According to a common view, sentience is necessary and sufficient for moral status. In other words, whether a being has intrinsic moral relevance is determined by its capacity for conscious experience. The _epistemic objection_ derives from our profound uncertainty about sentience. According to this objection, we cannot use sentience as a _criterion_ to ascribe moral status in practice because we won’t know in the foreseeable future which animals and AI systems are sentient while ethical questions regarding the possession of moral (...) status are urgent. Therefore, we need to formulate an alternative criterion. I argue that the epistemic objection is dissolved once one clearly distinguishes between the question what determines moral status and what criterion should be employed in practice to ascribe moral status. Epistemic concerns are irrelevant to the former question and—I will argue—criteria of moral status have inescapably to be based on sentience, if one concedes that sentience determines moral status. It follows that doubts about our epistemic access to sentience cannot be used to motivate an alternative criterion of moral status. If sentience turns out to be unknowable, then moral status is unknowable. However, I briefly advocate against such strong pessimism. (shrink)

Einfühlung wird ideengeschichtlich an das Konzept der Selbstperfektionierung geknüpft und insofern im Modus der Defizienz verhandelt. Dabei fungieren antike und mittelalterliche Diskurse um Gotteserkenntnis als historisch-konzeptionelle Vorläufer neuzeitlichmoderner Erklärungsfolien zwischenmenschlicher Alterität, mithin als semantische Vorform der zeitgenössischen Einfühlungs-Idee. In diesem Kontext ist eine ethisch-epistemologische Asymmetrie zu konstatieren, die Gott einerseits als den All-Empathischen beschreibt und zugleich die Erkenntnisbemühungen des Menschen als unabgeschlossen und prozessual vorstellt. Einfühlung produziert sich als regulative Idee im doppelten Sinne: Während Gott als empathische Transzendenz erscheint, bedarf (...) es unendlicher Annäherungsbewegungen, damit der Mensch sich in einem Akt transzendenter Empathie in Gott einfühlen kann. Durch die Etablierung dieser Vorstellungsverbindung hat das Innenleben des Anderen eine transzendente Aufladung erfahren. Das Fremdpsychische wurde zum modernen Mysterium. (shrink)

I develop the anticipatory argument for the view that it is nomologically possible that some non-biological creatures are phenomenally conscious, including conventional, silicon-based AI systems. This argument rests on the general idea that we should make our beliefs conform to the outcomes of an ideal scientific process and that such an ideal scientific process would attribute consciousness to some possible AI systems. This kind of ideal scientific process is an ideal application of the iterative natural kind (INK) strategy, according to (...) which one should investigate consciousness by treating it as a natural kind which iteratively explains observable patterns and correlations between potentially consciousness-relevant features. The relevant AI systems are psychological duplicates. These are hypothetical non-biological creatures which share the coarse-grained functional organization of humans. I argue that an ideal application of the INK strategy would attribute consciousness to psychological duplicates because this gives rise to a simpler and more unifying explanatory account of biological and non-biological cognition. If my argument is sound, then creatures made from the same material as conventional AI systems can be conscious, thus removing one of the main uncertainties for assessing AI consciousness and suggesting that AI consciousness may be a serious near-term concern. This research investigates gender differences in employer-sponsored medical insurance coverage among full-time male and female workers in the United States and assesses the relevance of human capital theory and its compensating differentials corollary in predicting coverage. Data are analyzed from a subsample of the Quality of Employment Survey, a national probability sample of workers in the United States. Results indicate that men were more likely to have medical insurance coverage from their employers than were women; however, gender differences were minimized (...) in a multivariate context when human capital and structural variables were controlled. Furthermore, human capital variables are, overall, weak predictors of whether both women and men received coverage. More generally, the data suggest that structural conditions of the occupation, rather than individual human capital, may be most relevant for future research. (shrink)

Illusionism about consciousness entails that phenomenal consciousness doesn’t exist. The distribution question concerns the distribution of consciousness in the animal kingdom. Skepticism of animal consciousness is the view that few or no kinds of animals possess consciousness. Thus, illusionism seems to imply a skeptical view on the distribution question. However, I argue that illusionism and skepticism of animal consciousness are actually orthogonal to each other. If illusionism is true, then phenomenal consciousness does not ground intrinsic value so that the non-existence (...) of phenomenal consciousness would not have ethical implications. In this case, the adequate reaction is to reformulate the distribution question in terms of the quasi-phenomenal functional features associated with the illusion of phenomenal consciousness which do ground intrinsic value. Hence, either illusionism is false or the distribution question does not concern phenomenal consciousness. In any case, illusionism does not directly tell us anything about the distribution question. However, since illusionism forces us to revise our traditional conception of consciousness, it indirectly affects research on animal consciousness by questioning that consciousness is a unified and an all-or-nothing property. This article probes the relationship among constitutionalism, extra-legal prerogative power, and citizen judgment. While much has been written about the nature of Lockean prerogative, and while his theory serves as a direct inspiration for contemporary "normative extra-legalists," key participants in the debate over emergency powers, less attention has been paid to how the people judge prerogative. Attention to this issue is useful because an examination of the process of political judgment of extra-legalism in Locke leads to a complication of the (...) current extra-legalist vision of democratic mechanisms of accountability. The author argues that the extra-legal approach is right to consider the role of democratic publics in potentially constraining the exercise of emergency powers but wrong to formulate that role as one extra-constitutional power checking another extra-constitutional power. The author situates both prerogative power and citizen judgment of it at the threshold of the constitutional order. (shrink)

According to the Transmission View of Testimony : TVT: If a speaker testifies to a hearer that p, and if the hearer is justified in believing that p on the basis of that speaker's testimony, then the hearer's belief is justified by whatever justification the speaker has for believing that p. The aim of this paper is to develop and defend a novel objection to the TVT.

Now I continue the investigation, begun in Homo Quaerens: The Seeker and the Sought, into the generic traits of persons from a philosophic point of view. I treat such special topics of my method, set forth in that book, as bear upon the person's intrapersonal aspects: namely, his body and such of its functions as contribute to his preconscious acts. In particular, I deal with those aspects insofar as they may be construed as straining, so to speak, toward that self-transcendence (...) which culminates in the veridical person - in effect, strands of subpersonal events which contribute to and converge upon his consummate personhood. In consequence, I explore the ontology of the person under the perspective of his naturalistically interpreted makeup; and I conceive my enterprise as propaedeutic to more generalized ontologic topics which I shall take up in subsequent books. Leonard Krieger has long been revered as a contemporary master historian. This paper addresses the role of disagreement in relation to the goals of metaphysical inquiry. In particular, I will discuss two reactions to Kant’s initial observation that metaphysics does not make any lasting progress: Kant’s own demand for a critical revision of metaphysics and Schelling’s ideas as presented in his 1821 lecture On the Nature of Philosophy as a Science. Kant’s account allows for an appreciation of metaphysical conflict as a necessary precondition for a critically revised system of pure reason. (...) However, he thinks that such a system will ultimately replace all previous ones and thereby make further development of metaphysics obsolete. Although Schelling appropriates Kant’s notion of systematicity, he arrives at a positive evaluation of metaphysical disagreement as an expression of freedom which articulates itself within the history of metaphysics. I argue that Schelling’s view also entails that the history of metaphysics is an ongoing process rather than terminating in an ultimate system or a withdrawal from metaphysical inquiry. Thus, we get to see a) that Kant himself (not just his post-Kantian successors) entertains an account of the essential historicity of reason and b) how Schelling both preserves and transforms the Kantian legacy of a philosophical history of metaphysics.
