This paper aims to stablishes the sense in which propositions included under the perceptual use of ‘seeing-as’, developed by Wittgenstein in the Second Part of Philosophical Investigations, are justifiable from an epistemic point of view. To do this, first, it will be clarified the internal link between ‘visual experience’ and ‘interpretation’ for the type of mentioned cases. Second, it will be shown how the ‘seeing-as’ respects the rule-following paradox’s solution, as long as it does not presuppose any intermediary or need (...) anyone to account for what is perceived, highlighting the notions of ‘practice’, ‘familiarity’ and ‘context’ common both in the aforementioned solution and in the ‘seeing-as’ cases. Third, the general distinction between certainties or ‘hinges’ and ‘epistemic propositions’ presented by Wittgenstein in On Certainty will be applied to cases of aspect perception as a possible field of application of the so called Hinge Epistemology, showing how, in specific cases, the perceptual certainties that shape our way of life and that are groundless, can be recontextualized and merit reasonable justification.Keywords: Wittgenstein, aspect perception, seeing-as, hinges, certainty, justification. The object of this essay is to explore the central role played by the ‘ethic of care’ in debates within and beyond feminist legal theory. The author claims that the ethic of care has attracted feminist legal scholars in particular, as a means of resolving the theoretical, political and strategic difficulties to which the perceived ‘crisis of subjectivity’ in feminist theory has given rise. She argues that feminist legal scholars are peculiarly placed in relation to this crisis because of their (...) reliance on the social ‘woman’ whose interests are the predominant concern of feminist legal engagement. With the problematisation of subjectivity, the object of feminist legal attention disappears and it is in attempts to deflect the negative political consequences of this that the ethic of care has been invoked, the author argues, unsuccessfully. The essay concludes with suggestions as to how the feminist project in law might proceed in the wake of the crisis of subjectivity and the failure of the ethic of care to resolve it. (shrink)

El debate en torno a Aristipo de Cirene, cuya concepción de la felicidad coloca en el centro de la escena al placer, pone en tela de juicio las afirmaciones propias de aquellas éticas nucleadas bajo el epíteto de eudemonistas. Con el desplazamiento de la felicidad del sitial del fin, Aristipo reformula la dimensión ética tradicional: a través del ejercicio de la enkráteia, y lejos de caer en un relativismo subjetivista, intenta construir una ética que tenga como base un objetivismo gnoseológico. (...) Demostraremos, además, que al ejercicio de la enkráteia cirenaica subyace la noción de autosuficiencia ( autárkeia ) –entendida en términos aristotélicos– del individuo . Esto nos enfrentará, irremediablemente, a la noción aristotélica de felicidad (en estrecho vínculo con la noción de enkráteia ), la cual no comporta una noción de autosuficiencia individual sino que restringe la posibilidad de la autárkeia a la autosuficiencia de la pólis. L’oxymore d’« art apophatique » nous sert ici pour envisager la spécificité de l’icône au-delà des mystifications dont elle fait souvent l’objet. L’art byzantin pourrait être entendu « en négations » par rapport à ce qui fut instauré comme principe esthétique à l’Occident depuis le temps de la Renaissance. En essayant de l’illustrer à travers cette juxtaposition, on constate toutefois que l’attitude « apophatique » loge au cœur de l’esthétique byzantine, conditionnant la vie des formes, ainsi que son socle théorique. Nas últimas décadas, a desconstrução do paradigma antropocêntrico colocou questões como a exploração animal no centro dos debates éticos e meta-éticos modernos. Este tema tem sido o foco de atenção também no âmbito dos estudos Kantianos. À luz das diferenças fundamentais entre seres humanos e animais e da impossibilidade posta pela teoria de Kant de atribuir deveres diretos aos animais, tornar sua filosofia prática útil para a defesa do bem-estar animal parece uma tarefa impossível. A esta dificuldade soma-se a crítica (...) de que uma teoria baseada em princípios universais e deveres individuais pode ser inadequada para lidar com o bem-estar animal sob considerações culturais e situacionais. Ao abordar estes desafios, pretendo mostrar que a filosofia prática de Kant fornece recursos valiosos para a defesa do bem-estar animal. Neste espírito, eu sustento que, embora limitado, o tratamento de Kant acerca do auto-engano é uma forma promissora de fazer a ponte entre o bem-estar animal e o ethos da sua teoria moral. (shrink)

Xavier Zubiri y Leonardo Polo son partidarios del realismo gnoseológico. Ambos reflexionan sobre lo que es propio del acto cognoscitivo, en cuanto acto cognoscitivo. Zubiri afirma que conocer es actualización de realidad, pues en el conocer está presente la actualidad de la realidad, no de modo intencional, está como realidad en su estricto de suyo. La superación del objeto se da por la riqueza en que queda la realidad actualizada, en su contenido y su formalidad. Para Polo, lo propio del (...) acto cognoscitivo es ser operación, praxis perfecta o inmanente, co-actualidad de acto y objeto; pero la presencia propia del objeto manifiesta su límite desde el conocimiento habitual. This paper has arisen from my interest in questions ofsubjectivity of primary concern to contemporaryfeminist jurisprudence. Rather than side with anyparticular view represented in the debates surroundingthese questions, I have used Foucault's concept ofepisteme to explore the tradition of feministlegal thought. By focusing upon seventeenth-centurywomen's writings in which the earliest statementslinking law to women's oppression are to be found, thepaper argues that knowledge claims about law'sassociation with women's oppression are predicated notupon the positing of a sovereign feministconsciousness, but upon the (...) specific positivities ofknowledge which existed at the time. Theunderstanding of the birth of the feminist legaldiscourse in terms of the specific conditions of itspossibility, although historically contextualised,raises questions about the hitherto seeminglyunassailable adherence to subjectivist epistemologywhich the current feminist engagement with lawmaintains. The aim of this chapter is to explore the relationship between metaphor and reasoning, by claiming that argumentation might act as a bridge between metaphor and reasoning. Firstly, the chapter introduces metaphor as a framing strategy through which some relevant properties of a source domain are selected to understand a target domain. The mapping of properties from the source to the target domain implicitly forces the interpreter to consider the target from a specific perspective. Secondly, the chapter presents metaphor as (...) an implicit argument where some inferences can be drawn from the comparison between the source and the target domain. In particular, this chapter aims to understand whether and to what extent such an argument might be linked to analogical reasoning. The chapter argues that, in case of faulty analogy, this kind of argument might have the form of a quaternio terminorum, where metaphor is the middle term. Finally, the chapter presents the results of an experimental study, aiming to test the effect of the linguistic nature of the middle term on the detection of such faulty analogy. The chapter concludes that a wider context is needed to make sense of an analogical argument with novel metaphors, whilst in a narrow context, a lexicalised metaphor might be extended and the overall argument might be interpreted as metaphoric. How do we measure economic growth? In the eighteenth century, well before the birth of Gross Domestic Product commonly used today, looking at the sign of the balance of trade was a way to take the pulse of a nation's economy. Adam Smith rejects this measure and instead suggests that we should look at population growth. Nations that are able to produce enough to support the life of a growing population have growing economies, nations with constant population have stagnant economies, (...) and nations that face a declining population have contracting economies. Thus, population for Adam Smith is a proxy for our Gross Domestic Product, indicating the changes in production in a country over time. (shrink)

This work provides an analysis of the basic cognitive components of envy. In particular, the roles played by the envious party's social comparison with, and ill will against, the better off are emphasised. The ill will component is characterised by the envier's ultimate goal or wish that the envied suffer some harm, and is distinguished from resentment and sense of injustice, which have often been considered part of envy. The reprehensible nature of envy is discussed, and traced back to the (...) analysis of its components. Finally, we explore both points of overlap and distinguishing features between envy and other emotions such as jealousy or emulation, and make a few general remarks, pointing to the necessity of overcoming conceptual looseness in the notion of envy. En este trabajo critico la interpretación moralizada de la obligación política en Hobbes que defiende Luciano Venezia. Exploro una lectura diferente que evita una dicotomía tajante entre las razones prudenciales y las razones morales y subraya en cambio la discontinuidad entre la normatividad subjetiva de la ley natural y la normatividad objetiva de la ley positiva. Sostengo que el contrato de sujeción política establece obligaciones objetivas recién cuando el soberano exige el cumplimiento de los contratos. La obligación política es entonces (...) una forma de obligación jurídica. Además, enfatizo que la comunidad moral de Hobbes solo es posible dentro del Estado. In this paper, I criticize Luciano Venezia's moralized interpretation of the Hobbesian concept of political obligation. I explore a different reading that avoids a clear-cut dichotomy between prudential and moral reasons and underscores instead the discontinuity between natural law's subjective normativity and civil law's objective normativity. I contend that the pact of political subjection establishes objective obligations only when the sovereign requires the fulfillment of contracts. Political obligation is then a form of legal obligation. In addition, I emphasize that Hobbes's moral community is only possible within the State. (shrink)

In this paper, I aim at explaining the difference Kant makes between emotion, the beautiful and the sublime. I begin by explaining what an emotion is, showing that it refers to feelings that are related to desire. In contrast, I show that the feeling of beautiful and the sublime give us an inactive delight, that is not related to an interest in the object. The feeling of beautiful is related to the judgment of taste, and it has a universal validity (...) for everyone. I ask then if we can judge art without any emotion at all. According to Kant, not only one can, but one should, since pure judgment of taste is independent from charm and commotion. At the end, I ask if it is possible to enjoy music without emotion. For a lover of music, perhaps the emotion it provokes is the main reason to like it. I show that this is probably the reason why music is considered to have the last place in the beautiful arts for Kant. (shrink)

Leibniz's repeated interventions in the Trinitarian polemics widespread throughout Europe in the seventeenth and eighteenth centuries cannot merely be read as scholastic exercises or concessions to the conventions of his time. On the contrary, they involved reflection on issues fundamental to Leibniz's philosophical doctrines: issues such as the relationship between faith and reason, the limitations of the human intellect and the various grades of human knowledge, and the significance of the ' analogia Trinitatis' reconsidered in light of the concept of (...) harmony. This paper concentrates on the writings of the young Leibniz before his visit to Paris and aims to examine the role played by contemporary discussions concerning the Trinity and the Incarnation in the formation of Leibniz's thought. Some business schools have come under considerable criticism for what observers see as their complicit involvement in the corporate scandals and financial crises of the last 15 years. Much of the discussion about changes that schools might undertake has been focused on curriculum issues. However, revisiting the curriculum does not get at the root cause of the problem. Instead, it might create a new challenge: the risk of decoupling the discussion of the curriculum from broader issues of institutional purpose. In (...) this article, we argue that the most pressing need facing business schools is not to teach new courses to be responsive to social demands and stay relevant. Instead, it is to revisit their basic mission—the principles and beliefs on which they were founded—and then to re-evaluate their curriculum design choices in this light. We contrast the Spartan and Athenian educational paradigms as a way of shedding light on the nature of a coherent response. (shrink)

Numerosas expresiones lingüísticas son producidas por los profesionales de las áreas de la Educación y Psicología para designar al sujeto con discapacidad. Nuestra mirada se centró en los discursos que se balizan en un lenguaje analítico y heurístico perteneciente al universo de la normalidad de la razón analítica. En contra de esta propuesta dialogamos con Wittgenstein sobre producción de sentido y de Vygotsky sobre mediación semiótica. Palabras claves: producción de sentido; mediación semiótica, discapacidad, inclusión.

El epistolario del filósofo argentino Francisco Romero (Sevilla, 1891 - Buenos Aires, 1962) con colegas y discípulos de Chile y con extranjeros afincados voluntariamente o no en ese país, constituyó una notable red intelectual en torno al conocimiento de América, entre 1934 y 1962. La construcción del americanismo filosófico fue una de las preocupaciones aglutinantes, y las reflexiones que se produjeron se entroncaron con las circunstancias políticas, ideológicas, sociales, culturales y económicas de cada uno de sus miembros. The correspondence of (...) the argentine philosopher Francisco Romero (Seville, 1891 - Buenos Aires, 1962) with colleagues and disciples of Chile and foreign voluntarily or not settled in that country, constituted a remarkable intellectual network in the knowledge of America, between 1934 and 1962. The construction of Philosophical Americanism was a central concern, and reflections that occurred were connected with political, ideological, social, cultural and economic circumstances of each member. The article investigates the evolution of views of a prominent Ukrainian philosopher S. Krymskyi proceeding from logics and methodology of science to philosophy of culture and spirituality.

The starting point of this paper is that both J Rawls's work "A theory of Justice" and feminist theory have contributed greatly to the revival of the moral and political philosophy. My aim here is to show the relationships between Rawls's and feminist theories, and particularly to analyze feminist criticism of "justice as fairness" in the context of a more general study on contemporary theories of justice and on the relevance of justice in feminist theories.

O artigo percorre argumentos presentes na obra de Lélia Gonzalez que justificam sua importância na formulação de uma perspectiva original interpretação da formação social do Brasil. Nesse sentido, sugere-se um percurso analítico a partir de diferentes textos da autora que traduzem seus vínculos teóricos e interesses especulativos. Marxismo, teoria social e psicanálise são eixos estruturais do pensamento de Gonzalez, em função dos quais procura-se evidenciar as contribuições dessa intelectual amefricana sobre a formação social do Brasil enquanto um campo aberto de (...) estudos. This article sheds light on the European Union’s policy on citizenship; on the collective dimension of this policy, its ‘we’. It is argued that the inclusive, identity-constituting forces prominent in EU policy on European citizenship serve as a basis for the exclusion of people, which is illustrated by the recent expulsion of Romani from France. Based on a reading of Derrida, the twofold aim of this article is to reformulate the concept of a European citizenship ‘we’ and secondly, to outline (...) some implications of this reframing as concerns the role of education in the formation of citizens.
