Building on the computer science concept of _code smells_, we initiate the study of _law smells_, i.e., patterns in legal texts that pose threats to the comprehensibility and maintainability of the law. With five intuitive law smells as running examples—namely, duplicated phrase, long element, large reference tree, ambiguous syntax, and natural language obsession—, we develop a comprehensive law smell taxonomy. This taxonomy classifies law smells by when they can be detected, which aspects of law they relate to, and how they (...) can be discovered. We introduce text-based and graph-based methods to identify instances of law smells, confirming their utility in practice using the United States Code as a test case. Our work demonstrates how ideas from software engineering can be leveraged to assess and improve the quality of _legal_ code, thus drawing attention to an understudied area in the intersection of law and computer science and highlighting the potential of computational legal drafting. The study aimed to explore the subjective need of healthcare professionals for ethics consultation, their experience with ethical conflicts, and expectations and objections toward a Clinical Ethics Committee. Staff at a university hospital took part in a survey (January to June 2010) using a questionnaire with open and closed questions. Descriptive data for physicians and nurses (response rate = 13.5%, n = 101) are presented. Physicians and nurses reported similar high frequencies of ethical conflicts but rated the relevance of ethical (...) issues differently. Nurses stated ethical issues as less important to physicians than to themselves. Ethical conflicts were mostly discussed with staff from one’s own profession. Respondents predominantly expected the Clinical Ethics Committee to provide competent support. Mostly, nurses feared it might have no influence on clinical practice. Findings suggest that experiences of ethical conflicts might reflect interprofessional communication patterns. Expectations and objections against Clinical Ethics Committees were multifaceted, and should be overcome by providing sufficient information. The Clinical Ethics Committee needs to take different perspectives of professions into account. (shrink)

Foundational investigations in quantum mechanics, both experimental and theoretical, gave birth to the field of quantum information science. Nevertheless, the foundations of quantum mechanics themselves remain hotly debated in the scientific community, and no consensus on essential questions has been reached. Here, we present the results of a poll carried out among 33 participants of a conference on the foundations of quantum mechanics. The participants completed a questionnaire containing 16 multiple-choice questions probing opinions on quantum-foundational issues. Participants included physicists, philosophers, (...) and mathematicians. We describe our findings, identify commonly held views, and determine strong, medium, and weak correlations between the answers. Our study provides a unique snapshot of current views in the field of quantum foundations, as well as an analysis of the relationships between these views. (shrink)

It has become commonplace to consider start-ups originating from the science field usually referred to as academic spin-offs as drivers of innovation, productivity, and employment. However, only little is known about the process of spin-off creation (e.g., Goethner et al., 2009) and development (e.g., Mustar et al., 2006; Vohora et al., 2004). Specifically, there has not been sufficient empirical research directly comparing equivalently matched groups of academic spin-offs and non-academic start-ups in order to draw definitive conclusions on whether there are (...) specific growth paths of firms spun off from scientific research (Ensley & Hmieleski, 2005). We aim to fill this gap in the literature and provide unique empirical evidence on the economic and innovative performance of academic spin-offs within the first three business years. (shrink)

Operationism may tentatively be defined as that scientific method which defines its concepts in terms of observable or communicable operations, however carried out. With few exceptions, it has been put forward as representing positivism in contemporary sociology. Sellars refers to it as a new and virulent form of positivism—logical positivism. In philosophy, logical positivism is the culmination of the sensationalism of Berkeley and Hume, the positivism of Mach and Avenarius and Comte, and the logistic of Russell and Wittgenstein. Georg Simmels philosophisches Werk steht quer zu etablierten Fachgrenzen. Das gilt auch für die "Philosophie des Geldes", in dem sein Interesse an unterschiedlichen Phänomenen des Sozial- und Kulturlebens – Freiheit, Weltanschauung, Gesellschaft, Politik, Religion, Kunst u.v.m – sich bereits abzeichnet, bevor es in den folgenden Jahren in Schriften zur Soziologie, Psychologie, Ästhetik, Kulturtheorie entfaltet wird. Schon der Titel einer "Philosophie des Geldes" ist ein Novum. Hier wird nämlich ein Bereich des sozialen Lebens, das wirtschaftliche Leben, zum Gegenstand der Analyse gemacht, (...) um nicht die Einheit des kulturellen Lebens, sondern um dessen geistige Grundlagen zu untersuchen. In der Selbstanzeige des Buches für den Verlag Duncker & Humblot schreibt Simmel, dass er mehrere Zielsetzungen verfolgt. Zum einen will er die Einseitigkeiten von Idealismus und Materialismus korrigieren und Geschichte respektive Kultur als ein Wechselspiel zwischen materiellen und ideellen Faktoren begreifen. Zum anderen will er den Beweis führen, dass sich von jedem Punkte der gleichgültigsten, unidealsten Oberfläche des Lebens ein Senkbeil in seine letzten Tiefen des menschlichen lebens werfen lässt. Damit ist gemeint, dass jedes Lebensphänomen als ein Aspekt und ein Träger einer Einheit von Sinn angesehen werden kann. Die These ist, dass sich menschliches Leben als Sinngeschehen vollzieht, was sich in allen Lebensvollzügen – vom ästhetischen über das wirtschaftliche bis zum religiösen Handeln – überprüfbar sein muss. Die "Philosophie des Geldes" besteht aus zwei Teilen, einem analytischen und einem synthetischen Teil. Im analytischen Teil wird die systematische und historische Explikation einer allgemeinen Kulturtendenz dargestellt. Es geht um den Befund eines Nebeneinanders zweier Welten, dort die Natur und hier die Welt der Werte, die sich aufeinander beziehen und doch voneinander getrennt entwickeln. Auf die Welt der Werte bezogen, also unsere menschliche Welt, die wir im Denken und Handeln erzeugen und die wir sinnverstehend erschließen können spricht Simmel von einer Entwicklungstendenz, einem Übergang von Substanz- zu Funktionsvorstellungen – vom einem sich verändernden Gebrauch der Kategorien, beispielsweise Mittel/Zweck. Im synthetischen Teil geht Simmel auf die Probleme der menschlichen Lebensführung ein, wozu das Problem von Freiheit und Verpflichtung und auch die Frage gehört, wie wir unserem Leben eine Form geben können, Im instruktiven, das Werk abschließenden Kapitel über den Stil des Lebens mündet die Diagnose der modernen Kultur in die Überlegung, was es für uns heißen könnte, unter den bedingungen eines relativistischen Weltbildes dem eigenen Leben eine Form und Richtung zu geben. Die "Philosophie des Geldes" ist ein großes Werk der Philosophie, in dem es, diesseits der üblichen Trennung in theoretische und praktische Fragen der Philosophie, noch einmal um die letzten Probleme der Philosophie geht. The executive board of the Academy for Ethics in Medicine and two AEM working groups formulated standards and recommendations for clinical ethics consultation in 2010, 2011, and 2013. These guidelines comply with the international standards like those set by the American Society for Bioethics and Humanities. There is no empirical data available yet that could indicate whether these standards and recommendations have been implemented in German hospitals. This desideratum is addressed in the present study. We contacted 1.858 German hospitals between (...) September 2013 and January 2014. A follow-up survey was conducted between October 2014 and January 2015. The data of the initial survey and the follow-up survey were merged and evaluated. The statements of the participants were compared with the standards and recommendations. The standards of the AEM concerning the tasks of clinical ethics consultation are employed by a majority of participants of the study. Almost all of these participants document their consultation activities by means of protocols or entries in the patient file. There are deviations from the recommendations of the AEM working groups regarding the drafting of statutes, activity reports, and financial support. The activities of clinical ethics consultation predominantly comply with the standards of the AEM and recommendations for the documentation. The recommendations for evaluation should be improved in practice. This applies particularly for activity reports in order to evaluate the activities. In most cultures, extramarital sex is highly restricted for women. In most of those cultures, men transfer wealth to their own sons. In some cultures extramarital sex is not highly restricted for women, and in most of those cultures, men transfer wealth to their sisters' sons. Inheritance to sisters' sons ensures a man's biological relatedness to his heirs, and matrilineal inheritance has been posited as a male accommodation to cuckoldry—a paternity strategy—at least since the 15th century. However, longitudinal analysis of (...) the cumulative effect of female extramarital sex indicates that matrilineal inheritance is most advantageous for women and would be more accurately considered a grandmaternity strategy. That is, if the probability that men's putative children are their biological children is less than 1, the probabilistic degree of relatedness between a female and her matrilineal heirs is higher than her corresponding relatedness to her patrilineal heirs. The same holds true for men only if ρ is very low. The upshot is that for moderate levels of female extramarital sex, matrilineal inheritance, relative to patrilineal inheritance, is highly advantageous for women and disadvantageous for men. Consideration of female variance in reproductive success beyond the first generation, and of a man's network of obligation to the inclusive fitness of his relatives, suggests that although the establishment of matrilineal inheritance may require extremely high levels of female extramarital sex, once established, it is likely to be maintained at levels of ρ that reasonably characterize many societies in the ethnographic record. New analysis of previously published data shows a strong association between matrilineal inheritance and moderate to low probability of paternity, and an even stronger relationship between patrilineal inheritance and high probability of paternity. In the absence of effective judicial remediation mechanisms after business-related human rights violations, companies themselves are expected to establish remediation procedures for affected victims and communities. This is a challenge for both companies and victims since comprehensive company-based grievance mechanisms are currently missing. In this paper, we explore how companies can provide effective remediation after human rights violations. Accordingly, we critically assess two different approaches to conflict resolution, alternative dispute resolution and restorative justice, for their potential to provide dialogue-based, non-judicial (...) remediation. We argue that remedy through agreement-driven ADR mechanisms risks marginalizing the interests and concerns of victims and affected community members, particularly in weak institutional contexts. Hence, we develop a dialogue-driven framework for corporate remediation of human rights violations grounded on RJ principles. This restorative framework provides a comprehensive CGM that focuses on the harms and needs of victims and aims at restoring justice through restorative dialogue. Based on a prompt discovery and a thorough investigation of the grievance, companies should design and prepare the remediation process together with victims, offenders and affected community members. Through restorative dialogue with the affected parties about the circumstances and impacts of the wrongdoing, companies can repair the harm, regain legitimacy amongst stakeholders as well as transform their business practices to avoid future human rights violations. ABSTRACTThe question of how to engage with stakeholders in situations of value conflict to create value that includes a plurality of conflicting stakeholder value perspectives represents one of the crucial current challenges of stakeholder engagement as well as of value creation stakeholder theory. To address this challenge, we conceptualize a discursive sharing process between affected stakeholders that is oriented toward discursive justification involving multiple procedural steps. This sharing process provides procedural guidance for firms and stakeholders to create pluralistic stakeholder value (...) through the discursive accommodation of diverging stakeholder value perspectives. The outcomes of such a discursive value-sharing process range from stakeholder value dissensus to low and increasing levels of stakeholder value congruence to stakeholder value consensus. Hence, this article contributes to the emerging literature on integrative stakeholder engagement by conceptualizing a procedural framework that is neither overly oriented towards dissensus nor consensus. Since the outbreak of the First World War, Max Scheler has been interested in political and cultural constellations within Europe. But he also thinks about Europe as a plural entity and its relationship to other world regions. Thus, he analyses processes of globalisation, in his view a Europeanisation of the world, from political, economic and cultural points of view. In his analyses of such a “Europeanisation of the world”, Scheler refers to the great studies on the history of capitalism by (...) Werner Sombart and Max Scheler, from which he takes the talk of the “capitalist spirit of modernity”. Scheler's analysis of globalisation leads to a critique of the European claim to cultural hegemony. He pleads for a preservation of differences and a new vitalisation of cultural values through productive conflicts such as wars on a global scale. Scheler's texts still provoke their readers today, at least to think about them. (shrink)

We need not accommodate facts about meaning if Quine is right about the indeterminacy of subsentential expressions; there can be no such facts to accommodate. Evans argued that Quine’s approach overlooks the ways speakers use predication to endow their use of subsentential expressions with the necessary determinacy. This paper offers a critical assessment of the debate in relation to current arguments about naturalism and shows how Evans’s response depends on a basic claim that turns out to be false.

This article examines the role of taste perception in Galen’s research on simple drugs in relation to the acquisition of knowledge. To this end, 1.) I make it plausible through an examination of sources that the sometimes increased, more detailed and divergent indications of taste compared to his predecessors, especially Dioscorides and Sextius Niger, are based on Galen’s own research, 2.) reconstruct Galen’s research practice and 3.) examine the presentation of his results in linguistic and logical terms and explain the (...) differences to traditional pharmacology. I argue that a) gustatory perception has a special significance in Galen’s work that goes far beyond its traditional descriptive function and b) that, starting from the realisation that taste and drug action are interrelated, he assigns to taste qualities an indicator function for a much more fundamental principle that causes drug action and thus c) has prepared the ground for a pharmacognosy that also classifies according to taste principles, which was to reach its climax much later. With a view to a practice of gustatory testing of herbal drugs that is still practised today in pharmacy, which, like any other natural science discipline, has otherwise largely lost the sensory reference to its subject matter, the article would therefore like to provide an encouragement to study the “history of pharmaceutical-medical tasting”. What I am going to say here may be thought by some to be more appropriate to science as a whole, rather than “what sociology has to offer to the physical sciences.” The main point of my remarks has to do with objectivity and values in science. Great masses of people are today in doubt as to whether science is a friend or an enemy of theirs. They do not see it as a means to continued material progress, as objectively (...) measured in such things as the level of living, and morbidity and death rates. To them it is, for example, a means for spreading mass misery through depressions due to technological unemployment. Or, it is the means for the production of ever more destructive weapons in continually more destructive wars. (shrink)

This article comments on the recent study “CEO hubris and firm pollution: state and market contingencies in a transitional economy” of Zhang et al. :459–478, 2020) in this journal. We very much appreciate the valuable initiative of Zhang et al. to study the potential effect of CEO characteristics on corporate pollution. At the same time, we are concerned with the authors’ interpretation of the regression results and their operationalization of CEO hubris. We hope to contribute to the literature on managerial (...) hubris in two ways. First, we repair the authors’ inferences and conclusions about the actual effect of CEO hubris on firm pollution with respect to their conflicting regression results. Second, we unpack and clarify the authors’ vulnerable operationalization of CEO hubris. We hope to stimulate more research on the relationship between CEO hubris and firm pollution, and managerial hubris more generally through a more rigorous operationalization and measurement of hubris. Artificial intelligence increasingly executes tasks that previously only humans could do, such as drive a car, fight in war, or perform a medical operation. However, as the very best AI systems tend to be the least controllable and the least transparent, some scholars argued that humans can no longer be morally responsible for some of the AI-caused outcomes, which would then result in a responsibility gap. In this paper, I assume, for the sake of argument, that at least some of (...) the most sophisticated AI systems do indeed create responsibility gaps, and I ask whether we can bridge these gaps at will, viz. whether certain people could take responsibility for AI-caused harm simply by performing a certain speech act, just as people can give permission for something simply by performing the act of consent. So understood, taking responsibility would be a genuine normative power. I first discuss and reject the view of Champagne and Tonkens, who advocate a view of taking liability. According to this view, a military commander can and must, ahead of time, accept liability to blame and punishment for any harm caused by autonomous weapon systems under her command. I then defend my own proposal of taking answerability, viz. the view that people can makes themselves morally answerable for the harm caused by AI systems, not only ahead of time but also when harm has already been caused. In order to build on the information that was obtained in the course of the first study, a follow-up survey was conducted first by phone and subsequently in a written form between August and October 2014. We contacted 1.858 hospitals in all of Germany for the follow-up survey by phone. In cases where a hospital had not participated in the first study, the willingness to participate in the follow-up survey was established in advance. The survey’s dispatch was ensured in the (...) case of acceptance. The same structured survey was used as a research tool. The data of the first study and the follow-up survey were merged and evaluated. 654 surveys could be evaluated altogether. Our survey by phone revealed that 912 hospitals in all of Germany have at least one form of clinical ethics consultation available. The health care ethics committee is the most frequently implemented structure of clinical ethics consultation. The implementation of clinical ethics consultation is dependent on sponsorship and hospital size. Recommendations to deliver structures of clinical ethics consultations have a smaller influence on the implementation compared to the certification by KTQ respectively proCum Cert. The rate of implementation in regard to the structures of clinical ethics consultation has steadily increased for years. The establishment of clinical ethics consultation in German hospitals should be further promoted. It would be desirable further to develop suitable juridical regulations in order to implement clinical ethics consultation as well as structural parameters. (shrink)

Die Genese einer im rechten Sinne verstandenen „Culturwissenschaft“, als einer Theorie, die es erlaubt, die Probleme des Prinzipienrelativismus’ in Logik, Ethik, Religion etc. anzugehen, beleuchtet Gerald Hartung in seinem Beitrag „Völkerpsychologie und Sprachwissenschaft – eine Kontroverse um die Grundlagen der Kulturwissenschaft“ im Ausgang von Wundts Völkerpsychologie, indem er die Diskussionen rekonstruiert, die sich um dieselbe in den Jahren zwischen 1860 und 1901 ereigneten. Als Ausgangspunkt für seine Untersuchungen nimmt Hartung die von Steinthal und Lazarus herausgegebene „Zeitschrift für Völkerpsychologie (...) und Sprachwissenschaft“, in deren Bemühungen um eine Methoden- und Gegenstandsbestimmung der Völkerpsychologie, gleichsam das „Profil einer ‚Culturwissenschaft‘“ sichtbar wird. Der grundlegenden Skizzierung des Programms der Zeitschrift in Hinblick auf die Frage nach der Funktion der Sprache für die Genese von Geist und Kultur im Allgemeinen folgt die Verortung der konstitutiven Funktion von Sprache innerhalb Wundts Völkerpsychologie, die Hartung aus den Kontroversen zwischen Wundt und Paul, der Kritik Steinthals an Wundt und Paul als auch der späten Auseinandersetzung zwischen Delbrück und Wundt herausarbeitet. So zeigt Hartung, dass Delbrück 1901 keinerlei Interesse mehr an der Völkerpsychologie hatte, da diese wie auch deren Organ längst in der Völkerkunde aufgegangen war. Während Wundt im Ausgang von Delbrücks Vorstoß erneuert die Verbundenheit von Psychologie und Sprachwissenschaft hervorhob und die Psychologie nicht allein als eigenständige Disziplin, sondern darüber hinaus als Leitwissenschaft der Sprachwissenschaft zu etablieren suchte, sah Steinthal in der Völkerpsychologie – so Hartung abschließend – die Möglichkeit einer Kulturwissenschaft, in der die „Gebilde des objektiven Geistes“ behandelt werden. Simmel hat das Thema Pessimismus in einer Vorlesung an der Berliner Universität im Wintersemester 1894/1895 und in den Jahren 1887 bis 1900 in vier Abhandlungen thematisiert.

Adorno und Kierkegaard trennen Welten. Dennoch hat sich der kritische Theoretiker der Gesellschaft zeitlebens intensiv mit dem religiösen Schriftsteller und Vater der Existenzphilosophie aus dem 19. Jahrhundert beschäftigt. Das vorliegende Buch untersucht die vielfältigen Motive dieses spannungsvollen Verhältnisses, von der Soziologie der Innerlichkeit bis zur Ästhetik. Grundlage ist die eingehende Analyse von Adornos Erstlingswerk und anderer Texte über den Dänen. Gleichwohl gilt es, dessen Denken auch in seiner Eigenständigkeit zu berücksichtigen. Denn nur wo beide auf Augenhöhe behandelt werden, lässt sich (...) die Frage nach dem Einfluss Kierkegaards auf Adorno stellen. Eine Antwort ist die Forschung bisher weitgehend schuldig geblieben, entweder weil sie sich die Deutung des Frankfurters zu eigen gemacht, oder diese umgekehrt als verfehlt abgetan hat. Was ihn mit Kierkegaard zugleich verbindet und entzweit, ist die Kritik des Deutschen Idealismus und die Radikalität, mit der das moderne autonome Subjekt als entfremdetes bestimmt wird. Überraschen mag die Erkenntnis, dass sie vor diesem Hintergrund und im Rückgriff auf Kant den Möglichkeitsspielraum individueller Praxis und der Ethik im engeren Sinne durchaus ähnlich bewerten. The Sleeping Beauty transposon system is a nonviral DNA transfer tool capable of efficiently mediating transposition‐based, stable integration of DNA sequences of choice into eukaryotic genomes. Continuous refinements of the system, including the emergence of hyperactive transposase mutants and novel approaches in vectorology, greatly improve upon transposition efficiency rivaling viral‐vector‐based methods for stable gene insertion. Current developments, such as reversible transgenesis and proof‐of‐concept RNA‐guided transposition, further expand on possible applications in the future. In addition, innate advantages such as lack of (...) preferential integration into genes reduce insertional mutagenesis‐related safety concerns while comparably low manufacturing costs enable widespread implementation. Accordingly, the system is recognized as a powerful and versatile tool for genetic engineering and is playing a central role in an ever‐expanding number of gene and cell therapy clinical trials with the potential to become a key technology to meet the growing demand for advanced therapy medicinal products. As presented by some, operationalism in sociology is Kantian in its view of the universe, of the assumptions and limitations of science, and of the scientist's ability to analyse and present the reality of the universe.In his exposition, George A. Lundberg rests operationalism upon a twofold basis. First there is a materially-conceived nature. This is expressed in the terms “X,” “the cosmos,” or “that which arouses certain responses.” We do not know, cannot know, nor can science tell us, anything about (...) the nature of this X, save that it precipitates responses. This position is qualified by making existence always relative to some responding organism.
