An applicant to our graduate program in philosophy, accepted as well by one (but only one) other graduate program, wrestles with his decision. Finally he decides to attend the other program, but he thanks me for our offer, telling me, "I'm glad that at least I had a choice." I want to focus a bit on these two stories, for while the central conclusion in each -- something turning on the importance of choice -- is initially compelling, it is also, (...) on reflection, philosophically puzzling. It is compelling, because many of us in similar positions would share this response; phenomenologically, it feels right to us. We want to believe that the central facts of our lives -- whether or not we have children, where we are educated, what career we follow, with 1 whom we join as partners -- contain in them some fundamental element of our own selection and decision. We will be exploring below exactly what will turn out to be important here, and why, but for now, in our pre-reflective grasp of this phenomenon, we can say that it seems to have something to do with the value we place on autonomy, self-governance, self-authorship. We want, metaphorically speaking, to write the story of our own lives. But let me now begin to draw out why I find this insistence on the importance of choice, which so many of us would share, to be so puzzling. Both individuals, in both stories, want to be offered a certain additional option in order to have -- or at least to feel that they have? -- a choice about what they are going to do next. But, on the one hand, we could argue that, even with this added option, they still don't have a "real" choice -- they don't have the choice of doing what they most want to do; and on the other hand, one could argue that even without the added option, they always had some choice. Let me explain. In the first story, my friend certainly doesn't have open to her the option that would have been her first choice (and, in our society, what we might call the standard choice, the most frequently chosen option): to produce a biological child with her partner in a happy marriage.. First, two stories. A friend, after struggling with years of infertility, divorces her husband. Single now, and still grieving her childlessness, she begins to explore the option of single-parent adoption. She tells me that she thinks in the end she will probably decide against adoption, but, in her words, "At least I'll know that I'm childless by choice.".

In this paper, I explore the insights suggested by Michele Borrelli's ‘The Utopianisation of Critique’ in the context of a real-life educational encounter that involves an attempt at being ‘critical’. Borrelli's observation that all positive utopian critique implies an inevitable degree of dogmatism takes on a new—and less depressing—significance when examined in the light of such an encounter. Acknowledging the tensions suggested by Borelli's analysis is, I argue, what makes a particular educational stance ‘critical’. In lieu of an abstract, here is a brief excerpt of the content:Mill on Capital Punishment-Retributive Overtones?Michael ClarkI.In his famous parliamentary speech of 18681 Mill defends the retention of capital punishment for the worst murderers on the Benthamite grounds of frugality and exemplarity.2 Punishment being an intrinsic "mischief," it should be no more severe than it needs to be to achieve its desired effect, principally that of deterring others from crime. That effect can be achieved more economically if the suffering (...) appears greater than it really is. Execution, Mill thinks, is less cruel than the alternative of life imprisonment with hard labour,3 for the offender would have died anyway sooner or later, probably in greater pain. It is also the most impressive way of punishing murder, since it closely resembles the offence. The more a penalty impresses itself upon people's minds the more likely it is to deter. And, as Bentham said, "exemplarity tends to increase the apparent, frugality to reduce the real [suffering]."4But the language Mill uses has seemed to import non-utilitarian, quasi-retributive elements into his thought. Thus Tom Sorrell says, "He brings in the appropriateness of execution to certain offences. The argument from appropriateness, if it is not retributivist, is at least consistent with retributivism, and has whatever intuitive appeal attaches to punishing purely on account of guilt."5 Is this perhaps another of those non-utilitarian elements in Mill's philosophy that many commentators have, rightly or wrongly, claimed to detect, like the supposed tension between the Principle of Utility and Mill's regard for the value of liberty? I shall argue, however, that it is a mistake to interpret Mill's remarks in a retributive way. The question may seem superfluous, since he gave his own apparently careful formulation (223/34-224/10).[Note 1] However he gave several formulations in different terms, and his principle has been interpreted in a number of ways.[Note 2] The Acts meant to be subject to social control have been said variously to be other-regarding acts, acts which harm others, or affect them, or affect their interests, or violate duties owed to them, or violate their rights. These formulae (...) are not equivalent. An act may harm others (indirectly), yet not be other-regarding; an other-regarding act may harm others without any violation of duty; an act may violate a duty to others without violating anyone's right. But it seems to me clear enough, if all Mill's statements are taken together, that the correct formulation is this: punishment is justified only for violations of secondary rules prescribing duties to others. Duty and Liberty divide the whole field of human conduct, without overlap; and there are no duties besides duties to others. (shrink)

Suppose that somebody is asking me kindly to do her a favor. She has no right to it. It is my choice whether or not to respond positively. Hence, she asks me for the favor rather than demand it. On the other hand, it seems that my refusal to do her the favor would be rude, inconsiderate, unkind, and morally wrong. This is why we tend to respond positively to favor asking and feel that we have to apologize if we (...) refuse. In this article, I address this puzzle. I claim that refusing to do a favor is morally wrong precisely because a favor has been asked. The requestee needs me, and her very need calls upon me to reveal my goodness. In a sense, this is the strength of her weakness. I claim that acceding to do a favor is a special kind of imperfect obligation in Kant's and Mill's terminologies. As opposed to their descriptions, this obligation is directed toward a definite person at a prescribed time. It turns out that small favors are of the greatest importance for human activity. We all have our needs. We are social animals, and we are depended on others to fulfill our needs. Agreeing to do a favor is one of the building blocks of our shared social endeavor. (shrink)

This is a memorial essay on how the life and work of Charles W. Mills influenced my development as a Black philosopher. Employing Mills’s use of the Jamaican creole term smadditizin’—meaning “becoming recognized as somebody in a world where, primarily because of race, it is denied”—I trace how Mills helped me become a human self myself. Inspired by using his books as texts in courses I taught, and working with him in the Radical Philosophy Association, I learned (...) what it means to be an engaged philosopher. This essay also explores the controversy surrounding radical Black liberalism as a means for attaining personhood. Finally, I defend Mills as a canonical radical philosopher who never wavered from his fierce anti-colonialist, anti-white supremacist, and anti-capitalist stances. (shrink)

The larger topic which interests me is the general influence of the Greeks on Mill but here I shall concentrate on one aspect of this larger problem – can some of the difficulties which Mill is seen as getting into with his modified utilitarianism be better understood through an appreciation of the primacy of Greek views on happiness instead of the usual emphasis given to the Benthamite starting-point? The traditional objections to Mill's version of utility hardly need rehearsing: how can (...) he admit a qualitative element into a scale which only objectively measures quantity? How can he include the higher nature of man in a scheme which only recognizes pleasures and pains? Whether these and other criticisms lead the commentator to condemn Mill's attempt or whether they act as a springboard to discover a plausible defence of Mill, there is today a consensus that Mill's trouble arises from tampering with Bentham as a result of later alien influences. In my dissertation, I analyze, interpret, and defend John Stuart Mill's proof of the principle of utility in the fourth chapter of his Utilitarianism. My purpose is not to glorify utilitarianism, in a full sweep, as the best normative ethical theory, or even to vindicate, on a more specific level, Mill's universalistic ethical hedonism as the best form of utilitarianism. I am concerned only with Mill's utilitarianism, and primarily with his proof of the principle of utility. My overarching purpose guiding (...) the entire work is to show that Mill proceeds intelligibly and systematically in pursuing a well-defined project in the fourth chapter of Utilitarianism, and that he successfully defends what he sets out to establish in his proof of the principle of utility. To this end, I devote the bulk of my efforts to studying and responding to traditionally popular and persistently enduring objections to the proof that are handed down from one generation to the next in the philosophical community as a standard companion to Utilitarianism. The primary objections to which I respond at length are the charges that Mill commits the naturalistic fallacy, the fallacy of equivocation, and the fallacy of composition in his proof. Secondary literature on the subject consists of journal articles and book chapters that treat one or another but not all of these problems. My research has convinced me that, although these commentaries are generally quite good, they are mutually incompatible, and they are neither severally nor jointly sufficient to produce the kind of comprehensive defense that would do justice to Mill's proof of the principle of utility. This kind of comprehensive defense is what I intend to contribute to secondary literature on the subject. Specifically, my ultimate contribution to secondary literature is an interpretation of Mill's proof of the principle of utility in its entirety, absolved of the three fallacies commonly attributed to the proof, yet faithful to the text at all points. In this paper I address the questions posed to me by Bret Davis, Zeynep Direk, and Charles Mills, by focusing on, first, the eurocentrism of academic philosophy in the West and strategies to overcome it; secondly, the interface of critical philosophy of race and global politics, especially as the latter touches on Islamophobia; and, thirdly, the role of critical philosophy of race in challenging the complacency of philosophy departments in the face of the discipline’s long-standing complicity with racism.

This paper is designed to reinterpret and clarify John Stuart Mill's ideas on science. Past discussions of these ideas strike me as unsatisfactory in two crucial respects. In the first place they have encouraged us to regard Mill's principal work on epistemology, A System of Logic, as fundamentally inductivist This is the received interpretation of Mill's Logic and one finds it summarized and affirmed in the remark of Laurens Laudan that 'by and large' Mill was 'a rather orthodox inductivist who (...) saw science as the generalisation of observation and who argued that all scientific ideas come directly from experience. Aggregation-friendly moral theories such as classical utilitarianism are forced to invest a great deal of ingenuity in damping out and modulating the effects of welfare aggregation. In Mill's treatment, the problem famously appears as the puzzle of how the Principle of Liberty is meant to be compatible with the Principle of Utility, and there have been a great many attempted interpretations of his solution, all, in my view, unsatisfactory. I will first reconstruct Mill's generally unnoticed account of the psychological implementation (...) of higher pleasures; this will allow me to explain what the distinction between higher and lower pleasures was, and how Mill was introduced lexical preference orderings into his theory. Then I will show how the underlying psychological theory permits Mill to argue for the lexical priority of liberty over the goods which liberty allows us to obtain. Finally, I will turn to the Millian considerations omitted from the argument I will have reconstructed. By way of explaining why they are so difficult to accommodate, I will consider why Mill might have abandoned his projected sciences of character. I will take my leave by asking what Mill's failure to turn his implementation analysis of the higher pleasures into an argument expressing the importance of individuality and originality means for us. Liberalism is the political philosophy of equal persons, yet liberalism has denied equality to those it saw as black sub-persons. In Black Rights/White Wrongs: The Critique of Racial Liberalism, political philosopher Charles Mills challenges mainstream accounts that ignore this history and its current legacy in the United States today.

Choice architecture is heralded as a policy approach that does not coercively reduce freedom of choice. Still we might worry that this approach fails to respect individual choice because it subversively manipulates individuals, thus contravening their personal autonomy. In this article I address two arguments to this effect. First, I deny that choice architecture is necessarily heteronomous. I explain the reasons we have for avoiding heteronomous policy-making and offer a set of four conditions for non-heteronomy. I then provide examples of (...) nudges that meet these conditions. I argue that these policies are capable of respecting and promoting personal autonomy, and show this claim to be true across contrasting conceptions of autonomy. Second, I deny that choice architecture is disrespectful because it is epistemically paternalistic. This critique appears to loom large even against non-heteronomous nudges. However, I argue that while some of these policies may exhibit epistemically paternalistic tendencies, these tendencies do not necessarily undermine personal autonomy. Thus, if we are to find such policies objectionable, we cannot do so on the grounds of respect for autonomy. (shrink)

Diseases caused by Salmonella species are characterized by bacterial invasion of host cells. Salmonella invasion requires a genetic locus (inv) with homology to bacterial systems involved in specific protein export and organelle assembly. Until recently, the actual Salmonella invasion factors exported or assembled by the inv system remained unidentified. It now appears that Salmonella produces novel appendages upon contact with host cells. These appendages are transient, appearing and disappearing rapidly from the bacterial surface. Appendages are altered in strains unable to (...) invade due to mutations within the inv/spa locus. Therefore, a role for the invasion locus has been identified, providing another example of bacterial pathogens responding to signals provided by the host cell surface. (shrink)

While the contemporary problem of the criterion raises similar epistemological issues as Agrippa’s Trilemma in ancient Pyrrhonian skepticism, the consideration of such epistemological questions has served two different purposes. On one hand, there is the purely practical purpose of Pyrrhonism, in which such questions are a means to reach suspension of judgment, and on the other hand, there is the theoretical purpose of contemporary epistemologists, in which these issues raise theoretical problems that drive the search for theoretical resolution. In classical (...) India, similar issues arise in Nāgārjuna’s Vigrahavyāvartanī, but it is not entirely clear what Nāgārjuna’s purpose is. Contrary to the theoretical interpretations of several recent scholars such as Jan Westerhoff according to which Nāgārjuna is proffering a contextualist epistemological theory, I argue that Nāgārjuna as well as the later Madhyamaka Candrakīrti, much like Pyrrhonian skeptics, employed concerns about epistemic criteria in service of purely practical purposes. There is no positive epistemological theory to be found in Nāgārjuna’s Vigrahavyāvartanī and Candrakīrti’s Prasannapadā; furthermore a putative thesis of universal emptiness is self-undermining, a conclusion which itself can be seen as part of a therapeutic program. Nonetheless, the historical persistence of these epistemological issues shows that they ought to continue to be areas of theoretical inquiry for epistemologists today. I end with reflections on the wider relevance of my conclusions, particularly with regard to demonstrating the value of philosophy. (shrink)

Despite the fact that ethics consultations are an accepted practice in most healthcare organizations, many clinical ethicists continue to feel marginalized by their institutions. They are often not paid for their time, their programs often have no budget, and institutional leaders are frequently unaware of their activities. One consequence has been their search for concrete ways to evaluate their work in order to prove the importance of their activities to their institutions through demonstrating their efficiency and effectiveness.

Some recent hostile responses to the rapid growth of Libertarianism have depicted it as a febrile spin-off from the post-hippy 'Me Decade'. In fact we are the inheritors of an illustrious centuries old tradition, largely overlooked by the myopic current fashions in the history of ideas. Liberals like J. S. Mill and Jeremy Bentham receive plenty of attention in college courses, but the libertarian tradition as a whole is largely ignored, and misrepresented where touched upon. Mill and Bentham constitute one (...) aspect - in many ways the feeblest - of liberalism. G. A. Cohen's influential ?technological determinist? reading of Marx's theory of history rests in part on an interpretation of Marx's use of ?material? whose idiosyncrasy has been insufficiently noticed. Cohen takes historical materialism to be asserting the determination of the social by the material/asocial, viz. ?socio?neutral? facts about human nature and human rationality which manifest themselves in a historical tendency for the forces of production to develop. This paper reviews Marx's writings to demonstrate the extensive textual evidence in favour of (...) the traditional interpretation ? that for Marx, the ?material? includes the economic, and is thus ineluctably social in character. Thus those critics of Cohen who have urged the inclusion of the relations of production in historical materialism's explanans do seem to have Marx's terminological and conceptual backing. (shrink)

Recent studies challenge the classical view that the origin of animal life was primarily controlled by atmospheric oxygen levels. For example, some modern sponges, representing early‐branching animals, can live under 200 times less oxygen than currently present in the atmosphere – levels commonly thought to have been maintained prior to their origination. A definition of [George] Eliot as renunciatory culture-mother may seem an odd preface to a discussion of Silas Marner since, of all her novels, this richly constructed work is the one in which the empty pack of daughterhood appears fullest, the honey of femininity most unpunished. I want to argue, however, that this “legendary tale,” whose status as a schoolroom classic makes it almost as much a textbook as a novel, examines the relationship between woman’s fate and the structure of (...) society in order to explicate the meaning of the empty pack of daughterhood. More specifically, this story of an adoptive father, an orphan daughter, and a dead mother broods on events that are actually or symbolically situated on the margins or boundaries of society, where culture must enter into a dialectical struggle with nature, in order to show how the young female human animal is converted into the human daughter, wife, and mother. Finally, then, this fictionalized “daughteronomy” becomes a female myth of origin narrated by a severe literary mother uses the vehicle of a half-allegorical family romance to urge acquiescence in the law of the Father.If Silas Marner is not obviously a story about the empty pack of daughterhood, it is plainly, of course, a “legendary tale” about a wanderer with a heavy yet empty pack. In fact, it is through the image of the packman that the story, in Eliot’s own words, “came across my other plans by a sudden inspiration”—and, clearly, her vision of this burdened outsider is a re-vision of the Romantic wanderer who haunts the borders of society, seeking a local habitation and a name.11 I would argue further, though, that Eliot’s depiction of Silas Marner’s alienation begins to explain Ruby Redinger’s sense that the author of this “fluid and metaphoric” story “is” both Eppie, the redemptive daughter, and Silas, the redeemed father. For in examining the outcast weaver’s marginality, this novelist of the “hidden life” examines also her own female disinheritance and marginality.12 11.
