The present analysis of the evolution of the concept of freedom in Ernst Tugendhat’s philosophy aims to highlight several interesting facts. First, Tugendhat attempts to describe the meaning of Kant’s statement “I could have acted otherwise” from a non-transcendental perspective. Second, he makes an effort to avoid the classical Kantian dilemma of the relation of free will and determinism by posing the question differently. Third, he situates the issue of the relation of freedom and causality in the framework of the (...) inner structure of freedom – examining it from the perspective of the human’s relation to him- or herself. Fourth, he attempts repeatedly to overcome the impossibility of considering freedom in the objective language of causality. The paper demonstrates why the issue of freedom remains a central problem of continental philosophy. (shrink)

Heidegger’s interpretation of Husserl’s Logical investigations as presented in his lectures History of the concept of time: Prolegomena was a remarkable contribution in the development of phenomenology: First, Heidegger starts with the interpretation of intentionality and his considerations become thus methodologically transparent . Second, Heidegger managed to answer the question: Why is Husserl’s phenomenology the philosophically decisive alternative when compared to the domination of reflexive consciousness and logical judgment in modern philosophy? It is because concepts are not the representations of (...) things any more; as the “states of things” they are explicit expressions of an implicitly given meaning . Third, Heidegger’s interpretation includes the fundamental question of being in its three meanings , due to which the status of the explanation of “reality” changes as well. (shrink)

Diese Arbeit untersucht das Verhältnis zwischen dem frühen Heidegger und seiner Kantinterpretation. Der Schwerpunkt liegt auf den Rückbezügen seiner Aussagen zu Kant und auf der Analyse der Endlichkeit in Sein und Zeit. Diese «Gewalttat» ist geleitet von dem Bemühen, in der entwerfenden Einbildungskraft die modale Differenz von Eigentlichkeit/Uneigentlichkeit einerseits und ihre zeitliche Fundierung andererseits unterzubringen. Die kritische Auseinandersetzung mit Heideggers Kantbuch führt zu der Frage, ob das Konzept der Zeitlichkeit der Zeit die Hauptaufgabe seiner Kantinterpretation erreichen kann: den Abschied vom (...) Ganzen aufgrund der eigentlichen Zeitigung der Zukunft zu verhindern. Konsequent gelangt die Arbeit zu dem Resultat: Heideggers Kant setzt in einer näher nicht erklärten Weise voraus, daß der Sinn des unverfügbaren Seins mit dem Seinssinn des je einzelnen Daseins in einer durchsichtigen Identität erschlossen liegt. The vast majority of research in nursing ethics over the last decade indicates that nurses may not be fully prepared to ‘deliver the good(s)’ for their patients, or to contribute appropriately in the wider current health care climate. When suitable research projects were evaluated for this article, one key question emerged: if nurses are educationally better prepared than ever before to exercise their ethical decision-making skills, why does research still indicate that the expected practice-based improvements remain elusive? Hence, a number (...) of ideas gleaned from recent research about the current nature of nursing ethics, and especially teaching nursing ethics to student nurses, are analysed and critiqued in this article, which concludes with a cluster of ideas and conclusions based on that analysis. It is hoped that such a review may serve as a catalyst for nurse educators to re-examine their teaching practices with a view to enhancing good (i.e. ethical) nursing practice through educational means. Background: Moral distress has been described as a major problem for the nursing profession, and in recent years, a considerable amount of research has been undertaken to examine its causes and effects. However, few research projects have been performed that examined the moral distress of an entire nation’s nurses, as this particular study does. Aim/objective: The purpose of this study was to determine the frequency and intensity of moral distress experienced by registered nurses in New Zealand. Research design: The research (...) involved the use of a mainly quantitative approach supported by a slightly modified version of a survey based on the Moral Distress Scale–Revised. Participants and research context: In total, 1500 questionnaires were sent out at random to nurses working in general areas around New Zealand and 412 were returned, giving an adequate response rate of 27%. Ethical considerations: The project was evaluated and judged to be low risk and recorded as such on 22 February 2011 via the auspices of the Massey University Human Ethics Committee. Findings: Results indicate that the most frequent situations to cause nursing distress were (a) having to provide less than optimal care due to management decisions, (b) seeing patient care suffer due to lack of provider continuity and (c) working with others who are less than competent. The most distressing experiences resulted from (a) working with others who are unsafe or incompetent, (b) witnessing diminished care due to poor communication and (c) watching patients suffer due to a lack of provider continuity. Of the respondents, 48% reported having considered leaving their position due to the moral distress. Conclusion: The results imply that moral distress in nursing remains a highly significant and pertinent issue that requires greater consideration by health service managers, policymakers and nurse educators. Questions concerning the proof-theoretic strength of classical versus nonclassical theories of truth have received some attention recently. A particularly convenient case study concerns classical and nonclassical axiomatizations of fixed-point semantics. It is known that nonclassical axiomatizations in four- or three-valued logics are substantially weaker than their classical counterparts. In this paper we consider the addition of a suitable conditional to First-Degree Entailment—a logic recently studied by Hannes Leitgeb under the label HYPE. We show in particular that, by formulating the theory (...) PKF over HYPE, one obtains a theory that is sound with respect to fixed-point models, while being proof-theoretically on a par with its classical counterpart KF. Moreover, we establish that also its schematic extension—in the sense of Feferman—is as strong as the schematic extension of KF, thus matching the strength of predicative analysis. (shrink)

Psychologists and philosophers have assumed that psychological knowledge is knowledge about, and held by, the individual mind. _Psychological Knowledge_ challenges these views. It argues that bodies of psychological knowledge are social institutions like money or the monarchy, and that mental states are social artefacts like coins or crowns. Martin Kusch takes on arguments of alternative proposals, shows what is wrong with them, and demonstrates how his own social-philosophical approach constitutes an advance. We see that exists a substantial natural amount (...) of philosophical theorising, a body of work that tries to determine the nature and structure of folk psychology. A mainstay of stakeholder management is the belief that firms create value when they invest more time, money, and attention to stakeholders than is necessary for the immediate transaction. This tendency to repeat interactions with the same set of stakeholders fosters what we call stakeholder friction. Stakeholder friction is a term for the collection of social, legal, and economic forces leading firms to prioritize and reinvest in current stakeholders. For many stakeholder scholars, such friction is close to universally beneficial, but (...) the associated costs—to both the firm and legitimate stakeholders—have been underspecified. Failure to account for the effects of stakeholder friction can cause managers to under-allocate attention and value to some legitimate stakeholders and to over-allocate attention and value to current stakeholders. We examine the concept of stakeholder friction and elaborate on three exemplar sources of friction prominent in the stakeholder literature. This is followed by an analysis of investments in stakeholder relationships and a consideration of the implications of stakeholder friction on the ability of firms to prioritize stakeholders. The tendency to reinvest in current stakeholders has, in addition to the oft-discussed benefits, a predictable downside. (shrink)

Prior research has demonstrated a strong relationship between team performance and team members’ team efficacy beliefs and perceptions of social integration. Performing well increases the feelings of collective ability that comprise team efficacy and the feelings of psychological connectedness that make up social integration, while performing poorly erodes them. In this article, we draw from the social cognitive base of ethical leadership theory to argue that ethical leadership moderates the relationship between team performance and team efficacy beliefs, and between team (...) performance and social integration, such that these important team attitudes are buffered against the negative effects of poor performance when leaders act ethically. Alternatively, when leaders act less ethically, team efficacy and social integration break down following poor performance. We test our hypotheses in a field study of U.S. military teams actively engaged in competition. The data support our arguments. We find that ethical leadership weakens the relationships among team performance and team efficacy and social integration, respectively, such that ethical leaders preserve team efficacy and social integration when their teams do not perform well. Euthanasia and physician-assisted suicide are common practice in the Netherlands. In response to increasing requests from patients to end their lives, physicians are finding themselves placed in particularly precarious situations because of advance directives written by patients suffering from severe dementia. In April 2020, the Supreme Court of the Netherlands issued two judgments in the so-called Dormicum case: a case involving the deliberate termination of the life of a 74-year-old woman suffering from advanced dementia by a geriatrician in a nursing (...) home in The Hague. The judgment of the lower criminal court was upheld, but the sanction imposed by the appellate disciplinary court was quashed. In this paper, the author reviews the two Supreme Court rulings, argues that both are fundamentally flawed and raises questions as to what they mean for Dutch criminal law, physicians, and patients going forward. The idea that the changing entropy of a system is relevant to explaining why we know more about the system's past than about its future has been criticized on several fronts. This paper assesses the criticisms and clarifies the epistemology of the inference problem. It deploys a Markov process model to investigate the relationship between entropy and temporally asymmetric inference.

Based on Moscovici’s classical study on the cultivation of psychoanalytic ideas in France in the 1950’s and our own research on modern biotechnology, we propose a paradigm for researching social representations. Following a consideration of the nature of representations and of the ‘iconoclastic suspicion’ that haunts them, we propose a model of the emergence of meaning relating three elements: subjects, objects, and projects. The basic unit of analysis is the elongated triangle of mediation : subject 1, object, project, and subject (...) 2, captured in the image of a ‘Toblerone’. Such social units cultivate, that is produce, circulate and receive representation which may be embodied in four modes–habitual behaviour, individual cognition, informal communication and formal communication–and in three mediums–words, visual images or non-linguistic sounds. We propose an operational definition of a ‘social representation’ as the comparison of four characteristics of communication systems: the content structures , the typified processes , and their functions , within the context of segmented social milieus. Seven implications for research on social representations are outlined: content and process; segmentation by social milieus rather than taxonomies; cultivation studies within social milieus; multi-method analysis; time structures and longitudinal data; the crossover of cultural projects and trajectories; the disinterested research attitude. This ideal type paradigm leads to an operational clarification to identify new research questions, and to guide the design and evaluation of studies on social representations. (shrink)

Nursing acts occur in thousands of instances daily, being a major component of professional health care delivery in institutions, communities and homes. It follows that the ethical practice of most nurses is put to the test on an everyday rather than an occasional basis. Hence, within nursing practice there must be a rich and deep seam of reflective interpretation and practical wisdom that is 'embedded' within the experiences of every experienced nurse. This article presents discussion on some of the main (...) findings of a recently completed study on nursing ethics in New Zealand. Increasingly, companies implement social and environmental standards as instruments towards corporate social responsibility (CSR) in supply chains. This is based on the assumption that such standards increase legitimacy among stakeholders. Yet, a wide variety of standards with different requirement levels exist and companies might tend to introduce the ones with low exigencies, using them as a legitimacy front. This strategy jeopardizes the reputation of social and environmental standards among stakeholders and their long-term trust in these instruments of CSR, meaning that (...) all expenses for their implementation are of no avail for the companies. Therefore, this paper highlights which criteria are important for the selection, implementation and improvement in order to achieve a company's aim, but also to strengthen the legitimacy of social and environmental standards. This research is based on conceptual thought and some existing empirical research, comparing four different social and environmental standards, revealing weaknesses and strengths. It exposes the basic conditions for the success of such standards among stakeholders and identifies the need for more empirical data. (shrink)

Scientific discoveries are often to some degree influenced by luck. Whether luck’s influence is at odds with common-sense intuitions about responsibility, is the central concern of the philosophical debate about moral luck. Do scientists acknowledge that luck plays a role in their work and – if so – do they consider it morally problematic? The present article discusses the results of four focus groups with scientists, who were asked about their views on luck in their fields and its moral implications. (...) The participants underscored circumstantial luck as a key dimension of luck in science. Nevertheless, most participants insisted that there are ways of executing ‘control’ in science: They believe that virtues and skills can increase one’s chances for success. The cultivation of these skills and virtues was considered a reasonable ground for pride. Prizes and rewards were rarely tied to personal desert, but instead to their societal function. (shrink)

According to both traditional positivist approaches and also to the sociology of scientific knowledge, social analysts should not themselves become involved in the controversies they are investigating. But the experiences of the authors in studying contemporary scientific controversies—specifically, over the Australian Animal Health Laboratory, fluoridation, and vitamin C and cancer—show that analysts, whatever their intentions, cannot avoid being drawn into the fray. The field of controversy studies needs to address the implications of this process for both theory and practice.

Among the most promising options for vindicating Oppenheim and Putnam’s unity of science hypothesis is the ‘Mentaculus’ of Albert and Loewer. I assess whether this promise can be borne out. My focus is on whether the Mentaculus can deliver what Oppenheim and Putnam call the ‘unity of laws’: the reduction of special science laws to the laws of fundamental physics. I conclude that although the Mentaculus may support a fairly strong form of reductionism, it falls short of upholding the unity (...) of laws. (shrink)

Die nicht-intendierten Folgen menschlichen Handelns hingegen sind das Kardinalproblem der Geschichtsphilosophie, die nach dem Sinn, mitunter auch nach dem Ziel der Geschichte fragt. Die Anthropologie schliesslich sucht anzugeben, was den Menschen jenseits seiner Geschichte ausmacht. Der unhistorische Charakter der Anthropologie einerseits sowie das unvollstandige Menschenbild traditioneller Geschichtsphilosophien andererseits schienen eine gegenseitige Verstandigung bislang auszuschliessen.Die Psychoanalyse, an der Schnittstelle von Natur- und (...) Boarding school is a major educational option for many students (e.g., students living in remote areas, or whose parents are working interstate or overseas, etc.). This study explored the motivation, engagement, and achievement of boarding and day students who are educated in the same classrooms and receive the same syllabus and instruction from the same teachers (thus a powerful research design to enable unique comparisons). Among 2,803 students (boardingn= 481; dayn= 2,322) from 6 Australian high schools and controlling for background (...) attributes and personality, we found predominant parity between boarding and day students in their motivation, engagement, and achievement. We also found that classroom-average motivation, engagement, and achievement was not significantly affected by the number of boarders (relative to day students) in the classroom. In addition, the effects of boarding were generally not moderated by students’ background or personality attributes. We conclude that boarders have academic opportunities and outcomes that are comparable to their day student counterparts. Implications for students, teachers, and parents are discussed. (shrink)

A recent article in this Journal argued that insider trading is an unethical practice leading to an inefficiently functioning market. The debate on this topic has primarily pitted ethical defenses of prohibition against economic arguments extolling its allowance. In addition to being incomplete, this approach ignores other unwanted economic effects of prohibition itself and unethical implications of its existence. This article shows that Adam Smith's free market concept, when properly interpreted, provides all the incentive structure necessary for an efficient and (...) ethical marketplace even when insider trading is permitted. Jan Patočka's “Galileo Galilei and the End of the Ancient Cosmos” was initially published in the popular science journal Vesmír, 33 (1954), no. 1, pp. 27–29. The year before, there had been published in the same journal, under the general heading “On the Development of the Ideas of Natural Science,” a series of Patočka’s articles, including “The First Critics of Aristotelianism” [Vesmír 32 (1953), no. 7, pp. 254–256]; “The Breakdown of Aristotle’s Dynamics and the Prelude to Modern Mechanicism” (ibid., no. (...) 8, pp. 285–287); “Intermezzo on the Threshold of Modern Science: Cusanus and Comenius” (ibid., no. 9, pp. 322–325). This series had been introduced by yet another text: “Aristotle’s Philosophical Natural Science” [Vesmír 32 (1953), no. 3, pp. 102–105]. A last short essay on the theme of the birth of modern natural science—“On the Significance of Francis Bacon of Verulam” [Vesmír 40 (1961), no. 5, pp. 152, 155, and no. 6, pp. 186–188]—followed several years later.
