We believe we know our bodies intimately—that their material reality is certain and that this certainty leads to an epistemological truth about sex, gender, and identity. By exploring and giving equal weight to transgendered subjectivities, however, Gayle Salamon upends these certainties. Considering questions of transgendered embodiment via phenomenology (Maurice Merleau-Ponty), psychoanalysis (Sigmund Freud and Paul Ferdinand Schilder), and queer theory, Salamon advances an alternative theory of normative and non-normative gender, proving the value and vitality of trans experience for (...) thinking about embodiment. Salamon suggests that the difference between transgendered and normatively gendered bodies is not, in the end, material. Rather, she argues that the production of gender itself relies on a disjunction between the "felt sense" of the body and an understanding of the body's corporeal contours, and that this process need not be viewed as pathological in nature. Examining the relationship between material and phantasmatic accounts of bodily being, Salamon emphasizes the productive tensions that make the body both present and absent in our consciousness and work to confirm and unsettle gendered certainties. She questions traditional theories that explain how the body comes to be—and comes to be made one's own—and she offers a new framework for thinking about what "counts" as a body. This essay considers what is critical in critical phenomenology, and asks what features critical and phenomenological methods share. I suggest three fundamentally significant resonances between the critical and phenomenological enterprises. First is the suggestion that critique, like phenomenology, is an attempt to move beyond a dualism of inside and outside in order to extend into outer regions of what is known. Second is the insistence that what at first appears to be a purely negative endeavor, a finding of limit, is (...) incomplete if, upon finding that limit, it comes to a stop. Just as the reduction is not a means to banish or negate the world, but rather the condition through which it can more fully emerge, critique cannot be merely a cataloguing of the limitations of the present situation. Third is the openness to the possibilities of the world, a wonder or curiosity, that is revealed through the work of description in phenomenology, or Foucault’s characterization of philosophy not as an unmasking, but a making visible of what is visible. Finally I consider critical phenomenology’s futures: How is a newly enlivened kind of scholarship emerging from these two forms of thinking, both of which have been dismissed as outmoded or irrelevant? The new work currently emerging in phenomenology, with its emphasis on its own reflexive self-consideration and decolonization, offers hope that it might yet be capacious enough to simultaneously encompass the revelation of its limitations as well as the expansion of its reach. In this paper, I analyze the semantics of the first person pronoun “I” from the perspective of the user/producer distinction. In the first part of the paper, I describe the Simple View and propose three interpretations of its thesis. In the second part, I analyze the notions of use and production of a linguistic token. In the next part, I show that all of the interpretations of SV are sensitive to counterexamples. In the end, I discuss possible answers of the (...) proponents of SV and argue against them. The first aim of this paper is to show that SV is wrong, and the second is to convince the reader that the user/producer distinction is of high importance in the philosophy of language. (shrink)

The paper is a response to recent criticisms of agatheism, a new pluralistic interpretation of religious belief put forward by Janusz Salamon with the aim of accommodating the epistemological challenge of religious diversity. Agatheism is an axiologically grounded religious belief which identifies God, the Absolute or the ultimate reality religiously conceived with the ultimate good as the ultimate end of all human agency and thus an explanation of its irreducibly teleological character and a source of its meaning. Janusz (...) class='Hi'>Salamon argues that this grounding of religious belief in the human axiological consciousness makes it immune to falsification by any future science. Replying to the concerns of the critics about about irrationality of doxastic commitment to a particular religious tradition, Janusz Salamon argues that to the extent the fundamental agatheistic religious belief is presupposed in such tradition as its doxastic core, its belief system - if internally coherent and aligned with a worldview that is consistent with undisputed scientific findings - may be considered rational, despite there being a plurality of such belief systems. This paper aims to introduce Meinongian Abstractionism (MA), i.e. a view on the metaphysics of truthmaking and modality. This approach is based on the notion of objectives—one of the key elements of Alexius Meinong’s Theory of Objects. In the light of it, worlds are interpreted in terms of sets of subsistent and non-subsistent objectives. This—along with Meinong’s characterization of objectives—provides a ground for possible as well as impossible worlds. One of the consequences of Meinongain Abstractionism is a reformulation of the (...) relation of truthmaking in modal terms. Importantly, this reformulation avoids the problem of too-coarse grained analysis of truthmakers. This makes MA a metaphysically–oriented supporter of the so-called ‘hyperintensional revolution.’. It is not clear, however, whether positive emotional states are associated with differential ANS reactivity. To address this issue, we conducted a meta-analytic review of 120 articles, measuring ANS activity during 11 elicited positive emotions, namely amusement, attachment love, awe, contentment, craving, excitement, gratitude, joy, nurturant love, pride, and sexual desire. We identified a widely dispersed collection of studies. Univariate (...) results indicated that positive emotions produce no or weak and highly variable increases in ANS reactivity. However, the limitations of work to date – which we discuss – mean that our conclusions should be treated as empirically grounded hypotheses that future research should validate. (shrink)

The aim of this paper is to argue in favor of the view that some counterpossibles are false. This is done indirectly by showing that accepting the opposite view, i.e., one that ascribes truth to each and every counterpossible, results in the claim that every necessarily false theory has exactly the same consequences. Accordingly, it is shown that taking every counterpossible to be true not only undermines the value of debates over various alternative theories and their consequences, but also puts (...) into question the very possibility of such debates. In order to explicate this thesis, the close bond between counterpossibles and the so-called story prefix is explored. A number of possible responses to this criticism are also presented, and it is argued that none of them address the main problem. (shrink)

Recent research observed a sensitive window, at about 14 years of age, in the acculturation rates of Chinese immigrants to Canada. Tapping an online sample ofusimmigrants, we tested these relationships in a broader population and explored connections with new potentially causally related variables: formal education, language ability and contact with heritage-culture and mainstream United States individuals, both now and at immigration. While we found that acculturation decreased with age at immigration and increased with years in theus, we did not observe (...) a similar sensitive window. We also present an exploratory path analysis, exposing the relationships in our sample between acculturation and the variables above. The novel relationships documented here can improve theorising about this rich and complex empirical phenomenon. (shrink)

The obligation of the legalization of entrepreneurial activity from Article 14 of The Act of July 2, 2004 on the freedom of entrepreneurial activity caused deliberations regarding constitutive or declarative character of the legalization entry and as a result, created a problem with indication of the moment when the public law status of an entrepreneur is acquired. The answer to the question whether Central Register and Information of Entrepreneurial Activity or the register of entrepreneurs of the National Court Register have (...) also the creation function incites many controversies and is subject to discussions, in the process of which two main standpoints were formed. It is also important to note that the resolution of the discussed issue not only holds scientific value, but above all, it has significant importance in practice. Therefore, it is necessary and even essential. Furthermore, it is typical for this issue that concerns related thereto and arguments raised during the discussion have their basis in the legislation in force and in fact, encapsulate the favoured path of its interpretation. The starting point of the article is a passage in Tarski’s work entitled The Semantic Concept of Truth and the Foundations of Semantics (1944), in which he points out the difference between the concept of truth and other semantic concepts. According to Tarski, unlike other semantic concepts, “truth” does not indicate a relation but a property (property of sentences). Although Tarski did not elaborate on this claim in his seminal paper, I argue that this passage may be taken as a (...) starting point for further considerations of the essence of truth. In particular, one of the most important issues is the classical concept of truth and the problem of correctly constructing the definition of truth understood as not a relation but a property. This paper discusses three different contemporary uses of philosophy and literature in non-philosophical and non-literary texts. Most often, both discourses are used as tools, and they are invoked instrumentally in popularizing literature or in teaching. Philosophy and literature can also be treated as a source or starting point for reflection outside its mother field, or even as a cause of various social and political processes. The most interesting usage of both discourses is to refer to them as the symptoms or (...) signs of the times allowing us to make diagnoses about the present. These uses of the two discourses show the similarities between literature and philosophy on a purely pragmatic level that is relevant to their contemporary functioning in a non-specialist sphere. The convergence in this regard is a testimony to the transformation of the position of both discourses in the contemporary humanities involving the loss of their privileged position. At the same time, literature and philosophy in this crisis situation are gaining new areas of influence in public discourse, realizing their cognitive and reflexive potential through their utilitarian use. Temat to szeroko dyskutowany w ostatnich czasach, stąd wydawać by się mogło, że zorganizowanie jeszcze jednej sesji, która przyciągnęłaby uwagę środowiska filozofów religii, będzie przedsięwzięciem wyjątkowo trudnym. Tymczasem monachijska debata zasłużyła sobie na miano wydarzenia. O jej atrakcyjności zadecydował fakt, że została pomyślana jako próba ożywienia dialogu pomiędzy filozofami nawiązującymi do tradycji kontynentalnej z przedstawicielami filozofii analitycznej. Tego rodzaju ekumeniczne inicjatywy nalezą w tej dziedzinie do rzadkości. (...) Ten swoisty izolacjonizm ma wiele przyczyn, a kością niezgody jest między innymi stosunek do Kanta. Postkantowska kontynentalna filozofia religii, kładąca nacisk na epistemologię i fenomenologię doświadczenia religijnego, postrzega anglosaski renesans badań nad klasycznymi problemami teodycealnymi jako nawrót do przedkrytycznego dogmatyzmu. Z kolei niektórzy analityczni filozofowie religii zdają się uprawiać swą dyscyplinę w taki sposób, jak gdyby kopernikański przewrót Kanta uważali za niebyły, a czasem nazywają expressis verbis epoką nowożytną okresem błędów i wypaczeń. Epistemologiczne zagadnienie racjonalności religii należy do kręgu zainteresowań obydwu wymienionych tradycji, stad możliwe jest tu połączenie wysiłków w celu uporządkowania tematyki i oceny aktualnego stanu refleksji. The paper depicts the evolution of the conception of the method of analytical description of Czeżowski, one of the most important figures of the Lvov-Warsaw School of Philosophy. It portrays Czeżowski as an author, whose voice on relation between theory and experience, as well as language and empirical reality, can be still considered important and significant. Generally speaking, Czeżowski distinguishes between two kinds of methods: the inductive ones and the no inductive, i.e. the method of analytic description. The results of (...) the former are the base of every further scientific activity, from the empirical sciences to philosophy. The method serves, first of all, to define abstract concepts and to precise scientific terms, what allow next to set and to express relations between them. Its application is an indispensable and essential part of process of building every abstract scientific theory. Despite some similarities between Czeżowski’s method and other methods of conceptual analysis, the former is not subjected to the paradox of analysis, according to the author of the paper. (shrink)

Many irreconcilable accounts of ratio legis in legal science, often concerned with legal interpretation, suffer from being disconnected from practical reasoning. Different theories of legal interpretation which result in one-sided views of ratio legis are by-products of one-sided semantics. The first part of the chapter diagnoses this problem by providing a model of three types of one-sided semantics—upstream, midstream and downstream—and explaining how they translate into respective accounts of legal interpretation and ratio legis. The second part of the chapter presents (...) an alternative to one-sided semantics in legal theory. The alternative account which combines semantics and practical reasoning in legal theory is based on Brandom’s inferential pragmatism. The usefulness of inferential pragmatism in legal theory with regard to the problem of ratio legis is tested and followed by extending an inferentialist account of ratio legis provided by Canale and Tuzet. A model of agent’s actions and reasons, and their impact on the reasoning of interpreters and decision-makers is the essential part of this extension. (shrink)

The paper aims to develop an interactional account of illocutionary practice, which results from integrating elements of Millikan's biological model of language within the framework of Austin's theory of speech acts. The proposed account rests on the assumption that the force of an act depends on what counts as its interactional effect or, in other words, on the response that it conventionally invites or attempts to elicit. The discussion is divided into two parts. The first one reconsiders Austin's and Millikan's (...) contributions to the study of linguistic practice. The second part presents the main tenets of the interactional account. In particular, it draws a distinction between primary and secondary conventional patterns of interaction and argues that they make up coherent systems representing different language games or activity types; it is also argued that the proposed account is not subject to the massive ambiguity problem. In this study, we reconcile conflicting findings from the extant literature on the impact of tax system parameters on tax noncompliance. We argue that social norms play a role of heuristics facilitating tax payers’ response to the instrumental incentives posed by the systemic parameters, such as tax rate and penalties for evasion, and thus moderate the effect of those parameters on willingness to evade taxes. Relying on a unique survey experiment conducted in fourteen countries of Central-Eastern Europe, we demonstrate two (...) types of a conditioning effect of norms. First, the impact of tax rates on respondents’ propensity for tax evasion is moderated by the perceived norms of the society at large. In particular, an increasing tax rate lowers the probability of evasion as long as one views “most others” as honest taxpayers, which highlights the importance of equitability concerns for tax compliance decisions. In contrast, the impact of punishment is moderated by the perceived norms of one’s immediate reference group. Strong subjective compliance norms tend to effectively replace penalties as a mechanism discouraging tax evasion, suggesting that the deterrent effect of a penalty can be entirely suppressed when subjective norms are strong. These findings have important implications for the understanding of tax compliance decisions under different formal and informal regimes. (shrink)

The aim of this paper is to point out the limitations of Hybrid Modal Realism as a general theory of modalities, i.e. one that gives an analysis of possibilities as well as impossibilities. To do so we will firstly sketch the goals that theories of impossible worlds should achieve. Secondly we will briefly present the two most popular accounts of impossibilities—Extended Modal Realism and Extended Ersatzism. We will focus on the aspects of both theories which became the motivation for a (...) hybrid view. In the last part of this paper we will analyze Francesco Berto’s Hybrid Modal Realism and present reasons why this account is an insufficient tool for analyzing impossibilities. (shrink)
