The CISG is now being applied extensively both by international arbitral tribunals and by domestic courts of its more than 70 contracting states. But do they also apply it in the same manner? Although Article 7 of the CISG underscores "the need to promote uniformity in its application", it gives little guidance as to how to achieve this goal. Each judge and arbitrator is influenced by the legal methodology of his home jurisdiction. Therefore it is somewhat of a paradox that (...) whilst the number of contracting states is constantly increasing so too is the threat of variation in application. In this book the most important issues of the CISG's methodology are analysed by leading experts from five continents. Precision medicine and molecular systems medicine (MSM) are highly utilized and successful approaches to improve understanding, diagnosis, and treatment of many diseases from bench-to-bedside. Especially in the COVID-19 pandemic, molecular techniques and biotechnological innovation have proven to be of utmost importance for rapid developments in disease diagnostics and treatment, including DNA and RNA sequencing technology, treatment with drugs and natural products and vaccine development. The COVID-19 crisis, however, has also demonstrated the need for systemic thinking and transdisciplinarity and the limits (...) of MSM: the neglect of the bio-psycho-social systemic nature of humans and their context as the object of individual therapeutic and population-oriented interventions. COVID-19 illustrates how a medical problem requires a transdisciplinary approach in epidemiology, pathology, internal medicine, public health, environmental medicine, and socio-economic modeling. Regarding the need for conceptual integration of these different kinds of knowledge we suggest the application of general system theory (GST). This approach endorses an organism-centered view on health and disease, which according to Ludwig von Bertalanffy who was the founder of GST, we call Organismal Systems Medicine (OSM). We argue that systems science offers wider applications in the field of pathology and can contribute to an integrative systems medicine by (i) integration of evidence across functional and structural differentially scaled subsystems, (ii) conceptualization of complex multilevel systems, and (iii) suggesting mechanisms and non-linear relationships underlying the observed phenomena. We underline these points with a proposal on multi-level systems pathology including neurophysiology, endocrinology, immune system, genetics, and general metabolism. An integration of these areas is necessary to understand excess mortality rates and polypharmacological treatments. In the pandemic era this multi-level systems pathology is most important to assess potential vaccines, their effectiveness, short-, and long-time adverse effects. We further argue that these conceptual frameworks are not only valid in the COVID-19 era but also important to be integrated in a medicinal curriculum. (shrink)

The assessment of text quality is a transdisciplinary issue concerning the research areas of educational assessment, language technology, and classroom instruction. Text length has been found to strongly influence human judgment of text quality. The question of whether text length is a construct-relevant aspect of writing competence or a source of judgment bias has been discussed controversially. This paper used both a correlational and an experimental approach to investigate this question. Secondary analyses were performed on a large-scale dataset with highly (...) trained raters, showing an effect of text length beyond language proficiency. Furthermore, an experimental study found that pre-service teachers tended to undervalue text length when compared to professional ratings. The findings are discussed with respect to the role of training and context in writing assessment. (shrink)

In Entailment, Anderson and Belnap motivated their modification E of Ackermann’s strenge Implikation Π Π’ as a logic of relevance and necessity. The kindred system R was seen as relevant but not as modal. Our systems of Peano arithmetic R# and omega arithmetic R## were based on R to avoid fallacies of relevance. But problems arose as to which arithmetic sentences were (relevantly) true. Here we base analogous systems on E to solve those problems. Central to motivating E is the (...) rejection of fallacies of modality. A 'Kripke-style' semantics is given for combinatory logic using frames with a ternary accessibility relation, much as in the Tourley-Meyer semantics for relevance logic. We prove by algebraic means a completeness theorem for combinatory logic, by proving a representation theorem for 'combinatory posets.' A philosophical interpretation is given of the models, showing that an element of a combinatory poset can be understood simultaneously as a set of states and as a set of actions on states. This double interpretation allows (...) for one such element to be applied to another . Application turns out to be modeled the same way as 'fusion' in relevance logic.We also introduce 'dual combinators' that apply from the right. We then explore relationships to some well-known substructural logics, showing that each can be embedded into the structurally free. non-associative Lambek calculus, with the embedding taking a theorem ω to a statement of the form Γ ⊨ ω, where Γ is some fusion of the combinators needed to justify the structural assumptions of the given substructural logic. This builds on earlier ideas from Belnap and Meyer about a Gentzen system wherein structural rules are replaced with rules for introducing combinators. Many people living in highly industrialised countries and elsewhere emit greenhouse gases at a certain high level as a by-product of their activities, and they expect to be able to continue to emit at that level. This level is far above the just per capita level. We investigate whether that expectation is legitimate and permissible. We argue that the expectation is epistemically legitimate. Given certain assumptions, we can also think of it as politically legitimate. Also, the expectation is shown to (...) be morally permissible but with major qualifications. The interpretation of the significance of the expectation is compatible with the understanding that historical emissions should count in terms of fairly distributing the benefits of emission-generating activities over people’s lifetimes but constrains the way in which we may collectively respond to climate change. This paper defends a deontological egalitarianism in the ethics of future generations. Concerns about the non-identity problem have been taken as a reason to develop sufficientarian approaches to intergenerational justice. This paper argues for a solution to the non-identity problem that refers to the claims of future persons. In principle, the content of these claims could be spelled out with a sufficientarian and an egalitarian approach. What speaks against sufficientarianism, however, is that the sufficiency threshold, unless it is set very (...) low, would have to be set arbitrarily. The hidden justification behind a higher threshold would be egalitarian. It draws its plausibility from the justified belief that future persons have a claim on us that we leave equally valuable shares of natural resources to them. (shrink)

This book provides a systematic introduction to the debate on historical emissions and climate change, for students, researchers and policymakers.

Most approaches to iterated belief revision are accompanied by some motivation for the use of the proposed revision operator (or family of operators), and typically encode enough information in the epistemic state of an agent for uniquely determining one-step revision. But in those approaches describing a family of operators there is usually little indication of how to proceed uniquely after the first revision step. In this paper we contribute towards addressing that deficiency by providing a formal framework which goes beyond (...) the first revision step in two ways. First, the framework is obtained by enriching the epistemic state of an agent starting from the following intuitive idea: we associate to each world x two abstract objects x⁺ and x⁻, and we assume that, in addition to preferences over the set of worlds, we are given preferences over this set of objects as well. The latter can be considered as meta-information encoded in the epistemic state which enables us to go beyond the first revision step of the revision operator being applied, and to obtain a unique set of preferences over worlds. We then extend this framework to consider, not only the revision of preferences over worlds, but also the revision of this extended structure itself. We look at some desirable properties for revising the structure and prove the consistency of these properties by giving a concrete operator satisfying all of them. Perhaps more importantly, we show that this framework has strong connections with two other types of constructions in related areas. Firstly, it can be seen as a special case of preference aggregation which opens up the possibility of extending the frame-work presented here into a full-fledged framework for preference aggregation and social choice theory. Secondly, it is related to existing work on the use of interval orderings in a number of different contexts. (shrink)

There are two main sources of theoretical doubt regarding the validity of claims for reparation: the questions arising from the non-identity problem and those arising from the supersession thesis. Neither of them significantly undermines the Palestinian refugees’ claims to reparations and a right of return.

Modus ponens provides the central theme. There are laws, of the form A→C. A logic L collects such laws. Any datum A provides input to the laws of L. The central ternary relation R relates theories L,T and U, where U consists of all of the outputs C got by applying modus ponens to major premises from L and minor premises from T. Underlying this relation is a modus ponens product operation on theories L and T, whence RLTU iff LTU. (...) These ideas have been expressed, especially with Routley, as worlds semantics for relevant and other substructural logics.Worlds are best demythologized as theories, subject to truth-functional and other constraints. The chief constraint is that theories are taken as closed under logical entailment, which clearly begs the question if we are using the semantics to determine which theory L is Logic itself. Instead we draw the modal logicians’ conclusion—there are many substructural logics, each with its appropriate ternary relational postulates.Each logic L gives rise to a Calculus of L-theories, on which particular candidate logical axioms have the combinatorial properties expected from the well-known Curry–Howard isomorphism . We apply their bubbling lemma, updating the Fools Model of Combinatory Logic at the pure → level for the system BT. We make fusion an explicit connective, proving a combinator correspondence theorem. Having taken relevant → as a left residual for , we explore its right residual mate →r. Finally we concentrate on and prove a finite model property for the classical minimal relevant logic CB, a conservative extension of the minimal positive relevant logic B+. (shrink)
