohr’s use of the notion of a reference frame in his reply to EPR’s argument against the completeness (and consistency) of standard quantum theory, this paper presents an analysis ofthe role of reference frames in the situation considered by EPR, using a quantum‐theoretical account of physical reference frames based on the work of Mackey, and Aharonov and Kaufherr. That analysis appears to justify at least some crucial aspects of a Bohrian reply to EPR.

Promises raise two main philosophical problems, one moral and the other conceptual. The moral problem concerns the normative significance of promising: what is the nature and basis of the obligations and rights to which promises typically give rise? The conceptual problem is to say what a promise is: what is involved in making a promise? In this paper I defend three controversial claims about promising. One is about the moral problem of promising, one is about the conceptual problem, and the (...) last one is about the relationship between my conceptual claim and my moral claim. My conceptual claim is that a speaker makes a promise only if he communicates an intention to undertake an obligation to the hearer. (I refer to this as the “Obligation Conception Thesis.”) My moral claim is that the obligations typically attached to promises are such that they can be acquired only by those who communicate an intention to undertake an obligation. (I refer to this as the “Voluntary Obligation Thesis.”) My third claim is that if the Obligation Conception Thesis is true, the Voluntary Obligation Thesis is true. (shrink)

Silvius: It is to be all made of sighs and tears...—Shakespeare, As You Like It (5.2.83–84)ISighs and tears permeate John Donne's poetry, as well they should. Crying in particular functions as a costly signal in biological terms: a blatant, physiologically-demanding, involuntary indicator of hurt feelings. "Tears dim mine (...) eyes," laments Donne's Sappho ("Sappho to Philaenis," l. 56); they are "Fruits of much grief" in "A Valediction of Weeping" (l. 7).1 The theory of costly signaling, related to the handicap principle, was developed fairly recently by Israeli zoologists Amotz and Avishag Zahavi. As the Zahavis explain: "in order to be effective, signals have to be reliable; in order to be reliable, signals have to be costly."2 Initially their idea was resisted, but it has since become widely accepted and it has proven very helpful in making sense of both animal and human behavior. Wasteful conspicuous consumption among upper-class Americans, as noted a century ago by sociologist Thorstein Veblen, exemplifies this handicap principle in action. Like gazelles jumping in place or stotting rather than running away when wolves appear, it indicates fitness by flaunting excess resources.Shedding tears when feeling sad is an evolved human adaptation that broadcasts unhappiness. The wailing of infants demands attention, and crying does something similar for grown-ups: among other things, it tests the commitment of hearers to appease the distressed. For instance, in Chaucer's tragic medieval romance Troilus and Criseyde, Pandarus advises [End Page 329] Troilus to provoke a suitable reaction from Criseyde by embellishing his billet-doux: "Towchyng thi lettre... Biblotte it with thi teris ek a lite" (touching thy letter... Be-blot it with thy tears a little).3 Early modern authors also knew their importance. In the words of Robert Herrick, "tears are tongues," while Claudius suspects that "There's matter in these sighs, these profound heaves" (Hamlet, 4.1.1).4As a case in point, Donne was overwhelmed by the death of his dear wife Anne in 1617. As his contemporaneous biographer Izaak Walton reported: "his very soul was elemented of nothing but sadness; now, grief took so full a possession of his heart, as to leave no place for joy."5 Donne even hoped to be literally entombed with her soon: "as the grave is become her house, so I would hasten to make it mine also; that we two might there make our beds together in the dark" (Walton, p. 51). His miserable mood was revealed in his initial sermon after her demise:His first motion from his house was to preach, where his beloved wife lay buried (in St. Clement's Church, near Temple-Bar, London) and his text was a part of the Prophet Jeremiah's Lamentation: "Lo, I am the man that have seen affliction."And indeed, his very words and looks testified him to be truly such a man; and they, with the addition of his sighs and tears expressed in his Sermon, did so work upon the affections of his hearers as melted and molded them into a companionable sadness; and so they left the Congregation.(Walton, p. 52)Listeners responded in kind to his honest confessions, a textbook illustration of the empathy generated by crying. Serious difficulties attend the reading of David Hilbert's 1925 classic paper ?On the infinite?. I claim that the peculiarities of presentation plaguing certain parts of that paper, as well as of the earlier ?On the Foundations of Logic and Arithmetic? (1904), are due to a tension between two incompatible semantical approaches to numerical statements of elementary arithmetic, and accordingly two incompatible metaphysical conceptions of the natural numbers. One of these approaches is the referential, or model-theoretical one; the other is the (...) iterativist's approach. I draw out the two tendencies in these works, with more attention paid to Hilbert's iterativistic tendency because of the unfamiliarity of iterativism generally. Financial statement users must believe that external auditors are free from management control, or users will doubt the verity of auditors' representations. Although U.S.-based auditing firms claim they are independent of their corporate clients, research has demonstrated that many individuals and groups perceive the situation otherwise. A proposal for enhancing perceptions of auditor independence is offered in this article. The proposal calls for an auditor-administered educational program, complemented by corporate audit committee involvement to lend credibility to auditors' claims.
