'Ethics' was not developed as a separate branch of philosophy in Buddhist traditions until the modern period, though Buddhist philosophers have always been concerned with the moral significance of thoughts, emotions, intentions, actions, virtues, and precepts. Their most penetrating forms of moral reflection have been developed within disciplines of practice aimed at achieving freedom and peace. This Element first offers a brief overview of Buddhist thought and modern scholarly approaches to its diverse forms of moral reflection. IN THE LAST PART of the Theory of Moral Sentiments, Adam Smith puts his theory in a class with those of his contemporaries Francis Hutcheson and David Hume, namely, the systems that make sentiments the principle of approbation. Despite recognizing important differences with both of them, he thinks that since he has placed the origin of moral sentiments in sympathy, and in particular the fact that we are able to enter into the motives of the agent and get pleasure from (...) finding them appropriate to their cause, sentiments are the foundation of his theory of morals. Many of Smith’s commentators, in fact almost all of the most important studies over the last few years, reaffirm the author’s self-description. However, my aim in this paper is to challenge this view by showing that Smith’s system can also be plausibly seen as a theory of practical reasoning, and in some important aspects very similar to Aristotelian ethics. Surprisingly few scholars have seen this parallel. Laurence Berns, Samuel Fleischacker, Charles Griswold, and Gloria Vivenza are the latest exceptions, identifying several points of coincidence between Adam Smith and Aristotle’s ethics. None of them, however, has tied all these similarities under a unified interpretation, such as the one I propose here: The basic analogy between these theories, and the source of those particular coincidences, is the operation of practical reason. Moreover, and besides the common elements with Aristotle’s ethics, Smith’s reconstruction of practical reason simultaneously announces some of the main features of modern accounts of ethics, such as impartiality and universality as preconditions of moral judgment. The integration of these ancient and modern elements in a single coherent theory allows Smith’s TMS to overcome the insufficiencies and paradoxes of both these traditions, and it constitutes one of the most interesting and challenging proposals of modern ethics. La integración de la tecnología en el ámbito del derecho penal plantea desafíos significativos debido a la falta de regulación de la inteligencia artificial (IA), lo que podría comprometer los derechos fundamentales. Este estudio se centra en abordar estos desafíos y proponer soluciones mediante un análisis exhaustivo de la situación actual y las posibles implicaciones de la IA en el sistema jurídico penal. El objetivo principal de esta investigación es analizar los problemas, desafíos y oportunidades que surgen con la implementación (...) de la inteligencia artificial en el ámbito penal. Se busca identificar la necesidad de una regulación específica para la IA en el derecho penal, con el fin de proteger los derechos fundamentales de las personas y garantizar un sistema jurídico justo y equitativo. Para abordar esta problemática, se adoptó un enfoque metodológico cualitativo. Se llevó a cabo una revisión bibliográfica detallada para examinar los antecedentes, problemas y desafíos asociados con la IA en los sistemas jurídicos, especialmente en el ámbito penal. Además, se realizaron análisis de criterios y opiniones de expertos en derecho para obtener una comprensión más profunda de la situación y las posibles soluciones. Los resultados de este estudio revelan la necesidad urgente de establecer una normativa específica para regular la aplicación de la inteligencia artificial en el ámbito penal. Se destaca que la falta de regulación representa un riesgo significativo para los derechos fundamentales, especialmente en lo que respecta a la configuración de delitos con el apoyo de la IA. Además, se identifican diferentes dimensiones que deben abordarse en la regulación, incluyendo principios y reglas básicas del derecho, supervisión humana de los sistemas de IA y la promoción de la innovación responsable en este campo. Este artículo subraya la importancia de establecer una regulación efectiva para la inteligencia artificial en el ámbito penal. Esta regulación no solo protegerá los derechos fundamentales de las personas, sino que también promoverá un uso responsable y progresivo de la IA como una herramienta valiosa para los profesionales del derecho. Es crucial que la regulación sea integral y adaptable para garantizar un sistema jurídico justo y equitativo en la era digital. (shrink)

El debate en torno a Aristipo de Cirene, cuya concepción de la felicidad coloca en el centro de la escena al placer, pone en tela de juicio las afirmaciones propias de aquellas éticas nucleadas bajo el epíteto de eudemonistas. Con el desplazamiento de la felicidad del sitial del fin, Aristipo reformula la dimensión ética tradicional: a través del ejercicio de la enkráteia, y lejos de caer en un relativismo subjetivista, intenta construir una ética que tenga como base un objetivismo gnoseológico. (...) Demostraremos, además, que al ejercicio de la enkráteia cirenaica subyace la noción de autosuficiencia ( autárkeia ) –entendida en términos aristotélicos– del individuo . Esto nos enfrentará, irremediablemente, a la noción aristotélica de felicidad (en estrecho vínculo con la noción de enkráteia ), la cual no comporta una noción de autosuficiencia individual sino que restringe la posibilidad de la autárkeia a la autosuficiencia de la pólis. Cheating and deception are terms often used but rarely defined. They summon up unpleasant connotations; even those deeply involved with cheating and deception rationalize why they have been driven to it. Particularly for Americans and much of Western civilization, official cheating, government duplicity, cheating as policy, and conscious, contrived deception, are all unacceptable except as a last resort in response to threat of extinction. As a distasteful tool, deception is rarely used to achieve national interests, unless in relation to the (...) deployment of military force. As an area of study, it has by and large been ignored.Intrigued by attitudes toward cheating and deception, the authors decided to analyze its roots, structure, and process. They asked fundamental questions: are there categories of deception, general steps in the process of deception, and ways to evaluate its results across time and in different modes? This book demonstrates the vast range of philosophical approaches, regional issues and problems, perspectives, and historical and theoretical frameworks that together constitute feminist philosophy in Latin America and Spain.This is important while feminist philosophy was long dominated by Anglo-American authors. It makes available recent feminist thought in Latin America and Spain to facilitate dialogue among Latin American, North American, and European thinkers.

In this paper, I examine the role played by the emotion of admiration in formulating moral judgments. First, I discuss whether and when admiration is a reliable source of moral knowledge, or, on the contrary, it misleads the subject, leaving her prey to forms of uncritical devotion to unworthy objects of admiration. To do so, I try to elucidate which underlying theory of emotions best allows one to characterize admiration as a reliable source of moral knowledge. Second, I introduce the (...) notion of transformative moral experience, understood as a subclass of transformative experiences, and I argue that it is precisely admiration that ensures the rationality of the choices made in such experiences. Finally, in light of this analysis, I show how admiration—together with the constellation of positive and negative emotions connected to the perception of moral exemplarity—acts as a central element for the maintenance of moral integrity. I defend, in particular, the idea that integrity should not be understood as mere coherence, nor as a static maintenance of the moral status quo, but as being firmly rooted in one’s own identity yet open to novelty and especially to the novelty represented by transformative moral experiences. Como respuesta a una práctica clínica cada vez más especializada, tecnologizada y cientificista, la medicina y la bioética buscan restituir el protagonismo a la experiencia del paciente. Para ello, cada vez más sectores dentro de la medicina y la bioética adoptan un marco teórico proveniente de la tradición hermenéutica o del giro narrativo. Ya no se interpretan sólo los síntomas fisiológicos y los resultados de laboratorio: al incorporar la voz del paciente, se busca considerarlo de manera íntegra, como un texto (...) a ser comprendido. No obstante, la heterogénea recepción de estas perspectivas, obstaculiza la retroalimentación entre teorías. Las que subrayan la arista narrativa dejan entrever un dualismo subyacente entre el cuerpo y el paciente, las capacidades técnicas e interlocutivas de los profesionales, y lo científico y lo narrable, y las que enfatizan la arista hermenéutica tienen inconvenientes a la hora de argumentar la aplicación de la teoría a la vida. En este trabajo, se sostiene que es preciso incorporar la dimensión retórica al horizonte teórico hermenéutico-narrativo en medicina y bioética. Se espera que el presente constituya un aporte a “lo no-dicho” en las definiciones que los especialistas en salud emplean de narrativa, hermenéutica y por supuesto, de texto. (shrink)

El epistolario del filósofo argentino Francisco Romero (Sevilla, 1891 - Buenos Aires, 1962) con colegas y discípulos de Chile y con extranjeros afincados voluntariamente o no en ese país, constituyó una notable red intelectual en torno al conocimiento de América, entre 1934 y 1962. La construcción del americanismo filosófico fue una de las preocupaciones aglutinantes, y las reflexiones que se produjeron se entroncaron con las circunstancias políticas, ideológicas, sociales, culturales y económicas de cada uno de sus miembros. The correspondence of (...) the argentine philosopher Francisco Romero (Seville, 1891 - Buenos Aires, 1962) with colleagues and disciples of Chile and foreign voluntarily or not settled in that country, constituted a remarkable intellectual network in the knowledge of America, between 1934 and 1962. The construction of Philosophical Americanism was a central concern, and reflections that occurred were connected with political, ideological, social, cultural and economic circumstances of each member. Valdivia, Geógrafo de profesión, quien pese a ser Chileno tuvo una corta instancia (en 1974) de desempeño laboral en nuestro país en el Centro de Investigación de Recursos Naturales, CIREN.
