When several agents together produce suboptimal outcomes, yet no individual could have made a difference for the better, Act Consequentialism counterintuitively judges that all involved agents act rightly. I address this problem by supplementing Act Consequentialism with a requirement of modal robustness: Agents not only ought to produce best consequences in the actual world, but they also ought to be such that they would act optimally in certain counterfactual scenarios. I interpret this Modally Robust Act Consequentialism as Act Consequentialism plus (...) a requirement of moral virtue, namely, to reliably act rightly and to act rightly for the right reasons. As a scientific discipline and profession, law has been for centuries at the heart of social and political power of many Western societies. Professors of law, as influential representatives of the profession, are important powerbrokers between academia, politics and the corporate world. Their influence is based on scientific reputation, institutional mandates inside and outside academia or privileged network connections with people in powerful positions. In this study, based on a full sample of all Swiss law professors in the years 1957, (...) 1980 and 2000, we contrast two theories of the distribution of power among law professors: Bourdieu’s thesis on the trade-off between scientific reputation and -academic institutional power vs. the thesis of an opposition between a group of established incumbents and socio-demographically marginal challengers who try to gain access to the profession. We show that among Swiss law professors the endowment with scientific capital is not opposed to the possession of institutional power within academia. Our findings reveal rather an opposition between a challenging group of professors devoid of resources and an incumbent fraction with a high amount of scientific, institutional and social capital alike. In the conclusion we discuss a series of explanations of this specific power structure, including the specific status scientific reputation and social capital can have for law professors. (shrink)

Several authors have argued that we ought to have fewer children in order to reduce our contribution to climate change. Proponents of this view generally hold a moderate version of the view, according to which it is still permissible to have one or two children per couple. One recent exception is Chad Vance’s paper “Procreation is Immoral on Environmental Grounds” in this journal, in which he argues that procreation is always, or almost always, morally impermissible. I argue, first, that Vance (...) is mistaken in conceding that his radical position holds only if individual acts of procreation can make a difference, rather than being only a causally insignificantly contribution to collective harm. Instead, given his assumptions, he should hold on to the radical view that we ought to have no children at all. Second, I argue against Vance’s strongest argument for his radical view. Vance argues that procreation harms others, and that obligations to avoid harming rule out the demandingness considerations that are used to support a permission to have one or two children. However, contrary to paradigmatic cases of harming, any procreation-related harms result not only from procreators’ actions, but also from our collective failures to rapidly reduce emissions. This complex causal structure undermines Vance’s rejection of demandingness considerations. I conclude that the moderate view that we may have one or two children per couple survives Vance’s criticism. (shrink)

Both the conception of a God responsible of an universal rational order and the solution to evil question are the grounds for the idea of happiness related to the virtue understood as rational control of passions. Devotion, passion derived from love, is considered by Descartes as the most useful passion that man can experience, as it contributes to the strengthening of the thinking subject, (...) to the so-called ‘generosity’, the true objective of Cartesian ethics. El presente artículo se centra en el estudio de la exégesis que lleva a cabo Plotino en torno a la significación de la inefabilidad del uno, planteada en el Parménides platónico al hilo de la primera hipótesis. Este ubica a este primer uno inefable en el centro mismo de su sistema, lo que tendrá fuertes implicaciones tanto a nivel ontológico como por lo que respecta a la comprensión del lenguaje. la concepción de la realidad que se deriva de esta inefabilidad (...) del primer principio, de un lado, y las implicaciones en la naturaleza del lenguaje filosófico que abre este postulado, de otro, ocuparán la centralidad de nuestras reflexiones. Atenderemos a los textos originales en los que se plantea la cuestión, apoyándonos en la labor de la crítica, discutiendo los puntos fundamentales a fin de esclarecer la posición que encontramos en las Enéadas. Tomaremos, asimismo, en consideración la actualidad que tiene esta posición y su capacidad de ir más allá de la crítica heideggeriana a la metafísica. (shrink)

On a remarqué très tôt qu’il existait une parenté quant aux moyens rhétoriques entre la phénoménologie de Husserl et l’Archéologie de Foucault. Si on comprend la rhétorique non pas (comme les premiers dialogues de Platon voulaient le montrer) comme contraire de la philosophie, ni comme son vis-à-vis, mais comme dimension incontournable de l’argumentation philosophique, à travers la mise en place de moyens rhétoriques, performatifs et de mise en scène, alors cette parenté gagne une nouvelle signification. Husserl lui-même utilise le concept (...) d’« archéologie phénoménologique », dans un texte de 1932 (ici présenté, pour la première fois en français) et ce, dans un sens programmatique. À partir de cet arrière-plan, une convergence se dessine entre les tentatives de Husserl et de Foucault, d’une part de comprendre leur propre entreprise comme archéologie et de pourvoir celle-ci du prestige d’une science héroïque et en même temps d’une sobriété toute positiviste ; d’autre part d’éviter l’implication d’une ontologie platonicienne-dualiste de l’apparence et de l’Être, de la surface et de la profondeur à travers des interprétations spécifiques, visant à mettre en place une disposition horizontale des objets. en el presente artículo abordamos la cuestión de la naturaleza del símbolo en la filosofía de Jámblico a través del análisis del pasaje de De Mysteriis 2.11.20-41. este pasaje ha servido de apoyo a la exégesis que ve en el símbolo un elemento apartado del intelecto. Según esta lectura, el símbolo habría sido introducido por Jámblico para salvar la debilidad del alma humana ante lo divino. éste habría dejado de confiar en las capacidades del hombre, abriéndose al ámbito de la (...) teúrgia. éste marco de interpretación adolece, sin embargo, de importantes carencias a la hora de ofrecer una comprensión profunda y coherente del papel del símbolo en la filosofía de Jámblico. A partir del estudio de este pasaje, nos acercaremos a la naturaleza de lo simbólico, buscando abrir una vía de comprensión de su papel en el proceso epistémico que perfila Jámblico. la relación que guarda esta noción con el término νοερός será determinante para nuestro estudio. This paper decribes the theoretical and methodological issues involved in the social shaping of technology and work, with particular reference to human centred computer integrated manufacturing (CIM) systems. Conventional approaches to the understanding and shaping of the relationship between technology, work and human development are criticised, and an alternative, human centred approach is outlined. The methods and processes whereby the design of human centred CIM systems may be shaped and evaluated are then described and appraised.
