Empirical results suggest that defocusing attention results in primary process or associative thought, conducive to finding unusual connections, while focusing attention results in secondary process or analytic thought, conducive to rule-based operations. Creativity appears to involve both. It is widely believed that it is possible to escape mental fixation by spontaneously and temporarily engaging in a more divergent or associative mode of thought. The resulting insight may be refined in a more analytic mode of thought. The question addressed here is: (...) how does the architecture of memory support these two modes of thought, and what is happening at the neural level when one shifts between them? Recent advances in neuroscience shed light on this. It was demonstrated that activated cell assemblies are composed of multiple ‘neural cliques’, groups of neurons that respond differentially to general or context-specific aspects of a situation. I refer to neural cliques that would not be included in the assembly if one were in an analytic mode, but would be if one were in an associative mode, as ‘neurds’. It is posited that the shift to a more associative mode of thought conducive to insight is accomplished by recruiting neurds that respond to abstract or atypical subsymbolic microfeatures of the problem or situation. Since memory is distributed and content-addressable this fosters remindings and the forging of creative connections to potentially relevant items previously encoded in those neurons. Thus it is proposed that creative thought involves neither randomness, nor search through a space of predefined alternatives, but emerges naturally through the recruitment of neurds. It is suggested this occurs when there is a need to resolve conceptual gaps in ones’ internal model of the world, and resolution involves context-driven actualization of the potentiality afforded by its fine-grained associative structure. An idea is not a replicator because it does not consist of coded self-assembly instructions. It may retain structure as it passes from one individual to another, but does not replicate it. The cultural replicator is not an idea but an associatively-structured network of them that together form an internal model of the world, or worldview. A worldview is a primitive, uncoded replicator, like the autocatalytic sets of polymers widely believed to be the earliest form of life. Primitive replicators generate (...) self-similar structure, but because the process happens in a piecemeal manner, through bottom-up interactions rather than a top-down code, they replicate with low fidelity, and acquired characteristics are inherited. Just as polymers catalyze reactions that generate other polymers, the retrieval of an item from memory can in turn trigger other items, thus cross-linking memories, ideas, and concepts into an integrated conceptual structure. Worldviews evolve idea by idea, largely through social exchange. An idea participates in the evolution of culture by revealing certain aspects of the worldview that generated it, thereby affecting the worldviews of those exposed to it. If an idea influences seemingly unrelated fields this does not mean that separate cultural lineages are contaminating one another, because it is worldviews, not ideas, that are the basic unit of cultural evolution. This paper describes a tentative model for how discrete memories transform into an interconnected conceptual network, or worldview, wherein relationships between memories are forged by way of abstractions. The model draws on Kauffman’s theory of how an information-evolving system could emerge through the formation and closure of an autocatalytic network. Here, the information units are not catalytic molecules, but memories and abstractions, and the process that connects them is not catalysis but reminding events (i.e. one memory evokes another). Like the information patterns that evolve through. biological processes, mental representations or memes evolve through adaptive exploration and transformation of an information space through variation, selection, and transmission. However since memes do not contain instructions for their replication our brains do it for them, strategically, guided by a fitness landscape that reflects both internal drives and a worldview that forms through meme assimilation. This paper presents a tentative model for how an individual becomes a meme evolving agent via the emergence (...) of an autocatalytic network of sparse, distributed memories, and discusses implications for complex creative thought processes and why they are unique to humans. A hypothetical scenario for the evolutionary dynamics of a given meme in a society of interacting individuals is presented. (shrink)

When we judge an action as morally right or wrong, we rely on our capacity to infer the actor's mental states. Here, we test the hypothesis that the right temporoparietal junction, an area involved in mental state reasoning, is necessary for making moral judgments. In two experiments, we used transcranial magnetic stimulation to disrupt neural activity in the RTPJ transiently before moral judgment and during moral judgment. In both experiments, TMS to the RTPJ led participants to rely less on the (...) actor's mental states. A particularly striking effect occurred for attempted harms : Relative to TMS to a control site, TMS to the RTPJ caused participants to judge attempted harms as less morally forbidden and more morally permissible. Thus, interfering with activity in the RTPJ disrupts the capacity to use mental states in moral judgment, especially in the case of attempted harms. (shrink)

People disagree about whether “moral facts” are objective facts like mathematical truths (moral realism) or simply products of the human mind (moral antirealism). What is the impact of different meta-ethical views on actual behavior? In Experiment 1, a street canvasser, soliciting donations for a charitable organization dedicated to helping impoverished children, primed passersby with realism or antirealism. Participants primed with realism were twice as likely to be donors, compared to control participants and participants primed with antirealism. In Experiment 2, online (...) participants primed with realism as opposed to antirealism reported being willing to donate more money to a charity of their choice. Considering the existence of non-negotiable moral facts may have raised the stakes and motivated participants to behave better. These results therefore reveal the impact of meta-ethics on everyday decision-making: priming a belief in moral realism improved moral behavior. (shrink)

Is the basis of criminality an act that causes harm, or an act undertaken with the belief that one will cause harm? The present study takes a cognitive neuroscience approach to investigating how information about an agent’s beliefs and an action’s conse- quences contribute to moral judgment. We build on prior devel- opmental evidence showing that these factors contribute differ- entially to the young child’s moral judgments coupled with neurobiological evidence suggesting a role for the right tem- poroparietal junction (RTPJ) (...) in belief attribution. Participants read vignettes in a 2 2 design: protagonists produced either a negative or neutral outcome based on the belief that they were causing the negative outcome (‘‘negative’’ belief) or the neutral outcome (‘‘neutral’’ belief). The RTPJ showed significant activation above baseline for all four conditions but was modulated by an interaction between belief and outcome. Specifically, the RTPJ response was highest for cases of attempted harm, where protag- onists were condemned for actions that they believed would cause harm to others, even though the harm did not occur. The results not only suggest a general role for belief attribution during moral judgment, but also add detail to our understanding of the inter- action between these processes at both the neural and behavioral levels. When we evaluate moral agents, we consider many factors, including whether the agent acted freely, or under duress or coercion. In turn, moral evaluations have been shown to influence our (non-moral) evaluations of these same factors. For example, when we judge an agent to have acted immorally, we are subsequently more likely to judge the agent to have acted freely, not under force. Here, we investigate the cognitive signatures of this effect in interpersonal situations, in which one agent (“forcer”) forces (...) another agent (“forcee”) to act either immorally or morally. The structure of this relationship allowed us to ask questions about both the “forcer” and the “forcee.” Paradoxically, participants judged that the “forcer” forced the “forcee” to act immorally (i.e. X forced Y), but that the “forcee” was not forced to act immorally (i.e. Y was not forced by X). This pattern obtained only for human agents who acted intentionally. Directly changing participants’ focus from one agent to another (forcer vs. forcee) also changed the target of moral evaluation and therefore force attributions. The full pattern of judgments may provide a window into motivated moral reasoning and focusing bias more generally; participants may have been motivated to attribute greater force to the immoral forcer and greater freedom to the immoral forcee. Studies of normal individuals reveal an asymmetry in the folk concept of intentional action: an action is more likely to be thought of as intentional when it is morally bad than when it is morally good. One interpretation of these results comes from the hypothesis that emotion plays a critical mediating role in the relationship between an action’s moral status and its intentional status. According to this hypothesis, the negative emotional response triggered by a morally bad action drives the attribution (...) of intent to the actor, or the judgment that the actor acted intentionally. We test this hypothesis by presenting cases of morally bad and morally good action to seven individuals with deficits in emotional processing resulting from damage to the ventromedial prefrontal cortex (VMPC). If normal emotional processing is necessary for the observed asymmetry, then individuals with VMPC lesions should show no asymmetry. Our results provide no support for this hypothesis: like normal individuals, those with VMPC lesions showed the same asymmetry, tending to judge that an action was intentional when it was morally bad but not when it was morally good. Based on this finding, we suggest that normal emotional processing is not responsible for the observed asymmetry of intentional attributions and thus does not mediate the relationship between an action’s moral status and its intentional status. Around the world, private and public organizations use software called legal expert systems to compute taxes. This software must comply with the laws they are designed to implement. As such, a bug or an error in a program that leads to tax miscalculations can have heavy legal and democratic consequences. However, increasing evidence suggests that some legal expert systems may not comply with the law. Moreover, traditional software development processes mean that legal expert systems are difficult to adapt to the (...) continuous flow of new legislation. To prevent further software decay and to reconcile these systems with the growing demand for algorithmic transparency, we argue that there is a need for a new development process for legal expert systems. This new system must be built to comply with the law, in particular the GDPR. It must also respect democratic transparency. For these reasons, we present a solution built by lawyers and computer scientists: C atala, a new programming language coupled with a pair programming development process. (shrink)

Moral judgments, whether delivered in ordinary experience or in the courtroom, depend on our ability to infer intentions. We forgive unintentional or accidental harms and condemn failed attempts to harm. Prior work demonstrates that patients with damage to the ventromedial prefrontal cortex deliver abnormal judgments in response to moral dilemmas and that these patients are especially impaired in triggering emotional responses to inferred or abstract events, as opposed to real or actual outcomes. We therefore predicted that VMPC patients would deliver (...) abnormal moral judgments of harmful intentions in the absence of harmful outcomes, as in failed attempts to harm. This prediction was confirmed in the current study: VMPC patients judged attempted harms, including attempted murder, as more morally permissible relative to controls. What is the role of self-concept in motivating moral behavior? On one account, when people are primed to perceive themselves as “do-gooders”, conscious access to this positive self-concept will reinforce good behavior. On an alternative account, when people are reminded that they have done their “good deed for the day”, they will feel licensed to behave worse. In the current study, when participants were asked to recall their own good deeds (positive self-concept), their subsequent charitable donations were nearly twice that (...) of participants who recalled bad deeds, or recent conversation topics, consistent with an account of moral reinforcement. In addition, among participants reporting good deeds, those who did not note whether they were recognized or unrecognized by other people donated significantly more than participants who took note of others’ responses. In sum, when people are primed to see themselves as good people, who do good for goodness’ sake, not to obtain public credit, they may be motivated to do more good. (shrink)

The improbability of a spontaneously generated self-assembling molecule has suggested that life began with a set of simpler, collectively replicating elements, such as an enclosed autocatalytic set of polymers (or autocell). Since replication occurs without a self-assembly code, acquired characteristics are inherited. Moreover, there is no strict distinction between alive and dead; one can only infer that an autocell was alive if it replicates. These features of early life render natural selection inapplicable to the description of its change-of-state because they (...) defy its underlying assumptions. Moreover, natural selection describes only randomly generated novelty; it cannot describe the emergence of form at the interface between organism and environment. Self-organization is also inadequate because it is restricted to interactions amongst parts; it too cannot account for context-driven change. A modified version of selection theory or self-organization would not work because the description of change-of-state through interaction with an incompletely specified context has a completely different mathematical structure, i.e. entails a non-Kolmogorovian probability model. It is proposed that the evolution of early life is appropriately described as lineage transformation through context-driven actualization of potential, with self-organized change-of-state being a special case of no contextual influence, and competitive exclusion of less fit individuals through a selection-like process possibly (but not necessarily) playing a secondary role. It is argued that natural selection played an important role in evolution only after genetically mediated replication was established. (shrink)

Because human cognition is creative and socially situated, knowledge accumulates, diffuses, and gets applied in new contexts, generating cultural analogs of phenomena observed in population genetics such as adaptation and drift. It is therefore commonly thought that elements of culture evolve through natural selection. However, natural selection was proposed to explain how change accumulates despite lack of inheritance of acquired traits, as occurs with template-mediated replication. It cannot accommodate a process with significant retention of acquired or horizontally (e.g. socially) transmitted (...) traits. Moreover, elements of culture cannot be treated as discrete lineages because they constantly interact and influence one another. It is proposed that what evolves through culture is the mind; ideas and artifacts are merely reflections of its current evolved state. Interacting minds transform (in part) through through a non-Darwinian autopoietic process similar to that by which early life evolved, involving not survival of the fittest but actualization of their potential. We outline the rationale and preliminary results of using the State Context Property (SCOP) formalism, originally developed as a generalization of quantum mechanics, to describe the contextual manner in which concepts are evoked, used, and combined to generate meaning. The quantum formalism was developed to cope with problems arising in the description of (1) the measurement process, and (2) the generation of new states with new properties when particles become entangled. Similar problems arising with concepts motivated the formal treatment introduced (...) here. Concepts are viewed not as fixed representations, but entities existing in states of potentiality that require interaction with a context---a stimulus or another concept---to `collapse' to observable form as an exemplar, prototype, or other (possibly imaginary) instance. The stimulus situation plays the role of the measurement in physics, acting as context that induces a change of the cognitive state from superposition state to collapsed state. The collapsed state is more likely to consist of a conjunction of concepts for associative than analytic thought because more stimulus or concept properties take part in the collapse. We provide two contextual measures of conceptual distance---one using collapse probabilities and the other weighted properties---and show how they can be applied to conjunctions using the pet fish problem. To cope with problems arising in the description of (1) contextual interactions, and (2) the generation of new states with new properties when quantum entities become entangled, the mathematics of quantum mechanics was developed. Similar problems arise with concepts. We use a generalization of standard quantum mechanics, the mathematical lattice theoretic formalism, to develop a formal description of the contextual manner in which concepts are evoked, used, and combined to generate meaning.

Moral judgment depends critically on theory of mind, reasoning about mental states such as beliefs and intentions. People assign blame for failed attempts to harm and offer forgiveness in the case of accidents. Here we use fMRI to investigate the role of ToM in moral judgment of harmful vs. helpful actions. Is ToM deployed differently for judgments of blame vs. praise? Participants evaluated agents who produced a harmful, helpful, or neutral outcome, based on a harmful, helpful, or neutral intention; participants (...) made blame and praise judgments. In the right temporo-parietal junction, and, to a lesser extent, the left TPJ and medial prefrontal cortex, the neural response reflected an interaction between belief and outcome factors, for both blame and praise judgments: The response in these regions was highest when participants delivered a negative moral judgment, i.e., assigned blame or withheld praise, based solely on the agent's intent. These results show enhanced attention to mental states for negative moral verdicts based exclusively on mental state information. (shrink)

Ordinary people often make moral judgments that are consistent with philosophical principles and legal distinctions. For example, they judge killing as worse than letting die, and harm caused as a necessary means to a greater good as worse than harm caused as a side-effect (Cushman, Young, & Hauser, 2006). Are these patterns of judgment produced by mechanisms specific to the moral domain, or do they derive from other psychological domains? We show that the action/omission and means/side-effect distinctions affect nonmoral representations (...) and provide evidence that their role in moral judgment is mediated by these nonmoral psychological representations. Specifically, the action/omission distinction affects moral judgment primarily via causal attribution, while the means/side-effect distinction affects moral judgment via intentional attribution. We suggest that many of the specific patterns evident in our moral judgments in fact derive from nonmoral psychological mechanisms, and especially from the processes of causal and intentional attribution. Autocatalytic networks have been used to model the emergence of self‐organizing structure capable of sustaining life and undergoing biological evolution. Here, we model the emergence of cognitive structure capable of undergoing cultural evolution. Mental representations (MRs) of knowledge and experiences play the role of catalytic molecules, and interactions among them (e.g., the forging of new associations) play the role of reactions and result in representational redescription. The approach tags MRs with their source, that is, whether they were acquired through social (...) learning, individual learning (of pre‐existing information), or creative thought (resulting in the generation of new information). This makes it possible to model how cognitive structure emerges and to trace lineages of cumulative culture step by step. We develop a formal representation of the cultural transition from Oldowan to Acheulean tool technology using Reflexively Autocatalytic and Food set generated (RAF) networks. Unlike more primitive Oldowan stone tools, the Acheulean hand axe required not only the capacity to envision and bring into being something that did not yet exist, but hierarchically structured thought and action, and the generation of new MRs: the concepts EDGING, THINNING, SHAPING, and a meta‐concept, HAND AXE. We show how this constituted a key transition toward the emergence of semantic networks that were self‐organizing, self‐sustaining, and autocatalytic, and we discuss how such networks replicated through social interaction. The model provides a promising approach to unraveling one of the greatest anthropological mysteries: that of why development of the Acheulean hand axe was followed by over a million years of cultural stasis. The argument that cumulative technological culture originates in technical-reasoning skills is not the only alternative to social accounts; another possibility is that accumulation ofbothtechnical-reasoning skillsandenhanced social skills stemmed from the onset of a more basic cognitive ability such as recursive representational redescription. The paper confuses individual learning of pre-existing information with creative generation of new information.

「臺灣哲學」因其詞彙上固有語義多義性(polysemy)的特徵，被賦予了廣泛的解讀模式與概念內涵，佔據主導地位的語義理解框架，深遠影響了「詮釋臺灣哲學」的研究方法論取徑選辨之爭端。本文闡述，傳統上「臺 灣哲學」語義差異的解讀模式主要座落在兩種不同的框架之內：分別為(1)PIT 框架:「在臺灣的哲學活動(或稱：『在臺灣的哲學(Philosophy in Taiwan)』, 簡稱 PIT)」、(2)TP 框架：「具主體特徵(或主體性)的臺灣哲學(或稱:『臺灣(式)的哲學(Taiwanese Philosophy)』, 簡稱 TP)」(參見 洪＆高, 2018)。臺灣於上世紀(即二十世紀)之際，牟宗三諸賢之新儒學盛行於學界之主流，雖有學人或對(PIT)框架保有開放態度，然針對(TP) 框架則多存疑慮與駁斥。在新儒家思潮的驅動下，涉獵與執論中國哲學的學者被囿於(CPIT, Chinese Philosophy in Taiwan)的框架範疇來詮釋「臺灣哲學」，大抵將「臺灣哲學」看作是一種「在臺灣的中國哲學實踐活動」或「中國哲學在臺灣之表現形式」。根據當代學術界主流之見解，早期新儒家學圈似未充分顧及後殖民與後遺民臺 灣哲學的異質性與特殊地位，偏狹獨斷地將「臺灣哲學」逕自簡化認作為(CPIT)的觀點——此見解於理論形而上學之層面，頗有昭示凸顯「『臺灣哲學』乃『中國哲學』一支」之姿態，且亦強調中國哲學之於臺灣哲學有「 主v.s客」、「核心v.s邊陲」、「宰制v.s隸屬 」等法統位階差異，繼後數旬間屢遭承襲西洋自由主義與解殖獨立運動思潮影響的志篤之士劇烈反撥。近年來學者們更加深切關懷與反思「臺灣哲學」與「臺灣理論」的重要性，諸多意見中，不乏有學者力言「臺灣哲學」之意義 ，在於學術探究價值與反映臺灣特色的群體精神上，其最適切之詮釋係屬(TP) 「具主體特徵的臺灣哲學」，而非(PIT)「在臺灣的(東方與西方 i.e. 中國、英美、歐陸⋯⋯)哲學活動」。倡議(TP)框架的學說家或可予以同意(PIT) 描繪與勾勒出臺灣哲學的歷史軌跡輪廓，但對於將(PIT)框架視為理解及詮釋「臺灣哲學」之充分要件，恐怕仍將遭到強烈排斥。本篇論文將指出，儘管利用(PIT)框架來詮釋「臺灣哲學」的取向近年受到眾多挑戰，但 透過重塑對(PIT)框架的認識並結合大型語料庫、文化檔案、思想史的研究方法，容或能為(TP)提供與奠定一個更全面的理解基礎。筆者將嘗試說明，(PIT)框架為何可能導向嚴重的認知誤區，其中涵蓋了兩項主要 偏誤：(偏誤一)(PIT)框架提出了「臺灣哲學」存有論上的充分要件；(偏誤二)(PIT)框架的「在臺灣(in Taiwan)」指的純粹是「空間地理內的臺灣」。本文透過對於前述偏誤的釐清與釋疑，提供了一種可能的善意調融詮釋。本文在最後再次審視，對於(TP)框架中所強調的主體性特徵而言，哪些要素構成了適當的形上學 描述。 -/- 關鍵詞：臺灣哲學、主體性與能動性、知識系譜、建構理論的方法論、地域哲學的特徵.

It is increasingly evident that there is more to biological evolution than natural selection; moreover, the concept of evolution is not limited to biology. We propose an integrative framework for characterizing how entities evolve, in which evolution is viewed as a process of context-driven actualization of potential (CAP). Processes of change differ according to the degree of nondeterminism, and the degree to which they are sensitive to, internalize, and depend upon a particular context. The approach enables us to embed phenomena (...) across disciplines into a broad conceptual framework. This paper reviews and clarifies five misunderstandings about cultural evolution identified by Henrich et al.. First, cultural representations are neither discrete nor continuous; they are distributed across neurons that respond to microfeatures. This enables associations to be made, and cultural change to be generated. Second, ‘replicator dynamics’ do not ensure natural selection. The replicator notion does not capture the distinction between actively interpreted self-assembly code and passively copied self-description, which leads to a fundamental principle of natural selection: inherited information is (...) transmitted, whereas acquired information is not. Third, this principle is violated in culture by the ubiquity of acquired change. Moreover, biased transmission is less important to culture than the creative processes by which novelty is generated. Fourth, there is no objective basis for determining cultural fitness. Fifth, the necessity of randomness is discussed. It is concluded that natural selection inappropriate is an explanatory framework for culture. (shrink)

This study aimed to explore the rhetorical moves of article abstracts in Taiwanese Chinese philosophy journals. The most common theory for the discourse analysis of research abstracts is proposed by Hyland（2000）. Most of the research abstracts in the field of social sciences and natural sciences are composed of Hyland’s five rhetorical moves: introduction, purpose, method, results, and conclusion. Therefore, the question to be explored in this research is how to compose the rhetorical moves of abstracts of Chinese philosophy journal articles. (...) What is the frequency and order of each rhetorical move in the abstract of each paper? Do they reflect some particular type of distribution? Are there any rhetorical moves that occur exceptionally rarely? Does the abstract of research articles in Chinese philosophy journals apply the framework of the same five rhetorical moves? What are the conventions of the philosophy writing community reflected in the rhetorical moves of abstracts of academic journal articles in philosophy? -/- To answer the above questions, this research collected the abstracts of 18 papers from the representative Chinese philosophy journal "SOOCHOW JOURNAL OF PHILOSOPHICAL STUDIES " in Taiwan in the past five years (2017-2021) and used the five moves of Hyland（2000） one by one to answer the above questions. The rhetorical moves of each abstract were analyzed and presented in tables to show the frequency, order, and type of each rhetorical move. -/- The results of this study found that "method (M)" and "conclusion (C)" are not the rhetorical moves that constitute the abstract of articles in Taiwanese philosophy journals, but the rhetorical move "purpose (P)" is "necessary" to appear. In the Purpose move, the subject is usually "this article"; the verbs are "argue" or "inquire." Although "introduction (I)" is a "conventional" move, the total number of words in the introduction is the highest in the whole abstract. This study also shows rhetorical move variation of the abstracts of philosophy journal articles, reflecting the writing culture and conventions of the academic philosophy community. -/- Finally, this study proposes three teaching guidelines for abstract writing of academic papers in philosophy, which will be useful for philosophy scholars and graduate students to consult when writing and submitting abstracts of philosophy in conference or journal papers. -/- Keywords: philosophy, journal article, abstract, discourse analysis, rhetorical move . This paper proposes that an entity is conscious to the extent it amplifies information, first by trapping and integrating it through closure, and second by maintaining dynamics at the edge of chaos through simul- taneous processes of divergence and convergence. The origin (...) of life through autocatalytic closure, and the origin of an interconnected worldview through conceptual closure, induced phase transitions in the degree to which informa- tion, and thus consciousness, is locally amplified. Divergence and convergence of cognitive information may involve phenomena observed in light e.g. focusing, interference, and resonance. By making information flow inward- biased, clo- sure shields us from external consciousness; thus the paucity of consciousness may be an illusion. (shrink)

In this paper, I expand my upon earlier linguistic research (Lian, 2023), which delved into the genre of abstracts from Western philosophical papers. I engage with the philosophical ramifications emanating from the guidelines established for crafting philosophy paper abstracts (Lian, 2023) and underscore their significance in the domain of academic philosophical writing. A pivotal focus of this research is to navigate the intricate philosophical challenges posed by cross-disciplinary investigations bridging applied linguistic statistics with philosophical paper composition, specifically, the nuanced interpretation (...) of linguistic findings in a manner palatable to philosophers. My exploration probes into the dynamics of various concepts within Inter-Disciplinary Research (IDR), highlighting the complexities in reconciling semantic intuitions related to the notions of "Method (M)" and "Conclusion (C)". I delineate three philosophical stances: (1) deferring to scientific authority, (2) recognizing domain-specific terminologies, and (3) interrogating peripheral scientific theories. I posit that these stances significantly influence the ways philosophers engage with and resolve the cross-disciplinary semantic and theoretical contentions stemming from the rhetorical structures of "Method (M)" and "Conclusion (C)". Contemporary moral psychology has focused on the notion of a universal moral sense, robust to individual and cultural differences. Yet recent evidence has revealed individual differences in the psychological processes for moral judgment: controlled cognition, mental-state reasoning, and emotional responding. We discuss this evidence and its relation to cross-cultural diversity in morality.

In this unique book, Alexander Lian, a practicing commercial litigator, advances the thesis that the most famous article in American jurisprudence, Oliver Wendell Holmes's “The Path of the Law,” presents Holmes's leading ideas on legal education. Through meticulous analysis, Lian explores Holmes's fundamental ideas on law and its study. He puts “The Path of the Law” within the trajectory of Holmes's jurisprudence, from earliest scholarship to The Common Law to the occasional pieces Holmes wrote or delivered after joining the U.S. (...) Supreme Court. Lian takes a close look at the reactions “The Path of the Law” has evoked, both positive and negative, and restates the essay's core teachings for today's legal educators. Lian convincingly shows that Holmes's “theory of legal study” broke down artificial barriers between theory and practice. This thesis addresses one of the central questions in political philosophy, the question of political obligation why people have a duty to support the political institutions of their countries. The traditional and dominant answer to this question is voluntarism, which claims that people have such a duty because they have consented to the ruling of their states. As a general concept, aesthetic education and art education are connected; to a certain extent, the two can be taken as one or two sides of the same coin. However, the specific questions involved are how they are connected and how to connect them in teaching practice. To answer these questions, I define aesthetic education as more general and theoretical and define art education as less general and more practical, that is, teaching students to read art works. The improbability of a spontaneously generated self-assembling molecule has suggested that life began with a set of simpler, collectively replicating elements, such as an enclosed autocatalytic set of polymers (or protocell). Since replication occurs without a self-assembly code, acquired characteristics are inherited. Moreover, there is no strict distinction between alive and dead; one can only infer that a protocell was alive if it replicates. These features of early life render natural selection inapplicable to the description of its change-of-state because they (...) defy its underlying assumptions. Moreover, natural selection describes only randomly generated novelty; it cannot describe the emergence of form at the interface between organism and environment. Self-organization is also inadequate because it is restricted to interactions amongst parts; it too cannot account for context-driven change. A modified version of selection theory or self-organization would not work because the description of change-of-state through interaction with an incompletely specified context has a completely different mathematical structure, i.e. entails a non-Kolmogorovian probability model. It is proposed that the evolution of early life is appropriately described as lineage transformation through context-driven actualization of potential (CAP), with self-organized change-of-state being a special case of no contextual influence, and competitive exclusion of less fit individuals through a selection-like process possibly (but not necessarily) playing a secondary role.
