In this article, the question is discussed if and how Healthcare Ethics Committees (HECs) should be regulated. The paper consists of two parts. First, authors from eight EC member countries describe the status quo in their respective countries, and give reasons as to the form of regulation they consider most adequate. In the second part, the country reports are analysed. It is suggested that regulation of HECs should be central and weak. Central regulation is argued to be apt to improve (...) HECs’ accountability, relevance and comparability. To facilitate biomedical citizenship and ethical reflection, regulation should at the same time be weak rather than strict. Independence of HECs to deliberate about ethical questions, and to give solicited and unsolicited advice, should be supported and only interfered with by way of exception. One exception is when circumstances become temporary adversarial to ethical deliberation in healthcare institutions. In view of European unification, steps should be taken to develop consistent policies for both Eastern and Western European countries. (shrink)

This paper examines the species problem in microbiology and its implications for the species problem more generally. Given the different meanings of ‘species’ in microbiology, the use of ‘species’ in biology is more multifarious and problematic than commonly recognized. So much so, that recent work in microbial systematics casts doubt on the existence of a prokaryote species category in nature. It also casts doubt on the existence of a general species category for all of life (one that includes both prokaryotes (...) and eukaryotes). Prokaryote biology also undermines recent attempts to save the species category, such as the suggestion that species are metapopulation lineages and the idea that ‘species’ is a family resemblance concept. Homeostatic Property Cluster (HPC) theory suggests that species and other biological taxa consist of organisms that share certain similarities. HPC theory acknowledges the existence of Darwinian variation within biological taxa. The claim is that “homeostatic mechanisms” acting on the members of such taxa nonetheless ensure a significant cluster of similarities. The HPC theorist’s focus on individual similarities is inadequate to account for stable polymorphism within taxa, and fails properly to capture their historical nature. A better approach is to treat distributions (...) of traits in species populations as irreducible facts, explained in terms of selection pressures, genealogy, and other evolutionary factors. We call this view Population Structure Theory (PST). PST accommodates the view, implicit in biological systematics, that species are identified by reference to particular historical populations. The goal of this essay is to assess the Selected-Effects Etiological Theory of biological function, according to which a trait has a function F if and only if it has been selected for F. First, I argue that this approach should be understood as describing the paradigm case of functions, rather than as establishing necessary and sufficient conditions for function possession. I contend that, interpreted in this way, the selected-effects approach can explain two central properties of functions and can satisfactorily (...) address some recent counterexamples. This reading, however, shows that there is only a partial overlap between biological functions and selected effects, so the former cannot be reduced to the latter. Finally, I maintain that this result is still compatible with a naturalistic theory of function that appeals to some evolutionary process. (shrink)

The thesis we develop in this essay is that all humans are endowed with a moral faculty. The moral faculty enables us to produce moral judgments on the basis of the causes and consequences of actions. As an empirical research program, we follow the framework of modern linguistics.1 The spirit of the argument dates back at least to the economist Adam Smith (1759/1976) who argued for something akin to a moral grammar, and more recently, to the political philosopher John Rawls (...) (1971). The logic of the argument, however, comes from Noam Chomsky’s thinking on language specifically and the nature of knowledge more generally (Chomsky, 1986, 1988, 2000; Saporta, 1978). If the nature of moral knowledge is comparable in some way to the nature of linguistic knowledge, as defended recently by Harman (1977), Dwyer (1999, 2004), and Mikhail (2000; in press), then what should we expect to find when we look at the anatomy of our moral faculty? Is there a grammar, and if so, how can the moral grammarian uncover its structure? Are we aware of our moral grammar, its method of operation, and its moment-to-moment functioning in our judgments? Is there a universal moral grammar that allows each child to build a particular moral grammar? Once acquired, are different moral grammars mutually incomprehensible in the same way that a native Chinese speaker finds a native Italian speaker incomprehensible? How does the child acquire a particular moral grammar, especially if her experiences are impoverished relative to the moral judgments she makes? Are there certain forms of brain damage that disrupt moral competence but leave other forms of reasoning intact? And how did this machinery evolve, and for what particular adaptive function? We will have more to say about many of these questions later on, and Hauser (2006) develops others. However, in order to flesh out the key ideas and particular empirical research paths, let us turn to some of the central questions in the study of our language faculty.. (shrink)

The goal of this essay is to put forward an original theory of artifact function, which takes on board the results of the debate on the notion of biological function and also accommodates the distinctive aspects of artifacts. More precisely, the paper develops and defends the Dual-Aspect Theory, which is a monist account according to which an artifact’s function depends on intentional and reproductive aspects. In this essay I argue that many nonhuman animal beings are conscious and have some sense of self. Rather than ask whether they are conscious, I adopt an evolutionary perspective and ask why consciousness and a sense of self evolved---what are they good for? Comparative studies of animal cognition, ethological investigations that explore what it is like to be a certain animal, are useful for answering this question. Charles Darwin argued that the differences in cognitive abilities and emotions among animals (...) are differences in degree rather than differences in kind, and his view cautions against the unyielding claim that humans, and perhaps other great apes and cetaceans, are the only species in which a sense of self-awareness has evolved. I conclude that there are degrees of consciousness and self among animals and that it is likely that no animal has the same highly developed sense of self as that displayed by most humans. Many animals have a sense of “body-ness‘ or “mine-ness‘ but not a sense of “I-ness.‘ Darwin’s ideas about evolutionary continuity, together with empirical data (“science sense‘) and common sense, will help us learn more about consciousness and self in animals. Answers to challenging questions about animal self-awareness have wide-ranging significance, because they are often used as the litmus test for determining and defending the sorts of treatments to which animals can be morally subjected. Due to their financial incentive, clinicians who earn income from a firm that markets medical devices, pharmaceuticals, tests, etc. might inappropriately prescribe their products or services. The Cleveland Clinic’s conflict of interest (CI) policy creates rules governing clinicians who accept compensation from outside firms that market products they prescribe or use in their practice (hereafter, covered financial relationships). The CI policy is implemented by the Innovation Management and Conflict of Interest Program (IM&COI) (hereafter the Committee).

Shaun Gallagher and Dan Zahavi have recently argued against a simulationist interpretation of neural resonance. Recognizing intentions and emotions in the facial expressions and gestures of others may be subserved by e.g. mirror neuron activity, but this does not mean that we first experience an intention or emotion and then project it onto the other. Mirror neurons subserve social cognition, according to Gallagher and Zahavi, by being integral parts of processes of enactive social perception. I argue that the notion of (...) enactive social perception does not yet explain why social perception is subserved by mirroring. I also argue that this problem cannot be avoided by means of an appeal to multiple realization. Instead, I propose a holistic model of neural resonance-based social cognition that does give an explanatory role to mirroring by allowing for a partial experiential overlap between experiencing and recognizing emotions and intentions. This account avoids the simulationist step-wise conception of social cognition and recognizes the qualitative difference between first- and third-person emotion and intention attribution. It does capture too much of the simulationist intuitions, however, to warrant the label ‘social perception’. (shrink)

Structured around Charles S. Peirce's three-fold categorical scheme, this article proposes a comparative study of Ayn Rand and Peirce's realist views in general metaphysics. Rand's stance is seen as diverging with Peirce's argument from asymptotic representation but converging with arguments from brute relation and neutral category. It is argued that, by dismissing traditional subject-object dualisms, Rand and Peirce both propose iconoclastic construals of what it means to be real, dismissals made all the more noteworthy by the fact each chose to (...) ground them in indissoluble triads of self-evident first principles. The present essay on the being of the sensible investigates the individuation of intensity differentials. This is Deleuze's theme in the fifth chapter of Difference and Repetition, where he places individuation in the context of his ‘transcendental empiricism’. The mechanisms of subjectivation are conceived as spatially-temporally determined actualisations (of the virtual) whose implicit intensity relations are neither accessible empirically nor are they governed by transcendental conditions (in the conventional sense). "Representation" is one of those Janus-faced terms that seems blatantly obvious when used in a casual or pre-theoretic manner, but which reveals itself far more slippery when attentively studied. Any allusion to "metarepresentation", it would then seem, only compounds these difficulties. Taking the metarepresentationalist framework in its roughest outline as our point of departure, we thus articulate four key "structural" features that appear binding for any such theory.

The federal government indirectly subsidizes the pharmaceutical industry by funding basic research, various tax credits and deductions, patent rules, grants of market exclusivity, and other means, in order to spur drug development, promote public health, and improve medical care. But today, the pharmaceutical industry often neglects these goals and sometimes even undermines them, due to what Lawrence Lessig refers to as institutional corruption — that is, widespread or systemic practices, usually legal, that undermine an institution’s objectives or integrity. A key (...) source of institutional corruption is improper dependence by the institution or its key actors on the actions of third parties that have fundamentally different interests. It is the health care system’s improper dependency on pharmaceutical firms that allows them to displace some public policy goals and to compromise the attainment of others. (shrink)

In recent years, there has been an increasing interest on the notion of freedom as non-domination, according to which a subject is free to the extent that no agent has the capacity to arbitrarily interfere on his actions. Now, the most common way of interpreting the notion of freedom as non-domination restricts its applicability to cases where particular agents can intentionally and arbitrarily interfere on a subject�s affairs. In this paper, I present an argument which shows that the standard conception (...) of freedom as non-domination is too restrictive, and that this notion can be extended so as to as to ground a critical point of view on economic and social inequalities. Recent scholarship on the idea of communism leads to questions of organization and what Michael Hardt refers to as “the problem of leadership.” Beyond the critical assessment of the crises of contemporary capitalism, and beyond the existing social democratic solutions, a psychoanalytically-informed Žižekian notion of the party offers solutions to ultra-left theories of networked horizontalism as well as versions of the party that repeat the problems of communist modernism. If the context of climate change, economic inequality and political authoritarianism require (...) that we reconsider “what is to be done” about global neoliberal capitalism, then the idea of the political party, understood in terms of Jacques Lacan’s Discourse of the Analyst, can provisionally occupy the place of a neutral knowledge of the objective demands of history that is premised on the experiences of the emancipatory left. Like the Analyst, the party does not stand in for or represent the people. However, through the fetishistic aspect of representation, as opposed to materially or ontologically-grounded guarantees for political power, the party registers a minimal difference from a technocratic University Discourse and an ultra-left Discourse of the Hysteric. This paper explores the biographical and cultural sources that inspired the decision of Janusz Korczak to make his life’s vocation the education of young children from dysfunctional families. This decision emerged out of the radical version of humanism he embraced. His identification of children as the population his humanist ethos must serve, distinguishes it from other versions of humanism. The paper explores the role his sense of self and his identification with Poles, Jews, and humanity play in the composition of (...) this humanism. It identifies the hybridity of his cultural identifications as its heart. It proposes that the tensions between these identifications in general, and his non-Jewish Jewish identification that situated him as being ‘a part of’ and ‘apart from’ Polish society in particular, induced Korczak to create a universal religion of children in which religious, ethnic, or physical distinctions do not generate prejudice, intolerance, and violence. Joseph Cardinal Ratzinger’s description of the Church as a creative minority provides the starting point. This paper investigates the communal, obedient practice of diaspora peacemaking from multiple and overlapping theological perspectives, including Biblical narratives of diaspora and of Babel, a comparison of political exile and critical exile, and diaspora peacemaking as a threefold ministry of the Church (priest, prophet, king). While Peace through Commerce (PTC) started as a conversation among a small group of scholars it has grown into an increasingly robust movement, giving rise to conferences, books, journal articles, and dialogue between scholars, managers, practitioners, government officials, and civil society actors, all of whom share an interest in the potential of commerce to foster greater peace. Because social movement scholarship explores the ability of collective interests to achieve social change it provides a useful lens through which to consider PTC's (...) maturation and, more broadly, the rise of scholarly conversations into social movements its. Increasingly, social movement theory has been used to describe and better understand a diverse range of social and organizational changes (Strang and II Jung, 2005) including academic endeavors (Hambrick and Chen, 2008). I draw on social movement theory to characterize the rise of PTC and to consider its future growth. I also suggest broader implications for the transition of academic dialogue as it attains movement status. (shrink)

Throughout his mature writings, Berkeley speaks of minds as substances that underlie or support ideas. After initially flirting with a Humean account, according to which minds are nothing but ‘congeries of Perceptions’, Berkeley went on to claim that a mind is a ‘perceiving, active being … entirely distinct’ from its ideas. Despite his immaterialism, Berkeley retains the traditional category of substance and gives it pride of place in his ontology. Ideas, by contrast, are ‘fleeting and dependent beings’ that must be (...) supported by a mental substance. There is no doubt that Berkeley's conception of the relationship between minds and ideas is non-traditional, but that fact does not undercut his commitment to the traditional conception of substance. “Biography” is a sober, precise and modern word. Like other words formed from a Greek root, it has a competent and knowing air. It makes a good appearance in the summary of reviews, on the platform at conferences, between “biology” and “bibliography,” between “necrology” and “radiography,” in that scientific elite of the lexicon that travels in “business” class from one language to another, always at home in the time belts, hotel lobbies, conference rooms or amphitheaters. Compared with this prosperity, the (...) word “Life” is old-fashioned, a poor relative doomed to retirement homes. In the period between the two wars it disappeared from bookstore windows and book jackets. The hesitations of André Maurois, the author of Aspects de la biographie (1928), are characteristic of a transition: he wavered between La Vie de Disraeli (1927), Ariel ou la vie de Shelley (1923), Prométhée ou la vie de Balzac (1965) and Byron (1930). We sense that the title Vie was on the way out or had to yield to a proper name or an allegorical figure. However, it was a word in good standing, nobly Latin in origin, as great a signore in its class as those Massimi or Colonna who claimed their ancestors were mentioned by Titus Livy. Its genealogy is still more ancient, if we recall that its metonymic and literary meaning in Latin is a translation of the Greek word Bios, which the Hellenes, inventors of the genre and who had a more pedantic use of their language than we do, were content to use up until the end. “Biography,” according to Liddell-Scott, is not found in Antiquity except in a very late neo-Platonian, Damaskios, who put this humorless escogriffe into circulation when twilight was descending on the Roman Empire, between the 5th and 6th centuries A.D., at the dawn of the Middle Ages. It made its entrance into modern languages in the last quarter of the 17th century, when the humanism of the Renaissance was coming to an end, and the Enlightenment was beginning its rise. This late and ill-boding word began a slow ascension, long delayed: it did not come into usage outside the circles of antiquarians until the 19th century. The old word “Life” proudly kept its importance until the ‘20s of our era in the particularly conservative language of titles of works. Its definitive effacement to the profit of “biography” brought that of the word “memoirs” or the word “confessions,” which yielded to “autobiography,” while “hagiography” without being able to impose itself so well in usage, took much gravity and credibility away from the “Lives of the Saints.”. In this paper, we provide a general setting under which results of normalization of proof trees such as, for instance, the logicality result in equational reasoning and the cut-elimination property in sequent or natural deduction calculi, can be unified and generalized. This is achieved by giving simple conditions which are sufficient to ensure that such normalization results hold, and which can be automatically checked since they are syntactical. Is medical commerce a recent phenomenon? Does it distort the patient–physician relationship? Are investor-owned firms the main source of medical commercialism? I contend that medicine has generally been commerce in the United States, that medical commerce is a problem when it creates or worsens physicians' conflicts of interest, and that these conflicts thrive in nonprofit organizations as well as in investor-owned firms. I provide a historical sketch to show that physician entrepreneurialism, rather than commerce generally, is the main source of (...) physicians' conflicts of interest. (shrink)

It is widely believed that play and curiosity are key ingredients as children develop models of the world. There is also an emerging consensus that children are Bayesian learners who combine their structured prior beliefs with estimations of the likelihood of new evidence to infer the most probable model of the world. An influential school of thought within developmental psychology, rational constructivism, combines these two ideas to propose that children learn intuitive theories of how the world works in part by (...) engaging in play activities that allow them to gather new information for testing their theories. There are still, however, at least two pieces missing from rational constructivist theories of development. First, rational constructivism has so far devoted little attention to explaining why children's preferred form of learning, play, feels so fun, enjoyable, and rewarding. Rational constructivism may suggest that children are curious and like to play because reducing uncertainty and learning better theories of the causal workings of the world is enjoyable. What remains unclear, however, is why reducing uncertainty in play is interesting, fun, and joyful, while doing so in other forms of learning can be frustrating or boring. Second, rational constructivism may have overlooked how children, during play, will take control of and manipulate their environment, sometimes in an effort to create ideal niches for surprise-extraction, sometimes for developing strategies for making the world fit with their predictions. These missing elements from rational constructivism can be provided by understanding the contribution of play to development in terms of predictive processing, an influential framework in cognitive neuroscience that models many of the brain's cognitive functions as processes of model-based, probabilistic prediction. Stressing that the pronoun "I" picks out one and only one person in the world (i.e., me), I argue against Hunt (and other like-minded Rand commentators) that the supposed "hard case" of destructive people who do not care for their own lives poses no special difficulty for rational egoism. I conclude that the proper response to a terse objection like "What about suicide bombers?" is the equally terse assertion "But I don't want to get blown up.".
