The Luck Problem has existed in one form or another since David Hume, at least. It is perhaps as old as Stoic objections to the Epicurean swerve. Although the general issue admits of different formulations with subtly different emphases, the characterization of it that will serve as my target focuses on “cross-worlds” luck, a kind of luck that arises when the decision-making of agents is indeterministic.

This article describes Catholic natural law tradition by examining its origins in the medieval penitentials, the papal decretals, the writings of Thomas Aquinas, and seventeenth-century casuistry. Catholic natural law emerges as a flexible ethic that conceives of human nature as rational and as oriented to certain basic goods that ought to be pursued and whose pursuit is made possible by the virtues. Four approaches to natural law that have evolved within the United States during the twentieth century are then identified, (...) including the traditionalist, proportionalist, right reason, and historicist approaches. The normative implications of these approaches are discussed in relation to ethical issues in the tobacco industry, ITT under Geneen, the marketing of pharmaceuticals, affirmative action, and bribery. It is argued that Alasdair MacIntyre is correct in claiming that the natural law tradition issuperior to the liberal ethics of modern deontology and utilitarianism. (shrink)

While Nietzsche's rejection of metaphysical free will and moral desert has been widely recognised, the sense in which Nietzsche continues to use the term freedom affirmatively remains largely unnoticed. The aim of this article is to show that freedom and agency are among Nietzsche’s central concerns, that his much-discussed interest in power in fact originates in a first-person account of freedom, and that his understanding of the phenomenology of freedom informs his theory of agency. He develops a non-reductive drive-psychological motivational (...) theory: reflective judgement and reasons can motivate by means of affective orientations agents have due to their drives. In particular, due to a standing desire or 'instinct for freedom' agents can generate, in mental simulations, the necessary motivational affects to unify their drives in view of certain long-term goals. When someone masters a skill, their performance looks to us like second nature: it looks as if their actions are smoothly performed without explicit, knowledge-driven, online monitoring of their performance. Contemporary computational models in motor control theory, however, are instructionist: that is, they cast skillful performance as a knowledge-driven process. Optimal motor control theory, as representative par excellence of such approaches, casts skillful performance as an instruction, instantiated in the brain, that needs to be executed—a motor command. This paper aims (...) to show the limitations of such instructionist approaches to skillful performance. We specifically address the question of whether the assumption of control-theoretic models is warranted. The first section of this paper examines the instructionist assumption, according to which skillful performance consists of the execution of theoretical instructions harnessed in motor representations. The second and third sections characterize the implementation of motor representations as motor commands, with a special focus on formulations from OMCT. The final sections of this paper examine predictive coding and active inference—behavioral modeling frameworks that descend, but are distinct, from OMCT—and argue that the instructionist, control-theoretic assumptions are ill-motivated in light of new developments in active inference. Necessitism about individuals claims that necessarily every individual necessarily exists. An analogous necessitist thesis attributes necessary existence to properties and relations. Both theses have been defended by Williamson. Furthermore, Williamson specifically argues against the hybrid conjunction of first-order contingentism and higher-order necessitism; a combination that would bring about additional drawbacks. I work out a defence of the hybrid combination, including some replies to Williamson’s additional objections. Considerations of ontological parsimony and pre-theoretical intuitions favour the hybrid view over necessitism at all (...) orders. (shrink)

According to the partisan cheerleading view, numerous political disagreements that appear to be genuine are not authentic disputes, because partisans _deliberately_ misreport their beliefs to show support for their parties. Recently, three arguments have been put forth to support this view. First, contemporary democracies are characterized by affective rather than ideological polarization. Second, financial incentives indicate that partisans often deliberately misreport their beliefs to express their attitudes. Third, partisans have inconsistent and unstable political beliefs, so we should not take these (...) attitudes seriously. In this paper, I examine these arguments and present an alternative view, which I call the partisan conviction view. According to it, partisans are not necessarily insincere in their political judgments, and they are in genuine disagreement. (shrink)

El filósofo francés en su obra _Réduction et donation_ nos propone un nuevo principio –“_autant de réduction, autant de donation_”–, a partir del cual planteará una tercera reducción en el campo de la fenomenología. La pretensión de este artículo consiste en mostrar cómo este principio señala que la reducción, cada vez más radicalizada, no solo reduce en un sentido restrictivo, sino, más bien, abre o amplía el horizonte de la donación, puesto que permite penetrar cada vez más en el hecho (...) mismo de la donación como tal. De este modo, concluiremos que tras la reducción fenomenológica-transcendental y la reducción ontológicaexistencial se ejerce la reducción _a_ y _de_ la llamada, la cual subyace como el esquema fundamental de las dos reducciones anteriores. Properly speaking, the corporation, considered as an entity distinct from its members, cannot be morally responsible for wrongful corporate acts. Setting aside (in this abstract) acts brought about through negligence or omissions, we may say that moral responsibility for an act attaches to that agent (or agents) in whom the act "originates" in this sense: (1) the agent formed the (mental) intention or plan to bring about that act (possibly with the help of others) and (2) the act was intentionally (...) brought about through bodily movements over which that agent had direct control (i.e. the kind of direct mental control that I have over the body I refer to as "my" body) and through which the agent carried out his (mental) intention or plan. Corporate acts do not thus originate in some corporate entity distinct from its members because the corporation has neither a mind to form intentions nor a body it directly controls: it lacks the proper mind/body unity. Instead, corporate acts originate in individual autonomous human beings who make up the corporation and who intentionally bring about corporate acts through their own bodily movements. Such human individuals, and not "the corporation," are morally responsible for corporate acts. Moreover, to say that an entity is "morally responsible" for a wrongful act is to say that the entity is liable to blame and punishment. But it is not possible to impose blame and punishment on a corporation without inflicting it on corporate members. Thus, to say that a corporation (as an entity distinct from its members) is "morally responsible" for a wrongful corporate act is to imply that a (possibly innocent) corporate member legitimately may be punished for something for which another entity was morally responsible. This violates the moral principles that underlie blame and punishment. To hold that the corporation can be morally responsible for its acts is to adopt a dangerous organicism. (shrink)

Hintikka's second generation epistemic logic introduces a syntactic device allowing to express independence relations between certain logical constants. De re knowledge attributions can be reformulated in terms of quantifier independence, but the reformulation does not extend to non-factive attitudes like belief. There, formulae with independent quantifiers serve to express a new type of attitude, intermediate between de dicto and de re, called ‘de objecto’: in each possible world compatible with the agent's belief, there is an individual with the specified property (...) – in each world the same individual, which or who need not exist actually. The philosophical benefits of our analysis of propositional attitudes include a refined account of the behaviour of proper names as well as of indefinite and definite descriptions in attitude reports. La doctrina establecida por la Corte Suprema de Justicia de la Argentina en relación a los crímenes de lesa humanidad cometidos durante la última dictadura militar, expresamente declaraba la obligación del Estado de investigar y juzgar a los responsables de su comisión. La Corte no sólo caracterizó dichos delitos, sino que también estableció que no eran susceptibles de amnistía, indulto, ni prescripción. Pero, en el año 2017 dictó el fallo “Muiña” donde, por voto mayoritario, decidió otorgarle el beneficio del “2 (...) por 1” a un condenado por dichos delitos. La consecuencia fue su inmediata libertad por el vencimiento de la condena. La respuesta de la sociedad fue clara. Con diversas manifestaciones, la sociedad civil, las instituciones y las personalidades públicas se declararon en contra de la sentencia. Más aún, del voto de los mismos jueces se observan expresiones que denotan un gran pesar a la hora de tomar la decisión. Más precisamente, sostenían estar ante un dilema. En este trabajo, lejos de realizar un análisis de la interpretación jurídica que se efectuó en la sentencia, se propone trabajar sobre el concepto de dilema y la posibilidad de aplicación en el presente caso. La finalidad concreta es indagar si se está ante un dilema y en su caso si los jueces utilizan este concepto como un arma argumentativa para lograr adhesión o compasión de la opinión pública. En este sentido, se comenzará relatando el marco jurídico del fallo, donde se describirá la historia judicial de Muiña y los argumentos dados por el voto mayoritario y el minoritario de la Corte. Luego, se realizará un análisis del concepto de dilema, para reconstruirlo sobre la base de dos grandes posturas: Una lógica conceptual y otra fenomenológica. Posteriormente, se realizará un examen de la dimensión institucional del derecho y la moralidad judicial, para - finalmente - poder intentar responder si se está efectivamente ante un dilema. El artículo trata sobre la negación estoica y su crítica a la fórmula aristotélica según los testimonios de Apuleyo, Alejandro de Afrodisias y Boecio. La crítica se divide en tres aspectos: (i) sistematicidad (ya que una misma regla no se aplica a todo tipo de proposición); (ii) universalidad (ya que todo par contradictorio no divide la verdad y la falsedad sin excepción alguna); y (iii) rigurosidad (ya que el sujeto de la proposición puede no existir o no ser lo que (...) creemos que es). Se concluye que el fondo de la crítica no se relaciona con que una fórmula es inconsistente o hace imposible la lógica y sus operaciones, sino que tiene relación con cuál fórmula es más ambigua y menos preferible. En este artículo se pretende explicar cómo debe ser comprendida la relación entre la causalidad formal y del esse en las etapas de constitución del ente según el pensamiento de Tomás de Aquino. Forma y esse, que son acto en su respectivo orden, se relacionan como acto y potencia, lo cual obliga a un detallado análisis que explique cómo es esta relación y cómo su interpretación condiciona el modo de entender la constitución metafísica del ente. Llevaremos a cabo este propósito (...) dividiendo el artículo en dos grandes apartados: En el primero abordaremos la relación entre forma y esse tal como el Aquinate lo expone en el capítulo cincuenta y cuatro del segundo libro de la Summa contra gentiles. En la segunda intentaremos articular la relación causal entre forma y esse desde el punto de vista metafísico a partir de las enseñanzas obtenidas en el apartado anterior. Nuestro objetivo es proporcionar una respuesta que medie entre las dos posiciones tradicionales que han interpretado la filosofía tomista, bien acentuando el papel del esse sobre la forma o bien al contrario la forma sobre el esse. Este trabajo entra en uno de los aspectos más debatidos en el tomismo contemporáneo, que es la comprensión de la causalidad del esse respecto al ente y la forma. Lo primero que defiende es que el esse es verdadera causa, algo que sólo tímidamente ha puesto en evidencia Cornelio Fabro. Seguidamente, después de justificar esta tesis mayor, propone concretamente el modo en que debe ser comprendida esta causalidad, especialmente respecto a la forma. En definitiva, se trata de una articulación entre ambos tipos de causalidad, de forma y esse, salvando la primacía que el Aquinate da al segundo. (shrink)

In relevance-theoretic pragmatics thelower-levelorfirst-order explicatureis a propositional form resulting from a series of inferential developments of the logical form. It amounts to the message the speaker communicates explicitly. Thehigher-levelorsecond-order explicatureis a description of the speech act that the speaker performs, her affective attitude towards what she says or her epistemic stance to the communicated information. Information about the speaker’s affective attitude or epistemic stance need not solely be represented in the latter, though. It could be included as beliefs in the (...) mental files of pragmatically adjusted conceptual representations featuring in lower-level explicatures. Those beliefs would originate as lexical pragmatic processes operate and their representation would be triggered by elements like evaluative morphemes, expressive expletives, insulting terms and evidential participles. Although they may be true or false in their own right, such beliefs would not affect the truth-conditional content of the expressed proposition. (shrink)
