Developing and implementing artificial intelligence (AI) systems in an ethical manner faces several challenges specific to the kind of technology at hand, including ensuring that decision-making systems making use of machine learning are just, fair, and intelligible, and are aligned with our human values. Given that values vary across cultures, an additional ethical challenge is to ensure that these AI systems are not developed according to some unquestioned but questionable assumption of universal norms but are in fact compatible with the (...) societies in which they operate. This is particularly pertinent for AI research and implementation across Africa, a ground where AI systems are and will be used but also a place with a history of imposition of outside values. In this paper, we thus critically examine one proposal for ensuring that decision-making systems are just, fair, and intelligible—that we adopt a principle of explicability to generate specific recommendations—to assess whether the principle should be adopted in an African research context. We argue that a principle of explicability not only can contribute to responsible and thoughtful development of AI that is sensitive to African interests and values, but can also advance tackling some of the computational challenges in machine learning research. In this way, the motivation for ensuring that a machine learning-based system is just, fair, and intelligible is not only to meet ethical requirements, but also to make effective progress in the field itself. Retaliation against whistleblowers is a well-recognized problem, yet there is little explanation for why uninvolved peers choose to retaliate through ostracism. We conduct two experiments in which participants take the role of a peer third-party observer of theft and subsequent whistleblowing. We manipulate injunctive norms and descriptive norms. Both experiments support the core of our theoretical model, based on social intuitionist theory, such that moral judgments of the acts of wrongdoing and whistleblowing influence the perceived likeability of each actor and (...) ultimately influence intention to ostracize each actor and indicate more willingness to ostracize the whistleblower than the wrongdoer. When we vary norms for the wrongdoing in Experiment 1, we find that descriptive and injunctive norms indirectly influence intentions to ostracize both the wrongdoer and whistleblower. These relationships are serially mediated by the observers’ moral judgments of the act and likeability of the actor. When we vary norms for whistleblowing in Experiment 2, the injunctive norm manipulation affected moral judgment of the action of whistleblowing, and we do not observe any other significant effects of the norm manipulations on moral judgments of the actions of wrongdoing or whistleblowing. ABSTRACT This paper argues for a hidden way in which speech constitutes harm by enacting harmful norms. The paper then explores the potential legal consequences of uncovering such instances of harm constitution. In particular, the paper argues that some public racist speech constitutes harm and is thus harmful enough to warrant legal remedy. Such utterances are actionable, it is contended, because they enact discriminatory norms in public spaces.

If Kant's account of rights had continued the "early modern Natural Law tradition", basing rights on some notion of human flourishing, there would be no difficulty about including socio-economic rights for the needy in his theory. However, his division of moral philosophy into Rechtslehre and Tugendlehre limits Rechtspflichten to duties that a moral agent can be coerced to fulfill. If a state is to give the needy statutory rights, the justification for using coercion on its citizens cannot be that they (...) have a duty of virtue to assist the needy. In order to determine whether such a justification can be found, the one innate socio-economic right Kant admits, a child's right to be cared for and educated, is examined and found to be a right against its parents, not against the state. Kant does, however, hold that a state should establish institutions to provide for abandoned children and for the poor in general. His justification for a state's use of coercion with regard to such statutory rights is considered and a criterion is suggested for the possible consent of its non-virtuous citizens to proposed measures for assistance to the needy. It is suggested that if advocates of aid to the needy cannot justify their proposals by such a criterion they will have to provide a very different account of rights than Kant gives in his Rechtslehre , which is concerned with the moral permissibility of using coercion. Deshalb kann, wenn ein Staat den Bedürftigen durch ein positives Gesetz irgendwelche Rechte auf Hilfe gewährt, die Rechtfertigung der Anwendung von staatlichem Zwang nicht darin gesucht werden, daß die dadurch in Anspruch genommenen Personen die Tugendpflicht haben, die Bedürftigen zu unterstützen. Um festzustellen, ob sich staatlicher Zwang in bezug auf solche Hilfspflichten überhaupt rechtfertigen läßt, erörtert der Beitrag das Recht des Kindes auf Fürsorge und Ausbildung als das eine und einzige angeborene sozio-ökonomische Recht, das Kant akzeptiert. Freilich ist das Recht des Kindes ein Recht gegen seine Eltern und nicht gegen den Staat. Gleichwohl nimmt Kant an, daß der Staat Einrichtungen schaffen sollte, die für verlassene Kinder und für die Armen im allgemeinen zu sorgen haben. Der Beitrag untersucht die Rechtfertigung, die Kant für die Anwendung von staatlichem Zwang zur Durchsetzung solcher positiv-gesetzlicher Rechte gibt, und arbeitet die Gründe dafür heraus, warum der nicht tugendhafte Staatsbürger in die vorgesehenen Hilfsmaßnahmen für die Bedürftigen einwilligen könnte. Wenn sich die Verfechter von Hilfsmaßnahmen für die Bedürftigen außerstande sehen, ihre Vorschläge auf Gründe dieser Art zu stützen, dann werden sie mit einem Konzept von subjektivem Recht aufwarten müssen, das sich von dem Konzept Kants von Recht und Rechtslehre , bei dem es allein um die moralische Erlaubtheit von Zwangsmaßnahmen geht, ganz erheblich unterscheidet. Searching for that spirit within is what it's all about for me—whether best expressed through the tilt of the head, The curve of a wrist or through an expression in the eyes. For many years I have kept a sketch pad and pen, or charcoal, In a separate purse, just in case something or someone of interest might appeal to me, (...) To draw as I pass the time, In doctors' offices, airports and bus stations, places where I seem to be spending more of my time, waiting for my number to be called. It occurred to me these were ideal opportunities to people watch—opportunities for a moment in time to be captured, To be revealed—before he, she or they became conscious of being watched. If I feel that anyone is puzzled by my staring, or made uncomfortable by my intrusion, I wave a hand, turn the sketch toward them, and share what I am doing. Once, at the airport, I saw a toddler who had fallen sound asleep in his chair. I asked the father if I could sketch his son. He acquiesced, with one caveat: "Don't wake him up." After 15 minutes, simultaneously, I finished, The child woke up, And The announcement came over the PA system. Time to get in line. Trying to convey what seems to be special about a person—it takes awhile to see what I want to record. But in these sketches I look for what speaks to me, when I am not making an effort to get a likeness, and am led by JOY. Segundo de uma série de três artigos que visam a analisar a utilização do discurso alegórico – em sua vertente alegórica e hermenêutica – em três obras de José Saramago: Memorial do convento, Manual de pintura e caligrafia e O evangelho segundo Jesus Cristo. Neste segundo ensaio, enfocaremos a visão clássica sobre alegoria e metáfora, destacando as três qualidades básicas para a “boa mímeses” – a brevidade, a clareza e a verossimilhança – e os fines da alegoria retórica, os quais (...) eram determinados em função da maior ou da menor clareza existente entre sentido literal e figurado. Analisaremos ainda as diferenças estabelecidas pela Retórica clássica entre tota allegoria, permixta apertis allegoria e mala affectatio, considerando ainda como o Maneirismo e o Barroco, inverteram esses valores e de que modo o Memorial do Convento e o Manual de Pintura e Caligrafia, de José Saramago, resgatam a concepção barroca da alegoria construtiva ou retórica.
