There are few problems to which legal philosophers have devoted more attention than the relationship between morality and law, or, said in different terms, between the “good” and the “obligatory”. One might think that all that should and could be said about it has already been uttered or written. Nevertheless philosophy — and legal philosophy is no exception — is just this: rethinking old problems which are in fact always new,1 and for which no definitive solution is given — nor (...) is possible, I would add — and which need a permanent effort of reassessment. We present an account of semantics that is not construed as a mapping of language to the world but rather as a mapping between individual meaning spaces. The meanings of linguistic entities are established via a “meeting of minds.” The concepts in the minds of communicating individuals are modeled as convex regions in conceptual spaces. We outline a mathematical framework, based on fixpoints in continuous mappings between conceptual spaces, that can be used to model such a semantics. If concepts are (...) convex, it will in general be possible for interactors to agree on joint meaning even if they start out from different representational spaces. Language is discrete, while mental representations tend to be continuous—posing a seeming paradox. We show that the convexity assumption allows us to address this problem. Using examples, we further show that our approach helps explain the semantic processes involved in the composition of expressions. (shrink)

The term pseudoscience refers to a highly heterogeneous set of practices, beliefs, and claims sharing the property of appearing to be scientific when in fact they contradict either scientific findings or the methods by which science proceeds. Classic examples of pseudoscience include astrology, parapsychology, and ufology; more recent entries are the denial of a causal link between the HIV virus and AIDS or the claim that vaccines cause autism. To distinguish between science and pseudoscience is part of what the philosopher (...) Karl Popper referred to as the demarcation problem, a project that has been dismissed by another philosopher, Larry Laudan, but that keeps gathering much interest in philosophers, scientists, educators, and policymakers. Ever since Darwin a great deal of the conceptual history of biology may be read as a struggle between two philosophical positions: reductionism and holism. On the one hand, we have the reductionist claim that evolution has to be understood in terms of changes at the fundamental causal level of the gene. As Richard Dawkins famously put it, organisms are just ‘lumbering robots’ in the service of their genetic masters. On the other hand, there is a long holistic tradition that (...) focuses on the complexity of developmental systems, on the non-linearity of gene– environment interactions, and on multi-level selective processes to argue that the full story of biology is a bit more complicated than that. Reductionism can marshal on its behalf the spectacular successes of genetics and molecular biology throughout the 20th and 21st centuries. Holism has built on the development of entirely new disciplines and conceptual frameworks over the past few decades, including evo-devo and phenotypic plasticity. Yet, a number of biologists are still actively looking for a way out of the reductionism–holism counterposition, often mentioning the word ‘emergence’ as a way to deal with the conundrum. This paper briefly examines the philosophical history of the concept of emergence, distinguishes between epistemic and ontological accounts of it, and comments on conceptions of emergence that can actually be useful for practising evolutionary biologists. As short a time ago as 1992, political scientist Francis Fukuyama was optimistically (and wrongly, as it turned out) predicting “the end of history”, a stable future where liberal democracies would be the norm throughout the world, leading to lasting peace and economic prosperity. A few years later we have Eric Li, who equally gingerly predicts (for example in the pages of Foreign Affairs magazine) a “post-democratic” future, beginning with the success of China. Oh boy.

The term ‘naturalism’ has a long and complex history in modern philosophy. W.V.O. Quine famously advocated what has come to be known as a ‘naturalistic turn’ for philosophy as a discipline, meaning that philosophical thought should become continuous with the natural sciences – even claiming that epistemology (theory of knowledge) is nothing but applied psychology.

This paper discusses some models purported to legitimise a European supranational legal order. In particular, the author focuses on an application of the so‐called regulatory model to the complex structure of the European Community and the European Union. First of all, he tackles the very concept of legitimacy, contrasting it with both efficacy and efficiency. Secondly, he summarises the most prominent positions in the long‐standing debate on the sources of legitimation for the European Community. Thirdly, in this perspective, he analyses (...) several, sometimes contradictory, notions of the rule of law. His contention is that we can single out five fundamental notions of the rule of law and that some but not all of them are incompatible with or oppose democracy. Finally, the paper addresses the regulatory model as a possible application of the rule of the law to the European supranational order. The conclusion is that the regulatory model should be rejected if it is presented as an alternative to classical democratic thought, though it might be fruitful if reshaped differently and no longer assessed from a functionalist standpoint of deliberation. Effective methods for evaluating the reliability of statements issued by witnesses and defendants in hearings would be an extremely valuable support to decision-making in court and other legal settings. In recent years, methods relying on stylometric techniques have proven most successful for this task; but few such methods have been tested with language collected in real-life situations of high-stakes deception, and therefore their usefulness outside lab conditions still has to be properly assessed. In this study we report the results obtained (...) by using stylometric techniques to identify deceptive statements in a corpus of hearings collected in Italian courts. The defendants at these hearings were condemned for calumny or false testimony, so the falsity of (some of) their statements is fairly certain. In our experiments we replicated the methods used in previous studies but never before applied to high-stakes data, and tested new methods. We also considered the effect of a number of variables including in particular the homogeneity of the dataset. Our results suggest that accuracy at deception detection clearly above chance level can be obtained with real-life data as well. (shrink)

ABSTRACT: After World War Two a gigantic effort was made in order to build a viable and stable international order, beginning with the Bretton Woods agreement that was aimed to stabilize the international monetary system, and with the United Nations, that were intended to restore legality in interstate affairs and somehow initiate a cosmopolitan conversation among Nation States. This order is now slowly crumbling down, paradoxically through globalization, and a triumphant neoliberalism. La caída del Muro de Berlín fue saludado por muchos analistas y académicos como el inicio de una nueva era. Con el fin de la Guerra Fría se vislumbraba una nueva etapa de paz y prosperidad. Tras la “revolución liberal” algunos avistaban el “fin de la historia”. Pero tal esperanza se disipó rápidamente: la desaparición del “socialismo real” relanzó un capitalismo desenfrenado y no sólo en los países ayer bajo la órbita soviética. El ordoliberalismo entendido como el establecimiento de un (...) modelo económico altamente competitivo y garantizado jurisdiccionalmente, se infiltró también en las instituciones europeas. La crisis del año 2010 vino a confirmar para Europa su deriva neoliberal, tecnocrática. La onda expansiva del 9 de noviembre de 1989 aún no ha concluido. Nuevas turbulencias aguardan. The Collapse of the Rule of Law. The Messina Earthquake and the State of Exception Messina, a Sicilian town, was devasteted by an earthquake in1908. It was an hecatomb. Stricken through this unfathomable disgrace Messina’s institutions and civil society collapsed and a sort of wild natural state replaced the rule of law. In this situation there was a first intervention of the Russian Czarist navy who came to help but immediately enforced cruel emergency measures. The Italian army followed and there (...) was a formal declaration of an ‘emergency situation.’ Around this event and the several exceptional measures taken by the government a debate took place about the legality of those exceptional measures. The article tries to reconstruct the historical context and the content of that debate and in a broader perspective thematizes how law (and morality) could be brought to meet the breaking of normality and ordinary life by an unexpected and catastrophic event. In the 5th century BCE, Sophocles wrote a tragedy about the rivalry between the Greek heroes Ajax and Odysseus. The two competed for the title of most valuable man in the army that was laying siege to Troy. The prize was Achilles’ armor (he was dead, you know), which was forged by none other than the god Hephaestus. The Greeks’ leader, Agamemnon, was a bit of a coward, and he made a jury of soldiers decide the contest instead of taking (...) responsibility for the decision himself. The soldiers unanimously awarded the armor to Odysseus (who eventually did lead them to victory, via his Trojan Horse stratagem), even though Ajax had arguably been the more valiant soldier, and many owed their life to his bravery in battle. As a result of the decision against him, Ajax was irreparably wounded in his honor, became temporarily mad, attacked his superiors, and ended up committing suicide. (shrink)

What kind of reference (if any) do terms such as “pencil,” “chair,” “television,” and so on have? On the matter, a de-bate between directly referential theorists and descriptiv-ist theorists is open. It is largely acknowledged that natural kind terms (such as “water,” “gold,” “tiger,” etc.) are directly referential expressions (cf. Putnam,1975). That is, they are expressions whose reference is determined by their refer-ents' nature, independent of whether we know or will ever know what this nature is. However, it does not (...) seem like-wise convincing that all artifactual kind terms (like “pen-cil,” “chair,” “television,” etc.) semantically behave the same. Terms for artifactual kinds seem more likely to be subjected to a descriptivist view, that is, definable not by links to their extensions' nature but in terms of conjunctions or clusters of properties. In his celebrated “The Meaning of ‘Meaning’” (1975), Hilary Putnam originated the mentioned debate by arguing that artifactual kind terms also refer directly. Thus, the discussion ultimately revolves around establishing whether artifactual and natural kind terms are both directly referential expressions. The authors engaged in this debate have tried to argue in favor of (or against) Putnam's proposal by highlighting the similarities (or differences) between nat-ural vis-à-vis artifactual kind words and their respective ref-erents. What sets the practice of rigorously tested, sound science apart from pseudoscience? In this volume, the contributors seek to answer this question, known to philosophers of science as “the demarcation problem.” This issue has a long history in philosophy, stretching as far back as the early twentieth century and the work of Karl Popper. But by the late 1980s, scholars in the field began to treat the demarcation problem as impossible to solve and futile to ponder. However, the essays that (...) Massimo Pigliucci and Maarten Boudry have assembled in this volume make a rousing case for the unequivocal importance of reflecting on the separation between pseudoscience and sound science. The “nature” of an artifact is often equated with its function. Clearly, an artifactual function must be an extrinsic property. This feature of functions has important implications on the semantics of artifactual kind terms: it enables us to vindicate that artifactual kind terms have an externalist semantics. Any alleged externalist theory, indeed, must show that the referents of the considered terms share a common nature (i.e., an extrinsic property), whether we know or could possibly ever know what that nature is. (...) However, the state of the art shows that function is not enough to represent such “nature”: function does not exhaustively account for important phenomena that characterize artifacts and artifactual kinds, nor does it thoroughly define what they are. Thus, extending the scope of externalism to artifactual kind terms seems doomed to fail. Pace opposite views, it could even be argued that artifacts are a sub-class of social kinds. If so, not only social but also artifactual kind terms cannot refer externalistically, since their referents constitutively depend on human intentions and norms. Either way, externalism fails to apply to those kinds of terms. (shrink)

Le fonti antiche, concordi nel ritenerlo ‘filosofo’ e ‘filosofo platonico’, affermano che le sue dissertazioni o indagini filosofiche sono da ricondursi al suo primo soggiorno a Roma, al tempo dell’imperatore Commodo. Le quarantuno dissertazioni filosofiche di Massimo di Tiro offrono una visione privilegiata della cultura imperiale del secondo secolo, epoca in cui, dominante l’eleganza stilistica, anche la filosofia non disdegnava di dispiegare i propri contenuti mediante il bello stilo dello (...) strumento retorico. Nello svolgimento dei temi, perlopiù platonici nell’ispirazione e orientati ad argomenti presenti al dibattito coevo, ma comunque non escludenti altre influenze filosofiche, Massimo di Tiro si mostra pensatore dalla non banale semplicità. Muovendosi fra filosofia e letteratura, fra Platone e Omero, egli calibra l’erudizione sul filtro di un’esigenza educativa di ampio respiro. Nel volume si presenta la prima traduzione italiana completa dal greco. Il commento critico, aggiornato al dibattito accademico internazionale, mira a mostrare come l’opera del pensatore meriti una rinnovata attenzione nell’ambito degli studi classici letterari e filosofici, giacché nel delineare il quadro culturale del tempo essa consente di meglio precisare alcuni non marginali aspetti del platonismo del secondo secolo. Kants kritische Philosophie hat der traditionellen Metaphysik so gründlich die Flügel gestutzt, dass das Transzendente weitgehend aus dem Blickfeld der Kant-Forschung geraten ist. Der vorliegende Band will dieser Entwicklung entgegenwirken. Er fragt in interdisziplinärer Perspektive (Philosophie, Politikwissenschaft, Theologie) nach den transzendenten Geltungsgründen politischer Ordnungen einerseits und nach der Gültigkeit und dem Sinn einer epistemisch unverfügbaren Transzendenz andererseits. Inwiefern ist unsere Praxis durch Transzendenz fundiert und welchen Sinn verleihen wir der uns unverfügbaren Transzendenz in unseren lebensweltlichen Vollzügen? Diese Fragen werden entlang (...) der politischen Philosophie sowie der religionsphilosophischen Philosophie Kants untersucht. ‘Pencil’, ‘Tiger’, ‘Christianity’. What kind of reference (if any) do these terms have? Do they have the same semantics? In his celebrated The Meaning of ‘Meaning’ (1975), Hilary Putnam suggests so when arguing that they have externalist semantics. However, this claim is highly controversial. A lengthy discussion has been going on the matter. So far, neither Putnam’s nor other defenses of Externalism proposed within this debate have actually succeeded in showing that the terms at stake (and their likes) are semantically (...) on a par. Here I examine further options left to the externalist. I conclude that, still, none is a viable alternative for defending that Externalism applies to the mentioned terms (and their likes). (shrink)
