Este trabajo tiene por objetivo responder al problema de la falta de sentido en el que se ve inmerso nuestro tiempo presente. Consideramos que la propuesta de Mauricio Beuchot, de una hermenéutica analógica, pensada aquí como política de la interpretación, es la mejor opción para problematizar y proponer respuestas al estado de situación actual, ya que evita desbordes que nos lleven hacia la inconmensurabilidad, y que cierren el paso a una acción transformadora, que, al mismo tiempo, sea acción constructora de (...) nuevos campos semánticos. Para esto, pondremos en tensión a la modernidad caracterizada como univocista, con la posmodernidad –regulada desde la tríada: relativismo-escepticismo-nihilismo– de tipo equivocista. Será importante tener en cuenta el valor que aquí le otorgamos al contexto de producción e interpretación textual, el cual se vuelve punto de referencia siempre necesario, que niega toda idea equivocista, sobre una semiosis sin fin. This paper shows a new philosophical turn towards a new realism emerging today. And its originality lies on Maurizio Ferraris, who has recently published his Manifiesto del nuevo realismo**, which has been followed by personalities such as Umberto Eco and John Searle. On this basis, Mexican philosopher Mauricio Beuchot and me have written our Manifiesto del nuevo realismo analógico***, which had had a great acceptance by Maurizio Ferraris himself. He translated our manifest and introduced it into Italy. I will take (...) this article as a chance to thank him for reading and considering our manifest. In the evolution of criminally relevant action in modern crime theory, social action has assumed a particular significance as a dogmatic element that enables the effective protection of legal assets in a society beset by risks. In the vast array of theories regarding the role of the guarantor and its legal and doctrinal development, as well as the jurisprudential extension of equivalence clauses of improper omissions that serve as amplifier devices of the criminal statue through an indirect adaptation, there is (...) a need to identify the most effective means to shield legal assets, which allows for an imputation of passive conducts, despite having an active typical description. This introduces the controversial figure of the improper omission, which is used with the function of perfecting all of the structural elements of the criminal conduct. When an individual knows he is in a position of guarantor and is aware of the potential consequences, but fails to take action, having the means to prevent a foreseeable outcome, this device serves to enhance the criminal protection of legal assets, fostering social solidarity as the basis of the criminal justice system. This system, by satisfying the function of general prevention of the punishment, ideally dissuades the individual from committing crimes with the threat of penalty. These theories are fundamental to understanding criminal responsibility by improper omission in the context of the objective imputation theory. By guiding the evolution and delimitation of its application, they serve as a significant factor in criminal social control in Colombia. (shrink)

Cosmopolitanism is said by many critics to be arrogant. In emphasizing universal principles and granting no fundamental moral significance to national or other group belonging, it wrongly treats those making non-universalist claims as not authorized to speak, while treating those in non-Western societies as not qualified. This book works to address such objections. It does so in part by engaging the work of B.R. Ambedkar, architect of India's 1950 Constitution and revered champion of the country's Dalits (formerly "untouchables"). Ambedkar cited (...) universal principles of equality and rights in confronting domestic exclusions and the "arrogance" of caste. He sought to advance forms of political humility, or the affirmation of equal standing within political institutions and openness to input and challenge within them. This book examines how an "institutional global citizenship" approach to cosmopolitanism could similarly advance political humility, in supporting the development of input and challenge mechanisms beyond the state. It employs a grounded normative theory method, taking insights for the model from field research among Dalit activists pressing for domestic reforms through the UN human rights regime, and from their critics in the Hindu nationalist Bharatiya Janata Party. Insights also are taken from Turkish protesters challenging a rising domestic authoritarianism, and from UK Independence Party members demanding "Brexit" from the European Union-in part because of possibilities that predominantly Muslim Turkey will join. Overall, it is shown, an appropriately configured institutional cosmopolitanism should orient fundamentally to political humility rather than arrogance, while holding significant potential for advancing global rights protections and more equitable rights specifications. En este trabajo analizaremos algunos aspectos involucrados en el concepto de demostración matemática. Comenzaremos con la descripción de Enderton, sobre los requisitos que una demostración debe cumplir, estas son convicción final, finitud y verificabilidad algorítmica, para luego analizar las objeciones que Chateaubriand hace al respecto, y señalar algunas discrepancias con sus planteos. Estas discrepancias no pretenden apoyar la perspectiva de Enderton. En una segunda instancia, procuraremos observar algunas dificultades que surgen, cuando queremos determinar lo que es una demostración. Si bien (...) el concepto de demostración puede ser analizado desde diversas perspectivas, teniendo en cuenta sus múltiples dimensiones, por ejemplo su dimensión retórica, ontológica, me concentrare fundamentalmente en su aspecto epistémico.In this paper I analyze some aspects involved in the concept of mathematical proof. I begin with Enderton’s description of the requirements that a proof must fulfill, namely, a final conviction, finitude and algorithmic verifiability, and then analyze the objections that Chateaubriand raises on this topic, and indicate some discrepancies in his exposition. These discrepancies are not meant as an argument for Enderton’s perspective. Although the concept of proof can be analyzed from different perspectives, i.e., taking into account its several different dimensions, for example its rhetorical, ontological dimension, I will concentrate fundamentally on its epistemic dimension. Resumen Este artículo proponemos un abordaje de las elaboraciones en torno a la singularización en la época de Sein und Zeit. Mediante un recorrido por sus consideraciones respecto al Dasein y las especificaciones sobre las dinámicas de mismidad, tanto en su carácter primario y cotidiano, como en su modalidad propia, buscaremos demostrar el carácter correlativo entre el tratamiento de la singularización en la analítica y la propia articulación discursiva de Heidegger en sus relaciones con la tradición, destacando algunas tensiones y (...) discusiones respectivas. Junto a ello, distinguiremos en qué medida estas caracterizaciones pueden condicionar la modalidad de abordaje y lectura de su obra. De esta manera, esperamos desplegar una articulación comprensiva fundamental del existente humano en vistas de sus continuidades y derivas en el pensamiento contemporáneo.In this article we propose an approach to the elaborations around the singularization at the time of Sein und Zeit. Through a tour of their considerations regarding Dasein and the specifications on the dynamics of sameness, both in their primary and daily character, and in their own modality, we will try demonstrate the correlative character between the treatment of the singularization in the analytics and the articulation itself Heidegger's discourse in his relations with tradition, highlighting some tensions and respective discussions. Along with this, we will distinguish to what extent these characterizations can condition the approach and reading modality of his work. In this way, we hope to display a fundamental comprehensive articulation of the existing human in view of its continuities and drifts in contemporary thinking. (shrink)

We point out the need to clarify some of the ideas related to the connection between development and sustainability in the Report of the Open Working Group of the General Assembly on Sustainable Development. In particular, the meaning of ‘sustainable’ is not clear when applied to specific areas of human activity. A more detailed explanation of the kind of equality sought for in the proposal is also needed. Because of potential conflicts between goals, we miss some considerations on the impact (...) of population increase both on development and on sustainability. A distinction is made here between two kinds of goals included in the Report. Some of the proposed 17 goals can then be seen as ends in themselves, whereas others seem to be means for the first set. The two sets thereby established should be seen in theory and dealt with in practice in a differentiated manner. (shrink)

The article deals with the constitution of a «historical people» in the conference munity that underlie to the interpretations of works of art in the conference are examined, pointing out the relationship of both with two types of different communities. In turn, they also constituted the images of ideal community of nacionalsocialism in power. This coincidence shows a deep agreement of Heidegger with governing nacionalsocialism different from a mere adhesion to the party. In this way, it is shown the parallel (...) of the question about the «new beginning» looked for by Heidegger starting from the Kehre and his political commitment for those years. (shrink)

This collection of articles provides an overview of current generative theorizing and empirical work on the nature, origin and scope of parameters of linguistic variation. Often taking diverging views, the papers in the volume address some or all of the main debated topics in parametric syntax.

As far as we are aware, this study presents the first comparative analysis of the stock picking and market timing abilities of managers of conventional and socially responsible (SR) pension funds, and of their use of superior information. For the United Kingdom, the results obtained show a slight stock picking ability on the part of SR pension fund managers (although it disappears if multifactorial models are considered), and a negative market timing ability on the part of both SR and conventional (...) pension fund managers (these results hold for multifactorial models controlled by home bias). In relation to the management styles, both conventional and SR pension funds usually invest in small cap and growth values, although it is the SR pension funds that are the most exposed to these styles. We also observed that, while conventional pension fund managers make certain use of superior information to follow stock picking strategies, managers of SR pension funds use superior information to follow market timing strategies. The goal of this article is to discuss several critical positions published recently in academic journals on the book The order of ‘Capital’, which aim is to lay the foundations for a republican reading of Marx’s major work. The core of the argument focuses against any attempt to derive normative proposals from scientific discoveries. From here, clarifying some key concepts and positions of the republican tradition is a necessary condition in order to show the close solidarity between Marx and Kant (...) about the formal and institutional conditions of any possible theory of justice. Nos ocupamos aquí de cómo se produce y comprende la publicidad del espacio público y de cómo dicha producción y comprensión repercute normativa y performativamente sobre los usuarios de aquel. El enfoque que hemos escogido pretende comentar estos aspectos con la ayuda de las etnografías que se han venido realizando en los últimos tiempos sobre el cruising, por cuanto esta actividad, que implica una apropiación furtiva de determinados espacios públicos para el desarrollo de actividades sexuales anónimas entre hombres, ofrece un (...) observatorio privilegiado del desfase entre el espacio público como dispositivo performativo y los agentes, que no siempre son meramente moldeados por tales dispositivos. Encontramos en esta práctica una ventana privilegiada para el análisis de la forma en que lo público y lo privado son construidos espacial y conceptualmente en la dialéctica entre marcos morales y prácticas subjetivas. In this article a study is carried out to identify the aspects of student satisfaction that allow improving university academic performance through applied educational research with a qualitative approach. Likewise, it is specified that the study problem is: how to enhance academic performance based on the satisfaction of the university student seen as a customer? The theoretical framework states that the way to be able to plan, know, and evaluate the satisfaction of students concerning the service they usually receive in (...) academic terms is considered a relevant factor concerning the quality of education at the national level, such efforts demanding an objective of excellence in education. The study subjects were 06 teachers of the Administration and Marketing career of a private university in Lima. As main results, 02 axes were evidenced: how satisfaction influences university academic performance and the elements to know which motivational strategies improve university academic performance. A discussion of the results was carried out, contrasting what was obtained in the qualitative focus group instrument to affirm or not the delimited category and the emerging categories of the study subjects with the scientific literature. Likewise, in conclusion, we have the reflection to reinforce the importance of student satisfaction to improve student performance in their educational experience at an integral level. (shrink)

It is possible to find in Machiavelli an expression of the original consent to explain the origin of the political communities. This paper investigates this hypothesis in the approach of the roman political thought. With Lucretius and Cicero, it is clear the terms of the pact, covenant, consensus, and the primitivism of the difference between man and beasts, the fear and the common safety to founder the political community under the leadership of one man. The paper also debates the Aristotelian (...) premises of the political nature of man and explores some examples of the Machiavellian time, that aims to confirms the existence of the language of the Aristotelianism within the original consent. It concludes that Machiavelli does not have a substantial theory to explain the origins of the political community, because politics and its study requires the research of the cities in the historical mean. This contractual language in accordance with that Aristotelian is used as a rhetoric strategy in the beginning of the Discourses. (shrink)
