I develop a theory of counterfactuals about relative computability, i.e. counterfactuals such as 'If the validity problem were algorithmically decidable, then the halting problem would also be algorithmically decidable,' which is true, and 'If the validity problem were algorithmically decidable, then arithmetical truth would also be algorithmically decidable,' which is false. These counterfactuals are counterpossibles, i.e. they have metaphysically impossible antecedents. They thus pose a challenge to the orthodoxy about counterfactuals, which would treat them as uniformly true. What’s more, I (...) argue that these counterpossibles don’t just appear in the periphery of relative computability theory but instead they play an ineliminable role in the development of the theory. Finally, I present and discuss a model theory for these counterfactuals that is a straightforward extension of the familiar comparative similarity models. (shrink)

I argue that scientific realism, insofar as it is only committed to those scientific posits of which we have causal knowledge, is immune to Kyle Stanford’s argument from unconceived alternatives. This causal strategy is shown not to repeat the shortcomings of previous realist responses to Stanford’s argument. Furthermore, I show that the notion of causal knowledge underlying it can be made sufficiently precise by means of conceptual tools recently introduced into the debate on scientific realism. Existing proposals concerning the ontology of quantum mechanics either involve speculation that goes beyond the scientific evidence or abandon realism about large parts of QM. This paper proposes a way out of this dilemma, by showing that QM as it is formulated in standard textbooks allows for a much more substantive ontological commitment than is usually acknowledged. For this purpose, I defend a non-fundamentalist approach to ontology, which is then applied to various aspects of QM. The paper explains in what sense the GRW matter density theory is a primitive ontology theory of quantum mechanics and why, thus conceived, the standard objections against the GRW formalism do not apply to GRWm. We consider the different options for conceiving the quantum state in GRWm and argue that dispositionalism is the most attractive one.

In both the public and the business world, in academe as well as in practice, the ideas of Adam Smith are regarded as the bedrock of modern economics. When present economic conditions and management practices are criticised, Adam Smith is referred to by defenders and detractors of the current status quo alike. Smith, it is believed, defined the essential terms of reference of these debates, such as the rational pursuit of self-interest on part of the individual and the resultant optimal (...) allocation of goods in free markets thanks to the workings of an “invisible hand.” In this article, we question whether this standard view of Smith, the economist, is tenable. We provide an extensive review of the extant secondary literature from economists, business ethicists, and philosophers, comparing their assessments to crucial elements of Smith’s theoretical system. As a result, we show that Smith, far from being an advocate of a value-free or even value-averse conception of economic transactions, stood for a virtue-based and values-oriented model of business. Accordingly, we argue current management education and the pedagogy of business ethics ought to be changed, and certain strategic conclusions drawn for business practice. (shrink)

Adam Smith’s is often falsely portrayed as having argued that radical selfishness is a force for the good and that this “invisible hand’ is his market mechanism. This paper argues that Smith’s real market mechanism, the sympathy manoeuvre, is a viable alternative to Schumpeterian and mainstream models of innovation in economics and also could help build a firmer theoretical basis for other approaches such as Responsible Innovation. To Smith all human activity was social and must be understood and explained in (...) terms of the sentiments involved. Discovery, for instance, is driven by three sentiments (wonder, surprise, admiration), economic activities by sympathetic imagination, the need for exchange, the need to better one’s position in life, and the need for gratitude. Through sympathetic imagination, his famous model of the impartial spectator, Smith elegantly connects the individual and society. Smith’s innovation process is thus an exercise in social construction and not a destructive process based on radical selfishness. The paper argues that this social innovation process is a viable alternative to the extant approaches that are essentially asocial and amoral (economism) or ideologically normative (Responsible Innovation). This book considers Robert Brandom's philosophy and presents an original and exciting analysis of the semantic argument in legal argumentation.

All conceptions of equal opportunity draw on some distinction between morally justified and unjustified inequalities. We discuss how this distinction varies across a range of philosophical positions. We find that these positions often advance equality of opportunity in tandem with distributive principles based on merit, desert, consequentialist criteria or individuals' responsibility for outcomes. The result of this amalgam of principles is a festering controversy that unnecessarily diminishes the widespread acceptability of opportunity concerns. We therefore propose to restore the conceptual separation (...) of opportunity principles concerning unjustified inequalities from distributive principles concerning justifiable inequalities. On this view, equal opportunity implies that that morally irrelevant factors should engender no differences in individuals' attainment, while remaining silent on inequalities due to morally relevant factors. We examine this idea by introducing the principle of ‘opportunity dominance' and explore in a simple application to what extent this principle may help us arbitrate between opposing distributive principles. We also compare this principle to the selection rules developed by John Roemer and Dirk Van de Gaer. (shrink)

Metrology is a discipline of expunging impurities. The mid-nineteenth century French physicist Henri-Victor Regnault created a whole new way of doing experiments, attempting to produce standards physically by the "direct method." His immodest ambition to control all disturbing parameters represents a relict in the physical sciences of Romantic hopes for an all-embracing, artistic and aesthetic approach to nature, expressed in the absolute, eternal determination of nature's constants and their numerical relationships. The novelist Gustave Flaubert, whose rejection of metaphysics, love for (...) finest detail, concern for impartial treatment of the human psyche, and perfectionism, made him Regnault's literary complement, likewise hoped for this utopian union of science and art. There is a romantic and a modern ring to their ideals which were not to be achieved by optimism, but by introducing systematic doubt, by thoroughly studying impurities and expunging them. Nature did not speak clearly, but hid behind a multitude of disturbing effects—revealed only by the experimenter's or writer's voluntary restraint and self-denial, a disinterestedness Regnault and Flaubert celebrated as the highest and holiest morality. For them, attention to secondary matters became primary, because they expected them to lead the way to the grail. (shrink)

Closed systems are mental artefacts whose structure can neither be explained in terms of innate dispositions nor in terms of the mechanism of natural selection and which stands in contradiction to the conditions of the possibility of information transfer. Kant takes the formal structure of pure mathematics as a guarantor for his reconstruction of a closed system of the subject's structures of knowledge a priori, thereby giving rise to the problem of a normative interface between interior system and exterior information (...) – a problem which is, in this form, not to be solved. By tracing the structure of generative grammar and formal logics back to innate modules, respectively, Chomsky and Fodor are creating the same interface problem, whose basic structure has not yet received the necessary attention. Human-wildlife interactions frequently lead to conflicts – about the fair use of natural resources, for example. Various principled accounts have been proposed to resolve such interspecies conflicts. However, the existing frameworks are often inadequate to the complexities of real-life scenarios. In particular, they frequently fail because they do not adequately take account of the qualitative importance of individual interests, their relative importance, and the number of individuals affected. What is the core of legal scholarship? How can we understand its relation to other disciplines, such as moral and political philosophy, sociology, and economics? I explore these questions by analysing the impact of the dual nature thesis. Criticising established theories of legal scholarship, I defend the ideal of an integrative jurisprudence. Integrative jurisprudence combines the two dimensions of law by employing analytical, empirical, and normative methods. I then discuss three objections and address the problem of how to bridge is (...) and ought. In the course of my analysis of three different bridge theories, I ultimately further develop the dual nature thesis into a triadic nature thesis. (shrink)

This article investigates the concept and the construction of judicial discretion. The strengths and weaknesses of both Dworkin and Hart are analysed, and in view of these, it is argued that a full picture of judicial discretion is between the two extremes. Thus, a moderate theory of judicial discretion is maintained which is based on achievements by Robert Alexy (2002b). The article develops a balancing model of discretion and relates it to the theory of legal argumentation. The limits of discretion (...) and the relation between structural (strong) and epistemic (weak) discretion are addressed in detail, both with illustrations from the jurisdiction of the German Federal Constitutional Court. Definition of the Problem: One of the main ethical arguments against the therapeutic transplantation of fetal tissue in severe cases of Parkinson’s disease is the allegation that the relationship between the abortion and the transplantation is a (bad)-means-to-a-(good)-end-relation.Arguments: This paper differentiates between the actual experimental single-case treatment and a potential mass treatment. In the former case, ethical guidelines seem to guarantee that abortion and transplantation are two distinct actions and therefore abortion is not a means to the end transplantation on (...) principle. However, in the latter case – the potential mass treatment of patients with more severe cases of Parkinson’s disease – there seem to be several technical, logistical and psychological reasons for the impossibility to distinguish between abortion and transplantation.Conclusion: Although abortion is not a means to the end transplantation as a matter of principle the ethical problems of a mass treatment would be immense.
